Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on February 21, 2017, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda item No.1/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Reverend David E. Pritchett, III from Cleveland, Ohio gave the invocation. MayorAmes led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tem Mouton, Councilmembers Guidroz, Getz, Wright and Pate. Absent: Councilmember Samuel. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Councilmember Samuel was absent due to work. Proclamations, Presentations, Recognitions Magnolia Garden Club had a video played in regards to Cattail Marsh, they also spoke about the new Wetlands Education Center that will be built at Cattail Marsh Public Comment: Persons may speak on scheduled agenda items No. 1/Consent Agenda. None X91. &I =1 `III WIT -el 211"D * Approval of minutes — February 14, 2017 * Confirmation of committee appointments — None A) Approve the award of a contract for real estate brokerage services to Ken Wheel, Inc. dba Wheeler Commercial of Beaumont — Resolution 17 - 037 B) Authorize the City Manager to execute an agreement with Lamar University for video production services — Resolution 17 - 038 Mayor Pro Tem Mouton moved to approve the Consent Agenda. Councilmember Guidroz seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS GUIDROZ, GETZ, WRIGHT AND PATE NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider a resolution authorizing the City Manager to execute Change Order No. 1, accept maintenance and authorize a final payment to LD Construction of Beaumont for the Avenue A Asphalt Rehabilitation Project (From Elgie to US 69 Frontage). On July 26, 2016, by Resolution No. 16-130, City Council awarded a contract in the amount of $642,783.50 to LD Construction, of Beaumont, Texas for the Avenue A. Asphalt Rehabilitation Project (From Elgie to US 69 Frontage). Change Order No. 1, in the amount of $66,374.45, is required to adjust the estimated quantities to reflect the actual quantities used in the completion of the project, which increases the final contract amount to $709,157.95. The project has been inspected by the Engineering Division and found to be complete in accordance with the provisions and terms set forth in the contract. Acceptance of maintenance, approval of Change Order No. 1, and release of final payment in the amount of $164,017.18 is recommended. Approval of the resolution. Mayor Pro Tem Mouton moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE CHANGE ORDER NO. 1 FOR ADDITIONAL WORK, THEREBY INCREASING THE CONTRACT AMOUNT BY $66,374.45 FOR A TOTAL CONTRACT AMOUNT OF $709,157.95 FOR THE AVENUE A ASPHALT REHABILITATION (FROM ELGIE TO US 69 FRONTAGE) PROJECT. Councilmember Pate seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS GUIDROZ, GETZ, WRIGHT AND PATE NAYS: NONE MOTION PASSED Resolution 17 — 039 WORKSESSION * Review and discuss private streets located within the City of Beaumont City Manager, Kyle Hayes, discussed private streets located within the City of Beaumont. He discussed private streets in each Ward. Ward 1 has 25 private streets; Ward 2 has 26 private streets; Ward 3 has 7 private streets and Ward 4 has 5 private streets. The City manager spoke about the private streets in each Ward that were