Getz, Ward II Robin Mouton, Mayor Pro Tem Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on June 6, 2017, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda item No. 1-3/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor Willie Williams of Star Light Baptist gave the invocation. Sebastien Kuriakose, 8th grade student at All Saints Catholic School, led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tem Mouton, Councilmembers Jordan, Getz, Wright, Pate and Samuel. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Proclamations, Presentations, Recognitions "Hurricane Preparedness Week" - June 4-10, 2017 - Proclamation read by Mayor Ames; accepted by Tim Ocnaschek, Emergency Management Director along with Carol Riley Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda. None CONSENT AGENDA Approval of minutes — May 30, 2017 Confirmation of committee appointments — None Mayor Pro Tem Mouton moved to approve the Consent Agenda. Councilmember Wright seconded the motion. Minutes — June 6, 2017 AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, WRIGHT, PATE AND SAMUEL NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider a resolution authorizing the City Manager to apply for and receive funding through the Department of Homeland Security 2017 Port Security Grant (PSGP) Program. The Port Security Grant that is being applied for would include the following four (4) projects: Project 1 — Required Radio Maintenance The cost of this project is approximately $781,449 which would cover the required annual maintenance service to the regional radio system. There is a 25% local match but since the required annual maintenance costs are allocated to each participating jurisdiction based on the number of radios (also known as subscriber units) each uses, the match requirement for that project will be divided between jurisdictions. Thus, the local match for the City will be approximately $65,362. Project 2 — EOC Elevator Repairs The cost of this project is approximately $250,000 and would cover the cost to refurbish an out -of -service elevator in the Municipal Court Building. Currently, only one elevator serves the three floors that are occupied. A local match of 25% is required at an estimated cost to the City of $62,500. Project 3 — Phase II EOC 3rd Floor Remodel The cost of this project approximately $120,000 to complete Phase II of the 3rd floor construction of the EOC to include walls and a ceiling drop for one large classroom. The ceiling drop would include applicable lighting and new fire sprinkler heads. A local match of 25% is required at an estimated cost to the City of $30,000. 1 Project 4 — Mobil Radios The cost of this project is approximately $250,000 to replace approximately 55 mobile and portable radios for police and fire that are past end -of -life. A local match of 25% is required at an estimated cost to the City of $62,500. Capital Reserve Fund FY2018. If the grant is awarded, a local match of approximately $220,362 would be required from the City of Beaumont. Approval of the resolution. Mayor Pro Tem Mouton moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO APPLY FOR AND RECEIVE FUNDING IN THE AMOUNT OF $1,401,449.00 THROUGH THE DEPARTMENT OF HOMELAND SECURITY 2017 PORT SECURITY GRANT PROGRAM (PSGP AND THAT THE CITY MANAGER BE. AND HE IS HEREBY AUTHORIZED TO EXECUTE ALL DOCUMENTS NECESSARY TO APPLY FOR AND ACCEPT GRANT FUNDING THROUGH THE DEPARTMENT OF HOMELAND SECURITY 2017 PORT SECURITY GRANT PROGAM (PSGP IN THE AMOUNT OF $1,401,449.00. Councilmember Samuel seconded the motion. Consider a resolution authorizing the City Manager to execute an Earnest Money Contract and other related documents for the sale of city -owned property located at 320 College Street. On February 25, 2014, City Council passed Resolution No. 14-043 accepting the bid submitted by Wheeler Commercial formerly known as NAI Wheeler for an annual contract for real estate broker services to list and sell City -owned property. Wheeler Commercial has secured one (1) potential buyer who is interested in purchasing city -owned property located at 320 College Street. The subject property is listed at $275,000.00 and has been on the market for 790 days. After reviewing the Earnest Money. Contract, it is in the best interest of the City of Beaumont to execute the Earnest Money Contract with Dr. Hervy H. Hiner, Jr. with a cash offer in the amount of $260,000.00. Dr. Hervy H: Hiner, Jr. will deposit $5,000.00 as earnest money to Texas Regional Title for a feasibility period of 45 days. If Dr. Hervy H. Hiner, Jr. terminates the earnest money contract, $4,000.00 of the earnest money will not be refunded toDr. Hervy H. Hiner, Jr. The date of closing will be thirty (30) days after the expiration of the feasibility period. Approval of resolution. Councilmember Getz moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE AN EARNEST MONEY CONTRACT WITH DR. HERVY