The City Council of the City of Beaumont, Texas, met in a regular session on January 12, 2010,
at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider

Mayor Ames called the council meeting to order at 1:30 p.m.
Pastor "Big Jim" Salles of West End Baptist Church gave the invocation. Mayor Ames led the
Pledge of Allegiance. Roll call was made by Stephanie Gandy, Deputy City Clerk.
Present at the meeting were Mayor Ames, Councilmembers Coleman, Beaulieu, Pate, Samuel
and Smith. Absent: Mayor Pro Tem Wright and Tina Broussard, City Clerk. Also present were
Kyle Hayes, City Manager; Tyrone Cooper, City Attorney; Stephanie Gandy, Deputy City Clerk.
Mayor Pro Tern Wright was absent due to her husband being ill.

1. Consider a request for a zone change from RS(Residential Single Family Dwelling)District
to GC-MD (General Commercial-Multiple Family Dwelling) District at 2415 and 2435
Delaware.
Administration recommended approval of the zone change.
Mr. Makdsi would like to build a strip shopping center on the subject property. He states
that the shopping center would cater to small retail and/or office clients.
At a Joint Public Hearing held December 21, 2009, the Planning Commission
recommended 7:0 to approve a zone change from RS to GC-MD at 2415 and 2435
Delaware.

2. Consider a request for a specific use permit to allow the expansion of a cemetery at 3965
Scranton.
Administration recommended approval of the specific use permit.
Community Cemeteries, Inc., has applied for a specific use permit.
In June, 2001, City Council approved an expansion of Greenlawn Cemetery. That property
is located east and west of Scranton and south of Gill. This latest expansion incorporates
0.193 acres immediately south of the previous expansion.
No buildings or other structures are proposed for this site.

Administration recommended denial of the zone change and specific use permit.
Troy Booker has applied for a zone change and specific use permit.
This rezoning could be considered spot zoning. Spot zoning connotes an unacceptable
zone change that singles out a single tract for treatment that differs from that accorded
similar surrounding land without proof of changes and conditions.

of Pinchback Road
Administration recommended approval subject to the following conditions:
1. The driveway layout shall be approved by the Transportation Engineer
2. An 8'tall wood screening fence shall be constructed along the south property
line, stopping a minimum of 16'from the edge of the street shall be required
until such time that Mr. Dishman acquires the property to the south.
and with a modification of the landscaping requirement along the south property line (no
10' wide landscape strip).
Fittz & Shipman, Inc., representing Austin Dishman, has applied for a zone change and
specific use permit.
In October, 2009, City Council approved a zone change and a specific use permit to allow
a self-storage warehouse facility on 13 acres north and west of the subject property.
Driveways, as shown on the original site plan,will not be allowed because of their proximity
to railroad quiet zones. In train quiet zones, federal regulations prohibit driveways
accessing commercial properties because they are considered to be intersections.
Therefore, the developer has to provide an alternative if he is going to provide access to
his mini-warehouse facility. Underthe current proposal, Mr. Dishman is leasing a 0.32 acre
tract of land from DD#6 and would move the proposed driveway outside either railroad
quiet zone.

Administration recommended approval of the specific use permit, subject to a modification
to the landscaping/screening requirements along the south and west property lines (6'tall
chain link fence along the south and west sides and no additional trees within the 10'wide
landscape strip).
The Knights of Peter Claver#28 have applied for a specific use permit.
Blessed Sacrament Council #28 Knights of Peter Claver is a social organization. The
group currently has no meeting place of its own. They would like to use the existing
commercial structure as a meeting place. The facility would be used monthly for scheduled
meetings and on special occasions (not open to the public).

Rob Clark, representing Beaumont Independent School District, has applied forthe specific

The bus parking and fueling facility will be located behind the school district's existing
administration annex building on Woodrow.

8. Consider authorizing the City Manager to apply for and receive funding from FEMA's
Severe Repetitive Loss Grant Program
Administration recommended approval.
Recently, City Council considered whether or not to apply for funds from the Severe
Repetitive Loss (SRL) Flood Buyout Program. The advantages of providing relief to
homeowner's with recurring flooding was weighed against the disadvantages of having
permanently vacant lots within various neighborhoods. As any buyout program is
voluntary, a survey was sent out to all of the owners on the SRL list to determine the level
of interest in a buyout program, with a majority of the respondents possibly interested.
Following this, each resident was further evaluated for eligibility, according to FEMA
guidelines, and each eligible applicant was contacted. The result found that the following
properties met the cost-benefit analysis and would be included in the application:

If approved, the grant will cover ninety(90) percent of the costs to administer the program,
survey, abate and demolish the structures and relocate tenants. This cost is estimated to
be $2,494,552, with the remaining ten (10) percent ($249,455.20) paid from the proceeds
of the sale of the property under this grant. The City contribution will be limited to $5,000
paid to Jeff Ward and Associates to prepare and administer the application and program,
if awarded.
The application and administration fee would be paid from the General Fund. Funds for
the program would be available through this grant,with no required local match by the City

BE AND HE IS HEREBY AUTHORIZED TO APPLY FOR AND RECEIVE FUNDS IN AN AMOUNT UP TO
$2,494,552 THROUGH THE FEDERAL EMERGENCY MANAGEMENT AGENCY (FEMA) SEVERE
REPETITIVE LOSS GRANT PROGRAM TO PROVIDE RELIEF TO HOMEOWNER'S WITH RECURRING

9. Consider authorizing the City Manager to execute a contract for the Sanitary Sewer
Rehabilitation of Small Diameter Mains Contract-XVII
Administration recommended approval of a contract with Horseshoe Construction, Inc. La
Porte, Texas, in the amount of$788,933.00 to rehabilitate approximately 7,327 linearfeet
of 6-inch, 11,627 linear feet of 8-inch, 1,151 linear feet of 10-inch, and 1,578 linear feet of
12-inch sanitary sewer lines,to stabilize approximately 10 vertical feet of existing manhole,
to furnish and install approximately eight manholes, to remove and replace approximately
48 manholes, to abandon one manhole in place, to furnish and install five end of line
cleanouts, to replace approximately 261 short side and 92 long side service line
connections, clean and televise 21,683 linear feet of existing and newly burst sanitary
sewer lines and televise approximately 353 existing sanitary sewer service lines. The
project is split between two areas. The first area is located between College Street and
Washington Boulevard on Chamberlin and Lindbergh Drives. The second area is located
East of Martin Luther King Parkway and West of Sycamore Street between Stanton Street
and Kansas City Southern Railroad. The project was designed by City Staff and the
Engineer's estimate for the project was $1.1 million.
The MBE participation will be with Chief Solutions, Inc. for$44,000, Deanie Hayes, Inc.for
$92,300, and Vila Trucking for $30,000. The total amount of the subcontracts is for
$166,300.00, which represents 21.08 percent of the total bid.

The existing sewer lines built in the1940's and 1950's have deteriorated and require major
rehabilitation.
This Contract is recommended for approval by the City Manager and the Water Utilities
Director.
Funds for the project are available in the Capital Program.
