Council consider authorizing the award of a contract for
temporary personnel services.
Administration recommends the award of a contract to Advance Staffing, Inc., of Beaumont,
Texas in the amount of approximately $72,900, and to Personnel Staffing, Inc., of Beaumont,
Texas in the amount of approximately $22,622.50.
BACKGROUND
Eleven (11) companies submitted bids for an annual contract to provide temporary employees to
fill positions in business offices, skilled and unskilled laborers, equipment operators, and Licensed
Vocational Nurses (LVN). Temporary employees are necessary for various job positions
throughout the City when vacancies occur due to events such as medical leave, vacations, or short
term projects.
Specifications for the contract require temporary staffing agencies to provide pre-screened and
qualified individuals on an on-call and as -needed basis. Temporary employees must pass a drug
screen and a criminal background search prior to being assigned to the City. The contract
specifications requested firm hourly prices inclusive of wages, benefits, testing, screening, workers
compensation, taxes, and agency fees.
Administration recommends awarding the contract for Skilled and Unskilled Labor positions to
Personnel Staffing, Inc., at the hourly rates indicated below. This agency is the current contractor
and has consistently provided pre-screened, qualified individuals to fill frequent temporary
positions during its contract with the City.

Administration recommends awarding the contract for Office I and II, Equipment Operator I and
II, and LVN to Advance Staffing, Inc. at the hourly rates indicated below. This is the first year
the Equipment Operator positions have been submitted for bids.
Personnel Staffing, Inc., has held the temporary personnel services contract with the City from
1999 to 2007.
Reliable Staffing, Inc., of San Antonio, Texas, an apparent low bidder on a portion of this
contract, withdrew their bid.

REQUESTED ACTION: Council approval of a resolution authorizing the City

RECOMMENDATION
The Administration recommends approval of increasing the Proposed New Water Well No. 2 and
Related Pilot Hole Project amount by $52,638.99. The proposed changes to the contract will
include deletion of Entergy allowance for electrical service, deletion of aquifer tests during pilot
hole, addition of 80 feet of electrical service from transformer to main disconnect, addition of
electrical components and services for proposed control panels, addition of fuel transfer pump and
associated electrical conduit and conductors, and furnish and install 500 KW portable generator.
The proposed extra work will represent an increase of 3.10% and a total increase of 8.83% of the
original contract amount.
BACKGROUND
The existing Water Well No. 2, located in Lumberton, Texas, was designed and constructed in
1971. In 2006, the existing water well began pumping sand and a subsequent investigation proved
the gravel pack had failed. The City and Schaumburg & Polk studied the possibility of
rehabilitating the gravel pack, however the cost, reliability, and future rehabilitation requirements
deemed the project not cost efficient. Schaumburg & Polk recommended the City install a new
water well. The changes included in this change order are a result of adjustments during
construction and the decision to purchase a portable generator to serve the well during power
outages.
Previous actions include:
Resolution 08-005 in the amount of $1,700,059.00 was passed by City Council on
January 8, 2008,
Resolution 08-187 in the amount of $88,866.14 was passed by City Council on June 17, 2008.
Change Order #2 in the amount of $1,610.00 was signed by the City Manager on
September 29, 2008.

WHEREAS, on January 8, 2008, the City Council of the City of Beaumont, Texas,
passed Resolution No. 08-005 awarding a contract in the amount of $1,700,059 to T.
Johnson Industries, Inc. for the Proposed New Water Well No. 2 and Related Pilot Hole
Project; and,
WHEREAS, Change Order No. 1, passed by Resolution 08-187 on June 17, 2008,
in the amount of $88,866.14, was required to furnish all labor, materials, and equipment
to provide testing of the well header piping as specified, furnish all labor, materials, and
equipment to provide additional well disinfection, furnish and install, complete in place, one
(1) 24" flanged gate valve for the existing 24" transmission line, and to furnish all labor,
materials, and equipment for cementing between the 26" casing and the 20" liner pipe,
from the top of gravel to ground surface, thereby increasing the contract amount to
$1,788,925.14; and
WHEREAS, Change Order No. 2, dated September 29, 2008, in the amount of

RECOMMENDATION
The Administration recommends approval of Change Order No. 3 in the amount of $11,091.00, for
adding construction item quantities to the Calder Avenue Drainage and Pavement Improvement
Project Phase I.
BACKGROUND
On June 10, 2008, City Council awarded Reytec Contraction Inc. the contract for the Calder
Avenue Drainage Diversion and Pavement Improvement Phase I Construction Project in the
amount of $23,733,567.95 and authorized execution of Change Order No. 1 in the amount of
($59,762.39) reducing the contract amount to $23,673,805.56. Change Order No. 2 was issued to
add and delete construction item quantities for roadway and drainage system improvements in
the amount of $45,620.40 increasing the contract to $23,179,425.96.
Change Order No. 3 is required to add construction item quantities for roadway and water system
improvements to the contract. This Change Order in the amount of $11,019.00 will increase the
contract amount to $23,730,516.96. A copy of the change order is attached.
BUDGETARY IMPACT
Funds are available in the Capital Program.

