Cooper, City Attorney Kyle Hayes, City Manager Tina Broussard, City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on August 4, 2015, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30_ p.m. to consider the following: OPENING Invocation Pledge of Allegiance Roll Call Presentations and Recognition Public Comment: Persons may speak on scheduled agenda item 1/Consent Agenda Consent Agenda Mayor Ames called the council meeting to order at 1:30 p.m. Pastor Sharon Gazaway of St. Andrews Presbyterian Church gave'the invocation. Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tem Getz, Councilmembers Guidroz, Wright, Pate, Samuel and Mouton. Also present were Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Tina Broussard, City Clerk. Proclamations, Presentations, Recognitions "Celebrating the 19th Amendment Day" - August 5, 2015 - Proclamation read by Mayor Ames; accepted by Pioneer Women Member, Alicia Wells and honorees: Carol Fernandez, Mary Simon Mayor Ames read the announcement regarding. Executive Session being held at the conclusion of the General Business portion of the meeting. Public Comment: Persons may speak on scheduled agenda item 1/Consent Agenda. None CONSENT AGENDA Approval of minutes — July 28, 2015 Confirmation of committee appointments.— Resolution 15 —'154 Reverend David Robinson will fill the unexpired term of Dwaine K. Augustine on the Police Department Community Advisory Committee. The term would commence August 4, 2015. and Minutes—August 4, 2015 expire January 24, 2017. (Councilmember Robin Mouton) — Resolution 15 -155 Carl Briggs would be reappointed to the Parks and Recreation Advisory Committee. The current term would expire July 10, 2017. (Councilmember Robin Mouton) Georgine Guillory would be reappointed to the Community Development Advisory Committee. The current term would expire June 11, 2017. (Councilmember Robin Mouton) Georgine Guillory would be reappointed to the Small Business Revolving Loan Fund Board. The current term would expire June 11, 2017. (Councilmember Robin Mouton) Deloris Comeaux Guidry would be reappointed to the Community Development Advisory Committee. The current term would expire July 10, 2017. (Councilmember Gethrel Williams - Wright) Dora Nisby would be reappointed to the Community Development Advisory Committee. The current term would expire July 5, 2017. (Councilmember Gethrel Williams -Wright) Lynda Kay Makin would be reappointed to the Planning and Zoning Commission. The current term would expire April 14, 2018. (Mayor Becky Ames) Dana L. Timaeus would be reappointed to the Board of Adjustment (Zoning). The current term would expire May 12, 2017. (Mayor Becky Ames) A) Approve a payment to Jefferson County for the City of Beaumont's share of the annual maintenance cost for the 800 MHz radio system — Resolution 15 -156 B) Approve the appointment of Kelli Colbert as an Assistant City Attorney II and setting her starting compensation — Tabled. for 1 Week C) Authorize the law firm of Pate and Spivey, L.L.C. to bring suit against Payne's Wrecker Service, Inc. d/b/a Payne and Sons Body Shop and Wrecker and Russell Huff for damages caused to the City as a result of an automobile accident on or about July 23, 2013 — Resolution 15 -157 D) Authorize the City Manager to sign a contract with the South East Texas Regional Planning Commission (SETRPC) related to the planning, development and operation of the Regional 9-1-1 System — Resolution 15 -158 E) Authorize the settlement of the lawsuit styled Pamela Cole v. Emilio Romero; Cause No. 23081 — Resolution 15 - 159 Councilmember Pate moved to approve the Consent Agenda excluding Item B. Councilmember Guidroz seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM GETZ, COUNCILMEMBERS GUIDROZ, WRIGHT, PATE, SAMUEL AND MOUTON Minutes —August 4, 2015 MOTION PASSED GENERAL