Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on February 9, 2016, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor "Big" Jim Salles of West Baptist Church gave the invocation and led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tem Getz, Councilmembers Guidroz, Wright, Samuel and Mouton. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Councilmember Pate was absent due to being out of the City. Proclamations, Presentations, Recognitions None Public Comment: Persons may speak on scheduled agenda items 1-3/Consent Agenda. None CONSENT AGENDA Approval of minutes — February 2, 2016 * Confirmation of committee appointments — None A) Approve the termination of a Lease Agreement with UTMB for space at 950 Washington Boulevard - Resolution 16 — 026 B) Authorize the City Manager to execute all documents necessary, specifically including a contract, in order for the Southeast Texas Auto Theft Task Force (City of Beaumont) to transfer a vehicle title to the Hardin County sheriff's Office - Resolution 16 — 027 C) Authorize the City's Attorney to join the State of Texas into the litigation of the United States of America vs. The City of Beaumont, Texas - Resolution 16 — 028 Mayor Pro Tem Getz moved to approve the Consent Agenda. Councilmember Wright seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM GETZ, COUNCILMEMBERS GUIDROZ, WRIGHT, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED GENERAL BUSINESS Consider a resolution authorizing the City Manager to execute Change Order No. 1 to the contract with BIDS Constructors, LLC dba MK Constructors for the Goodhue Road Sanitary Sewer Project. On September 29, 2015, by Resolution 15-211, City Council awarded a contract to BIDS Constructors, LLC, dba MK Constructors, of Vidor, Texas, in the amount of $960,329.00 for the Goodhue Road Sanitary Sewer Project. The project consists of the installation of 1,470 linear feet of new 12 -inch diameter sanitary sewer line. Change Order No. 1, will provide for the installation of the sanitary sewer line by directional drill method instead of open -cut excavation; provide for the cleaning and television inspection of the existing Calder interceptor line; rehabilitate and seal the six (6) existing manholes between Goodhue Road and Caldwood Cutoff ditch; and replace the existing damaged sanitary sewer siphon under the Caldwood Cutoff ditch. The proposed improvements will enhance the capacity of the existing sanitary sewer system to better provide quality service to citizens in the area. The proposed change order in the amount of $225,529.50 would increase the original contract amount to $1,185,858.50. An additional 60 calendar days is also being requested to the original contract end date of March 8, 2016, which would make the new substantial completion date May 7, 2016. Approval of resolution. Mayor Pro Tem Getz moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A CHANGE ORDER NO. 1 FOR ADDITIONAL WORK, THEREBY INCREASING THE CONTRACT AMOUNT BY $225,529.50 FOR A TOTAL CONTRACT AMOUNT OF $1,185,858.50 FOR THE GOODHUE ROAD SANITARY SEWER PROJECT. Councilmember Guidroz seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM GETZ, COUNCILMEMBERS GUIDROZ, WRIGHT, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Resolution 16 — 029 Mayor Ames read the announcement regarding Executive Session being held at the conclusion of the General Business portion of the meeting. WORKSESSION Review and discuss a draft Request for Proposals related to the Management, Maintenance and Operation of the City of Beaumont Tennis Center located at 6455 College Street City Manager, Kyle Hayes, reviewed and discussed a draft Request for Proposal related to the Management, Maintenance and Operation of the City of Beaumont Tennis Center located at 6455 College Street. The scope of work was discussed, it was also asked that in the scope of work under Section 6.7, Facility Maintenance and Repairs, Item 1) be removed, it was stated that after careful review $30,000.00 was spent on utilities, this item should continue to be monitored by the City as the contractor would not know the extent of the charges. It was agreed by Council that Item 1) would be removed from the scope of work. Review and discuss Low Income Housing Tax Credit applications related to proposed projects within the City of Beaumont or the City's Extraterritorial Jurisdiction (ETJ) Community Development Director, Chris Boone, reviewed and discussed the Low Income Housing Tax Credit applications related to proposed projects within the City of Beaumont or the City's Extraterritorial Jurisdiction (ETJ). Mr. Boone stated that the Texas Department of Housing and Community Affairs (TDHCA), awards an annual allocation of funds for subsidized housing. The process is competitive and each application is graded on a variety of factors, defined by TDHCA. Two of these factors that offer developments an advantage include support by the local government in the form of a resolution as well as financial support for a project. There were eight (8) locations of project applications submitted to the City, included in the applications was the composition of units, whether planning approval is required and any requested support resolutions needed. It was also stated that developers must submit final applications to TDHCA, along with any resolutions by March 1, 2016. Funding decisions are usually made by TDHCA in July. Review and discuss the possible annexation of properties located along the west side of Major Drive between Dishman and Folsom Community Development Director, Chris Boone, reviewed and discussed the possible annexation of properties located along the west side of Major Drive between Dishman and Folsom. The possible annexation area and non-agricultural parcels were discussed along with the process which entailed; 1) development agreements for ag. Property; 2) owner notification; 3) hearings and approval; 4) Department of Justice preclearance approval; 5) begin delivery of services with 21/2 years. Box 20572 Beaumont TX Stated that he represents the Friends and Library, still not sure what the decision is in regards to the Down Town Library, stated that he has heard that a decision was made but would like Council to elaborate on what the decision is, if the Council has decided to keep the Library, he wanted to thank them for keeping it, also requested that if the library is kept asked that Council consider making the library energy efficient, also commented on the street projects Joyce Bowman 902 East Drive Beaumont TX Thanked Council for the decision not to close the Downtown Library, following this has taught her a lot about City Government, stated that she has seen firsthand that citizen input does matter Dora Nisby 4520 Corley St. Beaumont TX Thanked Council for making the decision not to close the Downtown Library and maintaining it as it is, also announced the book sale at the Downtown Library on February 20, 2016, asked that everyone attend Talsha Davis P.O. Box 7288 Beaumont TX Spoke to Council in regards to the Southeast Texas Tennis Association and the current staff, also commented on contracting or leasing the tennis center, stated that certain things need to be revisited, commented on the fees as well as SETA paying what they need to pay, feels that the program doesn't need to be contracted out Charles Kirkwood P.O.