REQUESTED ACTION: Consider authorizing the City Manager to apply for and receive
funding through the 2009 Edward Byrne Memorial Justice
Assistance Grant program, which is being administered by the
Governor's Criminal Justice Division through the Southeast Texas
Regional Planning Commission.
RECOMMENDATION
Administration recommends approval.
BACKGROUND
The City of Beaumont has been awarded funding through the Edward Byrne Memorial Justice
Assistance Grant program during the past three years. The funding has been used to upgrade
technology through the purchase of computer hardware and software, purchase additional officer
safety equipment and to fund several community programs.
The Southeast Texas Regional Planning Commission recently notified the City that additional
funding in the amount of $10,000 is available through the Program.
BUDGETARY IMPACT
No match is required.
RESOLUTION NO.
WHEREAS, The City of Beaumont finds it in the best interests of the citizens of
Beaumont that the Justice Assistance Grant be operated for the period of October 1, 2009,
through September 30, 2010; and
WHEREAS, The City of Beaumont agrees that, in the event of loss or misuse of the
Criminal Justice Division funds, the City of Beaumont assures that the funds will be
returned to the Criminal Justice Division in full; and
WHEREAS, The City of Beaumont designates Mayor Becky Ames as the grantee's
authorized official and the authorized official is given the power to apply for, accept, reject,
alter, or terminate the grant on behalf of the applicant agency.

REQUESTED ACTION: City Council authorize the City Manager to submit an
application and accept a grant to provide funding for
improvements at the Beaumont Municipal Airport.
RECOMMENDATION
Administration recommends authorizing the City Manager to submit an application and to accept
a grant from the Texas Department of Transportation (TxDOT) for the purchase of an Automated
Weather Observation System (AWOS) to be installed at the Beaumont Municipal Airport located
at 455 Keith Road.
BACKGROUND
An AWOS is a collection of sensors that measure and broadcast weather data to help pilots
monitor weather forecasts, plan flight routes, and execute correct takeoffs and landings. The
sensors measure weather parameters such as wind speed and direction, temperature and dew
point, visibility, cloud heights and types, precipitation, and barometric pressure. AWOS units
provide minute -to -minute updates to pilots by VHF radio or nondirectional beacon. Installation
of an AWOS was recommended in the recently completed Airport Development Planning Study.
The Beaumont Municipal Airport is eligible for federal grant funds through a program
administered by the TxDOT Aviation Division. The City is eligible to apply for grant funds for
the installation of the AWOS system. The estimated cost of the system is $85,000 with the City's
match being 25%, or $21,250. The City has applied for and received similar grants in the past
that have helped fund major improvements at the Airport.
BUDGETARY IMPACT
Funds for the City's share of this project will be available in the Municipal Airport Fund.

RECOMMENDATION
Administration recommends Council authorize the City Manager to execute an agreement with
Workforce Solutions Southeast Texas/Power Zone -Beaumont and Family Services of Southeast
Texas to provide the City of Beaumont with temporary summer workers for various City
Departments.
BACKGROUND
Workforce Solutions Southeast Texas/Power Zone -Beaumont has secured a grant through the
Workforce Investment Act of 1998 (WIA Adult, Dislocated, and Youth) and/or the Temporary
Assistance for Needy Families (TANF) program to pay wages for temporary workers during the
summer. This program will consist of summer workers, who will be referred by Workforce
Solutions Southeast Texas/Power Zone -Beaumont to the Worksite Employer. The Worksite
Employer will be responsible for providing meaningful work with adequate guidance and
supervision. All temporary workers must register with Workforce Solutions Southeast
Texas/Power Zone -Beaumont. City departments have identified the need for approximately 32
temporary summer workers. The program ends no later than September 30, 2009, unless
otherwise noted. This program will serve as another recruiting source for full-time employees
for the City.