BUSINESS Consider a resolution approving the award of a bid to Brystar ,Contracting, Inc., of Beaumont for the Reconstruction and Widening of Avenue A (South of Elgie Street to Washington Boulevard). A grant from the Texas Community Development Block Grant (CDBG) Disaster Recovery Program administered by the Texas General Land Office (GLO) for areas impacted by Hurricane Ike was awarded for the Reconstruction and Widening of Avenue A (So.uth of Elgie Street to Washington Boulevard). The City will remove the existing three (3) lane roadway and construct a new curb and gutter roadway to its original width with ADA compliant sidewalks. Work includes: constructing stabilized sub -grade, base, and concrete surface; construct curb and gutter, sidewalks with ADA compliant ramps, driveways, and remove existing miscellaneous items as needed; install signage and pavement markings; and perform site work associated with construction. Drainage work includes installing a new storm sewer system, inlets, manholes, headwalls, construct erosion features, and install other associated appurtenances. The Citywill also make water and sewer line improvements including replacement of existing lines, sanitary sewer line replacement via pipe burstings, adjust, manholes, install new fire hydrant assemblies, and install other associated appurtenances. On July 23, 2015, the City received four (4) bids for this project. The bid totals are shown below with the unit cost tabulation attached. Contractor Location Bid Brystar Contracting, Inc. Beaumont $2,158,069.50 Allco, LTD. Beaumont $2,317,514.26 APAC Inc. Beaumont $2,325;647.55 Excavation & Construction, LLC. Nederland $2,362,876.26 At total number of 180 days were allocated for the completion of this project. Brystar Contracting, Inc. is a Certified MBE/HUB company. A Texas General Land Office (GLO) Disaster Recovery Grant in the amount of $1,423,471.00 .is available for this project. The remaining balance of approximately $735-000 is available in the Capital Program (Public Works Projects and Water and Sewer Projects). Approval of resolution. Councilmember Wright moved to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE A. CONTRACT WITH BRYSTAR CONTRACTING, INC., OF BEAUMONT, TEXAS, IN THE AMOUNT OF $2,1.58,069.50 FOR THE RECONSTRUCTION AND,WIDENING Minutes — August 4, 2015 OF AVENUE A (SOUTH OF ELGIE STREET TO WASHINGTON BOULEVARD) PROJECT. Councilmember Getz seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM GETZ, COUNCILMEMBERS GUIDROZ, WRIGHT, PATE, SAMUEL AND MOUTON NAYS: NONE MOTION PASSED Resolution 15 - 160 COUNCILMEMBER-COMMENTS COUNCILMEMBER MOUTON - GAVE CONDOLENCES TO THE FAMILY OF MEL FARR, PRAYERS GO OUT TO THE FAMILY HERE IN BEAUMONT, THANKED EVERYONE FOR COMING OUT TO COUNCIL TODAY AND IT'S A PLEASURE TO SERVE ON COUNCIL COUNCILMEMBER SAMUEL - NONE COUNCILMEMBER PATE - GAVE CONDOLENCES TO THE FAMILY OF MEL FARR, SALUTED THE PIONEERING WOMEN AND THEIR HONOREES STATED IT'S ANOTHER GREAT DAY IN BEAUMONT COUNCILMEMBER WRIGHT - THANKED THE LIBRARY SYSTEM FOR ALL OF THE PROGRAMS THAT ARE BEING OFFERED AND FOR EXTENDING THOSE PROGRAMS TO THEODORE JOHNS LIBRARY AS WELL, CONGRATULATED THE HONOREES OF THE PIONEERING WOMEN, COMMENTED ON THE SALVATION ARMY SPECIAL HONORS PROGRAM, CONGRATULATED HER PASTOR RODNEY GRAVES AND JUDGES CRAIG LIVELY AND JOHN STEVENS WHO WERE HONORED, ALSO ANNOUNCED THE YOUTH WHO WERE HONORED, KEN MARKS, TAYLOR SMITH AND LANCE ZENO MAYOR PRO TEM GETZ - COMMENTED ON THE SALVATION ARMY EVENT THAT HE ATTENDED EARLIER, STATED THAT HE DIDN'T THINK THAT IT WAS INAPPROPRIATE TO ASK FOR ADDITIONAL INFORMATION WHEN AN APPROVAL IS BEING MADE FOR A HIRING OR APPOINTMENT OF ANYONE COUNCILMEMBER GUIDROZ - COMMENTED ON THE SALVATION ARMY EVENT THAT HE ATTENDED EARLIER, ALSO STATED THAT THERE IS AN AREA IN THE NORTH END CALLED EDGE WATER