Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on September 18, 2018, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentation and Recognition Public Comment: Persons may speak on scheduled agenda item No. 1-6/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Minister Letha Hayes with Universal Church of the Living God gave the invocation. MayorAmes led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tern Mouton, Councilmembers Jordan, Getz, Sam, Pate and Samuel. Public Comment: Persons may speak on scheduled agenda items 1-6/Consent Agenda None CONSENT AGENDA Approval of minutes — September 11, 2018 * , Confirmation of committee appointments — None Minutes — September 18, 2018 A. Amend a Memorandum of Understanding with Beaumont Pets Alive — Resolution 18-224 B. Authorize the Mayor, City Manager, and Emergency Management Coordinator to execute a Mutual Aid Agreement with the Chambers County Sheriff's Office — Resolution 18-225 C. Authorize the acceptance of a Water Meter Easement from Allstate BK Real Estate Holdings, LTD — Resolution 18-226 D. Authorize the City Manager to enter into an interlocal agreement with the Port of Beaumont to allow the Port to use City contracts for a 102" CMP Storm Sewer Emergency Repair Project — Resolution 18-227 Councilmember Jordan moved to approve the Consent Agenda. Councilmember Samuel seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, SAM, PATE AND SAMUEL NAYS: NONE MOTION PASSED GENERAL BUSINESS Consider an ordinance adopting the FY 2019 Budget by a record vote. Article VI, Section 8 of the City Charter states that "the budget shall be adopted by the favorable votes of at least a majority of all members of the Council." Section 9 states that "the budget shall be finally adopted not later than the twenty-seventh (27th) day of the last month of the fiscal year. Should the Council take no final action on or prior to such day, the budget as submitted by the City Manager shall be deemed to have been finally adopted by the Council." Also, SB 1760 provides that if the tax rate exceeds the effective tax rate, the vote on the ordinance setting the tax rate must be a record vote and must be approved by at least 60 percent of the members of the governing body. If the tax rate vote fails, then the lower of the effective rate or prior year tax rate will be the tax rate. Section 102.007 of the Government Code requires the vote to adopt a budget to be a record vote. In addition, the adopted budget will contain a cover page that includes the statement on whether the budget will raise more, less or the same amount of property taxes as -the prior year, the record vote of each member of council by name, property tax rates for the preceding and current fiscal years, the effective tax rate, the effective maintenance and operations rate, the rollback tax rate, and the debt rate, along with the amount of debt secured by property taxes. This information is required to be posted on the city's website and remain there for one year after adoption of the budget. The FY 2019 Budget was submitted to Council on August 14, 2018 and reviewed during a work session on August 28, 2018. A public hearing was held on August 28, 2018, which met the requirements of the Charter and state law. Approval of the ordinance: Minutes — September 18, 2018 2 3. Councilmember Pate moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE REFERRED TO AS THE "ANNUAL APPROPRIATION ORDINANCE" ADOPTING A BUDGET FOR THE FISCAL PERIOD BEGINNING OCTOBER 1, 2018 AND ENDING SEPTEMBER 30, 2019, IN ACCORDANCE WITH THE CHARTER OF THE CITY OF BEAUMONT; APPORTIONING THE FUNDS OF THE CITY OF BEAUMONT; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH AND PROVIDING FOR SEVERABILITY. Mayor Pro Tem Mouton seconded the motion. Article VI, Section 20 states that "the Council shall, by resolution, adopt the Capital Program with or without amendment after the public hearing and on or before the twenty-sevehth (27th) day of the last month of the current fiscal year." The Capital Program was originally submitted to Council on May 15, 2018. It was submitted to Council on August 14, 2018 with the Budget and reviewed during a work session on August 28, 2018. A public hearing was also held on August 28, 2018. Approval of the resolution. Councilmember