Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on July 12, 2016, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items 1-2/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor David Pritchett of Ebenezer Baptist Church gave the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tem Mouton, Councilmembers Guidroz, Getz, Wright and Pate. Absent: Councilmember Samuel. Also present were Kyle Hayes, City Manager, Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Councilmember Samuel was out of the city on vacation. Proclamations, Presentations, Recognitions "Know your County Courthouse Day" — July 13, 2016 — Proclamation read by Councilmember Wright; accepted by J.D. Roberts, founder of Save Our Children "Floyd Frank Day" — July 13, 2016 — Proclamation read by Councilmember Wright; accepted by Floyd Frank, family and friends Mayor Ames read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. Public Comment: Persons may speak on scheduled agenda items 1-2/Consent Agenda. Minutes—July 12, 2016 Jason Marshburn 1070 Monterray Dr. Beaumont TX Spoke to Council in regards to Item 2 on the Agenda; receive funding through the Office of the Governor Criminal Justice Division for the Body -Worn Camera Program, stated that he supported the Body -Worn Cameras for the Police Department asked that Council approve this item CONSENT AGENDA * Approval of minutes — July 5, 2016 * Confirmation of committee appointments — Resolution 16 — 122 * Lillie Babino would fill the unexpired term of Bart Owens on the Civil Service Commission. The term would commence July 12, 2016 and expire November 9, 2018. (Kyle Hayes, City Manager) A) Authorize the acceptance of two (2) ten foot (10') wide Water Line Easements located at 4205 Sarah Street — Resolution 16 - 123 Councilmember Getz moved to approve the Consent Agenda. Mayor Pro Tem Mouton seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS GUIDROZ, GETZ, WRIGHT AND PATE NAYS: NONE MOTION PASSED GENERAL BUSINESS Consider authorizing the City Manager to other related documents for the sale of Avenue known as Fire Station No. 11. execute an Earnest Money Contract and property located at 2185 Sabine Pass On February 25, 2014, City Council passed Resolution No. 14-043 accepting the bid submitted by NAI Wheeler for an annual contract to provide real estate broker services to list and sell City -owned property. NAI Wheeler has secured one (1) potential buyer that is interested in purchasing the property located at 2185 Sabine Pass Avenue. The property is known as Fire Station No. 11. After reviewing the Earnest Money Contract, it is in the best interest of the City of Beaumont to execute the Earnest Money Contract with Robert Wayne Phillips with a cash offer in the amount of $93,000.00. Robert Wayne Phillips will deposit $2,500.00 as earnest money to Texas Regional Title for a feasibility period of forty-five (45) days. If Robert Wayne Phillips terminates the Minutes — July 12, 2016 earnest money contract within the forty-five (45) days, the earnest money will be refunded to Robert Wayne Phillips less $1,000 that the City will retain. The earnest money contract is contingent upon the City vacating the property on or before 120 days after the effective date of the contract. If the City has not vacated the property by such date, Robert Wayne Phillips will have the right to terminate the contract and to be refunded all earnest money. The City is willing however to extend the contract until such time as the City vacates the property. The date of closing will be fourteen (14) days after the feasibility period provided that the property is vacated. Councilmember Guidroz moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE AN EARNEST MONEY CONTRACT WITH ROBERT WAYNE PHILLIPS FOR THE SALE OF PROPERTY AND IMPROVEMENTS A/K/A FIRE STATION NO. 11 LOCATED AT 2185 SABINE PASS AVENUE; AND THAT THE CITY MANAGER IS HEREBY AUTHORIZED TO EXECUTE ALL DOCUMENTS NECESSARY FOR THE SALE OF THE PROPERTY AND IMPROVEMENTS. Councilmember Wright seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM MOUTON, COUNCILMEMBERS GUIDROZ, GETZ, WRIGHT AND PATE NAYS: NONE MOTION PASSED Resolution 16 - 124 2. Consider a resolution