Work Activity Agreement
This Agreement is entered into by and between the Workforce Solutions Southeast Texas/Power Zone -Beaumont
and Family Services of Southeast Texas, hereinafter referred to as the Worksite. This Agreement is solely
between Workforce Solutions Southeast Texas/Power Zone -Beaumont and the Worksite. Workforce Solutions
Southeast Texas, Texas Workforce Commission and the Department of Labor are not parties to this Agreement.
The Agreement must be completed and approved prior to ' the placement of a participant for a work activity
position. The Worksite must comply with applicable, federal, state and labor laws and regulations.
Workforce Solutions Southeast Texas/Power Zone -Beaumont will administer this Work Activity with funds
provided through the Workforce Investment Act of 1998 (WIA Adult, Dislocated, and Youth), and/or the
Temporary Assistance for Needy Families (TANF) programs.
This Agreement is to provide work activities for participants by the Worksite. A description of duties to be

This Agreement is for the period beginning on and ending on

• Provide meaningful work experience and adequate supervision at all times;
• Provide safe working conditions;
• Assure that the placement of the participant on the worksite does not result in the displacement of any
currently employed worker (including partial displacement such as reduction in the hours of non -overtime
work, wages, or employment benefits);
• Insure that the work of participants is performed within the Child Labor Laws if participants are under the
age of 18;
• Promptly report to the Workforce Solutions Southeast Texas/Power Zone -Beaumont any injuries
sustained by participants while on the worksite;

• Maintain appropriate records; submit time sheets and other pertinent information as necessary;
• Cooperate fully with the Workforce Solutions Southeast Texas/Power Zone -Beaumont Representative
assigned to the Worksite in respect to resolve any conflicts that may arise;
• Assure that all work performed by participants is within the scope of their written training outline;
• Assure that participants will not be paid for any holidays, sick leave, or time off, or for time not worked;
• Assure that sufficient work is available to occupy the participants during work hours;
• Assure that the worksite will have sufficient equipment and/or materials to do the job;
• Notify the Workforce Solutions Southeast Texas/Power Zone -Beaumont immediately if the Worksite no
longer desires to work with a client;
• Assure that each participant must sign their time sheets;
• Assure that each participant will receive at least one break daily for a six (6) hour day;
• Comply fully with the Nondiscrimination and Equal Opportunity provisions of the Workforce Investment
Act (WIA) of 1998, the Nontraditional Employment for Women Act of 1991; the Disabilities Act of
1990; Title VI of the Civil Rights Act of 1964, as amended; Section 504 of the Rehabilitation Act of
1973, as amended; the Drug -Free Workplace Act of 1998 and with all applicable requirements imposed
by or pursuant to regulations implementing those laws;
• Assures that the business, branch, division or department of the business does not and will not knowingly
employ an undocumented worker as defined in Texas Government Code, 2264.001(4), and
• Provide each supervisor involved with the Work Experience program with a copy of this agreement and
all applicable attachments.
H. Workforce Solutions Southeast Texas/Power Zone -Beaumont agrees to:
• Process employees time sheets for payment (if applicable);
• Prepare and issue checks for participants (if applicable);
• Ensure Workmen's Compensation Insurance is provided to participants;
• Provide necessary technical assistance to insure compliance with this agreement;
• Provide counseling and other related services on an as needed basis to participants; and
Place and/or remove employees from the Worksite upon consultation with the Worksite Supervisor.
III. This agreement can be terminated for any of the following reasons:
• A 30 day written request by either the Workforce Solutions Southeast Texas/Power Zone -Beaumont or
the Worksite Representative;
• Failure to comply with the terms of this agreement by either party;
Failure to take corrective action; or
Unsafe or unsanitary working conditions.
By signing this agreement, I attest that I am an authorized official representing my respective party and
will abide by the terms of this agreement.

BACKGROUND
Redwood Development, LP, through its owner Taheruddin M. Quraishi, has agreed to convey
an exclusive ten (10) foot wide water line easement to the City of Beaumont. The easement is
located off Dowlen Road and will provide mandatory access for fire protection services for the
Dowlen Court Subdivision. It would also allow for the construction, alteration, operation and
maintenance of the said water line and appurtenances:

BACKGROUND
As part of the development of the Downtown Event Center and Park, lots are being acquired
in downtown Beaumont in the area bordered by Martin Luther King Jr. Parkway, Crockett
Street, Neches Street and an abandoned rail line. Owners of the properties listed below, have
agreed to convey their properties to the City:

