Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on August 16, 2016, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda item No. 1/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor Hector Ardoin, Jr., of Bethel Baptist Church gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tem Mouton, Councilmembers Guidroz, Getz, Wright, Pate and Samuel. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Proclamations, Presentations, Recognitions "Beaumont Police Department Cops and Kids Week" — August 15-20, 2016 - Proclamation read by Mayor Ames; accepted by Police Chief James Singletary and other staff members Public Comment: Persons may speak on scheduled agenda item No. 1/Consent Agenda. Bridget Johnson 2675 Gulf St. Beaumont TX Spoke to Council in regards to Item B on the Consent Agenda; renewal of the lease agreement with the Beaumont Art League, stated that on behalf of the Art League she wanted to thank Council for the renewal of their lease and Councils continued support CONSENT AGENDA * Approval of minutes — August 9, 2016 Confirmation of committee appointments — None Minutes — August 16, 2016 A) Approve a resolution adopting a Reasonable Accommodation Policy pursuant to the Americans with Disabilities Act — Resolution 16 — 146 B) Authorize the City Manager to execute a lease agreement with the Beaumont Art League - Resolution 16 - 147 C) Approve a resolution authorizing the acceptance of a ten foot wide Exclusive Water Line Easement located at 7080 Calder Avenue - Resolution 16 - 148 D) Approve a resolution authorizing the acceptance of two ten foot wide Water Meter Easements located at 1140 and 1160 Oregon Avenue - Resolution 16 - 149 Mayor Pro Tem Mouton moved to approve the Consent Agenda. Councilmember Guidroz seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS GUIDROZ, GETZ, WRIGHT, PATE AND SAMUEL NAYS: NONE MOTION PASSED GENERAL BUSINESS 1. Consider an ordinance to recognize the fire -damaged structure at 1691 Turon as unsafe and order its removal. The structure at 1691 Turon recently received fire damage. The Building Codes Division of the Planning & Community Development Department inspected the structure and found it to be unsafe as defined by the City of Beaumont's Code of Ordinances, Chapter 24, Article 24.04 Unsafe Substandard Structure, Division 1, Sec. 14.04.001 of the 2009 International Property Maintenance Code. Due to delinquent taxes on the property, the owner is now Jefferson County and the City of Beaumont. Despite the ownership, the full condemnation process is still necessary, given the method of acquisition of the property. Approval of the ordinance. Councilmember GUidroz moved to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE FINDING A CERTAIN STRUCTURE TO BE A PUBLIC NUISANCE AND ORDERING ITS DEMOLITION AND REMOVAL OR REPAIR; PROVIDING FOR SEVERABILITY AND PROVIDING FOR A PENALTY. Councilmember Wright seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS GUIDROZ, GETZ, WRIGHT, PATE AND SAMUEL NAYS: NONE MOTION PASSED Ordinance 16 - 038 Minutes -August 16, 2016 WORK SESSION * Review and discuss a proposed Curbside Recycling Program Kyle Hayes, City Manager discussed a proposed curbside recycling program. It was discussed that the recycled material could be picked up on a regular trash pick-up day. Citizens that want to participate would pay $58.00 for a recycling can which would be a one-time payment that would show up on their utility bill. The customer would then pay $11.50 per month. The new program would commence on October 1, 2016, products that would be included in the recycling would be paper, newspaper; cardboard; certain plastics; rib magazines; aluminum and tin cans. If 500 homes subsce, the City would cover its projected annual cost by charging $11.50 per month. COMMENTS Councilmembers/City Manager/City Attorney comments