The City Council of the City of Beaumont, Texas, met in a regular session on May 9, 2017, at the
City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the
following:

Mayor Ames called the council meeting to order at 1:36 p.m.
Pastor Dwight Benoit of Magnolia Baptist Church gave the invocation. Mayor Ames led the
Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk.
Present at the meeting were Mayor Ames, Mayor Pro Tem Mouton, Councilmembers Guidroz,
Getz, Wright, Pate and Samuel. Also present were Kyle Hayes, City Manager; Tyrone Cooper,
City Attorney; Tina Broussard, City Clerk.

A) Authorize the City Manager to execute all documents necessary to apply for and accept
new grant funding for the continuation of the Southeast Texas Auto Theft Task Force —

Councilmember Getz moved to approve the Consent Agenda. Councilmember Wright
seconded the motion.

GENERAL BUSINESS
1. Consider a resolution approving an amendment to the industrial district agreement with
ExxonMobil and approving a new addendum related to abatements and additional
payments.
By Resolution No. 16-024 and on February 2, 2016, ,City Council approved and industrial
district agreement (IDA) with ExxonMobil Oil Corporation. The IDA is being amended to
incorporate language from the first amendment into the body of the main agreement.
Article I, 4 (b) is being amended to include language that states "The payment each year
will never be less than $11 million during the seven year agreement expiring at the end of
2022."
Minutes — May 9, 2017
By Resolution 16-096 and on May 24, 2016, City Council approved an amendment to the
industrial district agreement (IDA) with ExxonMobil Oil Corporation. The IDAwas amended
to include the terms of two (2) abatement projects known as the ExxonMobil Beaumont
Polyethylene Expansion Project (BPEX) and ExxonMobil Beaumont Refinery Capacity
Expansion Project (SCANFiner). Since that time, ExxonMobil has requested an abatement
for a third project that the company is in the advanced stages of evaluating. This third
project is called the Beaumont Light Atmospheric Distillation Expansion Project (BLADE).
The IDA is being amended to clarify the terms of the abatement agreements for the BPEX
and SCANFiner projects and to include the terms of the requested abatement for the
BLADE project as follows:
BLADE: Construction of new facilities that would be integrated into the existing refinery to
expand the crude refining capability. All new construction and equipment related to this
project will receive 100% abatement for 11 years beginning the year following the start of
construction activities. The estimated value of this project is $1.5 billion.
In consideration for this abatement, ExxonMobil will pay the City $800,000 in each of the
first three years following the start of construction activities.
Payments are accounted for in the General Fund.

Mayor Pro Tem Mouton moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE
IS HEREBY AUTHORIZED TO EXECUTE A NEW INDUSTRIAL DISTRICT AGREEMENT WITH EXXONMOBIL
OIL CORPORATION TO INCORPORATE LANGUAGE FROM THE FIRST AMENDED AGREEMENT AND TO
CLARIFY ABATEMENT TERMS. Councilmember Pate seconded the motion.

Resolution 17 - 090
2. Consider a resolution authorizing the City Manager to award a bid to Brystar Contracting,
Inc., for the 2017 Paving Improvements Project (Harrison Avenue — IH -10 to Eleventh
Street) and (Bristol Drive/Rosine Street Intersection).
This project consists of improvements to Harrison Avenue from IH -10 to Eleventh Street
and the Bristol Drive/Rosine Street Intersection. Improvements include removing and
replacing the asphalt overlay, installing new storm sewer, new pavement markings and
road signs. Repairs will also be made to curb and gutter, sidewalks, driveways and
wheelchair ramps.
On April 13, 2017, six (6) formal bids were received.

The City's engineering consultant, HDR Engineering, Inc., recommends award to Brystar
Contracting, Inc., of Beaumont, Texas. The apparent low bidder, Simco Enterprises, Ltd.,
of Groves, Texas did not supply adequate credentials showing a sufficient level of
experience of completed projects comparable to the 2017 Paving Improvements Project.
The Public Works Engineering Department is in agreement with the consultant's
recommendation.
Brystar Contracting, Inc., has committed a registered Minority Business Enterprise (MBE)
contractor participation in the amount of $170,433.00. A total of 180 calendar days is
allocated in the completion of the project.

Councilmember Pate moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY
APPROVES THE AWARD OF A CONTRACT TO BRYSTAR CONTRACTING, INC., OF BEAUMONT, TEXAS, IN
THE AMOUNT OF $852,169.00 FOR THE 2017 PAVING IMPROVEMENTS (HARRISON AVENUE—IH-10
TO ELEVENTH STREET) AND (BRISTOL DRIVE/RESINE STREET INTERSECTION) PROJECT; AND THAT

Stated that he has spoken to individuals in regards to the homeless, there were several
proclamations earlier for mental health and first responders, asked that if Council or
management is approached by someone from the State etc., there is a facility on Highway

homeless people to receive the service that they need, please have your arms open, stated
a city is known by how it treats it's less fortunate

COUNCILMEMBER GUIDROZ - STATED THAT MAYOR PRO TEM MOUTON CAUGHT HIM OFF
GUARD WITH HER COMMENTS, WHEREAS THEY HAVE NOT
ALWAYS HAD THE SAME VIEWING ON ISSUES, HE WAS THERE
WHEN SHE WAS SWORN IN AND STILL CONSIDERS HER AS A
FRIEND, THANKED ALL OF COUNCIL FOR THEIR KIND WORDS,