BACKGROUND
Taher Quaishi has applied for a zone change.
Taher Quaishi has applied for a zone change from RS (Residential Single Family Dwelling) District
to GC -MD -2 (General Commercial -Multiple Family Dwelling -2) District. The property is located
at 2345 Wellington Place. Mr. Quaishi states builders do not want to construct homes next to GC -
MD -2 zoning.
In 1997, the subject property was rezoned from RS and RM -H (Residential Multiple Family -High
Density) District to NC (Neighborhood Commercial) District. In 2003, City Council denied a zone
change to GC -MD -2 and a specific use permit to allow over 21,000 sq. ft. of office and retail on 2.1
acres that included a portion of the subject property. In 2004, the property was rezoned to RS and
GC -MD -2. The RS portion of the property fronts on Wellington Place and the GC -MD -2 portion
fronts on Dowlen. In that same year, a specific use permit was approved for approximately 18,000
sq. ft. of office space within the GC -MD -2 portion.
It is now the desire of Mr. Quraisha to rezone that 1.93 acres that fronts on Wellington Place to GC -
MD -2. Past concerns over commercial development backing up to Wellington Place include
additional traffic on Wellington Place and flooding.
At this time, Mr. Quraisha has no definite plans for the subject property.
At a Joint Public Hearing held May 18, 2009, the Planning Commission recommended denial 7:0
of a zone change from RS (Residential Single Family Dwelling) District to GC -MD -2 (General
Commercial -Multiple Family Dwelling) District at 2345 Wellington Place.

BACKGROUND
Nga Duong has applied for a zone change and specific use permit.
Mr. Duong owns an existing commercial building at 2916 E. Lucas at Idlewood. Mr. Duong
received a zone change to GC -MD -2 in 2006 to allow the development of the commercial
building. He would like to construct another commercial building that would include a
convenience store, gas pumps and miscellaneous retail. The commercial property would also
include a self-service car wash. This property fronts on E. Lucas. He would also like to develop
apartments with frontage on Abilene north of the commercial property.
The total amount of property included in this request is 4.25 acres. The GC -MD -2 portion
includes 0.24 acres and the remaining 4.01 acres are being requested for RM -H. Phase One of
the development includes the commercial building and approximately 2 acres of apartments (see
site plan). The remaining 2 acres of RM -H zoning would be held for later phases of apartment
development.

Serafin Jaimes has applied for a specific use permit to allow a tire shop in an RCR (Residential
Conservation and Revitalization) District.
Mr. Jaimes currently leases the site where he presently operates a tire shop. He would like to
relocate his business to Concord. Mr. Jaimes states that he will sell new and used tires and do
tire repair. The business will be located in a new 1,750 sq. ft. building with related parking and
will be open 7 a.m. to 5 p.m., Monday - Saturday and closed Sundays. The property will be
surrounded by an 8' tall wood screening fence and a 10' wide landscape strip.

BACKGROUND
Jack Burklund, representing Verizon Wireless, has applied for a specific use permit.
Verizon Wireless would like to lease a 75'x 75' site from Beaumont Tractor. The lease site will be
enclosed by an 8' high chain link fence. Within the lease space will be the 160' tall monopole tower
and a 12'x 28' prefab aggregate stone building to house the electronic switching equipment and
backup generator. The lease site will be at the rear of the Beaumont Tractor property.
At a Joint Public Hearing held May 18, 2009, the Planning Commission recommended approval
6:0:1 of a specific use permit to allow a cellular tower in a GC -MD (General Commercial -
Multiple Family Dwelling) District at 4430 College Street.

DISTRICT AT 4430 COLLEGE STREET, IN THE CITY OF
BEAUMONT, JEFFERSON COUNTY, TEXAS.
WHEREAS, the City Council for the City of Beaumont desires to issue a specific use
permit to Verizon Wireless to allow a cellular tower in a GC -MD (General Commercial -
Multiple Family Dwelling) District at 4430 College Street, as described in Exhibit "A" and
shown on Exhibit "B" attached hereto; and,
WHEREAS, the City Council is of the opinion that the issuance of such specific use
permit is in the best interest of the City of Beaumont and its citizens;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That a specific use permit to allow a cellular tower in a GC -MD (General
Commercial -Multiple Family Dwelling) District at 4430 College Street, as described in
Exhibit "A" and shown on Exhibit "B" attached hereto and made a part hereof for all
purposes, is hereby granted to Verizon Wireless, its legal representatives, successors and
assigns.
Section 2.
That the specific use permit herein granted is expressly issued for and in
accordance with each particular and detail of the site plan attached hereto as Exhibit "C"
and made a part hereof for all purposes.
Section 3.
Notwithstanding the site plan attached hereto, the use of the property herein above
described shall be in all other respects subject to all of the applicable regulations contained
in Chapter 30 of the Code of Ordinances of Beaumont, Texas, as amended, as well as
comply with any and all federal, state and local statutes, regulations or ordinances which
may apply.

