HomeMy WebLinkAboutORD 26-KAN ORDINANCE ENTITLED AN ORDINANCE REPEALING_ SECTION 12 OF AN ORDINANCE COMMONLY KNOWN AS THE BUILDING CODE OF THE CITY OF BEAUMONT, PRESCRIBING RULES AND REGULATIONS FOR THE ALTERATION, CONSTRUCTION, MAINTENANCE, REPAIR, REMODELING, OR REMOVAL OF ALL BUILDINGS AND STRUCTURES IN THE CITY OF BEAUMONT, AND THE INSTALLATION THEREIN, OR IN CONNECTION THEREWITH, OF ALL PLUMBING, ELECTRICAL AND MECHANICAL EQUIP- MENT., ETC., AND PROVIDING FOR THE DIVISION OF THE TERRITORY OF THE CITY OF BEAUMONT INTO FOUR FIRE ZONES OR DISTRICTS, TO BE KNOWN AS FIRE ZONE OR DISTRICT A, OR NO. 1; B, OR NO. 2; D, OR NO. 3; AND C, OR NO. 4; AND DESCRIBING THE BOUND- ARIES THEREOF, PROVIDING THE MINIMUM REQUIREMENTS FON TIM- BER CONSTRUCTION WITHIN THE BOUNDARIES OF FIRE DISTRICT OR ZONE D. OR NO. 35 KNOWN AS THE MARITIME FIRE ZONE OR DIS- TRICT, PROVIDING A PENALTY FOR THE NON-COMPLIANCE WITH OR VIOLATION OF SAID REQUIREMENTS, REPEALING ALL ORDINANCES OR - PARTS OF ORDINANCES IN CONFLICT HEREWITH, AND PROVIDING THAT THE INVALIDITY OF ANY SECTION OR PART OF ANY SECTION THEREOF SHALL NOT INVALIDATE THE WHOLE -OF THIS ORDINANCE, BUT THE VALID PORTIONS HEREOF SHALL REMAIN IN EFFECT. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BEAUMONT, TEXAS; Section 1. That Section 12 of the ordinance commonly known as the Building - C ode of the City of Beaumont, referred to in the caption hereof, which Section delineates the Fire Districts of the City 'of Beaujiont, be and the same i -s hereby repealed. Section 2. That the territory of the City of Beaumont, for the purpose .of fire protection.and building regulations relative thereto, shall hereafter be divided into four fire districts or zones, to be known as Fire'Districts or Zones A, or No. 1; B, or No. 2; D, or No. 3; and C,, or No. 41 hav- ing boundaries as hereinafter provided. And whenever in this ordinance or in the present ordinance known as the Build- ing Code of the City of Beaumont, or in any ordinance herein- after enacted for such purposes, Fire District or Zone No. 1 is referred to, it shall mean and be synonymous with District or Zone A; that whenever Fire District --or Zone No. 2 is. referred to, it shall mean and be synonymous with Fire Zone or -District B; that whenever, Fire District or Gone No. 3 is referred -to, it shall mean.and be synonymous with Fire Zone or District D; that whenever -Fire Zone or District No. 4 is referred to, it shall mean`and be synonymous with -Fire Zone or District C. Section 3. The boundaries of Fire -Zone or District A, or No. 1, shall be as, follows: Beginning at the point -of -intersection of Brakes Bayou or the Neches River with the center line of Mul- berry Street;` Thence west along the.center line of Mulberry Street to its intersection with the center line of Walnut Street; Thence north along the center line of.Walnut Street to its intersection with the center -line of Elizabeth Street; Thence West along the center line.of Elizabeth Street to its intersection -With the center line of Main Street; Thence north along the center line of Thain Street to its intersection with the center line of Magazine Street; . Thence west along the center line of Magazine Street to its intersection with the.center line -of North- Pearl-Street; orth.Pearl Street; Thence south along the center line of North Pearl Street and the west.side of the Methodist Church prop- erty to the intersection of said line with the.center line of -Broadway; Thence wrest along the center line of Broadway to an. extension of the ."center line- of -Janes Street; Thence south along the extension of the center line of Janes Street, and also along the center line of Janes Street,.to its intersection -with the main line of the T. & N. 0,R. R. track; Thence westerly along the main line of T. & N. O. R. R. track to its intersection with the center line of Jefferson Street produced; Thence southerly along -the center line of Jefferson Street produced and -the center line of Jefferson -Street to its intersection with the center line of Crockett Street; Thence west along the center, line of Crockett Street to its intersection with the center line of Archie Street; Thence south along the center line.of Archie Street to its intersection withthecenter line of*Fannin Street;. Thence- east: along the centerline of Fannin Street to -its intersection with the center line of Neches Street; - Thence south along the center line of Neches Street to its intersection'with the.center line of Forsythe Street; ' Thence east along -the -center line of Forsythe Street to its intersection with the -center line -of Park Street; Thence south -.along the center line of Park -Street, .to its intersection with the center line of Milam Street;. Thence east -along the center line of Milam Street to its intersection with the center line of Orleans Street; Thence south along the center line of Orleans Street to its'intersection With the center line of Franklin Street; Thence -east along the center line of Franklin Street to its, intersection with -the center line of Main Street, connecting at -this point with Zone B. or No. 2, and Zone D, or No..3; Thence north along the -center line of Main Street and the west boundary of Zone D. or No. 31, to the center .line of Gilbert .Street (formerly Washington). Thence -east along the center line of Gilbert- Street- (forinerly Washington) if produced or -extended to its inte.rsection.with the east line of the Original Townsite of Beaumont; -Thence north along the east line -of the Original Townsite of Beaumont to -its intersection with the center line of .College Street; Thence west along the center