Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on October 2, 2018, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentation and Recognition Public Comment: Persons may speak on scheduled agenda item No. 1A 2/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor Howard Cameron, Trinity Church gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Approve the purchase of trash cans for use in the Solid Waste Department — Resolution 18-236 C. Authorize the acceptance of a fifteen -foot wide Exclusive Sewer Line Easement located on Farrah Street — Resolution 18-238 Councilmember Samuel moved to approve the Consent Agenda excluding Item B. Authorize the settlement of the claim of George W. Brown III — Resolution 18-237 Councilmember Samuel moved to approve Item B on the Consent Agenda. Councilmember Jordan seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, SAM, PATE AND SAMUEL NAYS: NONE ABSTAIN: COUNCILMEMBER GETZ MOTION PASSED GENERAL BUSINESS Consider amending Section 20.03.003 of the Code of Ordinances that will establish speed zone boundaries and the speed limit on one particular section of Major Drive. The Texas Department of Transportation (TxDOT) performed a traffic survey of Major Drive from Folsom Drive to Dishman Road due to multiple residents requesting an evaluation of the speed limit. The 2017 crash rate for this section of road described above is 158.57, nearly three (3) times the statewide average of 55.88 for similar roadways. Administration and TxDOT propose the speed zone boundaries and speed limit for these sections of Major Drive be amended under the schedule Chapter 20 Section 20.03.003 to read as follows: Minutes — October 2, 2018 Street Limits of Zone Direction of Travel Speed Major Drive (c) From the centerline of State North and South 60 Highway 105 to a point 225 feet north of the centerline of Folsom Drive. (d) From a point 225 feet north North and South 50 of the centerline of Folsom Drive to a point 158 feet south of the centerline of Dishman Road. Approval of the ordinance. Councilmember Getz moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 20, SECTION 20.03.003 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS BY CHANGING AND AMENDING SPEED LIMITS AND SPEED ZONE BOUNDARIES TO THE SCHEDULE FOR ONE (1) SECTION OF MAJOR DRIVE; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. Councilmember Sam seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, SAM, PATE AND SAMUEL NAYS: NONE MOTION PASSED Ordinance 18-058 2. Consider a resolution authorizing the City Manager to award a contract to T. Gray Utility Company, of Houston forthe Sewer Manhole Rehabilitation Work Order Contract— Phase II. As part of the City's Sewer Overflow Initiative, the Sewer Manhole Rehabilitation Work Order Contract — Phase II will be used to rehabilitate existing manholes by coating the inside walls with concrete liner, performing frame to manhole sealing, and by adjusting/resetting defective manholes. Gray Utility Company, the low bidder, in the amount of $615,585.00. A total of 365 calendar days has been allotted for completion of the project. T. Gray Utility Company is a Certified MBE company. Funds will come from the Capital Program. Approval of the resolution. COuncilmember Jordan moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY APPROVES THE AWARD OF A CONTRACT TO T. GRAY UTILITY COMPANY, OF HOUSTON, TEXAS, IN THE AMOUNT OF $615,585.00 TO REHABILITATE EXISTING MANHOLES BY COATING THE INSIDE WALLS WITH CONCRETE LINER, PERFORMING FRAME TO MANHOLE SEALING, AND BY ADJUSTING/RESETTING DEFECTIVE MANHOLES FOR THE SANITARY SEWER MANHOLE REHABILITATION WORK ORDER CONTRACT PHASE II PROJECT; AND THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A CONTRACT WITH T. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, SAM, PATE AND SAMUEL NAYS: NONE MOTION PASSED Resolution 18-239 WORK SESSIONS * Review and discuss making application to become a "Bee City" Chris Jarmon, Executive Assistant to the City Manager reviewed and discussed making application to become a "Bee City". Mr. Jarmon stated that Bee City USA fosters ongoing dialogue in urban areas to raise awareness of the role pollinators play in our communities and what each of us can do to provide them with a health habitat. Bee City USA encouraged Incorporated cities, towns and counties and communities across America to become certified as a Bee City USA affiliate. There was discussion as to why pollinators were important, pollinators are nearly as important as sunlight, soil and water to the reproductive success of over 75% of the world's flowering plants. Pollinators are crucial to the production of most fruits, nuts and berries on which