RECOMMENDATION
Administration recommends Council authorize the City Manager to amend the Interlocal
Agreement with Jefferson County Drainage District No. 6 for the Cartwright/Corley Relief
Project.
BACKGROUND
In May 2006, City Council approved an Interlocal Agreement with Drainage District No. 6 for
the Cartwright/Corley Relief Project. This project includes the construction of several
detention facilities near 11"' and Cartwright and improvements to the underground drainage
systems on Corley and Blanchette Streets. The District was awarded a Flood Mitigation
Assistance (FMA) Grant from FEMA for 75 % of the project costs. The estimated cost of the
Project is $4,750,000.
The District had requested City participation in the project by performing the following work:
Construct underground culverts, with inlets, in the Corley Street right-of-way
from 4`'' Street to the Santa Fe Railroad,
Enlarge the culverts under I Ith Street in the Cartwright Street right-of-way.
Enlarge the culvert under Corley Street at the intersection of 12`' Street.
Currently, the City is assisting the District in the installation of the culverts under 11`h Street at
Blanchette. The District is requesting that the City amend the previously approved agreement and
each party now perform the following work:
The District will be responsible for preparation of engineering plans and
specifications for the project.
• The District will construct underground culverts with inlets in the Blanchette
Street right-of-way from 9" Street to west of 11th Street.
• The City will resurface Blanchette with asphalt, relocate all City utilities and
construct the concrete catch basin on the east side of 11' Street. The District will
repair I I" Street, construct the concrete catch basin on the west side of 11 "' Street
and provide all the materials for both catch basins.
• The City will construct underground culverts with inlets in the Corley Street right-
of-way from 4t' Street to the Santa Fe Railroad, repair the concrete street and
relocate any City utilities.
• The District will prepare the engineering plans and specifications for the
Cartwright/Corley Project.
• The City will be responsible for the solicitation and award of bids on the
Cartwright/Corley Project, construction inspection and payments to the contractor.
Any work perform by the City or the City's contractor on the Blanchette or
Cartwright/Corley Projects will be reimbursed under the grant. The City will be
reimbursed for 75% of the construction costs as long as grant funds are available.
The estimated cost to the City to perform the aforementioned work is $1.25 million. In exchange
for the work to be performed by the City, the DD#6 has conveyed a portion of property to the
City for the Phelan Boulevard Widening Project in the vicinity of the Gulf Terrace Detention
Basin.
A copy of the agreement, in substantial form, is enclosed.
BUDGETARY IMPACT
Funds for the City's share of the project are available in the Capital Program.

BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BEAUMONT:
THAT the City Manager be and he is hereby authorized to execute an Amendment to the
Interlocal Agreement with Jefferson County Drainage District No. 6 for the
Cartwright/Corley Relief Project. The amendment is substantially in the form attached
hereto as Exhibit "A" and made a part hereof for all purposes.

COUNTY OF JEFFERSON
This contract is made by and between the City of Beaumont, a home rule City of the State of
Texas (hereinafter called "City") and Jefferson County Drainage District No. 6, a special district
of the State of Texas (hereinafter called "District") under authority of the Interlocal Cooperation
Act, Chapter 791 of the Texas Government Code.
The City and the District agree as follows:
WITNESSETH
The City and the District have agreed to construct regional detention ponds and underground
drainage improvements on Ditch 100D or the Cartwright/Corley Relief Project and have
further agreed to share the cost of this project on the following basis:
1. The District will be responsible for preparation of engineering plans and
specifications for the project.
2. The District will construct underground culverts with inlets, in the
Blanchette Street right-of-way from 9th to west of 11th Street.
3. The City will resurface Blanchette with asphalt, relocate all City utilities
and construct the concrete catch basin on the east side of 11th Street. The
District will repair 11 "' Street, construct the concrete catch basin on the
west side of 11th Street and provide all the materials for both catch
basins.
4. The City will construct underground culverts with inlets in the Corley
Street right-of-way from 4th Street to the Santa Fe Railroad, repair the

contractor. Any work performed by the City or the City's contractor on

the grant. The City will be reimbursed for 75% of the construction costs,
as long as grant funds are available.
6. Any expenses that are submitted by the City of Beaumont and are
reimbursed by Texas Water Development Board (TWDB), that are, later
deemed to be non -reimbursable by an audit of the funds, will be the sole
responsibility of the City of Beaumont for the Corley -Cartwright Street
Contractor work.
7. Any contracts let by the City of Beaumont related to this grant will name
the District as additionally insured and the Contractor(s) will be required
to indemnify and hold harmless the District.
8. The District will be shown as an additional named insured on the Acord
Certificate of Insurance with waiver of subrogation provided as to the
District.
9. The District will be responsible for grant administration of the Flood
Mitigation Assistance (FMA) Grant. This will include analyzing
requests from City of Beaumont for Corley -Cartwright Contractor(s) and
include this work in quarterly reports. A copy of all certified payroll
information and sub contract(s) will be provided to the District by the
City or the City's Contractor.
10. The District has completed all necessary Environmental Assessment
documents. The City of Beaumont will be responsible for any necessary
permitting and published notifications of road closures for the Blanchette
and Corley Cartwright Streets, including any intersecting or cross roads.
11. Upon receipt of reimbursement from TWDB, the District will reimburse
the City of Beaumont 75% of actual qualifying expenses for
Cartwright/Corley, streets, culverts and inlets, as long as all backup
material has been provided, within 5-10 days of receipt of funds.
12. All work must be completed prior to expiration of grant which is
September 18, 2009. An extension will be requested, if needed to extend
completion date (if approved by FEMA) to September 18, 2010.

