REQUESTED ACTION: Council consider a resolution authorizing the acceptance of a ten
foot (10') wide Water Line Easement out of the W. B. Dyches
Survey, Abstract 17, and the H. Williams Survey, Abstract 56, and
off the Folsom Road Extension.
RECOMMENDATION
Furniture Acquisition-Beaumont Limited has agreed to convey a ten foot (10') wide Water Line
Easement to the City of Beaumont. The easement, out of the W. B. Dyches Survey, Abstract 17,
and the H. Williams Survey, Abstract 56, is described as being across property owned by
Furniture Acquisition-Beaumont Limited(new Howell's Furniture Showroom)and off the Folsom
Road Extension (0.169 acres).
Administration recommends acceptance of the easement.
BACKGROUND
The Water Line Easement will provide service for the new Howell's Furniture Showroom.

REQUESTED ACTION: Council approval of a resolution authorizing the City Manager to increase

Miscellaneous improvements Project amount for "extra work."
RECOMMENDATION
Administration recommends approval of increasing the Water Treatment Plant 14 Million Gallons per Day
Expansion and Miscellaneous improvements Project amount by$28,475.60 to add a caustic injection line
at the chemical feed vault, change service pumps to sump pumps, add concrete sidewalks around east
stairway at Administration Building entry,add pipe support braces for 60-inch influent settled water piping
in filter gallery, and add embedded waterstop at the filter side of the cold joint required to install the
geotexctile drainage layer.
BACKGROUND
The proposed additions and modifications to the original contract documents and design will improve the
future operation and appearance of the of the Water Treatment Plant,and will help the City meet required
state and federal regulations. In addition,these changes can be done as part of the ongoing plant expansion
project at a lower cost than if they are bid in the future.
BUDGETARYIMPACT
Funds for the project are available in the Capital Improvement Funds.
PREVIOUS ACTION
Resolution No.03-271 in the amount of$11,029,000 was passed by City Council on December 16,2003.
Resolution No. 04-143 in the amount of$1,377,912.01 for Change Order No. 1 was passed by City
Council on June 29,2004.

REQUESTED ACTION: Council consider a request for a zone change from RS (Residential

RECOMMENDATION
The Administration recommends approval of a zone change from RS (Residential Single Family
Dwelling)to GC-MD(General Commercial-Multiple Family Dwelling)District for property located
on the east side of Old Voth Road, north of Lawrence Drive.
BACKGROUND
In August,2004,the City Council approved a rezoning from GC-MD to RS for the subject property.
In addition, Bruce Craig, the property owner, asked the Planning Commission to approve a 16 lot
single family residential subdivision. That plat was denied. The next month, Mr. Craig requested
approval of a 14 lot single family residential subdivision. That plat was denied as well.
In November,Mr. Craig made a request for the opportunity to make application for a rezoning of the
subject property prior to the expiration of the 12 month waiting period. That request was approved
by the Planning Commission.
In that request, Mr. Craig states that he has determined that any single family residential
development of less than 14 lots in unfeasible and therefore wishes to rezone the property to GC-
MD.
BUDGETARY IMPACT
None.
PREVIOUS ACTION
At a Joint Public Hearing held December 20, 2004, the Planning Commission voted 6:3 to approve
a zone change from RS (Residential Single Family Dwelling) to GC-MD (General Commercial-
Multiple Family Dwelling)District for property located on the east side of Old Voth Road,north of
Lawrence Drive.

BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular
the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of
Beaumont, referred to in Section 30-513 thereof, is hereby amended by changing the
zoning of property presently zoned as RS (Residential Single Family Dwelling) District to
GC-MD(General Commercial-Multiple Family Dwelling) District for property located on the
east side of Old Voth Road, north of Lawrence Drive, as described in Exhibit "A" and
shown on Exhibit "B", and the official zoning map of the City of Beaumont is hereby
amended to reflect such changes.
Section 2.
That, in all other respects, the use of the property herein above described shall be subject
to all of the applicable regulations contained in Chapter 30 of the Code of Ordinances of
Beaumont, Texas, as amended.
Section 3.
That if any section, subsection, sentence, clause or phrase of this ordinance, or the
application of same to a particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end, the various portions and provisions of this ordinance are
declared to be severable.
Section 4.
That all ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
Section 5.
That any person who violates any provision of this ordinance shall, upon conviction,
be punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.

