E . X . A . S City Council Agenda Item TO: City Council FROM: Kyle Hayes, City Manager MEETING DATE: January 12, 2010 REQUESTED ACTION: Consider a one-year renewal contract with Carolyn C. Chaney& Associates, Inc. to act as the City of Beaumont's Washington Assistant. RECOMMENDATION The Administration recommends approval of a one-year renewal contract with Carolyn C. Chaney& Associates, Inc. in the amount of$61,488.00. The contract will also include a maximum of$4,000 for reimbursable expenses. BACKGROUND: On a yearly basis since 1980, the City has contracted with an organization to provide legislative services on the federal level. Ms. Chaney, as the City Washington Assistant, is responsible for reviewing federal executive proposals, legislation under consideration and proposed and adopted administrative rules and regulations which could impact the City of Beaumont's policies or programs. A letter from Mrs. Chaney and the proposed contract are attached for your review. BUDGETARY IMPACT Funds are budgeted for this expenditure in the FY2010 Budget. We expect 2010 to be another busy year in Washington, particularly as Congress and the Obama Administration a ion look to address the issue of similar In unemployment.to p y s filar fashion to the economic stimulus bill that was being crafted one year ago, it is our intention to continue to advocate that federal programs that provide direct assistance to local governments such as Beaumont are best suited to stimulating the economy and creating long-term job opportunities. And if a jobs bill is enacted, we will provide the City with timely tools and information necessary to take advantage of the opportunities. In addition, Congress is expected to continue its consideration of a multi-year reauthorization of federal surface transportation programs next year. We will look to influence policies that would bypass the layers of bureaucracy on the state level and direct an increasing percentage of federal funds directly to local and regional entities such as the metropolitan planning organizations. As our recent visit to the City can attest, there are exciting things going on in Beaumont—particularly downtown Beaumont -- and we are grateful for the opportunity to assist in any way we can with those efforts. Chaney Washington,1212 New York Ave., NW Suite 250 000 202.842.4930 202.842.5051 fax www.capitaledge.com AGREEMENT BETWEEN THE CITY OF BEAUMONT, TEXAS AND CAPITALEDGE ADVOCACY, LLC 1212 NEW YORK AVENUE, NW- SUITE.250 WASHINGTON, D.C. 20005-3953 Pursuant to this agreement, the City of Beaumont, Texas (hereinafter sometimes referred to as the "City") and CapitalEdge Advocacy, LLC (hereinafter sometimes referred to as "Consultant") agree to assume the following obligations. I. Obligations of Consultant A. Consultant will organize and operate a unit to act as a Washington office for the City and will be the assigned member of its staff. Consultant will be responsible for obtaining and furnishing requisite staff, office space,utilities,furnishings,and equipment, common-use office supplies and services, and general administrative support according to the level of service specified in Paragraph IV; B. Consultant will confer with the City Manager and such other City personnel as the City Manager may designate at the times and places mutually•agreed to by the City Manager on all organizational planning and program activities which have a bearing on the ability of the City to make the best use of federal aid programs; and will act as Washington Assistant to the City of Beaumont, Texas; C. As Washington Assistant the Consultant will review federal executive proposals, legislation under consideration,proposed and adopted administrative rules and regulations and other Washington developments for the purpose of advising the City of those items which may have a bearing on City policy or programs; D. More specifically, as Washington Assistant the Consultant will advise and consult on behalf of the City with the White House and any other Federal agencies, departments and commissions as may be necessary to the performance of full Washington service to the City Manager and the City. Additionally, the Consultant will act as liaison with the U.S. Conference of City Managers and the National League of Cities, and will furnish legislative and administrative analyses of issues as requested; E. As Washington Assistant the Consultant will secure and furnish such detailed information as may be available on federal programs in which the City indicates an interest; 1 F. As Washington Assistant the Consultant will review and comment on proposals of the City which are being prepared for submission to federal agencies when requested to do so by the City Manager or his designees; G. As Washington Assistant the Consultant will maintain liaison with the City's Congressional delegation and will assist the delegation in any matter which the City determines to be in its best interest in the same manner as any other member of the City's administrative staff might render assistance; H. As Washington Assistant the Consultant will counsel with the City regarding appearances by City personnel before Congressional committees and administrative agencies and will arrange for appointments and accommodations for City personnel as necessary; I. As Washington Assistant the Consultant will contact federal agencies on the City's behalf when City applications are under consideration by such agencies and counsel the City to take whatever steps appear to be required to obtain the most favorable consideration of such applications; J. As Washington Assistant the Consultant will advise and consult with or otherwise make assistance available to such representatives of the private sector who are engaged in economic development activities as determined by the City Manager to be in the best interests of the City; K. In fulfilling her responsibilities under this Agreement, the Washington Assistant will act in the name of the City of Beaumont, Texas under the supervision of the City Manager. Any change in the person of the Washington Assistant from the person representing the City as of the effective date of this agreement must be approved by the City Manager. 