Manager to execute a contract for the Sanitary Sewer
Rehabilitation of Small Diameter Mains Contract -XV.
RECOMMENDATION
Administration recommends approval of a contract with Horseshoe Construction, Inc. La Porte,
Texas, in the amount of $348,062.75 to rehabilitate approximately 2,105 linear feet of 6 -inch and
5,538 linear feet of 8 -inch sanitary sewer lines, to furnish and install approximately four manholes,
to stabilize approximately eight vertical feet of existing manhole, to remove and replace
approximately 13 manholes, abandon two manholes, furnish and install approximately eight end of
line clean outs, to replace approximately 170 short side service line connections, and clean and
televise 7,643 linear feet of existing and newly burst sanitary sewer lines in the South Park area.
The project will rehabilitate Chaison, Ector, Fonville, and Ogden Avenue, and Park Street
between Pipkin and Virginia Street.
The MBE participation will be with Chief Solutions, Inc. for $25,000, Deanie Hayes, Inc. for
$25,000, and Vila Trucking for $20,000. The total amount of the subcontracts is for $70,000,
which represents 20.11 percent of the total bid.
BACKGROUND
The existing sewer lines built in the 1940's and 1950's have deteriorated and require major
rehabilitation. The primary goals ofthe project are to restore the integrity ofthe sanitary sewer lines,
restore the carrying capacity, provide customers with uninterrupted and adequate service and meet
the Sanitary Sewer Overflow Initiative agreement requirements with the state.
This Contract is recommended for approval by the City Manager and the Water Utilities Director.
BUDGETARY IMPACT
Funds for the project are available in the Capital Program.

RECOMMENDATION
The administration recommends approval of the purchase from Southwest International Trucks,
Inc., in the amount of $244,237.
BACKGROUND
Pricing for the vacuum truck is obtained through the BuyBoard Cooperative Purchasing Program.
BuyBoard is a cooperative purchasing association which provides cities and political subdivisions
with the means to purchase specialized equipment at volume pricing. BuyBoard complies with
State of Texas procurement statutes.
This vacuum truck will be used by the Streets and Drainage Division to maintain storm drain lines
and catch basins. This vacuum truck will be replacing unit 3270, which is a 1998 model with
134,000 miles. Unit 3270 will be disposed of according to the City's surplus equipment disposal
policy.
The basic warranty provided for the truck chassis is two (2) years with unlimited mileage.
Warranty service is available through local International Dealers. The basic warranty for the sewer
cleaner body is one (1) year parts and labor. Warranty service is available from Kinloch
Equipment & Supply, Inc., of Pasadena, Texas.
Delivery is estimated at one hundred twenty (120) days.
BUDGETARY IMPACT
Funds are budgeted in the Capital Reserve Fund.

REQUESTED ACTION: Council approval of a resolution authorizing the City

RECOMMENDATION
Administration recommends approval of a contract with Chief Solutions, Inc. of Houston, Texas,
in the amount of $201,620.00 to clean and televise 9,736 linear feet of 36 -inch and 229 linear feet
of 48 -inch sanitary sewer lines.
Chief Solutions, Inc. is a City of Beaumont approved MBE company. They will complete
approximately 75% ($151,620) of the project cost and subcontract with others the remaining
25%.
BACKGROUND
The line extends under Interstate 10 and then parallels the interstate from Kenwood to Laurel
Avenue. The line travels west just past 23rd Street and heads south to the 23rd Street lift station.
The line was originally installed in the mid 1980's. The project will allow City staff to evaluate the
integrity of the pipe, locate developing cavities, and remove settled solids in the pipe. A 20 linear
feet section of the line was recently rehabilitated by City forces to repair a large cavity.
This Contract is recommended for approval by the City Manager and the Water Utilities Director.
BUDGETARY IMPACT
Funds for the project are available in the Non -Operational Budget.