people and wildlife depend. Over 150 food crops in the United States depend on pollinators, including blueberries, apples, oranges, squash, tomatoes and almonds. What is the Issue? Reversing pollinator decline is the key to feeding the future. Without pollinators, we don't eat, it's as simple as that, and at the moment, large number of pollinators are dying. With the world's population projected to exceed 9 billion in just the next 30 years or so, that is not a good position for us to be in. There is Federal interest in this topic, the national strategy is to promote the health of honey bees and other pollinators. There are only two cities in Texas that are bee cities and those two cities are Beeville and Denton, Texas. Minutes — October 2, 2018 COMMENTS Mr. Jarmon discussed how the program would work; it would be jointly managed by the City of Beaumont and the Magnolia Garden Club. The commitments would be a once a year application fee of $500.00, a resolution needs to be passed by the City Council, a committee would be responsible for administering the program with a staff liaison; the City would assign a City staff liaison. There would also be a celebration of National Pollinator Week which occurs on February 22nd. There will be a link to Bee City, USA on the city's website, one street sign will be installed with BEE CITY on it, support pollinator habitats and plant pollinator friendly plants. There will be an annual report that will document activities that support pollinators. Review and discuss golf fees at the Henry Homberg Golf Course Kyle Hayes, City Manager reviewed and discussed the golf fees at the Henry Homberg Golf Course. The City Manager discussed a 5 year comparison of green fees and cart fees from 2013 to present, 2018 green fees for the weekday will increase to $16.00, green fees for the weekend will increase to $21.00 and cart fees will increase to $13.00. Regular membership fees will increase from $500.00 plus taxes to $525.00 plus taxes; Sr./Jr., from $300.00 plus taxes to $325.00 plus taxes. Golf Fees across SETX were discussed; Babe Zaharias in PortArthur has a weekday fee of $27.00 and weekend fee of $30.00; Willow Creek in Beaumont has a weekday fee of $27.50 and weekend fee of $36.00; Bayou Din in Beaumont has a weekday fee of $28.00 and weekend fee of $36.00; Idylwild in Sour Lake has a weekday fee of $26.00 and weekend fee of $36.00; Henry Homberg's proposed weekday fee will be $29.00 and weekend fee will be $34.00. Public Comments (Persons are limited to three minutes) Harold Haynes 5405 Seale Rd. Beaumont TX Stated that after the last meeting that there was a lot of dialogue one way, Council has never talked to the citizens, has never told the citizens what they are planning to do for them, said that there are a lot more pressing matters that need to be attended to other than bees and tennis courts, there are streets in Ward IV that need attention, he drives up and down those streets and it's tearing up his vehicle, asked that Council talk to them and tell them what they are planning and be as close to the truth as they possible can Marshall Scott 1890 Edwin Beaumont TX Made comments regarding the streets, stated that the citizens need to know the time, place and date as to when the streets will be repaired, they need something to take back to their people, named several streets that are so bad they are impassible, asked that Council stop talking about golf courses and bees and get the streets repaired, stated that the police can't get to them because the streets are so bad, they have to drive about 3 miles per hour, made comments regarding Councilmembers Getz and Pate, stated that they have to get rid of some of the Councilmembers that aren't doing anything, stated once again, citizens need answers Minutes — October 2, 2018 Eric Bender 27701 H 10 E. Beaumont TX Thanked Council for all that they do, realizes that the job they do isn't a high paying job but they do a good job regardless, stated that today's theme seems to be about streets, streets are public spaces, it's a public place for people, the streets used to be for children that skate, a gathering place, where kids ride bicycles, stated that the City wants to be a Bee City, how about making it a people city, instead of an automobile and truck city, how about making it an active transportation city, how about finishing the streets all the way to the curb, filing in the trenches that line the rode ways, make the streets safer for people who walk, push strollers, ride bicycles, and for children who want to play, Beaumont needs a polish there's no doubt about it, it needs to focus on its streets and public places Elizabeth Waddill 690 21St