AN ORDINANCE GRANTING THE TEXAS AND NEW ORLEANS RAILROAD
COMPANY, ITS SUCCESSORS AND ASSIGNS, FOR A PERIOD OF THIRTY-FIVE
(35) YEARS, THE RIGHT AND PRIVILEGE TO CONSTRUCT, OWN, MAINTAIN
AND OPERATE SPUR TRACKS OR S17ITCH TRACKS, ONE TRACTS EXTENDING
FROM POINT NEAR SOUTHEAST LINE LOT 533, BLOCK 1, NORTHWESTERLY
UPON AND ACROSS FRANKLIN STREET, UPON AND ACROSS MARKET STREET IN
BLOCK 2, AND UPON AND ACROSS MILAM STREET BETWEEN BLOCKS 2 AND 3;
ONE TRACK EXTENDING FROM SOUTHEAST LINE OF MILAM STREET FROM POINT
NEAR WEST CORNER OF BLOCK 2, NORTHWESTERLY UPON AND ACROSS MILAM
STREET, IN AND ALONG MAIN STREET TO POINT APPROXIMATELY FIFTEEN
(15) FEET SOUTHEAST OF SOUTHEAST LINE OF GILBERT STREET; -ONE TRACK
COMMENCING IN TRACK NEXT ABOVE DESCRIBED IN MAIN STREET OPPOSITE
THE SOUTH CORNER. OF BLOCK 3, AND EXTENDING -THENCE SOUTHEASTERLY,
UPON AND ACROSS MILAM STREET TO BLOCK NUMBER 2; ONE TRACK, NOW
EXISTING, UPON AND ACROSS FRANKLIN STREET, BETWEEN BLOCKS 1 and 2;
ONE TRACK, NOW EXISTING, ACROSS MAIN STREET AND FRANKLIN STREET
FROM POINT IN SOUTHWEST LINE BLOCK 2, NEAR ITS MOST SOUTHERLY COR-
NER, TO POINT IN NORTHEAST LINE OF BLOCK 8, NEAR ITS NORTH CORNER,
ALL ACCORDING TO EXHIBIT A, HERETO ATTACHED, AND GRANTING SAID
RAILROAD COMPANY, AND/OR ITS PATRONS, RIGHT TO USE TRACKS ON BLOCKS
1 AND 2, FOR LOADING AND -UNLOADING CARS, REPEALING ORDINANCE GRANT-
ING SAI RAILROAD COMPANY RIGHT TO REMOVE CERTAIN TRACKAGE FROM
-MAIN STREET AND RECONSTRUCT SANE Zit BLOCKS 1 and 21, PASSED BY THE
CITY COMMISSION OF-BEAUMONT, TEXAS, JANUARY 25th, 1927; AND PRES=
CRIBING THE TERMS -AND CONDITIONS THEREOF:
WHEREAS, The City of Beaumont -and the Texas and New Orleans
Railroad Company, in order to relieve congestion of vehicular
traffi.c on Main Street, entered into an agreement dated November
26th, 1932, covering the removal, by said Railroad Company, of a
certain trackage in.Main Street and the construction of a track in
a new location to serve in lieu -thereof, and also covering the
shifting and re -arrangement of certain trackage on and in the,,vici-
nity of Blocks Numbers One (1), Two (2) and Three (3), of the Old
Town of Beaumont;
NOW, THEREFORE, PURSUANT.TO THE TERMS -OF SAID CONTRACT,
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BEAUMONT:
Section 1,
That the Texas and New Orleans Railroad Company, its
successors and assigns, is hereby granted the right and privilege r
to construct and maintain, at its own expense, certain trackage in,
along and across certain streets of the City of Beaumont, particu-
larly described as follows:
(a) A spur -track commencing at a point in a connecting or
lead track, at or near the southeast line of Lot 533_, Block 1 and
extending in a general northwesterly direction upon a right of way
or easement to be conveyed by the City to the Railroad Company
across parts of Blocks 1, 2 and 3, and upon and across Franklin
Street, between Lot 533, Block 1 and Lot 539, Block 2, and upon and
across&arket Street in said Block 2, and upon and across Milani
Street between said Block s 2 and 3; the location of said track

1927, granting said Railroad Company the right to take up and
remove certain tracks in Main Street opposite Blocks'l and 2,
and t,o relocate said tracks upon and across Blocks 1 and 2, be
and the same is hereby repealed.
Section 8.
That any Ordinance in addition to the one above referred
to, or parts of Ordinances in conflict .with this Ordinance, be,
and the same are hereby repealed.
Section 9.
The right and privilege granted by this Ordinance shall
extend for a period of -thirty-five (35) years from the date this
Ordinance goes into effect.
Section 10.
That this Ordinance shall go into effect from and after
its passage, filing of.the written acceptance as provided in
Section 6 hereof, and lawful publication, and shall continue for
thirty-five (35) years thereafter.
