The City Council of the City of Beaumont, Texas, met in a regular session on December 6, 2016,
at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider
the following:

Mayor Ames called the council meeting to order at 1:30 p.m.
Pastor "Big" Jim Selles of West End Baptist Church gave the invocation. Mayor Ames led the
Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk.
Present at the meeting were Mayor Ames, Mayor Pro Tem Mouton, Councilmembers Guidroz,
Getz, Pate and Samuel. Absent: Councilmember Wright. Also present were Kyle Hayes, City
Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk.
Councilmember Wright was absent due to being out of the City.

Approval of minutes — November 22, 2016

A) Authorize the City Manager to execute a Memorandum of Understanding (MOU) with
Orleans San Jacinto, LP for use of the parking lot located at 600-612 Pearl - Resolution

Beaumont Preservation Partners, LLC for use of the parking lot located adjacent to 505
Orleans - Resolution 16 - 244
Councilmember Pate moved to approve the Consent Agenda. Mayor Pro Tem Mouton
seconded the motion.

1. Consider a resolution authorizing the City Manager to execute an Earnest Money Contract
and other related documents for the sale of city -owned property located at 985 Orleans
Street.
On February 25, 2014, City Council passed Resolution No. 14-043 accepting the bid
submitted by Wheeler Commercial formerly known as NAI Wheeler for an annual contract
for real estate broker services to list and sell City -owned property.
Wheeler Commercial has secured one (1) potential buyer who is interested in purchasing
city -owned property located at 985 Orleans Street. After reviewing the Earnest Money
Contract, it is in the best interest of the City of Beaumont to execute the Earnest Money
Contract with 1919 SJD Beaumont with a cash offer in the amount of $63,000.00.
1919 SJD Beaumont will deposit $1,000.00 as earnest money to Texas Regional Title fora
feasibility period of 60 days. If 1919 SJD Beaumont terminates the earnest money
contract, $500.00 of the earnest money will not be refunded to 1919 SJD Beaumont. The
date of closing will be fourteen (14) days after the expiration of the feasibility period.
Approval of resolution.
Councllmember GUlydoz moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE, AND
HE IS HEREBY, AUTHORIZED TO EXECUTE AN EARNEST MONEY CONTRACT WITH 1919 SJD
BEAUMONT FOR THE SALE OF PROPERTY LOCATED AT 985 ORLEANS STREET AND THAT THE CITY
MANAGER IS HEREBY AUTHORIZED TO EXECUTE ALL DOCUMENTS NECESSARY FOR THE SALE OF THE
PROPERTY AND IMPROVEMENTS. Councllmember Samuel seconded the motion.

2. Consider a resolution authorizing the purchase of four grapple trucks from Chastang
Enterprises, Inc. of Houston, in the amount of $1,054,052.00 for use by the Solid Waste
Division.
The new units will replace units 3310, 6153, 6157, and 3309 all of which are 2003 models
with in excess of 100,000 miles each. All have exceeded their expected service life. The
trucks are used for the collection of heavy trash from City residences and for debris
removal following hurricane events. The existing units will be disposed of in accordance
with the City surplus property policies.
Pricing was obtained through the Houston -Galveston Area Council (H -GAC), a cooperative
purchasing association providing cities and political subdivisions with the means to
purchase specialized equipment at volume pricing. H -GAC complies with State of Texas
procurement statutes.
Warranty service will be provided by Freightliner of Beaumont.
Approval of resolution.
Mayor Pro Tem Mouton moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE, AND HE
IS HEREBY, AUTHORIZED TO APPROVE THE PURCHASE OF FOUR (4) GRAPPLE TRUCKS FOR USE BY
THE SOLID WASTE DIVISION FROM CHASTANG ENTERPRISES, INC., OF HOUSTON, TEXAS, IN THE
AMOUNT OF $1,054,052.00 THROUGH THE HOUSTON -GALVESTON AREA COUNCIL (H -GAC)
COOPERATIVE PURCHASING PROGRAM. Councilmember Pate seconded the motion.