H. HINER, JR. FOR THE SALE OF PROPERTY LOCATED AT 320 COLLEGE STREET; AND THAT THE CITY MANAGER IS HERE AUTHORIZED TO EXECUTE ALL DOCUMENTS NECESSARY FOR THE SALE OF THE PROPERTY AND IMPROVEMENTS. Councilmember Wright seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, WRIGHT, PATE AND SAMUEL NAYS: NONE MOTION PASSED Resolution 17-117 3. Consider amending Sec. 2.02.001 of the Code of Ordinances and adding Division 12 Sec. 2.02.300 to Sec. 2.02.302 to create a Beaumont Youth Advisory Council. Minutes — June 6, 2017 The purpose of the Beaumont Youth Advisory Council is to provide local youths with the opportunity to develop leadership and citizenship skills while learning about and encouraging involvement with city government. The Advisory Council will be composed of twelve (12) students and would be open to any 10th or 11th grader attending one of six (6) area high schools: • Central Medical Magnet High School • Harmony Science Academy • Legacy Christian Academy • Monsignor Kelly Catholic High School • Ozen Fine Arts and Technology Magnet High School • West Brook High School An administrator from each school would recommend two (2) students to serve on the Advisory Council. These students would then be confirmed by the City Council. Private donations will be used to fund the activities of the Advisory Council. This item was placed on the agenda at the request of Mayor Becky Ames and Councilmember Audwin Samuel. Councilmember Pate moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 2, ARTICLE 2.02, SECTION 2.02.001 AND ADDING A NEW DIVISION 12, SECTIONS 2.02.300, 2.02.301, AND 2.02.302 OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS TO MAKE CHANGES AND ADDITIONS RELATING TO THE BEAUMONT YOUTH ADVISORY COUNCIL; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. Councilmember Getz seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS JORDAN, GETZ, WRIGHT, PATE AND SAMUEL NAYS: NONE MOTION PASSED Ordinance 17- 037 Mayor Ames read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. COMMENTS Public Comments (Persons are limited to three minutes) Mary Ann Johnson Homeless Veteran Beaumont TX Stated that she attended the Memorial Service on Monday for Veterans Day, asked the question as to how Maple Housing is still able to reopen, stated that she is trying to find her a place to live, keeps hearing that Beaumont supports Veterans but can someone make her Minutes — June 6, 2017 understand how Beaumont is helping veterans when no one wants or is trying to help her, pleaded with Council to please help her Pastor Vickery 2455 Commerce St. Beaumont TX Stated that he was schedule to pray over the meeting on today, said that traffic and other instances got in the way and prevented him, this isn't something that he takes lightly and offered his apology to Council for being late Councilmembers/City Manager/City Attorney comments on.various matters COUNCILMEMBER COMMENTS COUNCILMEMBER JORDAN - ANNOUNCED THE CALDER TWILIGHT 5K RUN ON FRIDAY NIGHT AT 7:00 P.M., HEAD OUT AND SUPPORT THE RUNNERS AND THE CITIZENS COUNCILMEMBER GETZ - GAVE CONDOLENCES TO THE PREGNANT MOTHER THAT WAS MURDERED, ASKED EVERYONE TO PRAY FOR HER FAMILY, THE POLICE DEPARTMENT AND THE CITY COUNCILMEMBER WRIGHT - GAVE CONDOLENCES TO THE FAMILY OF THE PREGNANT MOTHER THAT WAS MURDERED, THANKED COUNCILMEMBER SAMUEL FOR BRINGING FORTH THE YOUTH ADVISORY COUNCIL, ALSO THANKED TIM OCNASCHEK AND HIS TEAM FOR THE PRESENTATION IN REGARDS TO HURRICANE SEASON COUNCILMEMBER PATE - ASKED THAT EVERYONE TAKE THE TIME AND SAY A PRAYER FOR OUR COUNTRY ON TODAY JUNE 6, 2017, AND HOW FORTUNATE WE ARE TO BE HERE, ALSO GAVE CONDOLENCES TO THE FAMILY OF THE PREGNANT MOTHER WHO WAS MURDERED, STATED THAT PRAYER DOES MAKE A DIFFERENCE COUNCILMEMBER SAMUEL - CONDOLENCES TO THE FAMILY OF THE YOUNG LADY THAT WAS MURDERED, WHEN THINGS GET TO TOUGH TO STAND THEN WE JUST KNEEL AND PRAY, THAT'S WHAT WE NEED TO DO HERE IN THE CITY OF BEAUMONT, THANKED COUNCIL FOR DOING WHAT THEY DID FOR THE YOUTH MAYOR PRO TEM MOUTON - CONDOLENCES TO THE FAMILY OF THE YOUNG LADY THAT WAS MURDERED, THANKED COUNCILMEMBER GETZ FOR BRINGING THAT INFORMATION FORWARD, THANKED COUNCILMEMBER SAMUEL FOR IMPLEMENTING THE YOUTH ADVISORY COUNCIL, NOW THAT THERE IS A PLATFORM THEY CAN MOVE FORWARD, THANKED PASTOR WILLIE WILLIAMS FOR COMING FORWARD AND SAYING THE PRAYER, THANKED TIM OCNASCHEKAND HIS TEAM FOR A VERY WELL PLANNED AND THOUGHT OUT HURRICANE READINESS TRAINING FOR THE CITY AND COUNTY, ALSO THANKED SEBASTIAN KURIAKOSE FOR SAYING THE PLEDGE Minutes — June 6, 2017 CITY ATTORNEY COOPER - NONE CITY MANAGER HAYES - NONE MAYOR AMES - WISHED SEBASTIAN KURIAKOSE GOOD LUCK AND THANKED HIM FOR SAYING THE PLEDGE Open session of meeting recessed at 2:29 p.m. EXECUTIVE SESSION Consider matters related to contemplated or pending litigation in accordance with Section 551.071 of the Government Code: 0 Complaint of Extenet Systems, Inc.