RECOMMENDATION
The Administration recommends denial of a zone change from LI (Light Industrial) to GC-MD-2
(General Commercial-Multiple Family Dwelling)District and a specific use permit to allow a halfway
house in a GC-MD-2 District at 885 Crockett.
BACKGROUND
Merrick Brown,the applicant, is applying for a zone change from LI to GC-MD-2 and a specific use
permit to allow a "three-quarter house" to house up to 50 non-violent ex-offenders in an existing
structure at 885 Crockett Street. The 16,560 sq.ft. structure is a former commercial building that will
be remodeled to house the ex-offenders.
Mr. Brown states that the purpose of the facility will be to house the ex-offenders for periods of time
from 120 days to one year. The clients will pay$90 a week for room and board. They will not leave
the facility until they have completed substance abuse counseling, have $1,500 in a savings/checking
account and have been employed for 6 months. The clients will have the opportunity to receive
counseling and, if they have not done so, receive a GED.
Mr. Brown also states that the facility will have on-site supervision 24 hours a day. In addition to
10 staff persons, there will be an educator, doctor and dentist that will contribute to helping the
clients. Curfews will be set and will be enforced. The facility will work closely with the local police
department, sheriff department and all government agencies.
This request could be considered"spot zoning". When considering whether a zone change is spot zoning,
there are several issues or questions that need to be addressed.
1. The law demands that the approved zoning plan should be respected and not altered for
the special benefit of the landowner when the change will cause substantial detriment to
the surrounding land or serve no substantial public purpose. Would the zone change be
in compliance with the adopted comprehensive plan?
The subject property and the properties to the south,east and west are currently zoned Ll.
The property to the north is zoned HI. The Comprehensive Plan designates this area as
one for"Conservation and Revitalization". The zone change would specifically benefit
Mr. Brown in that it would enable him to operate the halfway house.
2) Will this change adversely impact the surrounding properties? The nature and degree of
an adverse impact upon neighboring lands is important. Lots that are rezoned in a way
that is substantially inconsistent with the zoning of the surrounding area, whether more
or less restrictive, are likely to be invalid.
While the zone change itself may not adversely impact the surrounding properties,the
specific use permit that is enabled by the zone change could negatively impact the
surrounding properties.
3) Is the tract of land suitable or unsuitable for use as presently zoned. This is a factor.
The size, shape and location of a tract of land or lot may render it unusable or even
confiscatory as zoned.
The subject property can be used as zoned.
4) Does the proposed zone change bear a substantial relationship to the public health,
safety,morals or general welfare or protect and preserve historical and cultural places
and areas. The amendatory ordinance must bear a substantial relationship to the
aforementioned considerations.
The subject property does not bear a substantial relationship.

PREVIOUS ACTION
At a Joint Public Hearing held December 20, 2004, the Planning Commission voted 9:0 to approve
a zone change from LI to GC-MD-2 District for the property at 885 Crockett Street.

BACKGROUND
Leslee Jordan, the applicant, is requesting a specific use permit to allow a photography and media
services business at 290 N. 10`h Street. This location is the site of an existing commercial building.
The type of business that Ms. Jordan is contemplating would include a photography studio and
website development. The photography will all be digital, thereby negating the need for an onsite
processing lab. Pictures will be uploaded to a lab in Iowa that will then ship back the completed
portrait. In addition, Ms. Jordan will act as a broker between website creators and those who need
websites. She will display the work of various website creators for clients to peruse.
The business will be open Monday- Saturday by appointment only. Ms. Jordan and two part-time
employees will work at this location.

BACKGROUND
Stacey Hansard,the applicant,is requesting a specific use permit to allow swimming lessons at 1265
Sandwood Lane. In July, 2004,the Planning Division cited the Hansards for conducting swimming
lessons in their backyard pool. The Planning Division had received numerous complaints about the
swimming lessons.
Ms. Hansard proposes to conduct water survival instruction during the months of June and July.
Lessons will be taught Monday through Thursday, 9:00 a.m. to 5:00 p.m. During a typical session,
8-10 students will be taught. Two instructors will teach the lessons.

