Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session in strict compliance with the Texas Open Meetings Act, Texas Government Code, Chapter 551 on February 13, 2018, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call * Presentation and Recognition Public Comment: Persons may speak on scheduled agenda Item No. 1/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor David Willis with Cathedral in the Pines Church gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Councilmembers Jordan, Getz, Pate, Samuel and 'Mouton. Absent: Mayor Pro Tem Wright. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Proclamations, Presentation, Recognitions Engineers Week" - February 18-24, 2018 - Proclamation read by Mayor Ames; accepted by Tyler Henneke, President and Michael Schneider, Past President of the Texas Society of Professional Engineers Mayor Ames stated that there will be an Executive Session held at the conclusion of the General Business portion of the meeting. Public Comment: Persons may speak on scheduled agenda Item 1/Consent Agenda None CONSENT AGENDA Approval of minutes — February 6, 2018 Confirmation of committee appointments — None Minutes — February 13, 2018 A) Approve the purchase of two waste water pumps from Weisinger Inc., of Conroe, for use at the Wall & Avenue C Lift Station — Resolution 18-034 B) Approve the renewal of a lease agreement with Some Other Place — Item Pulled C) Authorize the City Manager to enter into a contract with Legacy Community Development Corporation — Resolution 18-035 Councilmember )Samuel moved to approve the Consent Agenda excluding Item B. Councilmember Pate seconded the motion. AYES: MAYORAMES, COUNCILMEMBERS JORDAN, GETZ, PATE, SAMUELAND MOUTON NAYS: NONE MOTION PASSED GENERAL BUSINESS Consider a resolution acknowledging that Beaumont has more than twice the state average of units per capita supported by Tax Credits or private activity bonds and authorizes the developer to submit an application to the Texas Department of Housing and Community Affairs (TDHCA) for a proposed Housing Tax Credit (HTC) project known as St. Helena Square Apartments, located at 2020 Cottonwood, as well as approving a Concerted Revitalization Plan for the area surrounding the development and offering expressed support for the project and a Commitment of Development Funding by the City. The Golden Triangle Redevelopment Corporation, a corporation established by the Beaumont Housing Authority (BHA) is requesting authorization to submit an application to the Texas Department of Housing and Community Affairs (TDHCA) for use of Housing Tax Credit (HTC) funds for the construction of a one hundred (100) unit housing development located at 2020 Cottonwood. Currently, Beaumont has more than twice the state average of housing units supported by Tax Credits or private activity bonds per capita. As such, additional subsidized units could not be considered for this program by TDHCA unless the City acknowledges that Beaumont has more than twice the state average of subsidized housing units per capita and offers support for the project, as provided' for in §11.3(c) and §11.9(d) of the Qualified Allocation Plan (QAP) and as required by §2306.6703(A)(4) of the Texas Administrative Code. In addition, the Beaumont Housing Authority is requesting approval of the "North End Concerted Revitalization Plan". This plan (attached) outlines past, present and future initiatives, including the implementation of the Neighborhood Empowerment Zone in this area as well as significant infrastructure investment and includes a "North End Revitalization Strategies" document developed by Texas A&M, developed in 2008. By being located within this Plan's area as well as the Neighborhood Empowerment Zone, the project should gain additional points during the evaluation