The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with
the Texas Open Meetings Act, Texas Government Code, Chapter 551 on, at the City Hall Council
Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following:

Mayor Ames called the council meeting to order at 1:30 p.m.
Pastor "Big" Jim Selles with West End Baptist Church gave the invocation and led'the Pledge of
Allegiance. Roll call was made by Tina Broussard, City Clerk.
Present at the meeting were Mayor Ames, Councilmembers Jordan, Getz, Sams Pate and Samuel.
Absent: Mayor Pro Tern Mouton. Also present were Kyle Hayes, City Manager; Tyrone Cooper,

Spoke to Council regarding Item #9 on the Agenda; Consider an appeal of the Historic
Landmark Commission's decision to deny a request to remove the roof/ceiling structure,
wood doors and window sashes of the Tyrrell Park Community Building, asked that Council
vote to approve the appeal so that renovations can be done to the building that the building
is a part of history and should be renovated back to its original condition

GENERAL BUSINESS
1. Consider a request for a Rezoning from RM -H (Residential Multiple Family Dwelling -Highest
Density) and A -R (Agricultural -Residential) District to GC -MD (General Commercial -Multiple
Family Dwelling) or a more restrictive District for property located at 3955 North Major Drive.
Richard F. Faust has requested a rezoning from RM -H (Residential Multiple Family Delling -
Highest Density) and A -R (Agricultural—Residential) District to GC -MD (General Commercial -
Multiple Family Dwelling) or a more restrictive District for the property located at 3955
NorthMajor Drive. Shields of Strength, an inspirational jewelry/apparel retail and distribution
company, would like to construct a new facility at this location.
Mr. Faust mentioned properties in the area have developed as apartment complexes,
churches, and commercial uses. Although Mr. Faust is correct that such uses have
developed nearby, the underlying zoning for much of the area is designed for agricultural or
residential uses. Although the request may be seen as spot zoning, it should be noted that
property south of Folsom Drive was recently rezoned to GC -MD -2 (General Commercial -
Multiple Family Dwelling - 2). As this area will continue to develop with multi -family and
commercial uses, GC -MD -2 is an appropriate zoning to accommodate these uses. At some
point both sides of North Major Drive should be rezoned to GC -MD -2 to match zoning to the
south.

2. Consider a request for a revised Specific Use Permit to allow a tree service in a GC -MD
(General Commercial -Multiple Family Dwelling) District for property located at 6640 Concord
Road.
Charles W. Morris is requesting a revised Specific Use Permit to allow a tree service
operation at 6640 Concord Road. Mr. Morris, more specifically, would like to park supporting
equipment for his tree service at this location and process firewood.
A fence and landscaping buffers have been installed adjacent to high-density residential
uses in the area. No customers will be coming and going from this location and no unusable
debris will be kept on the property. All processing will occur between 8 a.m. and 5 p.m.,
Monday thru Saturday.
At a Joint Public Hearing held on May 21, 2018, the Planning Commission recommended

3. Consider a request for a Specific Use Permit to allow a gaming facility in a GC -MD (General
Commercial -Multiple Family Dwelling) District for property located at 4705-B Magnolia
Avenue.
Julius Johnson has requested a Specific Use Permit to allow a gaming facility at 4705-B
Magnolia Avenue. The applicant would like to have twenty (20) gaming machines at this
location. The hours of operation for the business would be 8 a.m. to 12 p.m. Entrance to the
smoke shop is restricted to eighteen (18) years old and above. Identification is checked to
ensure that customers are at least eighteen (18). For entry to the gaming area, customers
must be at least twenty-one (21) years old. Security will be provided by surveillance
cameras.
It should be noted that gaming facilities that have five or fewer machines tend to be
considered accessory in nature when part of a primary use, and as such, tend to result in
fewer negative impacts on surrounding land uses. However, larger game rooms with dozens
of machines take on the scale of a small casino and as a result, require careful consideration
as to their location and compatibility with surrounding land uses. Some of these
considerations include compatibility with other land uses, noise, and traffic as well as safety
considerations. 'As such, proximity to parks, schools and especially residential uses should
be carefully considered in the review of gaming facilities.
This property is adjacent to a residential neighborhood and residential single-family
dwellings. In addition, there is insufficient parking at this location for the total amount of retail
space.

