WHEREAS, Weston Trails Property, Ltd. has agreed to donate 4.380 acres of land
and 4.062 acres of land situated in the W. B. Dyches Survey, Abstract No. 17, as
described in Exhibits "A" and "C" and shown on Exhibits "B" and "D," attached hereto, to
the City of Beaumont for the Northwest Parkway Project and,
WHEREAS, the City Council has considered the donation of said tracts of land and
is of the opinion that the delivery and receipt of said tracts are necessary and desirable and
that same should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby, in
all things, approved and adopted; and,
THAT the donation of the above described properties donated by Weston Trails
Property, Ltd. is hereby in all things accepted; and,
BE IT FURTHER RESOLVED THAT the City Manager is hereby authorized to
execute all documents necessary to accept said donations.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 17th day of

A. W.B. DYCHES SURVEY, ABSTRACT NO. 17
JEFFERSON COUNTY, TEXAS
Being a 4.380 acre tract or parcel of land, a portion of that certain tract of land (called 85.710
acres) as conveyed by deed to Brian Brett Martin as recorded in Clerk's File No. 2012017083,
Jefferson County, Texas as situated in and a part of the W, B. Dyches Survey, Abstract No. 171,
of said County and being more particularly described by metes and bounds as follows;
Beginning at a concrete monument marked G.S.U. found marking the Northeast corner of that
certain tract of land (called 0.703 acres) conveyed by deed to Gulf States Utilities Company as
recorded in Volume 1651, Page 451 of the Beed Records of said County, a point in the West line
of Old Dowlen Road, a publicly dedicated Right -of -Way and being the Southeast corner and the
PLACE OF BEGINNING of the herein described tract of land;
THENCE South 86 deg. 57 min. 51 sec. West along and with the North line of said 0.703 acre
tract of land at 175.00 feet passing the Northwest corner of said 0.703 acre tract of land and
continuing a total distance of 1466.62 feet to a'/" steel rod with cap marked Arceneaux; & Gates
set in the West line of said 85.710 acre tract of land and in the East line of that certain tract of
land (called Tract 2-C and containing 7.57 acres) conveyed by deed to Jefferson County
Drainage District No. 6 in County Clerk's Film File Code 104-01-0353 of the Official Public
Records of said County marking the Southwest corner of the herein described tract of land;
THENCE North 04 deg. 03 min. 16 sec. West along and with the East line of said 85.710 acre
tract of land and the West line of said 7.57 acre tract of land a distance of 130.02 feet to a '/z"
steel rod with cap marked Arceneaux & Gates set for the Northwest corner of the herein
described tract of land;
THENCE North 86 del;. 57 min. 51 sec. East a distance of 1468.92 feet to a 'i/z" steel rod with
cap marked Arceneaux & Gates set in the East line of said 85.710 acre tract of land and the West

That, WESTON TRAILS PROPERTY, LTD., a Texas limited partnership, hereinafter called
GRANTOR GIVES, DONATES, GRANTS AND CONVEYS, as a gift, subject to the
reservations and exceptions hereinafter made, and by these presents does GIVE, DONATE,
GRANT AND CONVEY unto THE CITY OF BEAUMONT, TEXAS a municipal
corporation, domiciled in Jefferson County, Texas, hereinafter called GRANTEE, P. O. Box
3827, Beaumont, Texas 77704, and to its successors and assigns forever the property described
in Exhibit "A", attached'hereto and made apart hereof for all purposes (the:"Property").
GRANTOR also gives, donates, ' grants and' conveys unto GRANTEE a perpetual non-
exclusive easement for drainage purposes over and across the property described in Exhibit `B"
attached hereto and made a part hereof for all purposes (the "Easement").
GRANTOR does hereby except and reserve from this conveyance unto itself and its
successors and assigns, forever, all of the oil, gas, and sulphur in and under the Property and
Easement herein conveyed but waives all rights of ingress and egress to the surface thereof for
the purpose of exploring, developing, mining or drilling for same.
This conveyance is expressly made -subject to all - zoning laws : and to restrictions,
covenants, conditions, easements and • mineral and/or royalty reservations, if any, effecting the

PROVIDED, HOWEVER, Grantor reserves and retains a reversionary interest and right
of reverter in the Property so that if Grantee fails to construct a paved concrete road on the
Property within three (3) years and a completion of the road within ten (10) years from the date
hereof, title to the Property shall automatically revert back into the name of Grantor.
IT IS FUTHER AGREED THAT THE PROPERTY AND EASEMENT ARE
CONVEYED AND ACCEPTED BY GRANTEE "AS IS" AND WITH NO FAULTS AND
GRANTOR HEREBY DISCLAIMS AND MAKE NO REPRESENTATION OR WARRANTY
EXPRESS OR IMPLIED, RELATNG TO THE CONDITION, SUITABILITY, FITNESS OR
HABITABILITY OF THE PROPERTY OR EASEMENT.
TO HAVE AND TO HOLD the above described premises together with all and singular
the rights and appurtenances thereto and in any wise belonging, unto the said GRANTEE and
GRANTEE'S successors and assigns, forever; and said GRANTOR, binds, Grantor and
Grantor's successors and assigns to warrant and forever defend all and singular the said premises
unto the said GRANTEE and GRANTEE'S successors or assigns, against every person lawfully
claiming or to claim all or any part of the property, subject to the provisions stated above, when
the claim is by, through, or under GRANTOR but not otherwise.
