I. Guiding PhilosophX
Time to rest and recuperate from work is important in maintaining an individual's overall
health. Equally important is the maintenance of staffing to meet the emergency response needs of
the people we serve. We strive to keep these needs balanced by providing approved leave
benefits and privileges to members in a systematic and consistent manner, and by members
ethically and responsibly utilizing the leave time that they have accrued.
II. Purpose
The purpose of this policy is to define the general standards applicable to the accrual and
use of leave time for civil service members.
III. Goals
The goals of this policy are to:
A. Communicate a statement of intent relative to regulatory parameters.
B. List the types leave benefits and privileges available to civil service members.
C. Define the general regulations related to use of accrued leave.
D. Detail the general regulations for notification of and returning from absence.
IV. Definitions
A. Trading Time — privilege that allows a member to work for another provided that
stated criteria are met (see R&R 103.01A).
V. Statement of Intent
A. Various forms of leave time are regulated by federal and state laws, city policies,
civil service rules and regulations, and the collective bargaining agreement
currently in place with the International Association of Firefighters, Local 399.
B. The leave regulations that follow should not be construed as abrogating the
priority of civil and criminal law concerning employment in the State of Texas,
established civil service practices, or current contractual agreements.

VII. General Regulations
A. In general, leave begins to accrue immediately upon employment.
B. Leave is not transferable between members.
C. Leave of any type may be rescinded due to departmental necessity.
VIII. Notification of and Return from Absence
A. Members will insure that the Deputy or Division Chief in charge is notified prior
to their scheduled work time if they are unable to report as scheduled.
B. Depending upon the circumstances, the Fire Chief, Division or Deputy Chief in
charge may direct that unscheduled absences be charged to accrued vacation
leave, personal leave, emergency leave, sick leave, compensatory time, or absence
without pay.
C. Absence without proper notification, authorization, or excuse may result in
disciplinary action.
D. Absence without proper notification or authorization for 24 consecutive working
hours in a member's schedule will constitute abandonment of duties which shall
normally result in indefinite suspension.
E. Members on any extended leave of absence will provide notes, forms, or
statements as required by City policy, Department rules and regulations,
guidelines, the Fire Chief, and/or the member's Division or Deputy Chief.
F. Members returning to work following a leave of absence will provide notes,
forms, or statements as required by City policy, Department rules and regulations,
guidelines, the Fire Chief, and/or the member's Division or Deputy Chief.
G. Failure to provide required documentation may result in disciplinary action.