RECOMMENDATION
The Administration recommends approval of a specific use permit to allow an art gallery/antique
shop/gift shop in an RCR(Residential Conservation and Revitalization)District at 2520 North Street
with a modification to the landscaping/screening requirements along the east and west property fines
and the parking lots and require an 8' tall screening fence along the north end of the property line.
BACKGROUND
David and Virginia Major, the applicants, are requesting a specific use permit to allow an art
gallery/antique shop/gift shop at 2520 North. On the subject property is an existing structure that has
been used for commercial uses in the past. There are existing parking lots in the front and rear yards.
A free-standing sign will be installed that will meet the Historic District regulations.
The proposed business will include an art gallery featuring Beaumont and Texas artists,antiques sold
on consignment,the sale of vintage antique dolls and toys as well as modern dolls and toys,European
floral design, the sale of gift baskets, doll restoration services and the sale of gifts.
Hours of operation will be from Tuesday through Saturday, 9:00 a.m. - 5:30 p.m.

PREVIOUS ACTION
At a Joint Public Hearing held December 20, 2004, the Planning Commission voted 9:0 to approve
a specific use permit to allow an art gallery/antique shop/gift shop in an RCR District at 2520 North
Street with a modification to the landscaping/ screening requirements along the east and west
property lines and the parking lots and require an 8' tall screening fence along the north end of the
property line.

John Holm,the applicant,is requesting a specific use permit to allow a Laundromat at 4639 Highland
Avenue. Currently, there is a house and a garage apartment on the subject property. The house
would be demolished to allow for the construction of the 1,870 sq. ft. Laundromat. The garage
apartment will remain. Immediately to the north of the proposed laundromat is a six stall car wash.
The facility will house thirty washing machines. Five parking spaces are required and six are
provided. The laundromat's hours of operation are currently set for being open from 9:00 a.m. to
9:00 P.M.

property located on the west side of Mercantile Street, approximately 125' north of Cardinal Drive
subject to the following conditions:
1. Three trees be planted on each side as well as shrubs.
2. The wood fence be tall enough to conceal the barbed wire along the top of the
chainlink fence.
BACKGROUND
V erizon Wireless,the applicant,is requesting a specific use permit to allow the construction of a 180'
tall monopole cellular telephone transmission tower on the west side of Mercantile, approximately
190' north of Cardinal Drive. In addition to the tower, the facility will include an 11' 8" x 20'
equipment building, all within a 75' x 75' fenced enclosure. Access to the facility will be off of
Mercantile Street.
The site plan shows that shrubs will be planted along all four sides of the facility. The Planning
Manager is recommending that in addition to the shrubs, three trees be planted along each side of
the facility. The Planning Manager is also suggesting that the wood screening fence be extended in
height to conceal the barbed wire along the top of the chainlink fence.
The site of this proposed cellular telephone transmission tower is approximately 310' from the
nearest residentially zoned property.

Administration recommended approval of a specific use permit to allow a cellular
telephone transmission tower in a GC-MD (General Commercial-Multiple Family
Dwelling) District on property located on the west side of Mercantile Street,
approximately 125' north of Cardinal Drive subject to the following conditions:
• Three trees be planted on each side as well as shrubs.
• The wood fence be tall enough to conceal the barbed wire along the
top of the chainlink fence.
Verizon Wireless, the applicant, is requesting a specific use permit to allow the
construction of a 180' tall monopole cellular telephone transmission tower on the
west side of Mercantile, approximately 190' north of Cardinal Drive. In addition to
the tower, the facility will include an 11' 8" x 20' equipment building, all within a 75'
x 75 enclosure. Access to the facility will be off of Mercantile Street.
The p: shows that shrubs will be planted along all four sides of the facility.
The Manager is recommending that in addition to the shrubs, three trees
be planted along each side of the facility. The Planning Manager is also suggesting
that the wood screening fence be extended in height to conceal the barbed wire
along the top oft ink fence.
The site of this pr " cellular telephone transmission tower is approximately
310' from the neap r entially zoned property.