authorizing the City Manager to apply for and execute all documents necessary to receive funding through the Office of the Governor Criminal Justice Division for the Body -Worn Camera Program. The City of Beaumont has made a preliminary application for the Body -Worn Camera Program through the Office of the Governor Criminal Justice Division program. The grant funds, if awarded, would provide $192,500 and the city would provide matching funds of $48,125. Award notice is expected by October 26, 2016. The Body -Worn Camera program for the Police Department will provide 140 body cameras at approximately $1000 each, and the remaining funding will be used to provide hardware and software for retention of videos. This will coverthe majority of the Police Operations Division personnel, with prioritized issuance to the uniformed officers in patrol, traffic, and special assignment unit functions and first line supervisors. The body cameras would be purchased from Watch Guard to expand the current approved in -car camera system. Minutes—July 12, 2016 Councilmember Pate moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO APPLY FOR AND RECEIVE FUNDING FOR THE CITY OF BEAUMONT IN THE AMOUNT OF $192,500 THROUGH THE OFFICE OF THE GOVERNOR CRIMINAL JUSTICE DIVISION FOR THE BODY -WORN CAMERA PROGRAM TO PROVIDE 140 BODY CAMERAS FOR POLICE OFFICERS, AS WELL AS NECESSARY HARDWARE AND SOFTWARE FOR RETENTION OF VIDEOS. FLOYD FRANK, WHO IS CELEBRATING HIS 90TH BIRTHDAY AND ON BEING INDUCTED INTO THE COWBOY HALL OF FAME, COMMENTED ON THE SHOOTINGS OF DALLAS ON LAST WEEK, GAVE CONDOLENCES TO THE FAMILIES, ANNOUNCED A COMMUNITY FORUM ON TONIGHT, JULY 12, 2016, AT CATHEDRAL OF FAITH BAPTIST CHURCH, STARTING AT 6:00 P.M., THE PUBLIC IS INVITED COUNCILMEMBER SAMUEL - ABSENT COUNCILMEMBER PATE - CONGRATULATED J.D. ROBERTS FOR ALL THAT HE DOES IN THE COMMUNITY WITH THE YOUTH, GAVE CONDOLENCES TO THE FAMILIES OF THE FALLEN POLICE OFFICERS IN DALLAS, TX COUNCILMEMBER GETZ - STATED THAT THE CITY HAS SPENT A LOT OF MONEY PAVING SOME STREETS ON AMELIA AND OTHER STREETS IN THE WEST END ON LAST YEAR, THE CITY HAS SPENT OVER A MILLION DOLLARS ON REPAVING THESE STREETS WITH ASPHALT OVERLAY, STATED THAT THE CITY HAS KNOWN SINCE APRIL THAT THE ASPHALT THAT WAS PROVIDED BY THE SUPPLIER WAS DEFECTIVE, REQUESTED AN EXECUTIVE SESSION AT THE NEXT COUNCIL MEETING TO GET THE STATUS OF WHERE THE CITY IS WITH GETTING THESE STREETS REDONE BY THE CONTRACTOR, ANNOUNCED ON THURSDAY, JULY 14, 2016, THERE WILL BE A POLICE COMMUNITY FORUM AT THE WEST END BAPTIST CHURCH, LOCATED AT 8180 PHELAN BLVD., AT 7:00 P.M., THE PUBLIC IS INVITED, THANKED THE BEAUMONT POLICE OFFICERS FOR ALL THEY DO COUNCILMEMBER GUIDROZ - THANKED THE BEAUMONT POLICE OFFICERS FOR ALL THEY DO, COMMENTED ON THE SHOOTING IN DALLAS, TX, ALSO STATED THAT ON THIS WEEKEND HE WAS IN HOUSTON, TX, PASSED TO TWO POLICE OFFICERS, STOPPED AND SHOOK THEIR HANDS AND THANKED THEM FOR WHAT THEY DO, STATED THAT EVERYONE MAY GO TO DIFFERENT CHURCHES BUT WE ALL PRAY TO THE SAME GOD AND THAT CHILDREN LEARN HATE THEY KNOW NOTHING ABOUT HATE AS SMALL CHILDREN CITY ATTORNEY COOPER - NONE CITY MANAGER HAYES - NONE MAYOR AMES - THANKED THE BEAUMONT POLICE DEPARTMENT FOR THE VIGIL THAT WAS FORMED ON BEHALF OF THE FALLEN DALLAS POLICE OFFICERS, COMMENTED ON THE POLICE FORUMS, STATED THAT EVERY QUARTER THERE IS A FORUM THAT IS PUT ON BY THE BEAUMONT POLICE DEPARTMENT, THOSE FORUMS HAPPEN IN DIFFERENT AREAS OF THE CITY WHEN TIMES, PLACES AND DATES ARE SET, COMMENTED ON THE CURB SIDE RECYCLING Minutes — July 12, 2016 PROGRAM THAT WILL BE GOING AWAY ON JULY 31, 2016, WANTED TO INFORM THE CITIZENS THAT THE COUNCIL IS TRYING TO COME UP WITH SOMETHING TO FILL THAT VOID, THE COUNCIL WILL TRY TO CREATE ANOTHER AD HOC COMMITTEE TO LOOK AT OTHER OPTIONS THAT MAY BE OUT THERE, MENTIONED THAT THERE IS A DROP-OFF AT GULF COAST RECYCLING WHICH IS LOCATED AT 1995 CEDAR Public Comments (Persons are limited to three minutes) Orenthal Augustine 153 Orgain St. Beaumont TX Stated that he is the Vice President of the Amagated Transit Union for the Beaumont bus drivers, as a representative of the Beaumont Transit Bus Drivers they stand in support of their current