WHEREAS, an agreement has been negotiated for the acquisition of property
described below and in Exhibit "A" and shown on Exhibit "B," attached hereto:
Description: 3.2632 acre parcel of land in the 300
block of Neches Street described as
being part of the Noah Tevis League,
Abstract No. 52
Location: 300 block of Neches Street to its east with the
newly construction Magnolia Street to its west
Owner: Tidelands Specialty, Ltd.
Appraised Value: $462,000.00
Purchase Price: $400,000.00
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby, in
all things, approved and adopted; and,
THAT the purchase of the above described property in the amount of $400,000 be,
and the same is, hereby approved.

FOUR HUNDRED THOUSAND AND NO /100 ($400,000.00) DOLLARS and other good and
valuable consideration, to it in hand paid by the City of Beaumont, a municipal corporation,
domiciled in Jefferson County, Texas, hereinafter called GRANTEE, for the conveyance of the
hereinafter described property, the receipt and sufficiency of which is hereby acknowledged and
confessed, has GRANTED, SOLD and CONVEYED, subject to the reservations and exceptions
hereinafter made, and by these presents does GRANT, SELL and CONVEY unto the said CITY
OF BEAUMONT, 11. O. Box 3827, Beaumont, Texas 77704, and to its successors and assigns
forever the property described in Exhibit "A & B ", attached hereto and made a part hereof for
all purposes.
GRANTOR does hereby except and reserve from this conveyance unto herself, her
successors and assigns, forever, all of the oil, gas, and sulphur in and under the land herein
conveyed but waives all rights of ingress and egress to the surface thereof for the purpose of
exploring, developing, mining or drilling for same.
This conveyance is expressly made subject to all zoning laws and to restrictions,
covenants, conditions, easements and mineral and /or royalty reservations, if any, effecting the
property. TO HAVE AND TO HOLD the above described premises together with all and

singular the rights and appurtenances thereto and in any wise belonging, unto the said
GRANTEE and GRANTEE'S successors and assigns, forever; and said GRANTOR binds
herself acid her successors and assigns to warrant and forever defend all and singular the said
premises unto the said GRANTEE and GRANTEE'S successors or assigns, against every person
lawfully claiming or to claim all or any part of the property, subject to the provisions stated
above, when the claim is by, through, or under GRANTOR but not otherwise.

EXHIBIT 'A'
BEING a 3.2614 acre tract: of land out of and a part of that certain Tideland Specialty, Ltd. called 11.4488
acre tract of land, more fully described and recorded in Clerk's File No. 2002046131 of the Official Public
Records of Jefferson County, Texas. Said 3.2614 acre tract of land being situated in the Noah Tevis
League, Abstract No. 52, Jefferson County, Texas and being more particularly described as follows:
BEGINNING at a 5/8 inch iron rod with cap stamped "WORTECH SURVEYORS" set in a South line and at
an interior Angle corner of said 11.4488 acre tract, same being the North line of that certain City of
Beaumont tract (Fractional Block 29), recorded in Clerks File No. 2008007014 of said Official Public
Records. Said Fractional Block 29 being a part of the Van Wormer Addition, recorded in Volume 1, Page
16 of the Map Records of said Jefferson County;
THENCE South 55 deg. 24 min. 19 sec. West along and with a South line of said 11.4477 acre tract, same
being the North line of said Fractional Block 29, a distance of 188.87 feet to a 5/8 inch iron rod with cap
stamped "WORTECH SURVEYORS" set at the Southeast corner of that certain City of Beaumont called
0.456 acre tract of land, more fully described as Parcel "E" recorded in Clerks File No. 2009034437 of
said Official Public Records and being at the beginning of a non -tangent curve to the right;
THENCE in a Northerly direction along and with the East line of said 0.456 acre tract and non -tangent
curve to the right, having a delta angle of 41 deg. 18 min. 54 sec., a radius of 385.00 feet, a chord
bearing of North 08 deg. 26 min. 32 sec. West, a chord distance of 271.64 feet and an arc length of
277.62 feet to a 5/8 inch iron rod with cap stamped "WORTECH SURVEYORS" found at the Northeast
corner of said 0.456 acre tract, same being the Southeast corner of that certain City of Beaumont called
0.264 acre tract of land, more fully described as Parcel "B" recorded in Clerks File No. 2009044503 of
said Official Public Records, same being the Southwest corner of that certain City of Beaumont called
0.694 acre tract of land, more fully described as Parcel "I" recorded in Clerks File No. 2011032229 of said
Official Public Records and being in a North line of said 11,4488 acre tract;
THENCE North 69 deg. 07 min. 36 sec. East along and with a North line of said 11.448 acre tract, same
being the South line of said 0.694 acre tract, that certain WRDR Family Partners -II, Ltd. called 0.69 acre
tract of land, more fully described and recorded in Clerks File No. 9440894 of said Official Public Records
and that certain Wayne A Reaud called 0.055 acre tract of land, more fully described as Tract No. 2
recorded in Film Code No. 102-72-1458 of said Official Public Records, a distance of 542.35 feet to a 5/8
inch iron rod with cap stamped "Whiteley 3636" found at the Northeast corner of said 11.4488 acre
tract, same being the Southeast corner of said 0.055 acre tract and being in the West line of Neches
Street (61.11 feet wide right-of-way);
THENCE South 40 deg. 48 min. 08 sec. East along and with an East line of said 11.4488 acre tract, same
being the West line of said Neches Street, a distance of 169.56 feet to a 5/8 inch iron rod with cap
stamped "Whiteley 3636" found for corner at the beginning of a curve to the left;
THENCE in a Southeasterly direction continuing along and with an East line of said 11.4488 acre tract,
same being the West line of said Neches Street and curve to the left, having a delta angle of 03 deg. 15
min. 12 sec., a radius of 1030.00 feet, a chord bearing of South 42 deg. 24 min. 40 sec. East, a chord
distance of 58.48 feet and an arc length of 58.48 feet to a 5/8 inch iron rod with cap stamped "Whiteley
3636" found for corner;
THENCE South 44 deg. 02 min. 22 sec. East continuing along and with an East line of said 11,4488 acre
tract, same being the West line of said Neches Street, a distance of 6.72 feet to a 5/8 inch iron rod with
cap stamped "Whiteley 3636" found at the Southeast corner of said 11.4488 acre tract, same being the
Northeast corner of Block 27 of said Van Wormer Addition;