Pate moved to APPROVE A RESOLUTION THAT THE FY 2019 CAPITAL PROGRAM IS HERE ADOPTED AND WAS ORIGINALLY SUBMITTED TO COUNCIL ON MAY 15, 2018 WITH A PUBLIC HEARING HELD ON AUGUST 28, 2018. Councilmember Jordan seconded the -motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, SAM, PATE AND SAMUEL NAYS: NONE MOTION PASSED Resolution 18-228 Consider an ordinance accepting the tax roll and establishing the property tax rate for the tax year 2018 (FY 2019). The Jefferson County Appraisal District submitted the Certified Tax Roll on July 17, 2018, in the amount of $7,479,895,163. Based on this taxable value, a property tax rate of $0.71/$100 valuation for the tax year 2018 (FY 2019) is proposed, which is the current rate. The tax rate would be apportioned $0.49191/$100 assessed valuation to the General Fund Minutes — September 18, 2018 and $0.21809/$100 assessed valuation to the Debt Service Fund. As required by Section 26.05 of the Tax Code: The tax rate consists of two components, each of which must be approved separately by a record vote and at least 60 percent of the governing body must vote in favor of the ordinance. That ordinance must include the following statement: "THIS TAX RATE WILL RAISE MORE TAXES FOR MAINTENANCE AND OPERATIONS THAN LAST YEAR'S TAX RATE". Approval of the ordinance. Section 102 of the Local Government Code includes the following: "Adoption of a budget that will require raising more revenue from property taxes than in the previous year requires a separate vote of the governing body to ratify the property tax increase reflected in the budget. A vote under this subsection is in addition to and separate from the vote to adopt the budget or a vote to set the tax rate required by Chapter 26, Tax Code, or other law." The current tax rate of $0.71 per $100 assessed will remain at $0.71 per $100 of assessed valuation. The budgeted revenue from property taxes is expected to be $385,000 more than FY 2018. Of this amount, $481,184 is attributable to new property added to the tax roll this year. Approval of the ordinance. Consider a resolution authorizing the City Manager to award a contract to Excavation & Construction, LLC, of Port Arthur for the Chlorination Contact Chamber Rehabilitation Project The Chlorination Contact Chamber is located at the Waste Water Treatment Plant at 4900 Lafin Drive. The concrete walls that make up the chamber are damaged and require rehabilitation. A total of 150 calendar days has been allotted for completion of the project. Funds will come from the Capital Program Approval of the resolution. Councilmember Jordan moved t0 APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY APPROVES THE AWARD OF A CONTRACT TO EXCAVATION AND CONSTRUCTION, LLC, OF PORT ARTHUR, TEXAS, IN THE AMOUNT OF $1,099,759.98 FOR THE CHLORINATION CONTACT CHAMBER REHABILITATION PROJECT; AND THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A CONTRACT WITH EXCAVATION AND CONSTRUCTION, LLC, OF PORT ARTHUR, TEXAS. Consider amending Ordinance 17-59 to allow a six (6) month extension for the parking, use and occupancy of Recreational Vehicles (RVs), manufactured and industrialized housing as temporary living quarters on residential property, during the period of repair or reconstruction of damage to property caused by Hurricane Harvey. In September, 2017, as a response to over 2,000 households affected by Hurricane Harvey, Council approved an ordinance to allow for the use of Recreational Vehicles (RVs) and manufactured housing on residential property a period of one (1) year. Although many properties have been repaired in the past year, many are still under construction or awaiting repairs. Therefore, the Administration is recommending a six (6) month extension of this deadline. As this new deadline approaches, residents, upon application to the Planning & Community Development Department, would be allowed the opportunity to request a ninety (90) day extension. An extension could then be granted by the City Council if the home is still under construction, the resident is in litigation with their insurance company or if they have applied for and are awaiting CDBG disaster recovery assistance. Mayor Pro Tem Mouton moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE ALLOWING A PERIOD OF ONE (1 ) YEAR WITH AN OPTION TO EXTEND UP TO SIX (6) MONTHS FOR THE PARKING, USE AND OCCUPANCY OF RECREATIONAL VEHICLES, MANUFACTURED AND INDUSTRIALIZED HOUSING AS TEMPORARY LIVING QUARTERS ON RESIDENTIAL PROPERTY DURING THE PERIOD OF REPAIR OR Minutes — September 18, 2018 RECONSTRUCTION OF DAMAGE TO PROPERTY CAUSED BY HURRICANE HARVEY; PROVIDING FOR SEVERABILITY; AND PROVIDING A PENALTY. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, SAM, PATE AND SAMUEL NAYS: NONE MOTION PASSED Ordinance 18-054 PUBLIC HEARINGS * Receive comments on the 2017 Consolidated Annual Performance and Evaluation Report Public Hearing Open: 1:59 p.m. Lloyd J. Hebert 995 San Jacinto St. Beaumont TX Spoke to Council regarding his company that is local, stated that his company handles Small Business Development and Financing Services, stated that they have been in negotiations with EDA Commerce about the Consolidated Plan Report regarding the EDA Commerce money, the amount is about half a million dollars with a $250,000.00 match from the City, it's his understanding that the fund is underperforming or not performing at all, the City is supposed to be withdrawing their portion of the funding, there is a company out of Austin, TX, that wants to take over the fund, wanted Council to be aware that there are local lenders and loan packaging organizations that have the ability to do the work, those organizations can loan money out as micro loans to small businesses trying to recover from the hurricane, they have also been made aware by EDA that there is some additional dollars that can be tapped into for housing development that the City may not be aware of, his company's initial concern is the revolving loan that has been sitting for a long time that is under performing, would like to talk with the Mayor, City Manager and the Community Development staff regarding this situation Public Hearing Close: 2:02 p.m. 2018 Emergency Management Power Point Presentation Tim Ocnaschek, Emergency Management Director, discussed the Emergency Management Plan, he stated that every year the Emergency Management Office is directed under Government Code 418 to provide a public hearing regarding the Emergency Management Plan, under the direction of Mayor Ames. Staff has been able to incorporate a community approach to Emergency Management Planning. In addition to the Public Hearing, the plan is published on the City of Beaumont's website and encourages constant feedback. There is an annual Council and City Administration briefing that solicits feedback. After action reviews are conducted for all events and major incidents, there is a benefit from lessons learned and potential enhancements to the plan, there's also test to the plans through a wide variety of exercises with a specific annual focused based on a multi-year exercise plan. Minutes — September 18, 2018 Plans are adapted with constantly changing federal rules and processes, particularly those involving recovery from large disasters like Harvey. The goal is to include speeding recovery, maximizing reimbursement and improving mitigation planning. _Funding is also solicited and obtained through federal funds and local benefactors to assist with planning and preparedness measures. To pursue a whole community approach to planning, teams have been formed that include more than just members from all the City Departments. Planning input is solicited from businesses, industry, utilities, faith -based and volunteer organizations, neighborhood associations and other outreach briefings throughout the community, hospitals, schools, university, DD6, the LNVA as well as levels of government organizations. Mr. Ocnachek, discussed other items in the presentation such as the Mayor's 311 program, as well as a number of other programs that are available through their division to help individuals and organizations within the community to develop and improve their plans as well. The City's Emergency Management Plan and the great collaboration within our community has enabled a resilient City. This resiliency is a great testament to the leadership of the Mayor and City Manager. Receive comments regarding the City's Emergency Management Plan Public Hearing Open: 2: 06 p.m. None Public Hearing Close: 2:06 p.m. COMMENTS Public Comments (Persons