RECOMMENDATION
The Administration recommends approval of a specific use permit to allow a hair salon in an RM-H
(Residential Multiple Family Dwelling-Highest Density) District at 8155 Gladys.
BACKGROUND
Kimberly Tompkins,the applicant,is requesting a specific use permit to allow her to operate Kim's
Hair Studio at 8155 Gladys. The hair salon will encompass 800 sq. ft. and according to the site plan,
will house four hair cutting stations.
In November, 2003, City Council voted to approve a specific use permit for a real estate
service/general offices on the subject property. Since that time, a 4,000 sq. ft. building has been
constructed. Patti Merrill,the property owner,will soon be moving her real estate business into the
building. She would like to lease a portion of the building to Ms. Tompkins for use as the hair salon.
A hair salon is permitted in an RM-H District with a specific use permit.
BUDGETARYIMPACT
None.
PREVIOUS ACTION
At a Joint Public Hearing held December 20, 2004,the Planning Commission voted 9:0 to approve

ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT
TO ALLOW A HAIR SALON 1N AN RM-H (RESIDENTIAL MULTIPLE
FAMILY DWELLING-HIGHEST DENSITY) DISTRICT LOCATED AT
8155 GLADYS IN THE CITY OF BEAUMONT, JEFFERSON
COUNTY, TEXAS.
WHEREAS, the City Council for the City of Beaumont desires to issue a
specific use permit to Kimberly Tompkins, to allow a hair salon in an RM-H
(Residential Multiple Family Dwelling-Highest Density) District located at 8155
Gladys, being Lot 3, Block 37, Dowlen West Addition, Unit XIX, City of Beaumont,
Jefferson County, Texas, containing 0.44 acres, more or less, as shown on Exhibit
"A" attached hereto; and,
WHEREAS, the City Council is of the opinion that the issuance of such specific
use permit is in the best interest of the City of Beaumont and its citizens;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
Section 1.
That a specific use permit to allow a hair salon in an RM-H (Residential
Multiple Family Dwelling-Highest Density)District located at 8155 Gladys, being Lot
3, Block 37, Dowlen West Addition, Unit XIX, City of Beaumont, Jefferson County,
Texas, containing 0.44 acres, more or less, as shown on Exhibit "A" attached
hereto, is hereby granted to Kimberly Tompkins, her legal representatives,
successors and assigns.
Section 2.
That the specific use permit herein granted is expressly issued for and in
accordance with each particular and detail of the site plan attached hereto as
Exhibit "B" and made a part hereof for all purposes.
Section 3.
Notwithstanding the site plan attached hereto, the use of the property herein
above described shall be in all other respects subject to all of the applicable
regulations contained in Chapter 30 of the Code of Ordinances of Beaumont,

RECOMMENDATION
The Administration recommends approval of a specific use permit to allow a pest control business
and home inspection business in a GC-MD-2 (General Commercial-Multiple Family Dwelling-2)
District at 6550 Concord subject to the following condition:
1. Move the entire site plan 10'to the rear of the property to allow for the expansion of
Concord Road
and with a modification to the landscaping/screening requirements along the north, east and south
property lines.
BACKGROUND
Kenneth Carr, the owner of Guardtech Pest Management, Inc. and The Home Team Inspection
Service,is requesting a specific use permit to allow the operation of a pest control service and home
inspection service at 6550 Concord. The plans include the construction of a two story, 3,000 sq. ft.
building and related parking and company vehicle storage. The two companies will employ a total
of twelve employees. Two to three customers per day can be expected at the businesses. A
maximum 20' tall monument sign is proposed.
Mr. Carr states that the companies have outgrown their present location and wish to move to a new
location on Concord. In June, 2000, the City Council approved Mr. Carr's application for a zone
change to GC-MD-2.
The City Engineer states that additional right-of-way may be needed for the future widening of
Concord Road. He recommends that 10'be required of the applicant. The Planning Manager has
discussed this with the applicant and he is willing to amend his site plan to reflect the loss of 10' of
his property.
BUDGETARYIMPACT
None.

At a Joint Public Hearing held December 20, 2004,the Planning Commission voted 9:0 to approve
a specific use permit to allow a pest control business and home inspection business in a GC-MD-2

WHEREAS, the City Council for the City of Beaumont desires to issue a
specific use permit to Kenneth Carr, owner of Guardtech Pest Management, Inc.,
and The Home Team Inspection Service,to allow a pest control business and home
inspection business in a GC-MD-2(General Commercial-Multiple Family Dwelling-2)
District located at 6550 Concord, being Tax Roll Tract No.64-B, Plat RS-1,T. Spear

Section 2.
That the specific use permit herein granted is expressly issued for and in