4. Consider a request for a Specific Use Permit to allow a new cellular tower in an LI (Light
Industrial) District for property located at 5685 Washington Boulevard.
Andrew Kasparek on behalf of Verizon Wireless is requesting a Specific Use Permit to allow
the applicant to construct a cellular communications site including a 120 -foot tall monopole
tower, located on a 0.0581 acre lease site, at 5685 Washington Boulevard. This site meets
the distance requirement from residentially zoned property and will be constructed to city and
federal standards. In addition, Verizon will enclose the equipment with an eight (8) foot wood
privacy fence.
The applicant states that this tower will help provide additional coverage and capacity to the
customers in the area, and would be used for emergency services.

North Street.
Jantira C. Bruce has requested a Specific Use Permit to open a Facial Spa & Sauna at 3355
North Street. Ms. Bruce plans to have 2 or 3 workstations for contractors to conduct
business at this property. Contractors would provide make-up application and facial care
services as well as a sauna. All utilities are present and adequate for this facility. Business
hours will be from 9 a.m. to 8 p.m.

Ordinance 18-025
7. Consider a request to allow a restaurant in a GC -MD -2 (General Commercial — Multiple
Family Dwelling - 2) District for property located at 4490 Crow Road.
GBI Investments, L.L.C. would like to construct a new restaurant at 4490 Crow Road.
This property is located in the flood hazard. Properties along Dowlen and Crow Roads are
mostly developed in this area, creating large amounts of runoff during rain events. New flood
maps show a BFE (Base Flood Elevation) of 27' just west of this property. Therefore, the
lowest floor of new construction must be at least 18" above BFE. As drainage can be an
issue along Crow Road, drainage will need to be directed westerly.
Landscaping requirements shall include 8 -foot privacy, wood or masonry, screening fences
and 10' wide landscaped buffers along east and south property lines, as well as perimeter
landscaping at right-of-way, and islands for parking areas.

Ordinance 18-026
8. Consider an ordinance authorizing the suspension of the effective date of Entergy, Texas,
Inc.'s proposed rate increase to September 17, 2018.
On May 15, 2018, Entergy Texas, Inc. (ETI) filed its Statement of Intent to increase rates
with each city that retains exclusive original jurisdiction over electric rates and services in the
Entergy service area. This proposal would increase rates an estimated $16,689,590.00
annually. It would result in a monthly increase of $2..36 for the average residential customer
using 1,000 kWh per month.
The increase is intended to become effective on June 19, 2018. Each city retaining
exclusive original jurisdiction must make a determination regarding ETI's proposed rate
increase request or suspend the proposed effective date for a period of ninety (90) days or
until September 17, 2018. Each city retaining original jurisdiction over electric rates and
services has a responsibility to determine whether the requested increase allows for a
reasonable rate. The suspension would allow time for the cities rate attorneys and
consultants to determine whether the request is reasonable. The ordinance also provides for
the participation with the other cities in the ETI service area Steering Committee together
with the lawyers and consultants representing the cities in rate related matters.
The reasonable expenses associated with rate cases are reimbursable by the company