on various matters COUNCILMEMBER COMMENTS COUNCILMEMBER GUIDROZ - STATED THAT IT WAS GOOD TO SEE MARCO HERNANDEZ AND HOPEFULLY ONE DAY WE CAN SEE HIM AS ONE OF OUR CITY LEADERS, ALSO MENTIONED THE TWO SIMONE'S THAT ARE BRINGING A LOT OF HONOR TO THE UNITED STATES, RECEIVED A MESSAGE THAT SIMONE BILES JUST WON ANOTHER GOLD MEDAL, BOTH OF THEM ARE FROM SOUTH EAST TEXAS, ONE IS FROM SUGAR LAND, TX AND THE OTHER IS FROM SPRING, TX, SIMONE BILES ALSO HAS A GYMNASTIC MOVE THAT HAS BEEN NAMED AFTER HER CALLED, "THE BILES" COUNCILMEMBER GETZ - THANKED LENNY CABALLERO AND HIS STAFF FOR THE AWESOME EVENTS THAT THEY ARE BRINGING DOWNTOWN, COMMENTED ON MOVIE NIGHT AND WHAT A SUCCESS IT HAS BEEN, THE LAST MOVIE AT THE JEFFERSON THEATRE WAS SOLD OUT AS MOST OF THEM HAVE BEEN, ON SATURDAY NIGHT BOBBY BONES AND THE RAGGING IDIOTS WAS ALSO SOLD OUT, ASKED THAT ANYONE IN THE PRIVATE MARKET TO PLEASE CONSIDER COMING DOWNTOWN AND BUILDING SOME VENUES, WHEN CITIZENS ARE DONE WITH CONCERTS, THE MOVIES ETC., THEY ARE LOOKING FOR SOMETHING ELSE TO DO COUNCILMEMBER WRIGHT - THANKED COUNCILMEMBER GUIDROZ FOR HIS REMARKS ABOUT THE OLYMPICS AND COUNCILMEMBER GETZ FOR HIS REMARKS IN REGARDS TO DOWNTOWN, WISHED HER GRANDDAUGHTER MAYA WILLIAMS, A HAPPY BIRTHDAY, ANNOUNCED THE TASTING FOR SOME OTHER PLACE ON TODAY AT THE BEAUMONT CIVIC CENTER FROM 5:00 P.M., TO 7:00 P.M. Minutes—August 16, 2016 COUNCILMEMBER PATE - ANNOUNCED COPS AND KIDS AT THE BEAUMONT CIVIC CENTER ON SATURDAY FROM 10:00 A.M. TO 2:00 P.M., ALSO FROM 11:00 A.M., TO 2:00 P.M., THERE WILL BE SIGNING AT BUFFALO WILD WINGS WITH THE LAMAR UNIVERSITY FOOTBALL TEAM, ASKED THAT EVERYONE KEEP THE CITIZENS OF LOUISIANA IN THEIR PRAYERS FOR ALL THAT THEY ARE GOING THROUGH WITH THE FLOODING COUNCILMEMBER SAMUEL - NONE MAYOR PRO TEM MOUTON - THANKED BENGY WILLIAMS AND HIS STAFF FOR THE EXCELLENT JOB THEY DO, GO USA, COMMENTED ON THE OLYMPICS AND THE AWESOME ACHIEVEMENTS OF ALL PARTICIPANTS AND ALL THE GOLD MEDALS THAT HAVE BEEN WON, GAVE SPECIAL CONGRATULATIONS TO THE TWO SIMONE'S THAT HAVE WON GOLD MEDALS IN SWIMMING AND GYMNASTICS, THAT IS A BLACK HISTORY MAKING MOMENT, REMINDED EVERYONE THAT INIKA MCPHERSON, WHO IS A PORT ARTHUR NATIVE, SHE WILL BE COMPETING IN THE HIGH JUMP ON THURSDAY MORNING AT 7:00 A.M., ALSO LETS PRAY FOR THE CITIZENS IN LOUISIANA CITY ATTORNEY COOPER - NONE CITY MANAGER HAYES - NONE MAYOR AMES - NONE Public Comments (Persons are limited to three minutes) Marco Hernandez 2556 Angelina Beaumont TX Stated that he would like to give public appreciation for the project that he worked on, thanked the City Clerk for her guidance on the petition, the City Manager for hearing them out, Councilmember Guidroz for keeping in touch with him and the Mayor and Council for all of their help, also Ryan Slott for everything that he has done to help with the project, it's his hope that they will make space for the proposal of a soccer field in the upcoming budget, also commented on being downtown at the skate park and how he feels comfortable downtown and has met a lot of great people, stated that he wanted this project for the sake of the kids, it will bring a positive outlook for all of the kids in the community Mayor Ames read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. Open session of meeting recessed at 2:54 p.m. Minutes — August 16, 2016 EXECUTIVE SESSION * Consult with its Attorney on legal matters related to Washington Boulevard Pavement Widening Project Phase II in accordance with Section 551.071 of the Government Code * Consider matters related to the deliberation of the purchase, exchange, lease or value of real property in accordance with Section 551.072 of the Government Code, to wit.- Beaumont it: Beaumont Yacht Club located at 560 Marina Drive, Beaumont, TX 77703 There being no action taken in Executive Session, Council adjourned.
