Getz, Ward II Robin Mouton, Mayor Pro Tem Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on July 31, 2018, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call * Presentation and Recognition Public Comment: Persons may speak on scheduled agenda item No. 1 & 2/Consent Agenda * Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Elder Mike Rogers with First Christian Church gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tern Mouton, Councilmembers Jordan, Getz, Sam, Pate and Samuel. Absent: Kyle Hayes, City Manager. Also present were Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Proclamations, Presentation, Recognitions None Public Comment: Persons may speak on scheduled agenda items 1 & 2/Consent Agenda None CONSENT AGENDA Approval of minutes — July 24, 2018 Confirmation of committee appointments — Resolution 18-167 Laurie Leister would fill the unexpired term of Parker Langley on the Parks and Recreation Advisory Committee. The term would commence July 31, 2018 and expire September 30, 2019. (Mayor Becky Ames) Minutes — July 31, 2018 A. Authorize the City Manager to apply for and receive funding through the Department of Homeland Security Grant Program — Resolution 18-168 B. Approve the award of contracts for the emergency use of portable toilets and hand washing stations during an emergency event — Resolution 18-169 C. Authorize the settlement of the claim of Shirley Allen — Resolution 18-170 Councilmember Jordan moved to approve the Consent Agenda. Mayor Pro Tem Mouton seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, SAM, PATE AND SAMUEL NAYS: NONE MOTION PASSED GENERAL BUSINESS Consider a resolution approving a contract with Public Management of Cleveland, Texas for grant management services related to Hurricane Harvey. Councilmember Pate requested this item be tabled for one'week, Councilmember Samuel second. Specifications of the contract include assistance with the processes involved in applying for and submitting' claims; receiving and managing public assistance; developing cost effective mitigation solutions; seeking alternative funding sources from various agencies; and securing hazard mitigation assistance grant funding. Request for Qualifications were solicited from seventeen (17) vendors. Four responses were received and evaluated by City staff. All fees will be charged to the Hurricane Harvey Fund, however; those fees are considered Direct Administrative Costs (DAC) and are eligible for full reimbursement by FEMA. 2. Consider amending Section 2.02.031 of the Code of Ordinances related to the Beaumont Youth Advisory Council. On June 6, 2017, the Beaumont City Council passed an ordinance creating the Beaumont Youth Advisory Council. Since that time, the Beaumont Independent School District (BISD) has merged Central High School and Ozen High School into one school called Beaumont United High School. The Code of Ordinances needs to be updated to reflect that these schools have merged. Approval of the Ordinance. Councilmember Samuel moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 2.02, SECTION 2.02.031(A) OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS TO MAKE CHANGES RELATING TO THE BEAUMONT YOUTH ADVISORY COUNCIL; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. Mayor Pro Tem Mouton seconded the motion. Minutes —July 31, 2018 AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, SAM, PATE AND SAMUEL NAYS: NONE MOTION PASSED Ordinance 18-044 PUBLIC HEARING Receive comments related to a grant application to the Federal Transit Administration (FTA) for Operating Assistance funds for the Beaumont Municipal Transit System Public Hearing Open: 1:36 p.m. None Public Hearing Close: 1:36 p.m. 3. Consider a resolution authorizing the City Manager to submit a grant application and execute a contract with the Federal Transit Administration to receive Operating Assistance funds for the Beaumont Municipal Transit System. Beaumont Municipal Transit has prepared a grant application for FY 2018 FTA funds. The grant will help fund the labor, fringe benefits, parts and supplies, purchased services, utilities, insurance, licenses, and all other miscellaneous expenses needed for the operation and maintenance of the Beaumont Municipal Transit (BMT) System in FY 2018, the period from October 1, 2017 through September 30, 2018. The grant