Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentation and Recognition Public Comment: Persons may speak on scheduled agenda item No. 1, 2 & 4/Consent Agenda * Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Chaplain Schwartz with Baptist Hospitals of Southeast Texas gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tern -Mouton, Counciimembers Jordan, Getz, Sam, Pate and Samuel. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Proclamations, Presentation, Recognitions °National Mental Health Awareness Month" - May, 2018 - Proclamation read by Councilmember Pate; accepted by Lane Fortenberry, Public Relations Marketing Administrator for the Spindletop Center "Motorcycle Safety and Awareness Month" - May, 2018 - Proclamation read by Mayor Pro Tern Mouton; accepted by two members of a Motorcycle Group "Men's Health Month" - June, 2018 - Proclamation read by Councilmember Samuel; accepted by Ingrid Holmes, Gift of Life Program Services Liaison, along with staff and supporters Mayor Ames read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. Public Comment: Persons may speak on scheduled agenda items 1, 2 & 4/Consent Agenda None Minutes — May 15, 2018 CONSENT AGENDA Approval of minutes — May 8, 2018 Confirmation of board and commission member appointments - None A) Authorize the City Manager, or his designee, to execute all documents necessary to amend a contract between the City of Beaumont and the Texas Department of State Health Services to accept additional Federal funding — Resolution 18-107 B) Approve the purchase of a new elevator from Setex Construction Corp. for the Jefferson Theater — Resolution 18-108 C) Authorize the City Manager to execute Change Order No. 1, accept maintenance, and authorize a final payment for the Bigner Road Asphalt Resurfacing (Roland Road to East Lucas Drive) Project — Resolution 18-109 D) Approve the purchase and installation of new splash pad equipment for use at Perlstein Park — Resolution 18-110 E) Authorize the City Manager, or his designee, to execute all documents necessary for a Data Use Agreement between the City of Beaumont and the Texas Department of State Health Services — Resolution 18-111 F) Authorize the City Manager to execute Change Order No. 3, accept maintenance, and authorize a final payment for the 2017 Paving Improvements Project — Resolution 18-112 Mayor Pro Tem Mouton moved to approve the Consent Agenda. Councilmember Jordan seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, SAM, PATE AND SAMUEL NAYS: NONE MOTION PASSED GENERAL BUSINESS Consider a resolution approving the award of a contract to H. B. Neild & Sons, Inc. for plaster repair, restoration and painting at the Jefferson Theater. Several areas of the plaster ceiling in the Jefferson Theater are cracking and peeling due to the accumulation of condensation on the external side of the HVAC duct system located in the attic areas. The existing duct system has been externally insulated with a closed -cell foam insulation to prevent further condensation accumulation. The damage to the interior east wall has resulted from moisture migrating through the exterior masonry wall system due to thermal movement of the brick veneer and the aging effects of the building. Minutes — May 15, 2018 Bids were requested from eleven vendors and one response was received. The low qualified bid was received from H.B. Neild & Sons, Inc. in the amount of 328,525. Specifications allow for the work to be completed by September 30, 2018. Funds will come from the Capital Reserve fund. Approval of the resolution. Councilmember Getz moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY APPROVES THE AWARD OF A CONTACT TO H.B: NEILD & SONS, INC., OF BEAUMONT, TEXAS, IN'THE AMOUNT OF $328,858 FOR ORNAMENTAL LATH, PLASTER,' REPAIR, RESTORATION, PAINTING AND GILDING OF THE JEFFERSON THEATRE AND $287.50 PER SQUARE FOOT FOR ANY ADDITIONAL PLASTER REMOVAL, PLACEMENT AND PAINTING AND THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A CONTRACT WITH H.B. NEILD & SONS, INC., OF BEAUMONT, TEXAS. Councilmember Sam seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN,.GETZ, SAM, PATE AND SAMUEL NAYS: NONE MOTION PASSED Resolution 18-113 2. Consider a resolution authorizing the placement of "In God We Trust" decals on City emergency response vehicles. The placement of "In God We Trust" decals was previously discussed in a City Council Work Session. Funds were dedicated donated funds. Approval of Resolution. Mayor Pro Tern Mouton moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO CAUSE THE DISPLAY OF "IN