WHEREAS, a demolition lien, dated October 11, 2007, in the amount of
$40,418.75, represented by $20,755.00 in principal, $21,647.75 in interest, and $16.00
in lien assessment fee, exist against property described as 595 4th Street, Cartwright
Terrace Addition, Lots 5 through 11, Block 36; and,
WHEREAS, the Estate of Jim Austin is offering to compromise and settle the
amount of the pay off of the lien for the amount of $20,755.00 for property described as
5954 th Street, Cartwright Terrace Addition, Lots 5 through 11, Block 36; and,
WHEREAS, the City recommends approving payment in the amount of
$20,755.00 for the pay off of a demolition lien on property described as 595 4th Street,
Cartwright Terrace Addition, Lots 5 through 11, Block 36, waiving interest in the amount
of $21,647.75, and waiving lien assessment fee in the amount of $16.00 is in the best
interest of the City of Beaumont;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby,
in all things, approved and adopted; and,
THAT the lien payoff for 595 4th Street, Cartwright Terrace Addition, Lots 5
through 11, Block 36 be and it is hereby approved in the amount of $20,755.00, interest
be and it is hereby waived in the amount of $21,647.75, and lien assessment fee be and
it is hereby waived in the amount of $16.00; and;
BE IT FURTHER RESOLVED THAT the City Manager is hereby authorized to
execute all documents necessary to evidence the release of the demolition lien in the
amount of $42,418.75 for the above described property in return for the payment of
$20,755.00 principal.
The meeting at which this resolution was approved was in all things conducted in
strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter
551.