BACKGROUND
The abandonment request is for a portion of an unimproved 60' street right-of-way. This property
is located to the west of Adam's Self Storage at 650 IH-10 S. Mr. Bruce Craig states that he would
like to abandon the right-of-way so that he can clean it up and expand his self storage business.
During the review of this request, DD#6's Hillebrandt Bayou facility is immediately to the west of
this right-of-way. Initially,DD#6 recommended denial of the request because of the possible need
of this right-of-way for drainage purposes. However, DD#6 and Mr. Craig were in negotiation to
swap properties thereby allowing for the abandonment.
Before the Planning Commission meeting, Mr. Richardson stated that he did receive notification
from DD#6 that they had come to a written agreement with Mr. Craig so they have dropped their
opposition to the request.
BUDGETARY IMPACT
None.
PREVIOUS ACTION
At a Regular Meeting held December 20, 2004, the Planning Commission voted 9:0 to approve the
request to abandon the 60' right-of-way from Fannin Street Ditch to 311.42' south.

RECOMMENDATION
The Administration recommends approval of the request for a historic preservation loan for
renovations to the home at 2300 Harrison Street.
BACKGROUND
In October,2004,Mr. and Mrs. Charles Pickens requested a historic preservation loan in the amount
of$25,063 for renovations to be made to their home at 2300 Harrison. Due to past credit problems,
the Planning Manager recommended denial of the request. However, the Historic Landmark
Commission approved the request. On November 10, 2004, City Council denied the request due to
concerns over the Pickens' credit history.
The Pickens' are now requesting$3,500 to replace the roof. Two bids have been submitted-$3,325
and $6,500. The Planning Manager recommends a loan of in the amount of$3,500. If approved,
payments would be $145.33 over a two year period. The Planning Manager feels that the amount
requested carries less risk than the previous request.
The property is not listed in SPARE Beaumont.
BUDGETARY IMPACT
The Historic Preservation Loan program is funded with CDBG money. Currently, there is
$39,277.48 available in the loan account.
PREVIOUS ACTION
At a Regular Meeting held December 13, 2004, the Historic Landmark Commission voted 6:1 to
approve the historic preservation loan for renovations to the home at 2300 Harrison Street.

Administration recommends approval of increasing the Sanitary Sewer Rehabilitation of Small Diameter
Mains Contract VIII Project amount by$423,955 to furnish and install 7,740 linear feet of 8-inch sanitary
sewer pipe, 135 service line connections and 70 manholes.
BACKGROUND
The existing sewer lines on and in the neighborhoods of Azalea Dr., Camelia, 23'd Street, Shady Lane,
Longfellow, and Wheat were built in 1960 and have deteriorated and require major rehabilitation. The
primary goals of the project are to restore the integrity of the sanitary sewer lines, restore the carrying
capacity, and provide customers with uninterrupted and adequate service.
BUDGETARY IMPACT
Funds for the project are available in the Water Utilities Capital Improvements Fund.
PREVIOUS ACTION
Resolution No. 03-096 in the amount of 2,256,555.75 was passed by City Council on May 6,2003.

execute Change Order No. 3 for the Delaware Street Extension
Project to install additional 24 inch and 30 inch water transmission
lines.
RECOMMENDATION
Administration recommends Council approve Change Order No. 3 increasing the amount of the
Delaware Street Extension contract by $294,990.00, for installing an additional 344 linear feet of
30 inch and 264 linear feet of 20 inch water transmission lines and appurtenances. Itemized work
is shown in Change Order No. 3.
BACKGROUND
On October 28, 2003, City Council awarded Brystar Contracting, Inc., the contract for the
Delaware Street Extension Project in the amount of $4,224,066.30. On May 12, 2004, and
November 16, 2004, Change Order No. 1 and No. 2 in the amounts of$8,490.00 and$42,406.00
were issued to install a junction box on the existing 24 inch water line and provide sand bedding
for the installation of a 36 inch transmission line.
Change Order No. 3 funds are necessary for installing additional 30 inch and 20 inch water
transmission lines across Major Drive and capped. These lines will be extended to two million
elevated storage tanks on Dishman Road.
BUDGETARYIMPACT
Funds for the project are available in the Water Utilities Capital Improvement Program.