employer with whom they have a working relationship and a vested interest, through their pension, benefits and seniority, the drivers have worked hard for and what they have planted their futures around and feel all of this is in jeopardy, stated that through research of First Transit their business practices are not employee friendly, they will cut pay and fire drivers, asked that the City would consider those that are currently employed with the City during the contract bid on next Thursday Herman Davis IV 3055 Robinhood Ln. Beaumont TX Spoke to Council in regards to social media and an online forum that was created, there were citizens that were invited from the Police Department and other organizations, during the forum it was felt that bridges were crossed, wanted to give Council the web link so that they may go back and watch the forum for themselves, the web link is www.wewant.solutions, stated that there will be future forums for everyone to log onto and be a part of John Guidry 161 E. Caston Beaumont TX Spoke to Council in regards to his water bill and the policy that is in place that does not help people on a fixed income, stated that his water bill was sent to 1710 Cartwright, he hasn't lived at that address in ten years, wasn't sure how the water bill ended up there when the City has his current address Jason Marshburn 1070 Monterray Dr. Beaumont TX Spoke to Council regarding fear in this Country, such as illegal immigrants, terrorism, authority of the police officers, the local police department here in the City of Beaumont, it is all the same root cause, if everyone will come together and just be more optimistic and become more educated, everyone has a right to civil liberties Minutes — July 12, 2016 Jeanetta Price 4410 S. 5" St. Beaumont TX Discussed several things with Council, stated that as a blind woman her right to vote was denied twice, blind individuals have the right to vote independently, this will discourage blind people from voting if they are discouraged, stated that if she comes to Council with a problem she must come with a solution, announced that October 15, 2016, is National White Cane Awareness Day and that October is Meet the Blind Month, thanked the Beaumont Police and Fire Department as well as the citizens for supporting the National White Cane Awareness day on last year Landry Rountree 1565 S. Major Dr. Beaumont TX Stated how sorry he feels for what happened in Dallas, TX, on last year he filed a criminal complaint against a member of the City Attorney's office which ended up in the District Attorney's office, has inquired several times about this complaint, it seems to be lock down or the people that he speaks with tells him that they will get back with him, as of this date they haven't gotten back with him, stated he would like this complaint investigated Thefarro Richard Coulibaly 1960 Glendale St. Beaumont TX Thanked Congressman Jack Brooks for putting her through Howard University, if he were still here he would want her to let citizens know, commented on the bus service on Sundays, thinks that is very important to citizens, also requested sidewalks on all major thoroughfares, asked Mr. Hayes would he be willing to donate the $38,000.00 increase in salary that he received on last week to put benches and covers at every bus stop throughout the City Mark Taylor 2990 Texas St. Beaumont TX Stated that in light of the recent events, Council has a great responsibility and a great job to do, the City is a community that's divided, stated that he graduated from French High School in 1979 and his class has re -segregated, that's what has happened to the rest of Beaumont, we have one part of town that's one type of people and the other part another type of people, the churches talk about worshipping God, there is one God, if we can't worship together what can we do together Open session of meeting recessed at 2:50 p.m. EXECUTIVE SESSION * Consider matters related to contemplated or pending litigation in accordance with Section 551.071 of the Government Code: The City of Beaumont vs. Target Corporation; No. 120123 Minutes —July 12, 2016 There being no action taken in Executive Session, Council adjourned.
