104.04 Kelly Day

I. Guiding Philosophy
Kelly Days are a
the contract with IAFF Local 399 and the mandates of the Fair Labor Standards Act. Guidelines
regarding Kelly Day assignment should be consistently applied, and seniority should be
considered as one of the parameters for assignment. We therefore strive to implement a
transparent system of Kelly Day assignment that is administratively streamlined in its
application, maximizes our operational readiness, and maintains member morale.
II. Purpose
The purpose of this policy is to define the system of Kelly Day assignment.
III. Goals
The goals of this policy are to:
A. Detail how an individual requests a Kelly Day assignment, and how this
information will be compiled and communicated to members.
B. Communicate the parameters to be considered (in priority order) when assigning a
Kelly Day to an individual.
C. Provide for the chain of responsibility and accountability in the assignment of
Kelly Days.
IV. Definitions
A. Kelly Day a day where an individual does not report to work with his/her
respective shift. The Kelly Day is not a paid benefit like vacation, but is used as a
simple adhere to
with contractual and federal work hours requirements.
V. Requesting Kelly Days
A. At any time, an individual may submit his/her first, second and third choices for a
Kelly by submitting an email to the Solutions Box
(fsolutions@beaumonttexas.gov). It is not necessary to request the Kelly day that
Kelly day request list, and will be considered one of their requests.
B.At any time, an individual may change theirrequests by submitting a new email to
the Solutions Box. New requests require time to be processed and added to the list
to be considered for a Kelly Day award. This process is completed by the
Secretary and should take no more than a week from
Administration receiving the request until it is added to the active Kelly Day list.
C.
preferences:
1.The individual should maintain an electronic copy of the email he/she sent
until the list is posted, to insure his/her preferences have been accurately
transcribed.
2.If a discrepancy occurs, a request will be made that the individual forward
when sent) to the Assistant Fire Chief so that the issue can be effectively
resolved. (Since paper copies of an email can be easily manipulated with
modern technology, forwarding the original email is the most reliable
method of offering proof of the original submittal.)
D. An individual may submit emails from his/her personal email or City email box. If
the personal email is used, the individual will indicate his/her name and officer
number in the correspondence, since this may not be evident from with some
unusual personal user names.
E. Members who are currently assigned to the Planning or Logistics Sections are
allowed to make Kelly Day requests.
VI. Compiling, Posting, and Updating of Kelly Day Requests
A. The ecretary will insure that Kelly Day preferences
are compiled in a spreadsheet. The spreadsheet will list all personnel by seniority
in Grade (rank) basis. Next to each individual the following information
will be given:
1. the current Kelly Day
2. the primary Kelly Day preference
3. the indisecondary Kelly Day preference

C. The Kelly Day spreadsheet will be officially updated and posted in the G drive as
soon as possible after requests are made. The spreadsheet will be accessible by
all personnel as a read-only document.
D. Persons who are promoted or transferred will carry the same Kelly Day
preferences they previously requested and should be moved into the proper
rank/seniority position on the spreadsheet

E.Newly hired personnel will be placed in Kelly Day openings as available, and will
be able to submit Kelly day requests after they complete their probational year.
VII. Decision Parameters for Kelly Day Assignments
A. The following decision parameters (in priority order) will be used in making
Kelly Day assignments:
1. On each day of the week, there will be a maximum of ten (10) persons on
Kelly Day.
2. Allotments by rank will be as follows:
a. A maximum of three (3) and a minimum of two (2) Officers
b. A maximum of four (4) and a minimum of three (3)
Driver/Operators
c. A maximum of five (5) and a minimum of four (4)
Firefighter/EMTs
3. Chief Officers on a particular shift will not be assigned the same day of
the week.
4. If there are multiple individuals who have put in requests and could
receive a particular Kelly Day assignment, the assignment will be
determined by:
a)Highest Grade (Rank)
b) Seniority in Grade (Rank)
5. When an individual is awarded a new Kelly Day, a transitional work hours
adjustment (partial shift) is sometimes necessary to equalize the work
hours of the pay period or cycle. The individual accepting the new
assignment will be notified of transitional assignment, and must accept it
to be awarded the particular day.
VIII. Responsibility & Implementation
A. The Deputy Chief will routinely administer Kelly Day assignments. Any complaints
regarding Kelly Day assignment should be discussed first with the Deputy Chief, and
then routed through the chain of command if not resolved.
B. Vacated Kelly Days previously held by swing personnel will be filled as soon as
possible.
C. Vacated Kelly Days previously held by permanently stationed personnel will not be
filled until the bid comes down for that position, and will then be filled as soon as
possible.
D. If an individual notifies their Deputy Chief that they would like a certain Kelly Day
that has gone unfilled for staffing reasons, and they have previously submitted a
request for that day through the Solution Box, then the Deputy Chief will fill that
Kelly Day opening by utilizing the current spreadsheet of requests. Note: the

individual making the request may not be the most senior person to request that day
and should not be automatically given the Kelly Day without first utilizing the list.
E. Lateral trading of Kelly Days will not be permitted.