Upon recommendation by the U. S. Department of Housing and Urban Development ("HUD") and

Loan Counseling Program
Program Summary
Savannah Housing Corporation's ("SHC") will act as the loan counseling entity for
all potential homebuyers utilizing the First Time Homebuyer's programs of the
Cities of Port Arthur and Beaumont.
SHC's responsibility will be to:
• Market to and solicit applications from potential Iow-moderate income
homebuyers in Beaumont and Port Arthur.
• Provide an eight (8) hour Homebuyer Education Class to potential qualified
buyers.
• Provide loan and budget counseling to potential buyers
• Pre-Qualify Homebuyers at or below 80% of area median income.
• Prepare complete application packages for homebuyers seeking assistance
from either the City of Port Arthur or the City of Beaumont.
• Track all applicant activity and provide periodic reports Beaumont and Port
Arthur.
• Provide assistance to the qualified homebuyers during the closing process.
• Provide post close counseling
Objectives
The loan counseling program objectives are as follows:
• Solicit a minimum of seven hundred fifty(750)applicants annually
• Provide Homebuyer Education classes to two hundred fifty (250) potential
qualified buyers annually.
• Package and submit to the Cities of Port Arthur and Beaumont, a minimum
of seventy-five(75) qualified homebuyer applications annually.
• Work closely with Beaumont CHDO to insure qualified buyers are aware of
and have access to new homes constructed by Beaumont CHDO.
• To provide timely and pertinent information to the Cities of Beaumont and
Port Arthur on the program and the homebuyers.
About Savannah Housing Cornoration
SHC's mission is to empower low-moderate income families through education,
training, and the promotion of homeownership and asset development.
Formed in 1994, SHC has worked primarily in Port Arthur to increase the
opportunities available for tow-moderate income persons to acquire single-family
homes.
SHC currently has a staff of two, the Executive Director, Father Sinclair Oubre, and
the Director Of Homebuyer Education, Tracie Conyers. Father Sinclair is
responsible for implementing board decisions and policies and oversee the direct
day-to-day operations of the organization and maintain fiscal viability via effective
budgetary management. Tracie Conyers is responsible for the strategic planning,
implementing, and promotion of the day-to-day activities of the homeownership
program. Tracie Conyers has worked effectively in the community development
sector and will utilize experience and expertise to fulfill the mission. In addition,
SHC employees a part-time bookkeeper and will be hiring an assistant for the loan
counseling program.
Job descriptions for each position, and resumes for current staff are attached.
Pro ream
Marketing: SHC will place applications and brochures for the program at
the various locations in the Cities of Port Arthur and
Beaumont. Locations will include offices of the two Cities,
various neighborhood or community centers, the offices of
Beaumont CHDO, and the offices of churches and other non-
profit entities that serve the target population. SHC will
actively market the availability of the program in both Cities.
Pre-Qualification: Based on submitted applications, SHC will pull credit reports,
determine credit deficiencies, and determine the ability of
applicants to participate in the program and to purchase a
home.
Education Classes: SHC will provide an eight (S) hour Homebuyer Education
Class to potential qualified buyers consisting of the following
topic areas:
• Assessing Readiness For Homeownership
• Savings And Budgeting
• Understanding Your Credit And Credit Report
• The Key Players In The Home Purchasing Process
• Getting A Mortgage Loan
• Shopping For A Home
• Keeping Your Home And Managing Finances
Counseling: SHC will provide loan and budget counseling and monitor
client's savings and spending plans monthly to aid the potential
homebuyer in obtaining the required down payment and
closing costs.
Packaging: Once applicants have complete the Homebuyer Education
Class, have the funds necessary to pay the required down
payment, and have the credit necessary to acquire a home,
SHC will complete a applicant package to be submitted to the
Cities of Beaumont and/or Port Arthur.
Closing: Upon Certification of program qualification by either the City
of Port Arthur, or the City of Beaumont, SHC will assist the
homebuyer during the closing process.
Post Counseling: During the first six (6) months after the homebuyer closes on a
home, SHC will maintain contact with the buyer and provide
post closing loan counseling at least once.
Tracking: SHC will maintain a homebuyer database and shall provide to
the City of Beaumont and the City of Port Arthur, each month,
a copy of the database in the prescribed format.
Reporting: SHC shall submit to the City of Port Arthur and the City of
Beaumont, each quarter, a summary report of activity which
shall include on a quarterly and year to date basis:
• The number of applications received
• The number of applicants who are currently in the loan
counseling program (open cases)
• The number of applicants, for whatever reason, who left
the counseling program without completing the
program (closed cases). When apparent, the reasons
will be stated by general groupings.
• The number of applicants who have attended
homebuyer education classes.
• The number of applicants who have received
certificates from either the City of Port Arthur or the
City of Beaumont.
• The number of homebuyers who have successfully
closed on a house.
• The number of homebuyers who have completed the
program, including the entire post loan closing
counseling period.

