Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call * Presentation and Recognition Public Comment: Persons may speak on scheduled agenda item No. 1 &2/Consent Agenda * Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor David Johnson with Trinity United Methodist Church gave the invocation. Students from Martin Luther. King Middle School led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tern Mouton, Councilmembers Jordan, Getz, Sam, Pate and Samuel. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Proclamations, Presentation, Recognitions "Certificate of Appreciation for Jack Piper" - June 5, 2018 - Proclamation read by Mayor Ames; accepted by Jack Piper Public Comment: Persons may speak on scheduled agenda items 1 &2/Consent Agenda None CONSENT.AGENDA Approval of minutes — May 29, 2018 Confirmation of committee appointments — None A) Authorize the City Manager to execute Change Order No. 4 for the Washington Boulevard Pavement Widening Phase II Project (Corporate Drive to Amarillo Street) — Resolution 18- 123 Minutes — June 5, 2018 Councilmember Samuel moved to approve the Consent Agenda. Councilmember Jordan seconded the motion. AYES: MAYORAMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, SAM, PATE AND SAMUEL NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider a resolution authorizing the publication of a notice of intention to issue Certificates of Obligation in an amount not to exceed $10 Million for Street Rehabilitation. Consider a resolution approving the purchase of two Paratransit buses for use in the Beaumont Municipal Transit System. On May 15, 2018, Council received the 2019-2023 Capital Program. The Capital Program included $10 Million for the Street Rehabilitation Program for fiscal years 2019 and 2020. The proposed issue in an amount not to exceed $10 Million would be used to fund the Street Rehabilitation Program for those years. Council's approval of the sale of the Certificates is tentatively scheduled for July 17, 2018. All debt and other expenses related to the Certificates of Obligation shall be incurred by the Debt Service Fund. Approval of resolution. Councilmember Getz moved to APPROVE A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BEAUMONT, TEXAS, AUTHORIZING THE PUBLICATION OF THE NOTICE OF INTENTION TO ISSUE BEAUMONT, TEXAS CERTIFICATES OF OBLIGATION IN A PRINCIPAL AMOUNT NOT TO EXCEED $10,000,000 FOR THE CONSTRUCTION OF PUBLIC WORKS AND ANY ITEMS RELATED THERETO AND FOR THE PAYMENT OF CONTRACTUAL OBLIGATIONS FOR PROFESSIONAL SERVICES; AUTHORIZING THE DISTRIBUTION OF A PRELIMINARY OFFICIAL STATEMENT RELATING TO SUCH CERTIFICATES; AND CONTAINING OTHER PROVISIONS RELATING THERETO. Mayor Pro Tem Mouton seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, SAM, PATE AND SAMUEL NAYS: NONE MOTION PASSED Resolution 18-124 Minutes — June 5, 2018 2. Consider a resolution approving the purchase of two Paratransit buses for use in the Beaumont Municipal Transit System. Beaumont Municipal Transit currently operates eight Paratransit buses. The Federal Transportation Administration (FTA) requires that these buses to be operated until they reach 150,000 miles or five years of age. The City is replacing two buses that were acquired in 2010. Unit 1030 has 199,518 miles and Unit 1032 has 203,777 miles. All buses that are removed from service will be sold at auction or disposed of according to grant guidelines. The Paratransit buses will be purchased from Master's Transportation in the amount of $111,722 per unit, or a total of $223,444. A formal bid was solicited from four bus manufacturing companies and three responses were received. The bid tab is attached for your review. A Federal Transportation Administration Grant with no matching funds required. Approval of the resolution. Mayor Pro Tem Mouton moved to APPROVE A RESOLUTION THAT THE BID SUBMITTED BY MASTER'S TRANSPORTATION, OF HOUSTON, TEXAS, FOR THE PURCHASE OF TWO (2) PARATRANSIT BUSES FOR USE BY THE TRANSIT DEPARTMENT IN THE AMOUNT OF $111,722.00 PER UNIT, OR A TOTAL OF $223,444.00 BE ACCEPTED BY THE CITY OF BEAUMONT. Councilmember Samuel seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, SAM, PATE AND SAMUEL NAYS: NONE MOTION PASSED Resolution 18-125 COMMENTS * Public Comments (Persons are limited to three minutes) Casi ReKieta 510 Park St. Beaumont TX Stated that she was representing Region 5 Service Center regarding a new program called JAG (Jobs for Americas Graduates) that was brought to the State of Texas this past May, they help at risk youth overcome barriers to their success so that they can pursue their GED and transition into post -secondary education, quality employment or the Military, to date they have had 18 of their 47 students in paid work experience jobs and 31 of their 47 students are enrolled in an certificate training program, such as welding, CPR, medical assistant, dental assistant etc., the students do have the unconditional support of a JAG specialist such as herself to help them Minutes — June 5, 2018 Mary Nixon 3850 Roland Rd. Beaumont TX Requested consideration for sidewalks on Helbig Rd., there is a concern for safety especially at night when they have no easement to walk on, stated that she knows that the street is to be under construction but not sure when, would like this to be part of the reconstruction Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS COUNCILMEMBER JORDAN - COMMENTED ON THE BEAUMONT ANIMAL SERVICES UNDER THE DIRECTION OF MATT FORTENBERRY AND VETERINARIAN, DR. KELLY CASE, STATED THAT THE BEAUMONT ANIMAL SERVICES HAS TRANSITIONED FROM A CATCH AND CONTROL TO AN ADOPTION SERVICE AS WELL, DR. CASE HAS INFORMED HER THAT THE LIVE RELEASE RATE HAS BEEN 29% IN THE PAST AND IS NOW CLOSER TO 80% WHICH IS SOMETHING THAT EVERYONE SHOULD BE PROUD OF, ANIMAL SERVICES IS NOW TRANSPORTING ANIMALS TO RECUE ORGANIZATIONS ACROSS THE COUNTRY, THE SHELTER HAS TRANSFERRED 27 DOGS TO STERLING, MASSACHUSETTS, 40 WENT TO CANADA, WOULD LIKE TO SEE COUNCIL ADDRESS THE SPAY AND NEUTER LAWS, STATED THAT SHE WOULD BE COMING UP WITH SOMETHING CONCERNING THE LAW FOR EVERYONE TO REVIEW COUNCILMEMBER GETZ - STATED THAT HE HAS RECEIVED A LOT OF POSITIVE FEEDBACK REGARDING THE DECISION TO REHAB THE TYRRELL PARK COMMUNITY CENTER, STATED THAT A CONSTITUENT ASK THE QUESTION, IF THERE ARE CITIZENS THAT WANT TO ENGAGE IN CROWD FUNDING TO RAISE MONEY TO PUT A ROOF ON THE BACK PART OF THE TYRRELL PARK COMMUNITY CENTER STRUCTURE WHO WOULD BE THE APPROPRIATE ENTITY TO RECEIVE THE FUNDING.
