Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard; City Clerk The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m'. to consider the following: OPENING * Invocation Pledge of Allegiance Roll Call * Presentation and Recognition * Public Comment: Persons may speak on scheduled agenda item No. 1 & 2/Consent Agenda * Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor James Collins with Williams Memorial church of God in Christ gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tern Mouton, Councilmembers Jordan, Getz, Sam and Pate. Absent: Councilmember Samuel. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Public Comment: Persons may speak on scheduled agenda items 1 & 2/Consent Agenda None CONSENT AGENDA Approval of minutes — June 5, 2018 * Confirmation of committee appointments — None A) Authorize the City Manager to receive. Continuum of Care (COC) Grant funds from the Department of Housing and Urban Development and to enter into a contract with the Triangle Area Network — Resolution 18-126 B) Approve a contract with SERVPRO of Beaumont for mold remediation and HVAC duct cleaning at the Tyrrell Historical Library — Resolution 18-127 C) Approve a contract with Jack Built of Orange for painting the ceiling at the Tyrrell Historical Library — Resolution 18-128 D) Approve the purchase of a Blower Package from Atlas Copco Compressors LLC of Houston for use at the Sewer Treatment Plant — Resolution 18-129 E) Authorize the City Manager to receive Hazard Mitigation Grant funds from the Department of Homeland Security — Resolution 18-130 F) Authorize the City Manager to accept maintenance and authorize a final payment to Neon Electric Corporation related to the construction of nine bus shelters — Resolution 18-131 G) Approve a payment to Motorola for a maintenance agreement to support the 800 MHz radio system — Resolution 18-132 H) Authorize the City Manager to accept funding from the Office of the Attorney General that will be allocated for the Beaumont Police Department's training and technical assistance — Resolution 18-133 I) Authorize the granting of two Pipeline Agreements with Coastal Caverns, Inc. that will cross city utilities along Highland Avenue — Resolution 18-134 J) Authorize the granting of a Pipeline Agreement with Enterprise TE Products Pipeline Company, LLC that will cross three water lines and one sewer line near FM 3514 — Resolution 18-135 K) Authorize the acceptance of a ten -foot wide Exclusive Water Easement located at 3443 Fannett Road — Resolution 18-136 Minutes — June 19, 2018 L) Approve a contract with TNT Wrecker Service for towing and impounding services of uninsured vehicles for use by the Police Department — Resolution 18-137 Councilmember Jordan moved to approve the Consent Agenda. Councilmember Sam seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, SAM AND PATE NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider a resolution approving a contract with Delta Specialties Contractors, LLC of Monroe, LA, for the construction of perimeter fencing at the Beaumont Municipal Airport. Currently, the Beaumont Municipal Airport has a 6 -foot chain -linked fence with three strands of barbed wire on top in front of the airport and a 4 -foot barbed wire fence on the other three sides of the airport. Surrounding wildlife has been able to enter the airport grounds which is creating an unsafe environment for aircraft utilizing the taxiways and runways. The Federal Aviation Administration (FAA) has recommended that we replace the three sides of barbed wire fencing with a 10 -foot chain -linked fence to better secure the airport grounds from wildlife. Bids were requested from eleven (11) vendors with seven responses received. The low qualified bid is in the amount of $308,000. The contractor will complete the project in 70 days. Funds will come from the Beaumont Municipal Airport Fund. Approval of the resolution Councilmember Sam moved to APPROVE A RESOLUTION THAT THE BID SUBMITTED BY DELTA SPECIALTY CONTRACTORS, LLC, OF MONROE, LOUISIANA, FOR THE CONSTRUCTION OF PERIMETER FENCING AT THE BEAUMONT MUNICIPAL AIRPORT IN THE AMOUNT OF $308,000.00 BE ACCEPTED BY THE CITY OF BEAUMONT AND THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A CONTRACT WITH DELTA SPECIALTY CONTRACTORS, LLC. Councilmember Getz seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, SAM AND PATE NAYS: NONE MOTION PASSED Resolution 18-138 Minutes — June 19, 2018 2. Consider a resolution authorizing the City Manager to execute a Letter Agreement with Jefferson County Drainage District No. 6 for drainage improvements related to the Washington Phase II Project. The City of Beaumont and DD6 are working to improve drainage within the Washington Boulevard area. DD6 will install a 60 -inch pipe from the Washington Blvd. north right of way northerly into their Ditch No. 110. DD6 has agreed to supply all manpower and equipment with the City purchasing all of the materials. The estimated cost of the project is $120,000. Funds will come from the Capital Program. Approval of the resolution. Mayor Pro Tem Mouton moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A LETTER OF AGREEMENT BETWEEN THE CITY OF BEAUMONT AND JEFFERSON COUNTY DRAINAGE DISTRICT No. 6 (JCDD6) FOR DRAINAGE IMPROVEMENTS ALONG THE WASHINGTON BOULEVARD PHASE II PROJECT AND JCDD6 DITCH NO. 110-C. Councilmember Jordan seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, SAM AND PATE NAYS: NONE MOTION PASSED Resolution 18-139 WORK SESSION Review and discuss authorizing extensions and/or the sale of Temporary Housing Units (THUs) following Hurricane Harvey Chris Boone, Community Development Director reviewed and discussed authorizing extensions and/or the sale of Temporary Housing Units (THUs) following Hurricane Harvey. Mr. Boone stated that following the flooding caused by Hurricane Harvey, the Texas General Land Office (GLO) and the Federal Emergency Management Agency (FEMA) worked to provide temporary housing in the form of Temporary Housing Units (THUs) in the form of portable, manufactured homes or recreational vehicles. City Council allowed the placement of these temporary unites by authorizing a one-year suspension of the zoning rules that normally prohibit such placement. As of June, 2018, the City has permitted approximately one hundred (100) THUs within the city. As the one-year anniversary is approaching of the storm the GLO and FEMA are now asking for each jurisdiction's policies on extensions and/or the sale of these units to individual residents. Given that the long-term housing, recovery programs are only now beginning to be implemented by the GLO. Staff supports time extensions for the use of the THUs and will soon ask for a formal extension of the zoning waiver to allow them. Specifically, it is expected that the Administration will recommend a six-month blanket extension to the zoning Minutes — June 19, 2018 waiver and then ask that future extensions be reviewed on a case-by-case basis, similar to the process used following Hurricane Ike. With regard to the sale of the units, staff would recommend against this given that a significant amount of time, effort and expense were necessary to achieve zoning compliance following Hurricane Rita and Ike. In some instances, zoning violations persisted for years. This is of particular concern, given the susceptibility of some of these units to wind and flood events. It should be noted that several of the units have been placed within the floodplain and as such are especially at risk of flooding. It was the consensus of Council that they would consider a six-month extension and at the end of the that extension they would like FEMA to pick up the THUs and not sell them to residents. COMMENTS Public Comments (Persons are limited to three minutes) Landry Rountree 1565 S. Major Dr. Beaumont TX Congratulated the City employees with 25 to 40 years of service, congratulated his daughter Abbigail Faith who graduated from high school on Saturday, stated that when his daughter Abbigail was a baby she was accidentally left in the family van in the middle of June for about 2 hours, discussed the aftermath of the incident, with that being said he went on to speak to Council regarding child vehicular heatstroke fatalities between 1990 to 2017, also gave a handout for each Councilmember to read as well as maybe putting this information on the City's website Eric Bender 27701 H 10 E.