PARK, IT'S A FEDERAL PARK THAT IS INSIDE THE BEAUMONT CITY LIMITS, A CITIZEN IS INTERESTED IN DEVELOPING THIS PARK WITH A WALKING TRAIL ETC., ALSO CONGRATULATED JIM DURST WHO RETIRED FROM THE POLICE DEPARTMENT WITH 30 Minutes — August 4, 2015 YEARS OF SERVICE `AS WELL AS JIM CLAY ON HIS PROMOTION AS THE ASSISTANT POLICE CHIEF, COMMENTED ON A MEETING WITH JOHN LEWIS AND HIS PASTOR, THEIR CHURCH SERVES PEOPLE ON.A DAY TO DAY BASIS, THEY ARE WANTING TO DEVELOP THE PLAYGROUND NEXT TO THEIR CHURCH, THERE IS ANOTHER MEETING SCHEDULED, INVITED COUNCILMEMBER GETZ TO ATTEND SINCE IT'S IN HIS WARD, AS WELL AS COUNCILMEMBER MOUTON SINCE MR. LEWIS HELPED HER WITH HER CAMPAIGN, COMMENTED ON ATTENDING THE ASTROS BASEBALL GAME OVER THE WEEKEND CITY ATTORNEY COOPER - NONE 'CITY MANAGER HAYES - STATED THAT STAFF IS STARTING TO PLAN THE NEIGHBORS IN THE PARK EVENT THAT'S THEMED OCTOBERFEST, IN FISCAL YEAR 2014, THE CITY SPENT AN ESTIMATED $36,000.00 FOR THREE EVENTS, THERE WAS NOT A NEIGHBORS IN THE PARK IN WARD HN 2014 DUE TO LOW ATTENDANCE, THE ADMINISTRATION IS PURPOSING TO ALLOCATE $36,000.00 IN FISCAL YEAR 2016 FOR FOUR NEIGHBORS IN THE PARK, ONE IN MAGNOLIA PARK AND OCTOBERFEST IN ROGERS PARK, THE MANAGER STATED HE WOULD LIKE MEET WITH COUNCILMEMBERS MOUTON AND GUIDROZ ON EVENTS THEY WOULD LIKE TO HAVE IN THEIR WARDS, ASKED THAT COUNOLMEMBERS PLEASE NOT SOLICIT OR TRY TO GET CERTAIN RESTAURANTS OR GROUPS INVOLVED, THERE ARE POLICIES AND PROCEDURES IN PLACE REGARDING. PURCHASING ITEMS THAT NEED TO BE UTILIZED, HE ASKED THAT EACH COUNCILMEMBER WORK THROUGH HIM TO MAKE THE EVENTS HAPPEN, THERE WILL BE $9,000.00 FOR EACH EVENT, $7,000.00 IN EVENT COST AND $2,000.00 FOR ADVERTISEMENT AND PROMOTION MAYOR AMES - ENJOYED THE BOYS AND GIRLS EVENT THAT TOOK PLACE EARLIER, THANKED COUNCILMEMBERS WRIGHT AND GETZ FOR FILLING IN FOR HER FOR THE SUMMER READING PROGRAM, CONGRATULATED CAPTAIN Jim, DURST_ON HIS RETIREMENT AFTER 30 YEARS OF SERVICE, AS WELL •AS CONGRATULATIONS TO JIM CLAY, WHO WAS PROMOTED TO ASSISTANT POLICE CHIEF Public Comments (Persons are limited to three minutes) Cheryl Guillory 5555 Ada St. Beaumont TX Spoke to Council in regards to an urgent matter that she has `not be able to get resolved, stated that she is the owner and operator of Birds of a Feather, which supervises finding homes for people with intellectual developmental disabilities formerly known as retardation, Minutes — August 4, 2615 understands that the City is currently in litigation involving persons with disabilities, has spoken with Chris Boone, Tyrone Cooper, Marcus Rogers and Captain White in regards to the Ordinance, there is an issue as to how to measure the distance where she has housed a client, stated she needs some type of resolve Rodney Dencklau 3030 French Road #425 Beaumont TX Thanked Mayor and Council for getting the water fountain repaired at the Dannehaum Station, as well as getting the problem resolved where the wheelchair riders will be dropped off at a parking lot outlet if it's close to the bus stop Landry Rountree 1565 S. Major Dr. Beaumont TX Congratulated Jim Clay on being promoted to Assistant Police Chief, as well as Captain Durst on his retirement, read a letter that was previously read by his wife dated July 14, 2015, still requesting a rehearing by Council and the Police Chief Icy Wade 4375 Crow Rd. #127 Beaumont TX Spoke to Council in regards to Beaumont which was once a City that showed a lot of love for one another, doesn't understand why Beaumont doesn't have a bus station, quoted several verses from the bible Open session of meeting recessed at 2:30 p.m. EXECUTIVE SESSION Consider matters related to contemplated or pending litigation in accordance with Section 551.071 of the Government Code: Claim against Joe Marcus Mejia Claim against Gustavia Joseph a/k/a Gustavia Joseph Turner, Terry L.