process. In addition, applications that receive a Commitment of Development Funding in the amount of at least $500 in the form of a loan, grant or reduced fees will receive additional consideration by TDHCA, as provided for in §11.9(d) of the Qualified Allocation Plan (QAP). Councilmember Samuel moved to APPROVE A RESOLUTION THAT THE CITY OF BEAUMONT, TEXAS, ACTING THROUGH ITS GOVERNING BODY, HEREBY CONFIRMS THAT IT IS EXCLUSIVELY SUPPORTING IN THE TDHCA 2018 COMPETITIVE TAX CREDIT APPLICATION CYCLE IN THE AT -RISK FUNDING POOL, THE PROPOSED ST. HELENA SQUARE TO BE LOCATED AT 2020 COTTONWOOD, BEAUMONT, TEXAS 77703 WITH THE TDHCA APPLICATION NUMBER OF 18003 AND THAT THIS FORMAL ACTION HAS BEEN TAKEN TO PUT ON RECORD THE OPINION EXPRESSED BY THE CITY OF BEAUMONT, TEXAS AND THAT FOR AN ON BEHALF OF THE GOVERNING BODY, MAYOR BECKY AMES IS HEREBY AUTHORIZED, EMPOWERED, AND DIRECTED TO CERTIFY THIS RESOLUTION TO THE TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS. Councilmember Mouton seconded the motion. AYES: MAYORAMES, COUNCILMEMBERS JORDAN, GETZ, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Resolution 18-036 WORK SESSION Review and discuss the condition of the former Tyrrell Park Community Center City Manager, Kyle Hayes reviewed and discussed the condition of the former Tyrrell Park Community Center. There was a powerpoint showing the condition of the Community Center, it was stated that the roof has caved in on certain portions of the center. The Center sustained damage from two to three hurricanes and since has been gated to keep citizens out due to it being unsafe. There was a handout given to Council to discuss an estimated budget. The facilities maintenance staff prepared a budget estimate for the selective demolition of the Tyrrell Park Community Building. The scope of the demolition includes the complete removal of the roof structure, removal of the windows and doors, removal of the plumbing fixtures, asbestos, interior brick walls and exterior brick walls to prevent water intrusion between the brick walls where salvageable. The estimated budget doesn't include any asbestos abatement. The estimated cost breakdown is as follows: Selective Demolition $ 55,000.00 Cap Void between the Interior and Exterior Brick Walls Where Salvageable $ 30,000.00 Removal of Plumbing Fixtures and Cap Lines $ 6,000.00 Asbestos Survey $ 3,000.00 Grounds Repair $ 4,000.00 Infill of Fountain Areas two total $ 4,500.00 Subtotal $102,500.00 Contingency $ 20,000.00 Total Estimated Cost $122,500.00 Minutes — February 13, 2018 The City Manager stated that the buildings square footage is approximately 12,740. The numbers listed are the best estimated figures prior to seeking quotes from contractors. There are likely unknown items that may be encountered due to the type and complexity of the structure. A complete renovation is estimated to cost approximately $2,500,000 to $3,000,000. COMMENTS Public Comments (Persons are limited to three minutes) Ida M. Pyle 4715 Littlefield Beaumont TX Commented on the trash throughout the City, stated that, this is very disturbing, thought about a vacuum truck that could vacuum trash out of ditches, around hedges etc., stated that there needs to be a campaign slogan regarding the trash to beautify Beaumont, thinks that this would make the citizens proud and would make efforts to keep the City clean Dayna Rothenberger 3890 E. Lynwood Dr. Beaumont TX Stated that she visited with citizens that live under the interstate, realized that she was part of the problem, she brings them items that create trash, stated that they are anxious and eager to get the trash cleaned up in that area, they had a simple request and that was to receive some heavy-duty trash bags so that they could pick up the trash, also commented about there not being a place to use