Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on September 6, 2016, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on the Consent Agenda Consent Agenda Mayor Pro Tem Mouton called the council meeting to order at 1:30 p.m. Councilmember Samuel gave the invocation. Mayor Pro Tem Mouton led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Pro Tem Mouton, Councilmembers Getz, Wright, Pate and Samuel. Absent: Mayor Ames and Councilmember Guidroz. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Mayor Ames and Councilmember Guidroz were both absent as they were out of the City. Proclamations, Presentations, Recognitions None CONSENT AGENDA * Approval of minutes — August 23, 2016 * Confirmation of committee appointments - None A) Authorize the City Manager to execute Change Order No. 2 with Placo, LTD, of Lumberton for the Sewer Plant — Clarifiers Rehabilitation Project - Resolution 16 - 161 B) Authorize the City Manager to execute Change Order No. 1, accept maintenance, and authorize final payment to LD Construction for the Surface Rehabilitation Project for North Main Street & Pine Street - Resolution 16 — 162 Minutes — September 6, 2016 C) Approve a resolution accepting maintenance of the water and sanitary sewer improvements in The Crescent on Walden, Phase II, Private Subdivision - Resolution 16 - 163 Councilmember Samuel moved to approve the Consent Agenda. Councilmember Wright seconded the motion. AYES: MAYOR PRO TEM MOUTON, COUNCILMEMBERS GETZ, WRIGHT, PATE AND SAMUEL NAYS: NONE MOTION PASSED PUBLIC HEARING 1 Receive comments related to the proposed annexation of approximately 77.737 acres of land located at the southwest corner of Folsom Drive and Major Drive. Open: 1:37 p.m. None Close: 1:37 p.m. COMMENTS Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS MAYOR PRO TEM MOUTON - NONE COUNCILMEMBER GETZ - NONE COUNCILMEMBER WRIGHT - HOPED THAT EVERYONE HAD A GREAT LABOR DAY CELEBRATION, COMMENTED ON HER INVITE FROM ALMA HODGE FOR HER CHAT AND CHEW, IT WAS DISCUSSED IN THE CHAT AND CHEW HOW MANY WIDOWS THERE ARE WITHIN THE CITY OF BEAUMONT, MS. HODGE STATED THAT THAT THEY NEEDED TO START A PROGRAM THAT COULD BE Minutes — September 6, 2016 CALLED THE WIDOWS MIGHT OR WHATEVER THE GROUP WOULD LIKE TO CALL IT, THEY NEEDED TO COME TOGETHER TO WORK THROUGHOUT THE CITY IN A NONPARTISAN WAY, STATED THAT IF ANY WIDOW HAS AN INTEREST IN JOINING THE GROUP PLEASE CONTACT HER (COUNCILMEMBER WRIGHT) AT 409-880-3770 COUNCILMEMBER PATE - COMMENTED ON THE LAMAR UNIVERSITY FOOTBALL GAME, ALSO STATED THAT THIS COMING WEEK THEY WILL BE PLAYING UNIVERSITY OF HOUSTON COUNCILMEMBER SAMUEL - NONE COUNCILMEMBER GUIDROZ - ABSENT CITY ATTORNEY COOPER - NONE CITY MANAGER HAYES - NONE MAYOR AMES - ABSENT Public Comments (Persons are limited to three minutes) Alto Watson 4495 Thomas Glen Beaumont TX Stated that he wanted to comment on the 2016 legal issues that the City has had, the City had one lawsuit where they had to pay a $850,000 settlement, as well as paying a law firm in San Antonio versus hiring a law firm here in Beaumont, another lawsuit, the City allegedly owes the County money for people that were arrested and sent to the county jail, that lawsuit should have been settle years ago before the bill got to where it is now, there's also 12 City employees with the Water Department that have filed lawsuits, also Councilmember Samuel has an issue involving representing defendants who are arrested by City employees, it appears that there is a resolution that was done back in 1999 that states Councilmember Samuel needs to give the City Manager and City Attorney information before he does the representation, he has to get permission to do the representation, both the City Manager and the City Attorney can revoke the consent to represent the defendants, stated that he has done an Open Records Request to see if Councilmember Samuel has presented information to the City Manager and City Attorney to represent defendants in the past, it seems that the City Manager and the City Attorney have not policed this properly There being no Executive Session, Council adjourned at 1:46 Aud'iq-vailable upon request in the City Clerk's Offi Ro Mouton, Map r Pro Tem (� l / 1 Tina Broussard, City Clerk �10- Minutes — September 6, 2016