3. Consider a resolution providing for the reimbursement of a capital expenditure incurred
prior to future financing.
The FY 2016 Budget included the order of a new fire pumper. Due to the long lead time on
fire trucks, the financing was included in the FY 2017 Budget. The fire pumper was to be
financed over a period not to exceed 5 years. The fire pumper has been received prior to
the financing being secured. A reimbursement resolution is warranted in order to allow the
City to reimburse itself out of the proceeds of the financing for the fire pumper if payment is
required prior to the lease purchase being secured.
Approval of resolution.
Councilmember Guidroz moved to APPROVE A RESOLUTION THAT THE CITY OF BEAUMONT
HEREBY DECLARED AN INTENT TO ACQUIRE CERTAIN EQUIPMENT AS A CAPITAL EXPENDITURE WITH
REIMBURSEMENT TO BE FUNDED FROM PROCEEDS OF A LEASE PURCHASE AGREEMENT. THE
EQUIPMENT HEREINAFTER CALLED "PROPERTY" IS ONE (1 ) FIRE PUMPER TRUCK IN THE AMOUNT OF
$652,000.00. Councilmember Pate seconded the motion.

COUNCILMEMBER GUIDROZ - COMPLIMENTED DEAN CONWELL AND FREDDIE WILLARD
WHO WORKED DILIGENTLY WITH THE OPERATORS OF THE
TENNIS COMPLEX, THEY JUST SECURED THE (JTTNC) THE
JUNIOR TENNIS TEXAS NATIONAL CHAMPIONSHIP TO BE
HELD IN BEAUMONT IN JUNE, 2017, THANKED THEM FOR ALL
OF THEIR HARD WORK, IT'S AN HONOR TO SECURE THIS FOR
OUR CITY
COUNCILMEMBER GETZ - STATED THAT BEFORE SUNDAY NIGHT HE WASN'T SURE WHO
THE GOO GOO DOLLS WERE, NOW HE KNOWS, HE AND HIS
WIFE ENJOYED THEIR PERFORMANCE IN CONCERT,
COMPLIMENTED LENNY CABALLERO AND HIS STAFF FOR THE
CALIBER OF PERFORMANCES THAT THEY ARE BRINGING TO
BEAUMONT, ALSO MENTIONED A CREW THAT HE SAW
WORKING IN THE RAIN OVER THE WEEKEND TO FIX A BROKEN
WATERLINE, COMPLIMENTED THEM FOR THEIR HARD WORK
AND THE FACT THAT THEY WERE OUT WORKING ALL DAY AND
DIDN'T STOP UNTIL THEY GOT THE LINE REPAIRED

NECESSARILY REMOVE THEM FROM THE STREETS BUT TO

THE ART MUSEUM OF SOUTH EAST TEXAS WHICH WILL
START AT 4:00 P.M., THERE WILL BE LOTS OF THINGS FOR
THE KIDS TO DO, ENCOURAGED EVERYONE TO COME OUT AND
JOIN THEM, STATED THAT SHE AND THE CITY MANAGER HAD
A MEETING WITH THE ANIMAL CONTROL BOARD, STATED
THAT THERE WILL BE A NEW ORDINANCE THAT WILL BE
COMING BEFORE COUNCIL SOON, HOPED THAT EVERYONE
WILL SUPPORT THIS NEW ORDINANCE

Stated that he believes that City employees and Council are doing a good job, does
support the idea of looking into curtailing the future retirees health insurance and to
continue to subsidize the premium, the City needs to look at the private sector and what
they are doing to save money, very proud of the Event Centre, disappointed with the Best
Years Center, looked at the Capital Budget and the budget for the Center is $4.5 million
and the price tag right now to build the Center is $7 million, wished that the cost could have
stayed within the range it was budgeted, stated that he wouldn't support a bond issue for
streets, does not want to add another nickel or dime to taxes, also mentioned homestead
exemption, Port Arthur has a homestead exemption and Beaumont has none

Stated that he was at a meeting at Lamar University, there was discussion regarding
students and retaining students, growing the economy and the City, stated that there are
28.5 million people in the United States without health care insurance, 79% of those are
U.S. Citizens, 64% of those that don't have health care insurance don't have it because of
cost, we talk about keeping people in Beaumont but people are leaving, the population
seems to be going down instead of going up, doesn't think that not subsidizing health care
insurance for retirees is the right direction to go, if we take that away then citizens won't
want to work for the City or live here, we talk about leaving our City and Country better than
we found it, leaving it better for those coming behind us, but we continue to take away
those things that make life better, wished everyone a Merry Christmas and a Happy New
Year