determined to be in very poor condition. Mayor Ames read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. Public Comments (Persons are limited to three minutes) None COMMENTS Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS COUNCILMEMBER GUIDROZ - PROUD OF THE CONVENTION AND VISITORS BUREAU AND THE MAGNOLIA GARDEN CLUB FOR THE PROJECT AT CATTAIL MARSH, ALSO THOUGHT IT WOULD BE A GOOD IDEA FOR THE CITY TO SUPPORT OR START UP A YOUTH ADVISORY COUNCIL COUNCILMEMBER GETZ - CONGRATULATED THE CONVENTION AND VISITORS BUREAU AND THE MAGNOLIA GARDEN CLUB FOR WHAT THEY ARE DOING TO ENHANCE CATTAIL MARSH, ANNOUNCED THE DOWLEN/VVEST NEIGHBORHOOD ASSOCIATION MEETING, CHRIS BOONE WILL BE THE GUEST SPEAKER AND WILL BE GIVING AN UPDATE ON SOME OF THE CITY PROJECTS THAT ARE IN THE WORKS AND ON THE HORIZON, MADE COMMENTS IN REGARDS TO THE YOUTH ADVISORY COUNCIL, STATED THAT THE CITY NEEDS TO LOOK INTO HOW MUCH IS IT GOING TO COST TO RUN A PROGRAM LIKE THAT, ALSO ASKED THAT COUNCIL LOOK AT HAVING COUNCIL MEETINGS IN THE EVENING HOURS AND ROTATING THE MEETINGS IN EACH WARD ON A QUARTERLY BASIS COUNCILMEMBER WRIGHT - ANNOUNCED THE SENIOR MARDI GRAS PARTY THAT WILL BE ON THURSDAY, FEBRUARY 23, 2017, AT THE BEAUMONT CIVIC CENTER FROM 10:00 A.M. TO 2:00 P.M., ENCOURAGED EVERYONE TO COME OUT, THERE WILL BE NEW VENDORS PARTICIPATING, ALSO THOUGHT IT WOULD BE A GOOD IDEA TO START A YOUTH ADVISORY COUNCIL AND IF IT WAS STARTED, WOULD LIKE THE CITY TO THINK ABOUT ALSO SPONSORING THE YAC SO THEY MAY ALSO ATTEND ONE OR TWO OF THE TML CONFERENCES COUNCILMEMBER PATE - THANKED LYNN HUCKABEE AND HER GROUP FOR PUTTING ON THE SENIOR MARDI GRAS, ENCOURAGED EVERYONE TO ATTEND, ON THURSDAY, FEBRUARY 23, 2017, THERE WILL ALSO BE A RECOGNITION LUNCHEON AT THE BEAUMONT CHAMBER OF COMMERCE, ALSO INQUIRED ABOUT THE CITY STREAMING THE CITY COUNCIL MEETING LIVE ON FACEBOOK, ALSO ASKED IF ONE OF THE LANES ON GLADYS AND DOWLEN BY MARSHALL MIDDLE SCHOOL COULD BE A TURN ONLY LANE, TRAFFIC IS BACKING UP IN THAT AREA, ALSO ASKED THAT COUNCIL LOOK INTO AN YOUTH ADVISORY COUNCIL COUNCILMEMBER SAMUEL - ABSENT MAYOR PRO TEM MOUTON - STATED THAT SHE HAS A RELATIVE LINED UP TO COME TO COUNCIL TO DO THE PLEDGE AND TO SEE WHAT SHE DOES, HE IS THE STUDENT PRESIDENT AT HIS SCHOOL, HAS ALSO INVITED A LAMAR UNIVERSITY STUDENT AS WELL TO ATTEND THE MEETING AND SHADOW HER, GAVE CONDOLENCES TO THE FAMILY OF CONNIE PATTERSON, SERVICES WILL BE ON THURSDAY, FEBRUARY 23, 2017, AT 11:00 A.M., AT WEST TABERNACLE CHURCH, THANKED THE MAGNOLIA GARDEN CLUB ON THE BREATH TAKING VIDEO OF CATTAIL MARSH, IT WAS ABSOLUTELY BEAUTIFUL, WISHED HER DAUGHTER CARMEN A HAPPY 23RD BIRTHDAY, ALSO ENCOURAGED EVERYONE TO ATTEND THE SENIOR MARDI GRAS ON TOMORROW AT THE BEAUMONT CIVIC CENTER CITY ATTORNEY COOPER - NONE CITY MANAGER HAYES - MAYOR AMES - Open session of meeting recessed at 2 Iki=ek= COMMENTED ON A LUNCHEON THAT SHE ATTENDED "CELEBRATE FAMILIES" PUT ON BY FAMILY SERVICES, ENCOURAGED EVERYONE TO GO AND VISIT CATTAIL MARSH IF THEY HAVEN'T ALREADY, THANKED THE MAGNOLIA GARDEN CLUB FOR THE NEW PROJECT THAT THEY ARE ADDING TO CATTAIL MARSH 26 p.m. EXECUTIVE SESSION * Consider matters related to contemplated or pending litigation in accordance with Section 551.071 of the Government Code: Vanessa Coleman, et al v.