the restroom in downtown over the weekend, thanked Dr. Majdalani, Public Works Director for taking care of the bump in the road on her street Eric Bender 2770 110 E Beaumont TX Stated that his goal is to see every major roadway and street in Southeast Texas be bicycle friendly, if the roadway is bicycle friendly then it will be wheelchair friendly, when it's wheelchair friendly then -it's also nonmotorized vehicle friendly, this can be accomplished without pouring any new concrete, without passing any new laws but changing the way the roads are stripped, there will then be roads that are safe for bicyclist and wheelchair users, would love to see Beaumont lead the way with this project John G.uedry 760 Bancroft Dr. Beaumont TX Spoke regarding the trash issue in the City, stated that there are many citizens that live and work in Beaumont that would like to contribute to the betterment of life, ask that citizens would stand up and take'issue and tend to these task, this would make the City look better, this can be done as to not impact taxes and fees, if this can be done in- a way that people can come together it would be great, right now there! are 500 to a 1,000 citizens that are ready to volunteer to take this trash issue by the hand, the entire community can come together and make this happen Gary Taylor 8725 Braeburn Beaumont TX Spoke to Council regarding the sewer problems in his neighborhood in the West End off of Major Dr., stated that he has had conversations with Councilmember Getz, stated that when the rain comes the flushing stops, they were encouraged by Cou.ncilmember Getz to call 311 so that staff could come out and look at the sewer problem when it occurs, stated that he did Minutes — February 13, 2018 so when the heavy rain occurred several weeks ago, the staff did come out and he was able to show them the problem that has been occurring, thanked staff for coming out to actually see what the problem was Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS COUNCILMEMBER JORDAN - COMMENTED ON THE ISSUE OF TRASH WITHIN THE CITY, ANNOUNCED THE TRASH PICKUP IN HER WARD ON FEBRUARY 24, 2018, EVERYONE WILL MEET AT IDA REED PARK, STATED THAT HER AND HER HUSBAND PICKED UP OVER 38 TIRES THAT WEREN'T DISPOSED OF PROPERLY, AS WELL AS PEOPLE THROWING TRASH OUT OF THEIR CARS, STATED THAT THE CITY DOES NEED TO LOOK AT A TRASH CAMPAIGN, AND TO HAVE ORGANIZATIONS VOLUNTEER TO KEEP CERTAIN AREAS OF THE CITY CLEAN ON A REGULAR BASIS COUNCILMEMBER GETZ - COMMENTED ON THE TRASH CLEANUP, STATED THAT IT MAY BE TIME TO REINVIGORATE THE BEEP BEAUMONT BEAUTIFUL COMMISSION, ASKED THAT THE MAYOR THINK ABOUT WORKING WITH CITIZENS AND APPOINTING THEM TO THIS BOARD TO COME UP WITH SOME IDEAS, ALSO STATED THAT HE WAS SENT SEVERAL VIDEOS THAT OTHER CITIES ARE PAYING THEIR HOMELESS TO PICK UP TRASH, MAYBE THIS IS SOMETHING THAT CITY CAN LOOK AT, ALSO ASKED THE CITY MANAGER TO GIVE HIM SOME STATICS ON ENFORCEMENT ON LITTER IN FINES, STATED THAT THERE WAS VERY LITTLE ASSESSED FOR FINES WHEN DEALING WITH LITTER, ENCOURAGED THE POLICE OFFICERS THAT IF THEY OBSERVE AN EVENT OF SOMEONE LITTERING TO BY ALL MEANS WRITE THE CITIZEN A TICKET, ALSO MADE COMMENTS REGARDING THE DOCUMENT ON THE NORTH END THAT WAS DONE BY THE TEXAS A & M COLLEGE OF ARCHITECTURE MAYOR PRO TEM WRIGHT - ABSENT COUNCILMEMBER PATE - STATED THAT EVERYONE WANTS BEAUMONT TO COME CLEAN, APPRECIATES STAFF FOR TAKING A LOOK AT THE COMMUNITY CENTER AT TYRRELL PARK, TOTALLY AGREED THAT IT'S TIME TO DO SOMETHING WITH IT AND TO MAKE IT SAFE, REMINDED EVERYONE THAT TOMORROW IS VALENTINE'S DAY, ALSO MADE COMMENTS ABOUT THE TRASH AND FINES FOR LITTERING, KNOWS THAT EVERYONE IS COMMITTED TO MAKING THE COMMUNITY BETTER AND IT CAN BE IF WE ALL WORK TOGETHER COUNCILMEMBER SAMUEL - MADE MENTION OF SEVERAL NEWS ARTICLES THATAPPEARED IN