are limited to three minutes) Everlina Spikes Lee 820 Prairie St. Beaumont TX Spoke to Council regarding Atlanta St. and Prairie St:, she lives on the corner of both those streets, stated that her driveway is on Atlanta but has to enter on Roberts street because Atlanta is so bad, from 2500 to 2700 Atlanta the pot holes are really bad, the street needs to be repaired and not just have the pot holes filled, stated that she has called 311 so many times and nothing has yet to be done, she has resided at her address for over 40 years and can't remember the street ever being repaired, also Roberts and Cartwright needs to be repaired, Roberts Street floods when there is a heavy rain, this also need to be looked at Lafayette Spivey 6010 Chandler Dr. Beaumont TX Stated that he has received in'access of about a hundred calls from where he lives into the Tyrrell Park area, stated that Exxon mobile was flaring a line out there and no one was notified, stated that he wished that their community would have been notified that this was going to happen, stated that this is a hazard, made comments about the Council talking about adding more police officers, stated that, that means that there will be more officers in the neighbor that looks like him, stated that they aren't the only ones committing crimes, but they will be getting the bulk of this, asked that the Mayor talk with the Police chief and ask if that's a feasible thing to do for the City, stated that City looks like it's about to run down a rabbit hole like BISD, when there is talk about frugal spending, hopes that the City doesn't go down this road Minutes — September 18, 2018 David Pete 6355 Chinn Ln. Beaumont TX Stated that he was on Dowlen Road and noticed that there were eight workers servicing Dowlen Road from one end to the other, Council is talking about other communities with streets still unsettled and undone, at the last meeting Council talked about $10 million dollars for street repairs, stated that he would like to see where that money is being used, he's not seeing it used in .the South End, North End or Pear Orchard, streets need to be repaired equally throughout the City, the City isn't doing its job, Council is talking but nothing is getting done, everything is being done in the West End, made mention of Magazine St., stated that there is a church on that road and kids are out playing, cars are traveling that area and driving entirely too fast, stated that there needs to be speed signs or speed bumps on that street to slow the traffic down, also made comments about construction and adding more police officers Frances Bowman 5415 Concord Rd. Beaumont TX Spoke to Council regarding a situation with, her water bill, stated that she's a law abiding citizen, a tax payer and homeowner, received a letter from the City stating that she was being charged $145.00 because the meter that's in her yard was damaged, pictures have been taken of the meter, stated that she visited the Water Department and spoke with Ms. Bridgette Stewart who told her that she is responsible for the meter and that she would not be able to appeal nor file a complaint or speak with the Director, this is why she's at Council on today, asked Council to please take a closer look at this situation Jason Marshburn 1070 Monterrey Dr. Beaumont TX . Made comments regarding redeveloping downtown Beaumont, especially ,around Lamar University, thinks it needs to have a more downtown feel, stated that the City doesn't really have a plan for downtown and thinks that's what is really stressing his people out, if there is a plan that citizens can be informed about when buying the AT&T building then more citizens might be able to embrace the buy, right now all they know is that a building is being purchased only.to be demolished and what the cost will be to make the purchase and an estimated cost to demolish, it would probably be better if a private developer purchase the building and let them be on the hook for the cost of demolition, also citizens need to know what a, private developer will do with the property, there's not a lot of updates regarding the street rehabilitation, if that information could be on the website where citizens can see it, they might feel better about what is being planned in the City Dayna