GOD WE TRUST" DECALS ON CITY EMERGENCY RESPONSE VEHICLES. Councilmember Getz seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS GETZ, SAM AND PATE NAYS.: COUNCILMEMBERS JORDAN AND SAMUEL MOTION PASSED Resolution 18-114 Minutes — May 15, 2018 PUBLIC HEARING Receive comments on the Public Services and Public Facilities and Improvements line items of the Consolidated Grant Program's 2018 Annual Action Plan Public Hearing Open: 2:00 p.m. None Public Hearing Clos: 2:00 p.m. 3. Consider approving a resolution adopting the 2018 Annual Action Plan. As mandated by the U. S. Department of Housing and Urban Development (HUD), City Council has conducted public hearings and work sessions in previous years priorto adopting the City's Annual Action Plan. Planning & Community Development staff, along with the Community Development Advisory Committee (CDAC), has hosted Public Hearings in order to receive public comments on the process and activities related to the 2018 Annual Action Plan. Attached is the proposed Budget for the 2018 Program Year. The proposed budget reflects estimated allocations of $1,251,755 in Community Development Block Grant (CDBG) funding, an estimated $100,000 in Program Income and $505,704 in HOME funding. Please note these amounts may change slightly before the final adoption as we receive the final amounts from HUD. U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant and HOME Investment Partnership Grant funds. Conduct the Public Hearing and approve the resolution. COuncilmember Samuel moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY ADOPTS THE HUD CONSOLIDATED GRANT PROGRAM'S 2017 ANNUAL ACTION PLAN, AS WELL AS THE BUDGET OF THE ACTION PLAN IN THE AMOUNT OF $1,857,459. Councilmember Jordan seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, SAM, PATE AND SAMUEL NAYS: NONE MOTION PASSED Resolution 18-115 COMMENTS Public Comments (Persons are limited to three minutes) Minutes — May 15, 2018 Charles Ray Paul, Sr. 5615 Phelps Rd. Beaumont TX Spoke to Council regarding a particular contractor that has been doing business in the City of Beaumont that has lied, stolen and cheated citizens of Beaumont as well as himself, stated that he went through Dispute Resolution, the Better Business Bureau regarding what this contractor has done to him, just wanted to inform and let the City know who this contractor is so that the City doesn't allow this contractor to perform work for citizens in this City and allow them to get ripped off Luther Raymond Holmes 1230 Saxe #105 Beaumont TX Stated -that on May 14, 2018, he was pulled over by Beaumont Police at the intersection of Liberty and MLK, the police stated to him that he was stopped because he didn't put his signal light on in a timely manner, he was asked to see his driver's license and proof of insurance, the police officer asked to search his vehicle, he gave them permission to do so, there was a second police officer that was dispatched to come to the scene, he was questioned by the police officers, the questions that were asked had nothing to do with what he was being pulled over for, he stated that he didn't get a warning nor a ticket and didn't understand why he was pulled over in the first place, felt that he was being harassed at that point, wanted Council to know that there's a lot of harassment going by the Beaumont Police Department and it's his hope that someone will make a correction about what is going on Landry Rountree 1565 S. Major Dr. Beaumont TX Whished a Happy 70th Anniversary to the Nation of Israel, the rebirth of the people that trusted God, congratulated President Trumph for locating the Embassy in Jerusalem, also congratulated his son David Rountree who's in the Air Force and just. completed boot camp and went through Tech School, he will be in Okinowa for two years, also his oldest son Andrew Rountree has been accepted into the Army JAG reserve, commented on Earl White, stated that he was a great choice for Beaumont Fire Chief, he's a great man, as well as comments regarding the resurfacing of Washington Blvd., it looks great Kevin Allen 2390 Park St. Beaumont TX Stated that he is trying to get a minority grant, has contacted the City Manager and the Councilmember in his ward and hasn't gotten a response from either of them, would like to find a grant to start the program he's wanting to start and would like to get some help from City staff Wilferd Richard 3680 Blossom Dr. Beaumont TX Spoke to Council regarding Washington Blvd, informed them not to go down Washington Blvd., past 11th St., they have a hard time getting