will pay up to 50% of the net operating deficit. g Sogrce FTA Grant $2,139,995 City Share $1,636,210 State $503,785 Total: $4,279,990 Approval of the resolution. Councilmember Samuel moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO SUBMIT A GRANT APPLICATION AND EXECUTE A CONTRACT WITH THE FEDERAL TRANSIT ADMINISTRATION (FTA) TO RECEIVE AN OPERATING ASSISTANCE GRANT IN THE AMOUNT OF $2,139,995 FOR THE BEAUMONT MUNICIPAL TRANSIT SYSTEM. Councilmember Sam seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, SAM, PATE AND SAMUEL NAYS: NONE Minutes —July 31, 2018 MOTION PASSED Resolution 18-171 COMMENTS Public Comments (Persons are limited to three minutes) Mark Faggard 4320 Calder Ave. Beaumont TX Spoke regarding the proposed purchase of the AT&T building, stated that it is not a benefit to the tax payers of Beaumont, thinks this is a waste of tax payers money, there are too many other items that need attention in this City, one of which is the deplorable conditions of the streets, hurricane season is here and the City needs to be prepared, asked that Council reconsider moving forward on this building, this purchase would be better accepted if there were some private developers that were willing to come to Beaumont and purchase the land and reimburse the City for what they are planning on spending Marshall Scott 1490 Edwin Beaumont TX Spoke to Council regarding the deplorable streets in Beaumont, would like for the Council to give Mayor Pro Tem Mouton something to bring back to the people in her Ward so they can see what will be done regarding their streets, Ward III and IV have some of the worse streets in the City, made mention of the selling of the AT&T building, asked that Council not spend money on a building that isn't worth it, there needs to be some youngsters that are willing to come in and do a better job, citizens in Ward III and IV need to file a class action law suit regarding the streets Landry Rountree 1565 S. Major Dr. Beaumont TX Commended Councilmember Getz and the great job that he does, thanked him for the integrity that he brings to his office, also presented him with a utility knife as a token of his appreciation from his family to Councilmember Getz, made religious comments, appreciates the fact that Mr. Getz will not be silenced, encouraged him to take courage and be strong Pam Shelander 5555 Clinton Beaumont TX Stated that when she learned of the details about the purchase of 555 Main St., she decided to do some research, she went all the way back to May 8, 2018 Council meetings, stated that the purchase of the AT&T building was never discussed in a Work Session, it was only discussed in Executive Session, disagrees with the statement on last week that was made that the purchase of the AT&T building was a private matter, it's not private money that is being spent so it shouldn't be a private matter, citizens have a right to know how much is being spent, stated if Council is insistent on doing this they need to make sure and check into the demolition to see how much it's going to cost before moving forward since no one seems to know, doesn't think that Council has thought this through as of yet, she doesn't agree with Council Minutes — July 31, 2018 Dayna Rothenberger 3896 E. Lynwood Dr. Beaumont TX Made comments about Riverfront Park, feels that the City could do better with the money that they want to use to purchase the AT&T building, thinks it would be better spent on streets, stated that she had three flats on three different bicycles due to debris on the sidewalks and the bicycle lanes that aren't being cleaned, she has reported the condition on the 311 app and nothing has been done, thinks that things can be done better and the. citizens are trying to say that things can be done better, there's a lot of other things that need to be worked on before money is dumped into a building, asked that they make good things happen and not waste money while doing it Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS COUNCILMEMBER JORDAN - GAVE HER POINT OF VIEW ON THE DOWNTOWN DEVELOPMENT AND THE PURCHASE OF THE AT&T BUILDING, STATED THAT WHEN SHE FIRST RAN FOR OFFICE PEOPLE STATED TO HER THAT BEAUMONT NEEDS TO BE BETTERAND NEEDS A CHANGE, SHE VOWED SHE WOULD DO EVERYTHING TO MAKE IT BETTER, THERE'S A LITTLE BIT OF A BACKLASH FOR WHATEVER REASON, IT