The City Council of the City of Beaumont, Texas, met in a regular session on November 8, 2016,
at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider
the following:

Mayor Ames called the council meeting to order at 1:30 p.m.
Pastor Airon Reynolds of Borden Chapel Missionary Baptist Church gave the invocation. Vietnam
Veterans of America, Southeast Texas Chapter 292 led the Pledge of Allegiance. Roll call was
made by Tina Broussard, City Clerk.
Present at the meeting were Mayor Ames, Mayor Pro Tem Mouton, Councilmembers Guidroz,
Getz, Wright, Pate and Samuel. Also present were Kyle Hayes, City Manager; Tyrone Cooper,
City Attorney; Tina Broussard, City Clerk.
Proclamations, Presentations, Recognitions
"Veterans Day" - November 11, 2016 - Proclamation read by Mayor Ames; accepted by
Kerwin Stone, President of Vietnam Veterans of America Southeast Texas Chapter 292,
and Vietnam Veterans of Chapter 292
Recognitions — Mayor Ames recognized Mr. Brady Mazzola, with the Watering Seeds
Organization, Mr. Mazzola talked about the Tennis Expo that will be honoring our veteran
heroes at the Beaumont Municipal Tennis Center on Friday, November 11, 2016, and
Saturday, November 12, 2016. Mr. Mazzola will be introducing Mr. Bob Weiland, a well-
known Vietnam Veteran here from California he will also be introducing Mr. William
Hendrickson, a veteran from Orange both are participating in the Tennis Expo
"Alzheimer's Awareness Day" — November 15, 2016 — Proclamation ready by
Councilmember Wright; accepted by Lindsey Ramey, Regional Outreach Coordinator for
the Alzheimer's Association along with Linda Domino and others

Mouton; accepted by Shari Pulliam, with the Texas Department of Family and Protective

Recognitions — Mayor Ames recognized Nick Corsey with Boy Scout Troop #122, here to
observe Council and on his way to receive his Eagle Badge award
Mayor Ames read the announcement regarding Executive Session being held at the
conclusion of the General Business portion of the meeting.

* Confirmation of committee appointments — Resolution 16 - 219
Kelley Kays -City Veterinarian would be appointed to the Animal Health Advisory
Committee. The term would commence November 8, 2016 and expire September 30,
2017.
A) Approve the appointment of Craig Lively as Chief Magistrate of the Municipal Court for a
term of two years and approve his compensation - Resolution 16 — 220
B) Approve the issuance of a tax exempt loan by the Oglesby Cultural Facilities Corporation to
provide financing for the enhancement of various properties of Goodwill Industries of
Southeast Texas - Resolution 16 - 221
C) Approve the purchase of one John Deere tractor with a slope mower from Deere &
Company of Cary, NC - Resolution 16 - 222
D) Approve a one year contract with the Greater Beaumont Chamber of Commerce for the
period of January 1, 2017 through December 31, 2017 - Resolution 16 - 223
E) Approve a payment of dues to the South East Texas Regional Planning Commission for
Fiscal Year 2017 - Resolution 16 - 224

F) Approve a consignment agreement with Games People Play, Inc. for the golf pro shop
located at 5490 Babe Zaharias Drive (Tyrrell Park) - Resolution 16 - 225
G) Authorize the City Manager to receive funding through the 2016 Helping Heroes Grant for
the training, education, equipment and emergency notification needs of Texas fire
departments and emergency responders - Resolution 16 - 226
H) Approve the execution of a License to Encroach Agreement with Enterprise Logistic
Services, LLC - Resolution 16 - 227
Mayor Pro Tem Mouton moved to approve the Consent Agenda. Councilmember Guidroz
seconded the motion.

GENERAL BUSINESS
1. Consider a resolution approving the award of a contract to Grande Truck Center, Inc. of
San Antonio for the purchase of five dump trucks.
Three (3) new dump trucks will be purchased for the Streets and Drainage Division and
one each for the Parks and Recreation Department and the Water Utilities Department.
This purchase will replace units 3263, 3262, 3281, 3206 and 3305, all of which are
between 15 and 20 years old and all well in excess of 100,000 miles. The old units
have become unreliable, and require excessive maintenance. The old vehicles will be
disposed of in accordance with the City's surplus equipment policy.
Pricing was obtained through the Houston -Galveston Area Council (HGAC), a
cooperative purchasing association providing cities and political subdivisions with the
means to purchase specialized equipment at volume pricing. HGAC complies with
State of Texas procurement statutes. The total purchase price includes the HGAC of
$1,000 which is paid to the vendor.
Manufacturer's service and support are provided by Beaumont Freightliner, Inc.
Approval of resolution.
Councilmember Pate moved to APPROVE A RESOLUTION THAT THE CITY COUNCIL HEREBY
APPROVES THE PURCHASE OF FIVE (5) WESTERN STAR 16 -YARD DUMP TRUCKS FOR USE BY THE
STREETS AND DRAINAGE, PARKS, AND WATER UTILITIES DEPARTMENTS FROM GRANDE TRUCK
CENTER, INC., OF SAN ANTONIO, TEXAS, IN THE AMOUNT OF $561,025.00 THROUGH THE HOUSTON-
GALVESTON AREA COUNCIL (H -GAC) COOPERATIVE PURCHASING PROGRAM. Councilmember
Samuel seconded the motion.

STATED THAT PEOPLE HAVE DIED FOR US TO HAVE THE RIGHT

COUNCILMEMBER GETZ - STATED THAT IT CAN'T BE SAID OFTEN ENOUGH THAT
FREEDOM ISN'T FREE, JOINED HIS COLLOGUES AND THANKED
ALL VETERANS THAT HAVE HELPED US TO HAVE THE
FREEDOM OF ENJOYING THIS COUNTRY, WANTED TO THANK
VERNON DURDEN WHO HELPED HIM WHEN HE HIT A PIECE OF
METAL IN THE ROAD AND HAD A FLAT TIRE, STATED THAT
CITIZENS HAVE BEEN ASKING HIM ABOUT SIGNING THE
PETITION TO CHANGE THE CITY CHARTER, STATED THAT IT IS
SOMETHING THAT HASN'T BEEN LAUNCHED YET, HE IS STILL
LOOKING INTO THIS, IF IT MAKES FINANCIAL AND PRACTICAL
SENSE HE WILL MOVE FORWARD, IF IT DOESN'T THEN THERE
IS NO POINT IN CHANGING ANYTHING, APPRECIATED THE