line of College — Street to its intersection with the center line of Market Street;. Thence in a northerly direction along the center line .of Market Street to its intersection with the center line of Forsythe Street; Thence east along the center line of. Forsythe Street to its intersection with -the west bank of the Neches River; -Thence in a northerly.'direct_ion with the meanders of the westerly bank of the.Neches River to the point of beginning. Section 4. The,boundaries of Fire -District or Zone B, - or No. - 2, shall., -.be as follows:, 193 Beginning at the intersection of the center- line of Mulberry Street with the titi*est" bank of Brake -s Bayou or Neches River; Thence north following the meanders of the said west bank of the Neches River or Brakets Bayou, to the intersection with the -center line of Magazine Street; Thence west along the center line .of Magazine Street to its intersection with the center line of Willow Street;, Thence south along the center line of Willow Street to its intersection with Calder Avenue; Thence west along the center line of Calder Avenue to its intersection with Forrest Street; Thence.�south along the center line of Forrest Street and its extension .to its intersection with the southerly right-of-way line of the T... &. N.- 01 R. R. Thence" westerly along said southerly right-of- way line of the T. & N. 0. R.R. to its, intersection with the center line of`Holmnes Street; Thence -southerly with the center line of Holmnes.Street to its inters"ection with the center line of Forsythe Street; Thence easterly along.,the center line of. Forsythe Street to its -intersection with the center line of Trinity Street; Thence southerly along the center line -of Trinity Street to its intersection with the center line of College Street; Thence easterly along thecenter lire of College Street to its.intersection with.the center line of Neches Street; The southerly along.th:e center line.of Neches.Street to its intersection with the center line of Franklin Street; Thence easterly along .the center line of " Franklin Street to its -.intersection with the center line of Park Street; Thence southerly along the center line of-" Park. Street to its. intersection with .the center line of Austin Street; (now Blanchette Street.). Thence easterly along the center line of.. Austin_ Street (now Blanchette) to its --intersection with the center line of Main Street, connecting at this'.point with Fire Zone D, or District No. 3. . Thence north with the center line of Main Street to its -intersection with the center line of Franklin. Street-, connecting at this point with -Fire District A or Zone No, 13, and Fire District D, or Zone No. 3.`. : Section 5. The boundaries of Fire District or -Zone D, or No. 3,- known and designated as the Maritime Fire District or Zone, shall be as follows.:-- Beginning ollows:-- Beginning at the intersection of the center line of Forsythe'Street with the west bank of the Neches River; Thence west along the center ,line .of Forsythe Street to its intersection with the center line of Market Street; Thence south along the center line of Market Street to its intersection with the center line of College Street; Thence east along the center line of College Street to its.intersection with the east boundary line of the Original Townsite.of Beaumont; Thence south along the said east line of the Original Townsite of Beaumont to its intersection.with the center line of Gilbert Street (formerly Washington); Thence west along the center line of Gilbert Street (formerly Washington) to its intersection with the center line of -Main Street; Thence south along the center line of Main Street to its intersection with the center line of Blanchette Street (formerly Austin); Thence west along the center line of Blanchette (formerly Austin) Street -to its intersection with the center line of Orleans Street; Thence south with. -the center line of Orleans Street to its intersection with the east boundary line of Riverside Drive; Thence with the meanders of the east boundary lire of Riverside Drive to its intersection with the center line of Emmett Street; Thence east with the center line -of Emmett Street, if produced, to its intersection with the west bank of the Neches River; Thence following the meanders of the westerly bank of the Neches River to the place of beginning. Section 6. The boundaries of Fire.Distriet or Zone C, or No. 4, shall consist. of the territory within the corporate limits of the City of Beaumont, which is not included within the boundary lines of Fire Districts or Zones A, or No. 11, B, or No. 2, and D, or No. 3. Section 7. The minimum req'uirement's -for timber con- struction within the limits of Fire District or Zone D. or No. 3, as herein above defined, shall be as set forth in the following provisions; and for the purposes of this ordinance the following definitions shall govern: PIER -PILE, PLATFORM AND DECK -TYPE: This type of pier consists of a sub -structure of piles carrying a platform at low-water and a pier deck supported on columns extending up from the platform, or bridge walls may be erected on the platform to -support the pier deck and a wall built around the platform; the enclosed area may or may not be filled with incombustible material. PIER HEAD LINE: The pier head line is the - line established, in navigable streams and harbors, by Govern- ment-authority., overn=went authority, beyond which piers and marine structures.of any kind cannot extend. - SUBSTRUCTURE: The substructure is that por- tion of the construction below and including the pier deck. SUPERSTRUCTURE: The superstructure is that portion