The City Council of the City of Beaumont, Texas, met in a regular session on August 18, 2015, at
the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the
following:

Mayor Ames called the council meeting to order at 1:30 p.m.
Pastor Edison Colbert of Paradise Missionary Baptist Church gave the invocation. Mayor Ames
led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk.
Present at the meeting were Mayor;Ames, Mayor Pro Tem Getz, Councilmembers Guidroz,
Wright, Pate, Samuel and Mouton. Also present were Kyle Hayes, City Manager; Tyrone Cooper,
City Attorney; Tina Broussard, City Clerk.

Commented on Item B on the Consent Agenda; the lease agreement with the Beaumont

Councilmember Getz made a statement in regards to Item C on the Consent Agenda.
CONSENT AGENDA
Approval of minutes — August 11, 2015
Confirmation of committee appointments — Resolution 15 —170
Christina Howard would be appointed to the Library Commission. The term would commence
August 18, 2015 and expire August 17, 2017. (Councilmember W. L. Pate, Jr.)

A) Authorize the City Manager.- to execute all documents. necessary, specifically a
Memorandum of Understanding, with the Texas Attorney General's Office Internet Crimes
Against Children Task Force - Resolution 15 — 171
B) Authorize the City Manager to execute a lease agreement with the Beaumont Art League —
Resolution 15 - 172
C)' Approve the appointment of Kellie Colbert as an Assistant City Attorney I I and setting- her
starting compensation.`— Resolution 15,- 173
Councilmember Gudiroz moved to approve the Consent Agenda.- Councilmember Pate
seconded the motion.

GENERAL .BUSINESS '
1_. Consider a resolution authorizing the City Manager to accept the 54 -Inch Interceptor
Rehabilitation Phase II Project for maintenance, approve a change order to the contract
with Allco; LLC, and. authorize final payment.
The City Council approved a .contract with Allco, LLG, of Beaumont on June 12, 2012 in
the amount of $3,491,570.60. The contract was to rehabilitate the existing 54 -inch
diameter,sanitary sewer interceptor that runs along Blanchette Street.
The proposed change order will decrease the contract amount by $83,07-2.65 to adjust the
estimated. quantitiesto reflect" the actual quantities used during the performance of the
project. These adjustments are focused on those portions of the project where the
designed slip lining rehabilitation had to be replaced by open trench removal and
replacement of the existing line.
The project has been inspected:by Water Utilities and found to be complete in accordance
with the provisions and terms set.out in -the' -contract. A final payment will be made to the
contractor in the amount of $170,424.90.
Previous actions include:
Resolution 1.2-129, in the amount of $3,491,570.60 was approved by City Council on
June 12, 20.12.
Capital Program.

Councilmember Pate, moved to APPROVE A RESOLUTION THAT THE SANITARY SEWER SYSTEM
IMPROVEMENTS 54 -INCH INTERCEPTOR REHABILITATION PHASE II PROJECT BE AND THE SAME IS
HEREBY ACCEPTED; AND THAT THE CITY MANAGER IS HEREBY AUTHORIZED TO MAKE FINAL
PAYMENT IN THE AMOUNT OF $170,424.90 TO ALLCO, LTD., OF BEAUMONT, TEXAS.
Councilmember Wright seconded the motion.

Resolution 15 - 174
2. Consider a resolution authorizing the City Manager to accept the Sanitary Sewer
Rehabilitation of Small Diameter Mains Contract XXIII Project for maintenance, approve a
change order to the contract with Simco Enterprises, Ltd.., and authorize final payment'.
The City Council approved a contract with Simco Enterprises, Ltd., of Groves on December
11, 2012. in the amount of $1,895,761.75. The contract was to replace approximately
36,377 linear feet of sanitary sewer mains.
The proposed change order will decrease the contract amount by $118,227.65 to adjust
the estimated quantities to reflect the actual quantities used during the performance of the
project and the purchase of pipe materials on hand.
The project has been inspected by Water Utilities and found to be complete in accordance
with the provisions and terms set out in the contract. A final payment will be made to the
contractor in the amount of $33,206.40.
Previous actions include:
Resolution 12-288 in the amount of $1,895,761.75 was approved by City Council on
June 12, 2012.

Councilmember Pate moved to APPROVE A RESOLUTION THAT THE SANITARY SEWER

WORKSESSION
Review and discuss water repair procedures and receive a status report
Molly Villarreal, Interim Water Director introduced staff that was present, Operations and
Maintenance Manager, Fred Richardson; Administrative Personnel, Chris Catalina; Dress Up
General Foreman, Charles.Livings; Water Repairs General Forman, Peter Thomas. Ms. Villarreal
discussed that the Water Department is changing the way that they track water leaks specifically,
stated that on Monday there were twelve water calls to be investigated, twelve inspections were
done, confirmed one new leak and completed fourteen repairs, the total leaks and breaks to be
completed on the books are one hundred seven (107), forty two (42) are about thirty,days old.

BOBBY BOWDEN WILL ALSO BE COMING IN ON SUNDAY

DEFENSIVE, STATED IT'S FRUSTRATING WHEN YOU SEE A
NEWS STORY THAT THE CITY OF BEAUMONT HAS OVER 300
WATER LEAKS, KNOWING THAT INFORMATION WASN'T TRUE,
THERE'S'A GOOD STORY AS TO HOW THE CITY HAS
'INCREASED THE WATER UTILITIES FUND BALANCE BY A
MILLION DOLLARS AND THAT HASN'T BEEN REPORTED, THE
WATER DEPARTMENT WILL WORK ON GETTING BETTER AND
FOR THE FIRST TIME IN MORE THAN TEN YEARS THE
ADMINISTRATION HASN'T ASKED CITY COUNCIL TO INCREASE
WATER AND SEWER RATES THAT AFFECT. THE CITIZENS

Congratulated his, daughter Sarah and her new husband Cody Ballard on their beautiful
wedding on Saturday, appreciated the remarks made by Councilmember Wright about
women, stated that behind every successful man there's a tired woman, commended
Councilmember Getz and Guidroz and if any other Councilmember would like to help him
next week he would appreciate any help they can give him

Stated that on Monday kids will be going back to school, the various communities will be
welcoming"back the children, commented on the kids in a certain community that will be
out at recess, they will have certain people'speaking to them around the playground, those
people will be prostitutes that will be picked up right near the school, would like something'
to be done about this, it has been going on for years, something has to be done