Rothenberger 3890 E. Lynwood Dr. Beaumont TX Stated to Council that they are doing a fantastic job, commentedon bicycle lanes and the debris that's in those lanes, Calder bike lanes are the worst with debris, has reported the 7th Street and Calder Street bike lanes, the bike lanes on 7th Street were swept but all the truck did was sweep the debris in the middle of the lane, the bike lanes on Magnolia are fine, asked for a little help to keep the bike lanes a lot cleaner than they are Perry Busby 3010 Blossom Beaumont TX Stated that he hasn't resided in Beaumont since 1987, his father was a Pastor here in Beaumont for over 30 years, he's now on a book tour and his first stop was here in Beaumont, he wanted to bring his book back home, stated that a lot has changed in 25 years Minutes — September 18, 2018 and a lot hasn't, informed Council of everything that he has done which is a product of Beaumont, he has been following the politics in Beaumont for a while, what he has read about Beaumont has deeply saddened him, it's said that Beaumont is said to be the least educated City and high on the list of crimes, in the next ten or fifteen years the refineries located in this area will be revamped, there workforce will not be the workforce that we see today, if Council isn't careful to not bring good quality leadership that has vision, a town will be created not far from here to service the refineries, Beaumont will be a stop on the way, it will only be a stop for gas Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS MAYOR PRO TEM MOUTON - COMMENTED ON THE BOOK SIGNING AT THEODORE JOHNS LIBRARY WITH MR. PERRY BUSBY, THE BOOK IS "THE HACKS OF LIFE" IT'S AN AMAZON BEST SELLER, ENCOURAGED EVERYONE TO SUPPORT MR. BUSBY COUNCILMEMBER SAMUEL - ANNOUNCED LAMAR UNIVERSITY HOMECOMING, STATED TO MR. BOWMAN WHO SPOKE EARLIER REGARDING HER WATER BILL ISSUE, STATED THAT HE EMPATHIZES WITH HER AND THE LETTER THAT SHE RECEIVED, SHE SHOULD TAKE SOME SOLACE THAT THIS IS A MILDER VERSION OF A PREVIOUSLY LETTER, PREVIOUSLY A LETTER WAS SENT TO HER THAT BASICALLY ACCUSED HER AS THE ACCOUNT HOLDER OF CRIMINAL MISCHIEF, THAT LETTER DIDN'T PROVIDE A PHONE NUMBER FOR HER TO CONTACT SOMEONE, THESE ISSUES WITH DAMAGE TO THE AUTOMATED WATER METERS SEEM TO BE INCREASING IN FREQUENCY, HE HAS HAD A LARGE NUMBER OF CONSTITUENTS CONTACT HIM DUE TO A LETTER THEY RECEIVED FROM THE CITY ADVISING THEM THAT THERE IS DAMAGE TO THEIR AUTOMATED WATER METER AND THEY WILL BE BILLEDA $145.00 FOR IT, THEY AREN'T ADVISED OF ANY RIGHT TO APPEAL OR DUE PROCESS, CITIZENS HAVE BEEN TOLD THEY WILL HAVE TO PAY THE AMOUNT DUE OR HAVE THEIR WATER TURNED OFF, STATED THAT HE HAS MET WITH STAFF TO DISCUSS THIS ISSUE, COMMENTED ON THE STREET REHABILITATION PROGRAM, AS WELL AS THE LABOR AGREEMENT WITH THE POLICE DEPARTMENT COUNCILMEMBER JORDAN - STATED THAT SHE HAD BEEN MADE AWARE OF AN ISSUE BY A NEWS ORGANIZATION REGARDING THE NORTHWEST END OF THE HURLEY/SCOTT ADDITION OFF OF VOTH ROAD, WHEN THE NEWS ORGANIZATION CAME TO INTERVIEW HER SHE INQUIRED AS TO WHERE THEY RECEIVED THE INFORMATION, SHE WAS INFORMED THAT THEY GOT THE INFORMATION FROM THE APP NEXT DOOR, COUNCILMEMBER JORDAN STATED THAT THE APP NEXT DOOR HASN'T FIXED ANYTHING, IT DOESN'T HAVE TOOLS, PEOPLE OR RESOURCES, WHAT DOES HAVE TOOLS, PEOPLE AND RESOURCES IS THIS CITY, IT'S VERY DIFFICULT TO REMEDYANYTHING THAT HASN'T BEEN BROUGHT TO COUNCILS ATTENTION, GAVE CONDOLENCES TO THE FAMILY OF ANGIE WALKER, WHO WAS AN ARTIST THAT PARTICIPATED IN THE PAINT BOX PROJECT, SHE PAINED AN ELECTRICAL BOX ON THE CORNER OF EUNICE AND CALDER, COMMENTED ON HYPER VACANCY, STATED THAT THE CITY REALLY NEEDS TO LOOK AT THIS PROJECT, THE CITY IS BEING EATEN UP WITH VACANT PROPERTIES AND SOMETHING NEEDS TO BE DONE, ASKED IF THERE'S A STATEMENT THAT APPEARS ON THE WATER BILL THAT INFORMS CITIZENS OF THEIR RESPONSIBILITY REGARDING THE EQUIPMENT CITY ATTORNEY COOPER - NONE CITY MANAGER HAYES - NONE MAYOR AMES - NONE Open session of meeting recessed at 2:56 p.m. Minutes — September 18, 2018 EXECUTIVE SESSION Consider matters related to contemplated or pending litigation in accordance with Section 551.071 of the Government Code: Gaming Site Permit Revocation Appeal 3080 Washington Boulevard being no action taken in Executive Session, Council adjourned.