11 Obligations of the City of Beaumont, Texas A. To advise the Consultant of the name or names of persons other than the City Manager authorized to request service and the person or persons to be kept advised by the Washington Assistant; B. To supply the Consultant with a summary of all federal programs in which the City is participating and advise the Consultant of any new applications filed, together with pertinent details as to the substance of such applications; 2 C. To supply the Consultant with copies of budgets, planning documents, and regular reports of the City Manager and departments,Council agenda and proceedings,newspapers and other materials which will assist the Consultant in keeping current on City policies and programs; D. To reimburse the Consultant for(1)all travel expenses incurred pursuant to Paragraph I,Subparagraphs D and G; (2) expenses for attendance at any other meetings attended by the Washington Assistant outside Washington, DC, at the request of the City; E. To reimburse the Consultant for other expenses which are incurred within Washington, DC on behalf of the City in carrying out the provisions of this Agreement and as approved by the City Manager subject to the provisions of Paragraph IV; F. To bear long distance telephone, photocopying, executive expenses and postage expenses. III. The City of Beaumont, Texas and the Consultant concur that the following exclusions shall apply to this Agreement: z. The Consultant: 1. Will not represent commercial or industrial establishments of the City in pursuit of federal business except in accordance with the provisions of Paragraph I, Subparagraph J, above; 2. Will not, by virtue of this Agreement, represent other local government agencies in Beaumont, Texas except those which are instrumentalities or agencies of the City of Beaumont, Texas; 3. Will rot perform any legal, engineering, accounting or other similar professional service; 4. Will not directly or indirectly participate in or intervene in any political campaign on behalf of or in opposition to any candidate for public office in or representing the City. 3 IV. Compensation The cost of service will be $61,488.00 for twelve months,payable in advance,in equal monthly installments of$5,124.00 commencing on the first day of January, 2010. In addition, a maximum of $4,000.00 for reimbursable expenses incurred pursuant to Paragraph II, Subparagraphs D, E, and F. V. Termination Either party may terminate this Agreement at any time by giving the other at least sixty (60) days notice in writing of such termination. IN WITNESS WHEREOF: ATTEST DATE Carolyn (! RECOMMENDATION Administration recommends award of a three(3)year contract for plumbing services to All Star Plumbing of Beaumont, at the unit costs reflected in the attached bid tabulation, with an estimated total annual expenditure of$42,750. BACKGROUND The contract specifies that the successful bidder shall provide assorted plumbing services at fixed hourly rates and plumbing materials at a fixed percentage markup to maintain City plumbing systems. The contract term is three(3) years with annual percentage increases based on the Consumer Price Index for all Urban Consumers(GPI-U) Six (6)vendors were notified, with three (3) responding with bids as indicated on the attached Bid Tabulation. All Star Plumbing submitted the lowest bid and has held the plumbing services contract with the City for the past five(5)years. The previous contract prices are included on the Bid Tabulation for reference purposes. BUDGETARY IMPACT Funds are available for this expenditure in the Building Services Division's operating budget. RECOMMENDATION The Administration recommends acceptance of a Water Line Easement and a Sanitary Sewer Easement to provide water and sewer services for the new Amelia Elementary School located at 565 Major Drive. BACKGROUND Beaumont Independent School District has agreed to convey a 10 foot wide Waterline Easement and a 15 foot wide Sanitary Sewer Easement to the City of Beaumont. The easements are out of the C. Williams Survey and will provide water and sewer service for the new Amelia Elementary School located at 565 Major Drive, between Drennan Drive and Morgan Lane. BUDGETARY IMPACT None. \engamelia-ib 24 November 2009 RESOLUTION NO. S City Council Agenda Item TO: City Council FROM: Kyle Hayes, City Manager PREPARED BY: Chris Boone, Community Development Director MEETING DATE: January 12, 2010 REQUESTED ACTION: Consider authorizing the City Manager to enter into a contract for the provision of relocation assistance for the owner of a house flooded during Hurricane Ike in conjunction with the approved Hazard Mitigation Grant Program's Acquisition and Demolition Program. RECOMMENDATION The Administration recommends approval. BACKGROUND: As a result of Hurricane Ike, some homes located within the floodplain, east of Pine Street, received flood damage. Because the City's floodplain land use ordinance requires that homes in the floodplain that are substantially damaged be elevated prior to repair, many residents have found elevating their homes and repairing them difficult if not impossible. In order to provide relief to the residents and avoid future, repetitive flooding of these homes, the City applied for Hazard Mitigation funds to acquire and demolish these homes. The City was successfully awarded this grant for acquisition and removal of sixteen(16) homes. To date, we have inspected and secured appraisals for each of the sixteen(16) homes and made purchase and relocation offers. The amount of relocation assistance is based on the grant formula and differs, depending upon the resident's desire to secure rental housing or purchase a new home. It is