of the construction above the pier deck. WHARF OR QUAY: A wharf or quay is a structure of timber,.stone, concrete or other material having a platform built along or parallel to a navigable stream or harbor so that vessels may be moored alongside as for loading or unloading or for storage. Section 8. The substructure of any pier or wharf may be of ordinary wood piling extending to the pier deck. Where it is necessary to stiffen the piling this should be done -by the use of inclined -bracing piles and/or cross braces of tim- ber not smaller in cross section than 5x10 inches, which should be constructed as simply as possible, and designed so as to offer the minimum surface exposed to fire and the small- est possible obstruction to the distribution of water in fighting fires under . the pier deck. Section 9. The pier deck shall consist of sawed timber not less than Sxl2 inches in cross section for the -pile cap- ping and rangers.' On the rangers shall be laid a deck of three inch plank and on this a two inch sheathing or wearing surface. The sheathing and deck planks shall be laid at right angles, except that in the driveways the sheathing may be laid diag- ohally. Joists four inches or.less in thickness shall not be used in this type of construction. When -railroad tracks are -placed on'the pier deck and are depressed, the sides -and bottom of the depression shall be of.the-same construction -as the pier deck. The deck shall be crowned to a pitch of one inch. in 20 feet. - - All buildings, pier sheds or other structures within the Maritime Fire District shall be limited in areas, by exterior or subdividing fire walls of concrete or brick, as given below; Unsprinklered Sprinklered Unprotected TJietal Construction 5,0000, 0 sq. ft. Fireproof Construction 20,000 Unlimited Fire walls,and exterior walls within 50 feet of other buildings, shall be as required.in the building code for,fire walls, with all openings suitably protected. In piers-, wharves and other structures where the under structure above mean low water is of wooden con- struction, draft -stops or fire .stops shall be provided below the .deck at intervals not exceeding 250 feet.-- Where there are superstructures these stops shall be continuation of fire walls -or exterior walls., provided that when the deck is equivalent in fire resistance to 22 inches'of reinforced concrete, the under structure.fire stop may be built without regard to the super- structures. The fire or draft stop shall be equivalent -in fire resistance to 8 inches of reinforced concrete, extending from a point above low water, equal to 1/3.the distance between low and high water, through the deck;. with suitable supporting- foundation upportingfoundation and without.openings;,provided that -where the"pier, or wharf is less than 50 feet wide or the pier or wharf is without a superstructure exceeding 2,000 square feet in area, the material- used for the fire or draft stop may be of heavy timber construction equivalent to . tutu ,thickn:esses - of 2 inches thick . planking --spiked, together,, or such forms -of .,construction involving. -incombustible material as shall provide a reasonable draft stop. Section 10. The floors of any stories above the pier deck shall not be less than three inches, splined or tongued and grooved plank, and covered with one inch flooring laid cross- wise or diagonally. Waterproofing material shall be laid be- tween the planking and the flooring in such manner as to make a thoroughly waterproof flooring. The deck shall be crowned to a pitch of about one inch in 20 feet. Section ll. The roof of any structure herein provided for shall be of plank and timber construction, planks to be not less than two inches splined or tongued and grooved. Timber shall be not less than six inches in either dimension and shall be single stick or 2 inch built up. Roof covering shall be Class A or I3 roofing labelled by the Underwriters Laboratories or the equivalent. Roof trusses shall be enclosed in an acceptable manner at approximately 100 foot intervals to form satisfac- tory curtain boards or draft stops, with two inch matched lumber. Section 12. Columns shall be suitable for the load car- ried, but shall not be less than 8 inches in the smallest cross sectional dimension. Where there is more than one story, wooden columns shall be superimposed through all. stories and shall have approved caps. V'Iooden girders for floor timbers shall be single stick and suitable for the load carried, but in no case less than 8 inches in the least dimension, or built up of 2 inch lumber'. Section 13. No building or structure of the type of con- struction herein provided for shall be constructed or erected within the limits of Fire District or Zone D, or No. 3, nearer than -50 feet -to "each other unless fully protected by approved brick fire walls; and -all piers, wharves or quay exceeding in length 200 feet must be protected at each 200 feet by fire walls of concrete or brick constructed in substructure and extending from mean low water up to and, -even with the deck of such pier, wharf or quay, said walls to be not less tnan..12 inches thick. Section 14. All ordinances or parts of ordinances in any manner conflicting with the provisions of this ordinance are hereby repealed, and. should any Section or part of a section of this ordinance be held. invalid, such holding shall not invalidate the whole, but the valid portions shall remain in full force and effect. Section 15. Any person failing or refusing to comply with the provisions of this ordinance,"or violating the same, shall, upon conviction, be fined in any sum not exceeding $100.00.