Ordinance 18-027
WORK SESSION
* Review and discuss options related to the use of the former Tyrrell Park Community
Building
Kyle Hayes, City Manager reviewed and discussed options related to the use of the
former Tyrrell Park Community Building. The City Manager stated that the Facilities
Maintenance staff has prepared a budget estimate for the renovation of the Tyrrell
Park Community Building. The estimate is based on restoring a portion of the
building back to its near original condition and leaving the back portion of the building
(south wing) as an open courtyard. The estimate does include the installation of an
HVAC system for the enclosed portion of the building. There was discussion and
breakdown of the estimated cost, the total cost estimated is $2,056,460.00.
The portion of the building proposed for renovation is approximately 6,432 square feet
(including the porch areas). The total estimated cost of $2,056,460.00 equates out to
$319.72 per square foot. It was also stated that the numbers provided are subject to
change once a defined scope of work is prepared and presented to the contractors to
prepare a firm quote. There could be some unknown challenges that may be
encountered due to the type and complexity of the structure.
9. Consider an appeal of the Historic Landmark Commission's decision to deny a request to
remove the roof/ceiling structure, wood doors and window sashes of the Tyrrell Park
Community Building — After the Work Session there was no need to approve this Item
At the May 14, 2018 Historic Landmark Commission meeting, the City of Beaumont Facilities
Maintenance Department requested the removal of the roof/ceiling structure, wood doors
and window sashes of the Tyrrell Park Community Building.
The roof of this structure was damaged extensively during Hurricane Rita. A large portion of
the roof has collapsed. In order to stabilize the structure, the City of Beaumont is requesting
permission to remove all parts of the structure that are wood. In addition, there are plans to
fill in the two fountains at this location. The purpose of this request is to stabilize the building
until such time that funding and a use for the building can be secured.

After much discussion, the Historic Landmark Commission recommended 4:3 to deny the
request. The consequence of this decision is to allow continued deterioration of the facility.
The Administration on behalf of the applicant, the Facilities Maintenance Director, is now
requesting an appeal of this decision. On February 13, 2018, during a Work Session, the
City Council agreed on the scope of work to be performed.

Stated that he is a part of the Jefferson County Historical Commission as well as a past
member of the Beaumont Historical Landmark Commission, thrilled to hear the City
Manager's proposal and he and Council are on the right track, the Community Building
needs to be restored to its original condition, the Jefferson County Historical Commission
would be glad to help with funding or anything else that is needed to restore the building
back to its former glory, also commented that he would like to see a roof on the entire
building

Made comments regarding Tyrrell Park Community Building, stated that he has been doing
research regarding this building, the building at Tyrrell Park was the only CCC camp in
Jefferson County, that building has a lot of history and should be restored, the building is a
very important building to the City

Made comments regarding the Tyrrell Park Community Building, pleased with the City
Managers proposal and feels that Council is moving in the right direction, any plans to save
the building and bring it back to its original condition is what is needed and the building be
saved for future generations

Commented on a gentlemen that sat by him in Council on last week, the gentlemen made
statements about one of the Councilmembers, stated that the Councilmember was a person
that is always starting racism, stated that he followed the man outside and asked the
gentlemen to maybe try and have lunch with the Councilmember and try to get to know him,
the gentlemen stated that he wouldn't talk with the Councilmember nor would he sit down
and eat with him, stated that people need to try and communicate with each other and have
some dialogue and maybe this would alleviate some of the problems that go on

National Organization that reforms marijuana laws, he has heard concerns of fellow citizens
regarding safety of the streets and the neighborhoods, stated that his purpose for attending
the meeting was to talk about the cost and confinement of jail and sensible solutions to jail

overcrowding in Texas as proposed by the Texas Criminal Justice Coalition, stated that it's
imperative that Beaumont adapt new approaches to address the behavior of individuals
suffering from substance abuse and mental illness, commented on the fact that nonviolent
individuals should be handled outside of over burden court and jail systems, rather than
forcing tax payers to foot the bill for their confinement, there was also discussion on
statistics throughout- Jefferson County and throughout the State of Texas as well as
discussion of House Bill 9321
Albert Harrison 1155 Oakland Beaumont TX
Spoke to Council regarding a concern that he has with the senior citizens discount that he's
supposed to be receiving on his water bill, stated that on the water bill it doesn't show where
there is a senior citizens discount, would like to have someone explain or show him where
the discount is, also made mention regarding pot holes on Avalon and Oakland and Ashley
and Oakland, stated that he reported the pot holes to 311 about three weeks to a month and
to this day the pot holes are still there
Eric Bender 2770 IH 10 E Beaumont TX
Stated that he is thrilled that Council is talking about the Community Building at Tyrell Park,
the building needs to be restored to its original condition, made comments regarding another
park in the North End that needs some attention, stated that he will be attending a
International Event called "Walk, Bike, Places" in New Orleans, Louisiana, this event will
make their community more walkable, 'bikeable and likeable, will be excited to bring back
results, ideas and suggestions to the Council
