Prohibiting all dogs from running at large in the City of
Beaumont unless immunized against rabies by the injection of
Anti -Rabies vaccine; providing for such immunization by the
City Veterinarian and the fee to be paid therefor to the City
of Beaumont; providing that such immunization_ may be performed by
any registered, graduate Veterinarian, other than the City Veter-
inarian and the fee that shall be paid to the City of Beaumont
when so performed; providing for a general reduction in all of
such immunization fees for a period of thirty (30) days after the
enactment hereof, for the purpose of encouraging and stimulating
such immunization; providing proper means of identifying dogs so
immunized; providing that dogs so immunized may, under certain
conditions, run at large; providing that any dog running at large
and not immunized and properly tagged may be impounded; requiring
notice to be,published of all dogs impounded; and providing that
upon failure of an owner to redeem same and pay immunization fees
and costs accrued within the time prescribed, the dog shall be
destroyed; providing that any dog impounded shall not be released
until it is properly immunized against rabies; prescribing a pen-
alty for wilfully and negligently allowing dogs not immunized
against rabies and properly tagged to run at large; repealing
all ordinances in conflict therewith; and declaring an emergency.
BE IT ORDAINED BY THE CITY C OMIUSS ION
OF THE CITY OF BEAMONT:
Section 1.
That it shall hereafter be unlawful for the owner or keeper
of any dog to permit the same to run at large in the City of
Beaumont unless said dog is immunized against rabies by the in-
jection of Anti -Rabies vaccine by a registered, graduate Veter-
inarian under the direction of the Director of Sanitation, as
hereinafter provided. Any dog not properly tied or under leash
during transportation shall be considered running at large.
Section 2.
The owner or keeper of any dog immunized against rabies, as
provided in Section (1) one of this Ordinance, shall procure a
wtitten certificate of vaccination on forms to be provided by the
Director of Sanitation giving an accurate description of the dog,
the date of immunization and the name and address of the owner of
such dog, which certificate shall be signed by the veterinarian
administering the vaccine; at any time after seven days subsequent
to the date of vaccination of any dog upon presentation of the
above certificate at the office of the Director of Sanitation, and
payment of the fee hereinafter provided for, a metal tag will be
issued bearing a number corresponding to the number placed on such
certificate and with lettering showing immunization, which tag
shall be attached to the collar of the dog for which it was issued
and shall be worn in a conspict,ous.place on the collar at all
times while such dog is running at large.. The tag above required
shall be designed and issued under the direction of the Director
of Sanitation and shall be valid for one year after the date of
vaccination of the dog to whieh issued and .shall be non -trans-
ferable.
Section 3.
For a period of thirty (30) days (from and including the
-5th day of June, ,A. D. 1934:,: to and including the 5th day of
July; A. D. 1934) after the enactment. of this Ordinance, a fee
of one dollar ($1.00) shall be paid by every person procuring a
certificate, of immunization with tag for each dog, as required
hereunder, this fee shall.include the' cost of the vaccine and the
services .of the City Veterinarian -when such immunization is per
formed by him; provided, however, that such immunization may be
performed by any registered, graduate Veterinarian during said
thirty (30) day period other.than the said City Veterinarian, and
upon presentation of proper certificate from such veterinarian as
outlined in the next succeeding Section No. (4) four to the
Director of Sanitation, said Director of Sanitation shall issue
owner a certificate of immunization and cause to be attached to
the collar of said animal a metal tag as prescribed in Section
(2) two, and no -fee shall -be paid to the city for such services.
All provisions of .the. above. Section ( 3) three shall. be in-
operative after the said -5th day of July, A. D. 193 4.
Section 4.
Froin,and including July 6th, A. D. 1934, a fee of $2.50
shall be paid by every person procuring certificate of the imm-
unization with tag for each dog, as required hereunder, this fee
shall include the cost of the vaccine and the services of the
City Veterinarian when the.immunization is performed by him.
Any owner'of any dog immunized against Rabies by a Veter-
inarian other than the City Veterinarian.is hereby required to
obtain from Veterinarian immunizing his animal a written cert-
ificate containing name of owner,, color, breed and weight of dog
immunized, together with kind and amount of vaccine used and date
of administration. Upon presentation of these facts, together
with a fee of fifty cents to the Director of Sanitation said
Director of Sanitation shall issue owner a certificate of immun-
ization and cause to be'attached to collar of said animal a metal
tag as described'in Section (2) two.
Section 5.
All dogs immunized against rabies, as provided in Section
(1) one of this Ordinance, and wearing collar with metal tag
attached, as provided in Section (2) two of this Ordinance, shall
be allowed to -run at large after seven days, and for a period of
one year from the date of such treatment.
Section 6.
Any dog running at large in the City of Beaumont not properly
immunized and provided with collar to which is attached a metal
tag, as required in Section (2) two hereof shall be taken up by
the police and impounded in a place provided for that purpose.
Section 7.
The officer or person having charge of any dog impounded here-
under shall cause to be published by posting notices in three (3)
public places within the corporate limits of the City of Beaumont
L`, one of which shall be at the door of the City Hall, on Monday of
each week a list of all dogs taken up and impounded during the
preceding week,, giving the description of each dog by size,- color,
age and -breed, a,s nearly as can be ascertained, with any other
distinguishing marks or brands,.such notice shall also state the
date such dogs will be destroyed unless sooner redeemed by the pay-
ment of the fees and costs provided for in this Ordinance.
Section S.
Any dog taken up and impounded hereunder shall be held for
five ( 5) days after the publication of the notice herein provided
for, and released to the owner or keeper thereof, or his or their
agents upon payment of a fee of $2.00 and the immunization fee of
$2.150 required in Section (4) four hereof, together wi-1.7h all costs
of impounding and keeping said dog, and the publication of the
notice herein provided for. Upon payment of the fees and costs
above required, the City Veterinarian shall cause such dog to be
properly immunized against rabies by the injection of Anti -Rabies
vaccine, and no dog shall be released unless properly immunized
against rabies.
Provided, however, that for a thirty (30) day period (from
and including June 5th, A. D. 1934 to and including July 5th,
A. D. 1934) the fee of immunization for all dogs so impounded
shall beO the sum of one dollar ($1.00) as required in Section
(3) three hereof.
Nothing in this Section shall be construed ba during said
thirty (30) day pariod so,as to suspend or repeal the $2.00 im-
pounding fee as heretofore set out in this Section, nor the costs
of impounding and keeping said dog nor the costs of the publica-
tion of said notices herein provided for.
Section 9.
Upon failure of the owner or keeper of any dog impounded
hereunder to pay the costs prescribed in Section 8 hereof within
five days from the date of publication of the notice required in
Section ( 6) six, such .dog shall immediately be destroyed.
Section 10.
Any person who shall wilfully or negligently permit any dog
owned or kept by such person to run at large in the City of Beau-
mont, except as provided for in this Ordinance, shall be deemed
guilty of a misdemeanor and .upon conviction thereof shall be fined
in any sum not exceeding $100.00.
Section 11.
All Ordinances and parts of ordinances in conflict herewith
are hereby expressly repealed in so far as they conflict with the
provisions of this Ordinance.
The fact that an epidemic of rabies is imminent in the City of
Beaumont thereby endangering public safety creates an emergency
necessitating the suspension of the rule requiring ordinances :Eo be
read on three separate days before final passage; wherefore said
rule is hereby suspended and this ordinance shall take effect from
