AN ORDINANCE
Whereby the ,City, Council of the City' of Beaumont, grants to,'
the Beaumont, Sour Lake & West,ern.Railway Company, its successors
and assigns, the right 'to lay, its railroad tracks, ,-and- operate its
railroad across Bibb Avenue,'and, across Fannin Street'at the inter-
section thereof -;'and i'f necessary across .Rachford. Street and Forsythe,
Street, and over, along.and upon, a part of .Railroad 'Avenue and across
Mall Street= in -the . City of Beawnont, and to mike connections with the
Brack of the: Texarkana, & Ft. Smith. Railvray Company ., on, Railroad Avenue,
and imposing' c,,e,rtan conditions in respect thereto.:

Section I.
That- the Beaumont, , Sour Lake -& Wes tern Railway. Company in its
own right. and in the right° of its successors and assigns'. is -hereby
granted the right and authority to construct., own, mainiain.and
operate a railroad track over, along, upon and'.'acrose the. following.
pubic streets .or highways within' the corporate limits of the City of
Beaumont, as follows, towit:
1. Across Bibb Avenue and.across Fannin Street at theinter-.
section thereof immediately adj-oin ng andla3most parallel to the north
boundary line of the yards of the 'Texarkana & Ft.. Smith Railway Com-
".pany, and if nee eesary ,across Rachford Street and Forsythe Street im-
mediately north' ,of `and adjoining the north boundary line of said yards
of the Texarkana &' Fort Smith -Railway Company.
2. Beginning at� or near the north-west corner, at' the inter-
section of Wall Street _.with,.Railroad, Avenue, and thence on .a right
curve crossing Wall Street. -in a southeaste. nly- direction along Rail-
road Avenue' to a connection'.with the track of the Texarkana, & Fort

Section II. `
That -if the construction of said railroad track 'in any wise
interferes with catch basin or drains at the ,northeast corner of said
Block 7, the ' latter .shall' be reconstructed or . readjusted !at said point
or contiguous thereto in a manner as efficient and serviceable as' here-
tofore to' . the satisfaction of the City -Engineer at 'the sole cost and .
expense of `said Railway,
Section III.
The righte and privileges above granted ,'to the Railway:. Com
pany are subject to .all,of the liabilities. and obligations imposed upon
the Railway -Company by the provisions of Sections .3, 4, 5, 6, and 7
of the original ordinance in,favor of the, Beaumont, Sour: Lake & ,West
e'rn Railway Company, above referred .to, approved. February. _lst.,. 1906.
Section V.
The provisions of thils. ordif'mce 'shall take effect and be in.

We, the ordinance committee, to whom was referred
the above and foregoing ordinance, beg'to report that -we
have duly considered the sane, and recommend that .the, same
do pass, With the following amendment, viz:Amend the caption,so
that 'the 'same will :hereafter read as follows: "An Ordinance
whereby the City Council of the City of Beaumont,. -grants

Dear Sir:
This company is now engaged in constructing its.
tracks in the Van 'Wormer Addition to the City of Beau-
morit, on and along 'the streets and alleys, the right of
?,ray over which was granted by the Honorable, the City
Cowicil of this city, by ordinance ap'-proved Feb.? st,
1906. " Among other tracks provided for and authorized by
that ordinance, was a track adj oinin and practically
parallel to the northeast boundary line of the yards
of the Texarkana & Fort Smith Railway Company, described
in Section 8 of the ordinance, and 11hich track is essen-
tial to this company to enable us to connect the main
line track of this company Tvith the main line track of
the Texarkana & Fort Smith Rail,vay Company leading to and
dolvn Washington Street, over which it will be the p1.LY'-
-. --- _')o3e-of-this company to send a very large volume, if
not the entire volume, of the �YiTO11P,,Yl`fr�l�?1t`,traf_f-ic -of
this line. So that for the purposes of freight traffic
the track in question, which appears in red on the accom-
panying blue print, is substantially main line track.
'vhen the ordinance in question was passed, it was
thought by us practicable to effect the connection be-
t?v oen that track and the tracks of the Texarkana & Fort
Smith Railway Company in the yards of the latter company,
which, however, it has -now been found impracticable to
do, and that about the only - practicable connection 'or
the track will be. as shown on ,the accompanying blue
print, which will necessitate our connecting the same
along the northeast side of the Texarkana .& Fort Smith
Railmay Company's yards to the Fast thsreof, and passing
off of their property onto Railroad Avenue at the North-
west corner of the intersection of Railroad 'Avenuewith
'Tall Street on a curve of 7 deg. 7�0' , and affecting our
connection in the middle of Railroad Avenue about oppo-
site Bloc'. 8.
'Ve do not think that the short portion of this
track !vhich will lie in the streets will constitute any
- - add-:ition:l—o-bst Liction to Railroad Avenue or wall Street,
as it immediately adjoins and connects with the tracks

already located at that point, and we propose that you
require of us, and' that the comply with a requirement on
your part, to construct the track in conformity with
the street grades and promptly surface ,,ane.
The track in question passes over and to some ex-
tent ivi ll interfere .vith the catch basin at the northwest
corner of Block 7, but the engineers for the company
have consulted TYith your city -engineer and have agreed
upon a plan, if satisfaetofy to the Council, to complete-

omplete1 Y remedy this difficulty and provide a substitute' for
the drainage at this point by proper piping, which will
in every respect be as satisfactory as the existing .ar-
rangement. The details of this mill be explained to you
by the engineer, and if approved by you, the expense of
such alterations as may be regriired, will, of course,
be borne by us, and the work will either be done by us

its successors and assigns, the right to lay its
railroad tracks and operate its, railroad over, along

Street in the City of Beaumont , and to make connec-

Railway Company on Railroad Aveliue, and imposes
certain conditions in respect thereto.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BEAUMONT:
SECTION I.
That THE BEAUMONT, SOUR LAKE & WESTERN RAILWAY COM----
PANY in its own right and in right 6f its successors and
assigns is hereby granted the right .and authority to con-
struct, onn, maintain and operate a railroad track over,, .`
-along, upon- and -across- -the- following pl}blic streets- ar
highways within the corporate limits oz the City of Beau- � ~�

Beginning at or near the northwest corner, at the
intersection of Wall Street with Railroad Avenue, and
thence on a right elzrve crossing avail Street in a south-
easterly,direction along Railroad Avenue to a connection
with the track of the Texarkana & Fort Smith Railway Com-
I)any,. at or near the center of Railroad Avenue between
Blocks 7 and 3 of the Van Wormer Addition, a distanee�in
all of about two hundred (200 ) feet.,
SECTION II.
That if the construction of said railroad track in
any vise int--Tfer.es- with catch basin or drains at the
northeast corner of said Block 7, the latter shall be
reconstructed or readjusted at said point or contiguous
thereto in a manner as efficient and serviceable as here-
tofore to the satisfaction of the city engineer, at the
sole cost and ex-oense of said Railway Comparr�T.
SECTION III..
The rights and. privileges above granted to the
