WHEREAS, on January 24, 2017 the City Council of the City of Beaumont,
Texas adopted Resolution No. 17-016 acknowledging that Beaumont has more than
twice the state average of units per capita supported by Texas Credits or Private Activity
Bonds and authorized Herman & Kittle Properties, Inc. to submit an application to the
Texas Department of Housing and Community Affairs (TDHCA) for a proposed Housing
Tax Credit (HTC) project known as Old Dowlen Cottages Apartments, L.P. located at
4167 Old Dowlen Road, as well as expressing support for the project; and,
WHEREAS, §11.9(d)(2) of the Qualified Allocation Plan and Texas Government
Code §2306.6725(a)(5) provides that the City of Beaumont must also commit to provide
development funding for the proposed project in the form of fee waivers in an amount
not to exceed One Hundred and NO/100 Dollars ($100.00);
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby,
in all things, approved and adopted; and,
THAT Resolution No. 17-016 is hereby amended to state that as provided for in
§11.9(d)(2) of the Qualified Allocation Plan and in accordance with Texas Government
Code §2306.6725(a)(5), the City of Beaumont commits to provide development funding
for the proposed project, known as Old Dowlen Cottages Apartment, L.P., in the form of
fee waivers in an amount not to exceed One Hundred and NO/100 Dollars ($100.00).