out of their neighborhood, it's a single lane now going and coming, stated that a light has been asked for in the past, he has never gotten an answer regarding the light, also stated there are no street lights on Avenue A, C and Park St., they had lights before the construction, wanted to know how long does it take to put the street lights back, also mentioned that there is a Councilmember who still continues to keep racism going on in the City, also mentioned of the Superintendent of the School District, said he hasn't seen him at any of the low income schools Minutes — May 15, 2018 Eric Bender 2770 1 H 10 E Beaumont TX Commented on Moonlight Madness 2018, stated that it was a great crowd, police came up with a new route that was brilliant, the Parks and Recreation Department did a great job with registration they also set a gorgeous table at the rest stop, 100% of the comments received were fantastic, also praised the Sterling Pruitt Center, people didn't know this center existed and commented on how nice it was Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS MAYOR PRO TEM MOUTON - STATED THAT SHE GOT GREAT FEEDBACK REGARDING THE MOONLIGHT MADNESS, THANKED MR. LANDRY ROUNTREE FOR HIS COMMENTS AND SUPPORT FOR THE "IN GOD WE TRUST DECALS", WASN'T AT THE LAST COUNCIL MEETING WISHED ALL THE MOTHERS A BELATED MOTHER'S DAY COUNCILMEMBER SAMUEL - NONE COUNCILMEMBER PATE - NONE COUNCILMEMBER SAM - STATED THAT HE ATTENDED A NUMBER OF NEIGHBORHOOD ASSOCIATION MEETINGS, THERE ARE SOME AREAS WITH A LOT OF CAR BREAK THEFTS, CITIZENS NEED TO STAY VIGIL AND KEEP THEIR EYES ON THIS SITUATION, CITIZENS DID AN EXCELLENT JOB IN RELAYING TO TXDOT THEIR DISPLEASURE REGARDING THE CLOSURES OF THE DELAWARE AND TRAM ROAD EXITS, ALSO STATED THAT HE WOULD LIKE TO SEE MORE CITIZENS ACTIVE IN THEIR NEIGHBORHOOD ASSOCIATIONS COUNCILMEMBER GETZ - COMMENTED ON THE STREETS AND HOW MANY HAVE BEEN WORKED ON AND THOSE THAT ARE IN THE PROCESS OF BEING WORKED ON, THANKED DR. MAJDALANI AND HIS STAFF FOR ALL OF THEIR HARD WORK TO GET AS MANY ROADS AS POSSIBLE REPAIRED, ANNOUNCED A CONCERT THAT WILL BE HELD ON FRIDAY, MAY 18, 2018, AT THE JEFFERSON THEATRE FEATURING THE ROLLING STONES VERSUS THE BEATLES' COUNCILMEMBER JORDAN - STATED THE V.I.P. MAGAZINE FOR THE NEXT FEW MONTHS WILL BE HIGHLIGHTING ONE OF THE ARTIST AS WELL AS THE PAINTED BOX PROGRAM, THEY WILL HIGHLIGHT THE ARTIST AND THEIR CAREERS AND HOW THEY CAN BE REACHED, ALSO STATED THAT PARK BENCHES AT WUTHERING HEIGHTS PARK WILL BE PAINTED, THEY HAVE BEEN REPAIRED AND READY FOR PAINTING, THERE ARE ELEVEN ARTIST LINED UP TO DO THE WORK, ANNOUNCED THE CALDER TWILIGHT EVENT THAT WILL HELD JUNE 8, 2018, AT 7:00 P.M., IT'S A FUN RUN THAT WILL BE SPONSORED BY THE CITY OF BEAUMONT, ENCOURAGED Minutes — May 15, 2018 EVERYONE TO SIGN UP, HAS HAD CONTACT FROM CONSTITUENTS THAT HAVE CONCERNS REGARDING THE WIDENING OF Hwy 69 GOING NORTH, THE CONCERNS SURROUND THE PLANS TO DO AWAY WITH THE EXIT AT TRAM ROAD CITY ATTORNEY COOPER - NONE CITY MANAGER HAYES - NONE MAYOR AMES - STATED THAT SHE AND THE CITY MANAGER WOULD BE MEETING WITH TxDOT ON THURSDAY, MAY 17, 2018, REGARDING THE OPPOSITION OF THE CLOSING OF THE DELAWARE AND TRAM ROAD EXITS, ENCOURAGED EVERYONE TO WRITE LETTERS TO TxDOT AND THEIR STATE REPRESENTATIVES Council recessed into Executive Session at 2:34 p.m. EXECUTIVE SESSION * Consider matters related to appointment, employment, evaluation, reassignment, duties, discipline or dismissal of a public officer or employee in accordance with Section 551.074 of the Government Code to wit: City Magistrate Applicants — Terrence Allison and Brittanie Holmes Council reconvened into Regular Session at 3:20 p.m. 4. Consider a resolution appointing a part time City Magistrate. The City Council met in an Executive Session and discussed the appointment of a Municipal Magistrate to serve on an as -needed basis to assist the Chief Magistrate of the Municipal Court. The City Charter states, "There shall be one or more magistrates of said Municipal Court known as City Magistrates, one of whom shall be designated as Chief Magistrate..." Job notices were posted soliciting persons interested in serving in a part time capacity on an as -needed basis in the Municipal Court. The part time City Magistrate would be appointed for a two (2) year term with compensation set at $250.00 per session. Councilmember Jordan moved to APPROVE A RESOLUTION APPOINTING TWO PART-TIME CITY MAGISTRATES OF THE CITY OF BEAUMONT FOR A TWO (2) YEAR TERM. COMPENSATION SHALL BE $250.00 PER SESSION. Councilmember Getz seconded the motion.