expected that additional purchase contracts will be forthcoming as offers are accepted by the homeowners. Once these properties are acquired, the City will demolish these homes and deed restrict the properties, to prevent future flooding losses. These costs will also be covered by the grant. The only improvements will be the private drives, along with the necessary road ditch culverts, to provide direct vehicular access onto the property and the drainage swales adjacent to the private drives to provide drainage. Mr. Booker states that he has owned the property for the last fifteen years. The building, itself, appears to have been there for many years. He states that the building is used as storage for his personal and business use. He would store such items as lawn mowers, a trailer, garage doors, tools and a work truck. According to the site plan, the north end of the building is to be removed by Mr. Booker. This rezoning could be considered spot zoning. Spot zoning connotes an unacceptable zone change that singles out a single tract for treatment that differs from that accorded similar surrounding land without proof of changes and conditions. BACKGROUND Fittz & Shipman, Inc., representing Austin Dishman, has applied for a zone change and specific use permit. In October, 2009, City Council approved a zone change and a specific use permit to allow a self- storage warehouse facility on 13 acres north and west of the subject property. Driveways, as shown on the original site plan, will not be allowed because of their proximity to railroad quiet zones. In train quiet zones, federal regulations prohibit driveways accessing commercial properties because they are considered to be intersections. Therefore, the developer has to provide an alternative if he is going to provide access to his mini- warehouse facility. Under the current proposal, Mr. Dishman is leasing a 0.32 acre tract of land from DD#6 and would move the proposed driveway outside either railroad quiet zone. BACKGROUND Rob Clark, representing Beaumont Independent School District, has applied for the specific use permit. The bus parking and fueling facility will be located behind the school district's existing administration annex building on Woodrow. The proposed facility is a continuation of the district's goal to provide satellite bus facilities in order to reduce travel times and provide emergency centers in scattered neighborhoods Access to the bus facility will be on Virginia Street with recessed entries with secured electric operated gates permitting exit from the street to prevent obstructing standard traffic flow. Diesel underground fueling tanks will be located in the most central area of the site and a good distance from boundary lines. All fueling and washing facilities will be designed to state standards for vapor recovery and wash water separation. All site lighting will have sharp cut-off angles to prevent glare to adjacent residences and other uses. Landscape screens will be installed along the Virginia Street property line and along the eastern line abutting the Entergy utility easement. RECOMMENDATION Administration recommends approval. BACKGROUND Recently, City Council considered whether or not to apply for funds from the Severe Repetitive Loss (SRL) Flood Buyout Program. The advantages of providing relief to homeowner's with recurring flooding was weighed against the disadvantages of having permanently vacant lots within various neighborhoods. As any buyout program is voluntary, a survey was sent out to all of the owners on the SRL list to determine the level of interest in a buyout program, with a majority of the respondents possibly interested. Following this, each resident was further evaluated for eligibility, according to FEMA guidelines, and each eligible applicant was contacted. Tohme, Water Utilities Director MEETING DATE: January 12, 2010 REQUESTED ACTION: Council approval of a resolution authorizing the City Manager to execute a contract for the Sanitary Sewer Rehabilitation of Small Diameter Mains Contract-XVII. RECOMMENDATION Administration recommends approval of a contract with Horseshoe Construction, Inc. LaPorte, Texas, in the amount of$788,933.00 to rehabilitate approximately 7,327 linear feet of 6-inch, 11,627 linear feet of 8-inch, 1,151 linear feet of 10-inch, and 1,578 linear feet of 12-inch sanitary sewer lines, to stabilize approximately 10 vertical feet of existing manhole, to furnish and install approximately eight manholes, to remove and replace approximately 48 manholes, to abandon one manhole in place, to furnish and install five end of line cleanouts, to replace approximately 261 short side and 92 long side service line connections, clean and televise 21,683 linear feet of existing and newly burst sanitary sewer lines and televise approximately 353 existing sanitary sewer service lines. The project is split between two areas. The first area is located between College Street and Washington Boulevard on Chamberlin and Lindbergh Drives. The second area is located East of Martin Luther King Parkway and West of Sycamore Street between Stanton Street and Kansas City Southern Railroad. The project was designed by City Staff and the Engineer's estimate for the project was $1.1 million. The MBE participation will be with Chief Solutions, Inc. for $44,000, Deanie Hayes, Inc. for $92,300, and Vila Trucking for $30,000. The total amount of the subcontracts is for $166,300.00, which represents 21.08 percent of the total bid. BACKGROUND The existing sewer lines built in the I940's and 1950's have deteriorated and require major rehabilitation. The primary goals of the project are to restore the integrity of the sanitary sewer lines, restore the carrying capacity, provide customers with uninterrupted and adequate service and meet the Sanitary Sewer Overflow Initiative agreement requirements with the state. This Contract is recommended for approval by the City Manager and the Water Utilities Director.