THE NEWSPAPER REGARDING THE DRAINAGE IN THE NORTH END, ASKED THAT STAFF SPEAK TO THIS SO THAT CITIZENS Minutes — February 13, 2018 WILL KNOW THAT IT WON'T BE OVERLOOKED, DR. MAJDALANI GAVE AN OVERVIEW REGARDING THE DRAINAGE IN THAT AREA, THANKED MR. JOHNSON A NEW CITIZEN THAT JUST MOVED TO BEAUMONT FOR ATTENDING THE COUNCIL MEETING COUNCILMEMBER MOUTON - STATED THAT SHE'S VERY EXCITED ABOUT THE TYRRELL PARK COMMUNITY CENTER, HAS HAD A LOT OF CITIZENS CALL HER REGARDING THE CENTER AND THE REFURBISHING AND SAFETY OF THE BUILDING, MADE COMMENTS REGARDING THE CLEANUP OF BEAUMONT, THANKED MR. GUEDRY FOR HIS COMMENTS, STATED THAT FEBRUARY IS BLACK HISTORY MONTH, ANNOUNCED EVENTS FOR THE MONTH, THURSDAY, FEBRUARY 15, 2018, THERE WILL BE A BLACK HISTORY PROGRAM AT THEODORE JOHNS LIBRARY AT 6:30 P.M., LAMAR UNIVERSITY WILL FEATURE A SHORT FILM ABOUT A RIOT IN BEAUMONT, ON THURSDAY, FEBRUARY 21, 2018, LAMAR WILL BE HAVING A BLACK HISTORY PROGRAM, AT 6:30 P.M., TYRRELL PARK NEIGHBORHOOD ASSOCIATION WILL BE MEETING, THURSDAY, FEBRUARY 15, 2018, BISD WILL BE SWEARING IN TWO NEW SCHOOL BOARD MEMBER, DENISE SPOONER AND NATHAN CROSS, AT 6:30 P.M., ENCOURAGED EVERYONE TO TRY AND ATTEND SOME OF THE EVENTS CITY ATTORNEY COOPER - NONE CITY MANAGER HAYES - STATED THAT HE REALIZES THAT A LOT OF CITIZENS ARE STILL RECOVERING FROM HURRICANE HARVEY, THAT SOMETIMES HE AND COUNCIL HEAR FROM WHAT HE LIKES TO SAY THE 1 % OF CRITICS THAT LIKE TO HIDE BEHIND THEIR COMPUTERS AND POINT OUT THE NEGATIVE AND RARELY DO THEY OFFER ANY IDEAS OR SOLUTIONS, WITH THAT SAID, THE MANAGER STATED THAT THE CITY IS DOING A LOT OF GREAT THINGS, WANTED TO GO THROUGH THE POSITIVE THINGS THAT ARE HAPPENING, THE CITY IS STILL WORKING ON WASHINGTON BLVD., THEY ARE INTO THE 2ND PHASE FROM AMARILLO TO 110 WHICH IS THE BIGGEST PROJECT THAT THE CITY HAS HAD, WORKING ON REPAIRING STREETS AROUND THE ELEGANTE' HOTEL WHICH WERE IN DEPLORABLE CONDITION, STILL WORKING ON THE NORTHWEST PARKWAY PROJECT, WORK IS IN PROGRESS AND IS ABOUT 60% COMPLETE ON THE LAKESIDE CENTER WHICH WILL REPLACE THE BEST YEARS CENTER, THE CENTRAL FIRE STATION AT BABE ZAHARIAS PARK IN PROGRESS AND ABOUT 60% COMPLETE, THERE'S APPROXIMATELY 30 PLUS TRAFFIC BOXES THAT HAVE BEEN IDENTIFIED THAT WILL HAVE ART WORK ON THEM, TWO MURALS HAVE BEEN PAINTED DOWNTOWN IN THE LAST THIRTY DAYS WITH MORE TO COME, THE EMS DIVISION HAS BEEN RECOGNIZED BY THE STATE OF TEXAS FOR THEIR OUTSTANDING LEVEL OF SERVICE, THE TEXAS TRASH OFF WILL BE HELD IN APRIL, THIS IS DONE EVERY YEAR, NEXT WEEK THERE WILL BE AN ITEM BROUGHT TO Minutes — February 13, 2018 COUNCIL TO AMEND THE CODE OF ORDINANCE TO TAKEOVER I 10 AND 69 TO DO THE MOWING AND TRASH CLEANUP, FINANCIAL CONDITIONS OF THE CITY ARE VERY GOOD AND HAS BEEN FOR QUITE SOME TIME, THANKED COUNCIL AND WANTED THE PUBLIC TO KNOW THAT ALL OF THE THINGS MENTIONED IS DONE THROUGH COUNCIL AND STAFF, ENCOURAGED COUNCIL TO INFORM THE CITIZENS WHEN THEY ARE AT THE NEIGHBORHOOD ASSOCIATION MEETINGS OF ALL THE POSITIVE THINGS THAT ARE HAPPENING WITHIN THE CITY MAYOR AMES - COMMENTED ON TRASH AROUND THE CITY, STATED THAT SHE HAS HEARD OVER AND OVER CITIZENS SAYING IT WOULD BE GREAT IF THE CITY COULD HAVE ONE BIG CITY WIDE CLEANUP, STATED THAT THERE HAS BEEN A CITY TRASH OFF THAT HAPPENS EVERY YEAR WHICH IS THE TEXAS TRASH OFF AND IT'S EVERY YEAR IN APRIL, ANNOUNCED THAT THE TExAS TRASH OFF WILL BE ON APRIL 7, 2018, ENCOURAGED ALL CITIZENS TO SIGN UP TO VOLUNTEER TO PICK UP TRASH, THERE WILL BE MORE DETAILS TO COME AS THE DATE GETS CLOSER, ANNOUNCED THE NEW AND IMPROVED KALEIDOSCOPE THAT WILL BE SPONSORED BY THE ART LEAGUE OF BEAUMONT THAT COMING BACK, MORE INFORMATION WILL BE FORTHCOMING, ALSO ANNOUNCED THE TASTE OF THE TRIANGLE AT THE BEAUMONT CIVIC CENTER, 6:30 P.M., FEBRUARY 13, 2018, ENCOURAGED CITIZENS TO ATTEND, CONGRATULATED SGT.