RECOMMENDATION
Administration recommends the award of a bid to H.B. Neild and Sons, Inc., of Beaumont in the
amount of $200,912.
BACKGROUND
Four (4) bids were received on Thursday, April 16, 2009 for the construction of an entrance gate
to Tyrrell Park. The entrance gate will be constructed using both new and existing materials
supporting the City's efforts to adhere to sustainable building practices when possible.
Components of the original entrance gate built in 1940 by the Civilian Conservation Corps
(CCC) are still in existence. These components will be reused to create a welcoming entrance to
Tyrrell Park.
The gate is locked at dusk and opened at dawn each day. The entry gate will provide information
concerning the park and the onsite activities such as golf, botanical gardens, playgrounds and
Cattail Marsh.
A metal archway is also planned at the entrance with die cast metal letters adhered to a bronze
metal arch identifying the park. The archway was designed to notify park patrons of their
entrance to the multi use park. Its design is indicative of national parks constructed by the CCC
in the 1930's and 1940's.
Attached are photographs of the entrance as it is now and architectural renderings of the
proposed entrance with and without the arch. If it is determined that an archway should not be
constructed, a change order, at a future council meeting, would reduce the bid by $25,000.
Included in the base bid is a contingency of $20,000 for additional work to repair the existing
stone elements should they require more rehabilitation than originally planned. If they can be
moved without further damage, the contingency will be credited to the project cost.

The Administration recommends the award of a contract to Simpleview, Inc., of Tucson, Arizona
in the amount of $103,385.
BACKGROUND
The CVB maintains an interactive website designed to facilitate the bureau's mission to market
Beaumont as a travel destination for groups and individuals from around the world. The existing
CVB website was originally launched in 2003. The website has received some minor upgrades
and additions to the original tools and modules. The redesigned, state-of-the-art website will
apply proven strategies to engage visitors, build traffic and cultivate a loyal online community.
The Request for Proposals (RFP) were sent to four (4) potential responders and posted on the
City website. Twenty-nine (29) responses were received. All responses were evaluated with the
criteria provided in the RFP. After the initial evaluation, the two (2) highest ranking respondents
were invited to meet with City representatives to further review and discuss their proposals. The
respondents were Simpleview, Inc., and Miles Media. These respondents were allowed to
provide a best and final offer, for which a single response was received from Simpleview, Inc.

BACKGROUND
Contract pricing for this generator is obtained through the Houston -Galveston Area Council.
H -GAC is a cooperative purchasing association providing cities and political subdivisions with the
means to purchase specialized equipment at volume pricing. H -GAC complies with State of
Texas procurement statues. There is no administrative fee associated with this purchase.
The City owns and operates seventy-eight (78) sanitary sewer lift stations. The trailer -mounted
Kohler Power Systems DC 17 generator is portable and will be transported to various sanitary lift
stations in the event of extended power outages. This generator will be used, in conjunction with
three (3) existing generators, to provide service to the community.
Warranty service will be provided by Loftin Power Systems. The standard warranty is one (1)
year. Delivery will be in four (4) months.

Administration recommends the award of an annual contract with Beaumont Products and
Services, Inc., (BPS) for furnishing litter removal service on arterial street rights-of-way and other
specific areas at a rate of $14.08 per person, per hour worked. The contract will be effective
July 24, 2009.
BACKGROUND
BPS is defined as a private not-for-profit State Certified Workshop. State Certified Workshops
encourage and assist disabled persons to achieve maximum personal independence by engaging in
useful and productive activities. Job programs are designed for disabled individuals and marketed
throughout the community. The State exempts political subdivisions from competitive bidding
requirements when contracting with a certified workshop.
BPS has been furnishing biweekly litter removal services on specified arterial streets since 1987.
BPS provides a crew of four (4) collection personnel and one (1) supervisor/driver, five (5) days
per week, excluding City holidays. BPS will be paid $14.08 per hour, per person worked which
includes all labor, transportation, equipment, insurance, and litter disposal fees. An hourly rate
provides the City with the option of using the crews only when and where needed.
The requested rate per hour is a $1.00 increase from the previous contract. Minimum wage in the
State of Texas is scheduled to increase from $6.55 per hour to $7.25 per hour effective July, 24,
2009. The requested rate reflects that increase plus associated payroll costs.
During the past twelve months, BPS has worked approximately 1,869 labor hours, removing
about 1,527.47 cubic yards of litter, at an estimated cost of $121,874.

Funds are available in the Code Enforcement Division's operating budget.