SEEMS THAT PEOPLE LIKE IT THE WAY IT IS AND TO UTILIZE MONEY TO FIX POT HOLES, QUOTED COUNCILMEMBER SAMUEL AND HIS SAYING IN THE PAST THAT "WE HAVE TO GIVE PEOPLE A REASON TO GET OFF THE INTERSTATE", THIS IS THE BEST REASON THAT COUNCIL HAS COME UP WITH IN A LONG TIME, IT'S A PROGRESSIVE MOVE AND TO GIVE THE CITIZENS WHAT THEY HAVE BEEN ASKING FOR ALL ALONG AND NOT TO DO THE SAME THING YEAR AFTER YEAR, IF PEOPLE WILL REMEMBER THAT AT THE LAST MEETING COUNCIL APPROVED $10 MILLION TO WORK THE STREETS, THAT WOULD MAKE A HUGE DIFFERENCE, WANTED TO GO ON RECORD SAYING THAT A SIGN STATING THAT WE HAVE FEWER POT HOLES THAN WE HAD BEFORE ISN'T GOING TO GET ANYONE OFF THE INTERSTATE TO DOWNTOWN BEAUMONT TO CONSIDER LIVING HERE, WORKING HERE, TO RELOCATE HERE OR SCHOOLING THEIR KIDS HERE COUNCILMEMBER GETZ - STATED THAT HE WILL TRYAND MAKE HIS COMMENTS WITHOUT BEING INTERRUPTED OR THREATENED TO BE HOG TIED, HAS HEARD FROM A LOT OF CONSTITUENTS SINCE THE LAST MEETING, NOT A SINGLE ONE OF THEM THINK IT'S A GOOD IDEA TO PURCHASE THE AT&T BUILDING, THERE HAS BEEN SEVERAL PEOPLE THAT HAVE TALKED TO HIM FROM THE PRIVATE SECTOR THAT SAID THEY WOULD BE INTERESTED IN LOOKING AT THE BUILDING AS A PRIVATE DEVELOPMENT, THINKS THAT THIS IS THE WAY THIS NEEDS TO PROCEED, THE BUILDING IS ARCHITECTURALLY SOUND, CAPABLE OF BEING ELEVATED UP TO SIXTEEN STORIES, THE BUILDING COULD BE THE CENTERPIECE OF THE DOWNTOWN DEVELOPMENT, IT NEEDS TO COME FROM THE PRIVATE SECTOR, NOT AT THE Minutes —July 31, 2018 EXPENSE OF USING TAX PAYER DOLLARS ON A HOPE AND A DREAM, WHEN THERE IS A DECISION TO GO FORWARD WITH THIS, HE HOPES THAT EVERYONE ON COUNCIL REMEMBERS THE CITIZENS THAT SPOKE ON TODAY AND THOSE IN THE COMMUNITY THAT CAN'T MAKE IT FOR A 1:30 P.M., MEETING THAT AS TAX PAYERS ARE NOT IN FAVOR OF THIS COUNCILMEMBER SAM - THANKED THOSE CITIZENS THAT TOOK TIME TO SPEAK WITH HIM ABOUT THE STREETS AND THE PURCHASE OF THE AT&T BUILDING, STATED THAT THE CITY NEEDS TO GO FORWARD AND DO WHAT NEEDS TO BE DONE, PEOPLE ARE SAYING THAT COUNCIL NEEDS TO CREATE DOWNTOWN AGAIN, WHICH IS WHAT THEY ARE TRYING TO DO, HE THANKED EVERYONE THAT HAS ENCOURAGED THEM TO KEEP DOING WHAT THEY ARE DOING, IN REGARDS TO THE STREETS, WHEN THE REPAIRS ARE TO BE DONE THE STREETS WILL BE FIXED THE RIGHT WAY AND NOT JUST HALF REPAIR THEM BUT REPAIR THEM CORRECTLY COUNCILMEMBER PATE - GAVE CONDOLENCES TO THE FAMILY OF PASTOR HOWARD CAMERON OF TRINITY CHURCH ON THE LOSS OF HIS WIFE, COMPLIMENTED COUNCILMEMBER SAMUEL WHO'S WORKED REALLY HARD ON CREATING THE YOUTH ADVISORY COUNCIL, THERE ARE SOME GREAT KIDS- IN OUR SCHOOLS, ALSO COMPLIMENTED BILL MUNSON ON THE GREAT JOB HE DOES WITH THE PUBLIC TRANSPORTATION, AGREED WITH COUNCILMEMBER GETZ REGARDING THE VIA RIDE SHARE, COUNCIL SHOULD LOOK AT IT AND SEE IF IT BETTER SERVES OUR CITIZENS AND IF IT CAN AND WILL HELP THE CITY, ANNOUNCED THE PIONEERING WOMEN LUNCHEON THAT WILL BE HONORING MAYOR PRO TEM MOUTON AND OTHERS ON THURSDAY, AUGUST 2, 2018, AT 11:30 A.M., AT THE HOLIDAY INN ON WALDON RD., ALSO ANNOUNCED ON SUNDAY THERE WILL BE A VETERAN'S FEST AT THE EVENT CENTRE, ASKED THAT CITIZENS KEEP COUNCIL ON THEIR PRAYER LIST, IT'S OBVIOUS THAT EVERYONE ON COUNCIL IS PASSIONATE ABOUT THE CITY, EVERYONE ISN'T GOING TO AGREE ON EVERYTHING, THERE ARE A LOT OF THINGS THAT DON'T COME OUT AT COUNCIL MEETINGS BUT THERE'S A LOT OF TIME SPENT ON THE DECISIONS THAT ARE MADE, ASKED THAT CITIZENS GIVE THE COUNCIL A BENEFIT OF A DOUBT, THEY ARE TRYING TO MAKE THE BEST DECISIONS POSSIBLE FOR EVERYONE COUNCILMEMBER SAMUEL - ASKED THE PLANNING AND ZONING DIRECTOR ABOUT THE TURF THAT WAS DUMPED ABOUT THREE WEEKS AGO ON DELAWARE AND RENAUD, WENT BY EARLIER TODAY AND THE TURF IS STILL THERE, STATED THAT HE ALSO GOT WORD ON MONDAY THAT MORE TURF WAS DROPPED OFF AT ROSEDALE AND COLE, WENT BY THERE BEFORE COUNCIL MEETING AND IT WAS GONE, STILL WONDERING WHY THE TURF ON DELAWARE IS STILL THERE Minutes — July 31, 2018 MAYOR PRO TEM MOUTON - GAVE CONDOLENCES TO THE FAMILY OF CHARLIE MISHAW, JR., A CITY EMPLOYEE WHO WORKED IN STREETS AND DRAINAGE, AS WELL AS THE FAMILIES OF WARD BURTON AND MILDRED DARKINS, MADE COMMENTS REGARDING THE STREETS, STATED THAT STREET REPAIRS AREN'T UNIQUE TO BEAUMONT AND THERE ARE PROBLEMS THROUGHOUT TEXAS, ALSO MADE COMMENTS REGARDING THE CITY PURCHASING THE AT&T BUILDING CITY ATTORNEY COOPER -
