An Ordinance granting; to The Beaiiniont Gas and Fuel Comna:iy, a Franchise
over and through the streets, alleys and public grounds of the city of
Bea-=iont, for the purpose of laying', constructing and maintaining Gas
Mains, Latterals and connections with all Factories; Business Houses and
Private 'residences and properties within the city of BeaLwaont :
BE IT ORDAINED BY THE CITY COUNCiL OF THE CITY OF BEAU14ONT TEXAS.
Section I:- That the city of Beaumont by and throw h its ,city council
does hereby grant to the Beaviilont Gas and Fuel Company, a private corpor-
ation, incorporated under the laws of. the State of Texas, and to its
successors and assigns a:`franchise for the purpose of conveying Ga's
fooiu its Gas and Fuel plant to be located w lthin the corporate limits
of the city of Beaumont and the right to lay pipes in and through said
streets, alleys and public grounds of said city as it may seem proper
to be used for any and all purposes for w1r,i ch Gas can be used and
applied.
Section 2: -And it is further ordained that the said Beaumont Gas and
Fuel Coz�pany and its successors and assigns shall have the right to use
any and all streets, alleys and public grounds of the city of Beaumont
within its -present coibpolte limits, and all additions which iz?ay hereat
ter, be taXen within the city limits for the piu° -,ose of laying pipes
for the conveying of gas for the full period of fifty Vyears on the terms
and .conditions following -vi-z:
Section 3:- That the said Beaiunont Gas and Fuel Company and its succes-
sors and assigns shall have the right at, any time to connect with any
pine which it shall have laid so as to convey Gas to any factory,
business houses of all eharapters and of whatever kinds, and private
residences that they may see proper for the purpose of furnishing Gas
for the purposes of fuel, -heating and lighting and for all other Purposes
for which Gas may be,used, and shall have the right, to charge the sum of
Seventy Five. 75 Cents for each 1000 ' fiaok Cubic Feet of Gas used by the
conswer, and no more, upless by special permission of the city council
to raise said -rate _o.i__chargeso
Section 4:- That all pipea of every description laid shall be done undbr
off- gas ror the full period of fifty years on the terms
and .conditions following -viz:

Section 4:— That all pipes of every description laid shall be done undgr
the direction of the chairman of the street and bridge corLinittee and that
all pipes shall be laid in all instances so as to preserve street grades
and not interfere with the ditches and in accordance with the ordinances'
of the city.
Sect!on:6:— That the said Beaumont Gas and Fuel Company agrees as a part

consideration for this franchise to furnish and transmit to the city
of Beaumont, free of charge to said city all the Gas.necessary for the
use by said city in its city hall, police and fire departments for
heating and lighting purposes.for the full period- of twenty years.
Section 6:=- That the said Beaumont Gas and Fuel- Company agrees before
begining said work to enter into a good and solvent bond in the sun of
ONE THOUSAND DOLLARS payable to the cite of Beaumont aco ditioned :
Ist :-That it shall begin work in good faith within days after
the final passage of thisordinanceand shall: have its plant in full

2nd: -That it shall hold the city harmless against any damage that may
result from any act on the
�.paar�t, of said company in the construction of
its plant or mains, As
3rd:-That it shall replace all streets and sidewalks where excavations
are made in good condition and will carry out the conditions of this
franchise.
Section 7:- That this ordinance shall take effect and,be in full force
from and after its passage and approval.