St. Beaumont TX Thanked Council as well as the City Manager and his Assistant for listening to the Magnolia Garden Club and bringing the idea to be a Bee City forward, it's a great opportunity for education and awareness, it's an opportunity to plant native plants and to shine as a city David Pete 6355 Chinn Ln. Beaumont TX After listening to everything that was discussed, he finds it interesting that there are still things that are discussed that hold no bearing on the major issues in the City, stated that the streets have always been an issue regardless of what is going on, Council seems to trivialize it to make it seem like it's another thing we do, we can talk about Bees, the golf course and the tennis center, but there is nothing productively being done to get the streets done, stated that there's millions of dollars that are being allocated towards the tennis center and golf course that half the City doesn't use, would like to know if the City is benefitting from the indoor tennis court, Council needs to focus on the City as a whole and not doing certain things in one area of town, it's sad that other areas never get anything done and that can't happen anymore, stop focusing on the small things and focus on what's important and that's all citizens of the City Dayna Rothenberger 3890 E. Lynwood Dr. Beaumont TX Wanted to remind Council that bicycles don't ruin streets, if there can be more done where there are bicycles on the road, the roads may last longer, made comments about riding a bicycle around the community instead of driving all the time, presented Council with a bicycle air pump from the bicycle community Mary Nixon 3850 Roland Rd. Beaumont TX Commented on the bees, butterflies, wasp, grasshoppers and different types of pollinators, stated that the Bee Program is stinging some of them, thinks that this is just another exercise in what seems ridiculous when it avoids and sidesteps much larger issues, a distraction for sure, there are serious concerns regarding the streets, lighting, lack of sidewalks, drainage and sewage backup, the environment is important, thinks that trash in the ditches and what they are putting in the ditches is more harmful than the lack of bees, stated that $500.00 a year isn't a lot of money, the information from the work session stated that all the City gets for that $500.00 is a sign, feels that the City can make the sign, all of the things that were listed the City can actual do without having to pay the yearly fee, would like Council to consider utilizing the funds on other things within the City ,Minutes — October 2, 2018 Carrie Herring 2855 Westmont Beaumont TX Commented on the Bee Program, thinks it's a great program, spoke regarding homeless shelters, knows that there_ is only one homeless shelter in Beaumont which is the Salvation Army, asked if the City has any plans to get more homeless people off the street, suggested that there be a program that can help the homeless, the homeless population is high in numbers and the streets can't be beautiful if there are bodies on them Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS MAYOR PRO TEM MOUTON - COMMENTED ON THE PRAY FOR BEAUMONT DRIVE THAT WAS DONE THROUGHOUT THE CITY, STATED IT WAS A GREAT SUCCESS, CONGRATULATED BEAUMONT NATIVE BARBARA LYNN FOR BEING RECOGNIZED IN WASHINGTON D.C. BY THE NATIONAL HERITAGE FOLK AND TRADITIONAL ARTS, FOR HER LONGEVITY IN THE MUSIC INDUSTRY, ALSO STATED THAT OCTOBER IS BREAST CANCER AWARENESS MONTH, ANNOUNCED THE JULIE RICHARDSON PROCTOR 5K COLOR RUSH RUN, WHICH WILL TAKE PLACE ON SATURDAY, OCTOBER 6, 2018, AT 8:00 A.M., ALSO IT WILL BE FIRE PREVENTION WEEK, ENCOURAGED EVERYONE TO STOP BY THE FIRE DEPARTMENT FOR THEIR FESTIVITIES AFTER THE COLOR RUSH, CONDOLENCES TO THE FAMILY OF ALMA HODGE, WHO LOST HER FATHER COUNCILMEMBER SAMUEL - NONE COUNCILMEMBER PATE - STATED THAT HE WAS UNABLE TO ATTEND THE PRAY FOR BEAUMONT DRIVE DUE TO HIS BEING AT A FUNERAL, ENCOURAGED EVERYONE TO ATTEND THE 5K COLOR RUSH AND AFTERWARDS VISIT THE FIRE DEPARTMENT FOR FIRE PREVENTION WEEK FESTIVITIES, COMMENTED ON STAND DOWN THAT TOOK PLACE AT THE BEAUMONT CIVIC CENTER, THE EVENT WAS TO. HELP HOMELESS VETERANS, THERE WAS OVER 300 VETERANS THAT ATTENDED, THE EVENT WAS SPONSORED BY THE SOUTH EAST TEXAS REGIONAL PLANNING COMMISSION, THE VETERANS WERE GIVEN VOUCHERS FOR HOUSING AS WELL AS OTHER PROGRAMS THAT ASSISTED THEM WITH THEIR NEEDS, EXPLAINED TO CITIZENS THAT COUNCILMEMBERS DON'T RESPOND WHEN THEY COME UP TO SPEAK BECAUSE WHAT THEY ARE SPEAKING ABOUT ISN'T A POSTED ITEM, THE COUNCIL AS WELL AS THE PUBLIC WORKS DEPARTMENT IS DILIGENTLY WORKING TOWARDS GETTING THE STREET PROJECT STARTED, ALSO STATED THAT DOWLEN RD.