On May 21, 2009 the City of Beaumont received eight (8) bids for the Calder Avenue Drainage
and Pavement Improvement Project (Phase II). The lowest bid was submitted by BRH-GARVER
Construction, L.P. in the amount of $24,616,416.25. The Engineer's estimate for the project
before receipt of bid was $32,000,000.00.
The official total bid amount is determined by the summation of the contract amount "A" and
the time element `B". The City uses the following formula to make the calculation:

of the approximate quantities shown in the proposal and the unit prices bid, and; The time

BACKGROUND
On February 17, 2009, President Obama signed the American Recovery and Reinvestment Act of
2009 (ARRA), providing federal funds through the Community Development Block Grant
program to help stimulate the economy. The City of Beaumont received $484,556, as part of this
stimulus package. CDBG-R funds may be used for, a) preserving and creating jobs and promoting
economic recovery; b) assisting those most impacted by the recession; c) providing investment
needed to increase economic efficiency; d) investing in transportation, environmental protection,
or other infrastructure that will provide long-term economic benefits; e) minimizing or avoiding
reductions in essential services; or f) fostering energy independence.
During the normal CDBG allocation process, the Community Development Advisory Committee
(CDAC) spends months reviewing applications for Public Services and Public Facilities funding.
However, ongoing instructions and time restrictions from HUD for the special CDBG-R program
has resulted in a significantly abbreviated review process. In an effort to include the CDAC in this
allocation process, the CDAC conducted a public hearing/workshop on May 22, 2009 to review
applications and make recommendations to City Council regarding the use of these funds.
Additionally, the Administration has reviewed the applications received in order to make
recommendations to City Council.
Please note that the recommendations from the Administration differ from that of the CDAC for
several reasons. First, of the $484,556 total allocation, ten percent will be used for administrative
costs and $75,500 will be used for infrastructure improvement associated Jehovah lireh Phase II-
B, affordable housing project. As a result, the amount to be considered for these applications
would be $360,601, not the full $484,556. Second, HUD is requiring that these funds be spent
within a six-month time period and is requiring that eighty-five percent of the funds are to be used
for Public Facilities Improvements and only fifteen percent can be used for Public Services. Public
Facilities Improvements include expenses for physical improvements to service provider's
facilities and Public Services funding is used for ongoing operating expenses and service delivery.
Because of these HUD -imposed restrictions of use and time, and because the Administration feels
that expenditures to improve and enhance the physical facilities of the applicants will allow for a
more immediate economic impact to local economy, while providing for the long-term
enhancement of the service provider's facilities, the Administration's recommendations are
different from that of the CDAC.
To that end, the Administration identified all Public Facility applications that were recommended
by the CDAC and attempted to match the awards as closely as possible. As a result, several of
the applications that would fall into the Public Services, or operating, category would not be
recommended for funding. Specifically, Casa of Southeast Texas, Child Abuse & Forensics, One
Church One Child and Our Mother of Mercy applied for Public Services or operating funding and
were therefor not recommended for funding. Also, Southeast Texas Electrical Apprenticeship
Academy and the YMCA of Beaumont submitted applications for both Public Services and Public
Facilities. Therefore, the Administration recommends a partial funding amount. Also, the
recommendations reflect that any residual funds be allocated to other Public Facilities projects,
such as those proposed by the Shorkey Center and the Women's Club of Beaumont.
The CDAC and Administration recommendations are attached for your consideration.
The City must submit a substantial amendment to it's 2008 CDBG Annual Action Plan to include
the activities proposed for the CDBG-R Funds on or before June 5, 2009.
BUDGETARY IMPACT
Funding is available from Community Development Block Grant Funds received through the
American Recovery and Reinvestment Act of 2009 (CDBG-R Funds).

RECOMMENDATION
Administration recommends City Council condemn these fifty-six (56) structures and order the owner
to raze within ten (10) days. Additionally, if the property owner of a structure requests and is
authorized by City Council to enroll in a work program, all delinquent taxes shall be paid in full or a
payment plan shall be established prior to enrollment in the work program. Enrollment in the work
program shall occur within ten days after the effective date of this ordinance.
BACKGROUND
These structures have been inspected by the Building Codes Division and found to be dangerous
structures as defined by the City of Beaumont's Code of Ordinances, Article III, Dangerous
Structures, Section 14-50. Additionally, these structures have deteriorated to a condition that they
are no longer considered suitable for repair.
BUDGETARY IMPACT
City may incur the cost of demolition.

Section 2.
In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont,
Section 14-52 of the Code of Ordinances of Beaumont, Texas, it is hereby ordered that
the owner or owners of the above-described buildings demolish and remove said structures
within ten (10) days of the effective date of this ordinance. If the property owner(s) fail(s)
to comply within ten (10) days, Council orders that the property be demolished without
further notification to the property owners or City Council action.
Section 3.
If a property owner requests and is authorized by City Council to enroll in a work
program, all properties are to be secured from unauthorized entry, and all delinquent taxes
shall be paid in full or a payment plan executed prior to the enrollment of the property in
the work program.
Section 4.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end the various portions and provisions of this ordinance are
declared to be severable.
Section 5.
That any person who violated any provision of this ordinance shall, upon conviction,
be punished as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.