of bedrooms in the unit to be purchased:
A. Single persons may only purchase a two bedroom unit.
B. Two person families with or without children must purchase a two
bedroom unit
C. Three person families with one child must purchase a two bedroom
unit
D. Three person families with two children of different sexes must
purchase a three bedroom unit.
E. Four person families with two children must purchase a three bedroom
unit.
F. Five or more person families must purchase a four bedroom unit.
6. Applicant and co-applicant must meet the following underwriting criteria
A. Applicant and co-applicant must have a minimum FICO score of 600 at
loan closing.
B. Applicant and co-applicant must contribute at closing a minimum of
3% of the value of the home to be purchased in cash.
1. Funds utilized to meet this requirement must be placed in a
savings account at least sixty days prior to the purchase close
2. Gifts of these funds from any source are prohibited.
C. Applicant and co-applicant must have a debt to income ratio, including
the proposed mortgage payment, which does not exceed 42% of annual
income.
D. At closing, applicant and co-applicant must have no more than $7,500
in available cash after the down payment is made.

1. The amount of the City's contribution will be reduced to the
level necessary to bring cash on hand to $7,499 at the close.
E. Applicant and co-applicant must have a positive net worth.
7. The application fee for participation in the program is fifty ($50) dollars,
which is due at application submission.
A. Fee is non-refundable.
8. Applicant and co-applicant must complete an eight (8) hour home buyer
education course.
9. All homes purchased under the program must have a home inspection from a
certified home inspector not associated with the Realtor or Realty company
which represents the buyer or the seller. The house to be purchased must
meet Housing Quality Standards, and Local, State and Regional building
codes.
A. In order for the buyer to close, the house must be repaired, renovated,
or rehabilitated to the standards noted.
10. Applicant and co-applicant must be able to obtain financing from a private or
public lending source.
A. The lender must agree to a rate lock and provide a letter to the
borrower stating the interest rate lock, and delineating all closing costs
(see below). The rate lock must be effective for a period of at least
ninety (90) days.
B. The interest rate charged by the lender must be reasonable and
customary. Determination of reasonable and customary shall be at the
sole discretion of the City.
C. Adjustable rate mortgages of any type or form are prohibited.
D. All mortgages must allow prepayment without penalty.
11. Closing costs charged by the private or public lending source must be
reasonable and justifiable. In approving the buyer for the loan, the lender
must disclose in writing each of the closing costs and must give the borrower
a written guarantee that closing costs will not change before the loan close.
The lender will issue to the buyer, at least thirty days prior to closing a letter
stating the loan amount and the closing costs. The buyer shall provide the
City with a copy of the letter at least twenty-one (21) days before closing.

II. Application Submission (Average of four (4) hours per applicant)
A. Application and fee are submitted at the first interview with the loan
counselor.
1. Initial interview time is estimated at one hour per family.
2. Counselor reviews the application with the family, noting any
deficiencies.
3. Counselor has the applicant sign the appropriate third party
verification documentation instruments and waivers.
4. Counselor obtains the credit report and FICO.
a. Counselor goes over credit report with applicant to insure
applicant is aware of all items on the credit report.
b. Counselor gives applicant a copy of the credit report.
5. Counselor provides the applicant with a home buyer education
class schedule.
6. Counselor schedules follow-up interview with the applicant.
B. Upon completion of the initial interview
1. Administrative Assistant enters base data from application in
the LoanTracker program.
2. Counselor evaluates the overall package and classifies the
applicant based within LoanTracker on the following status
factors.

a. Ready: Is ready for immediate participation in the home
buyer counseling program and will be eligible to purchase
a home upon completion of the home buyer counseling
program. No defects to credit, has sufficient cash on hand.
b. Minor Repair: Can be moved to ready status within
ninety (90) days. Has minor credit defects and/or needs
ninety (90) days to gain the savings necessary to
participate in the program
C. Moderate Repair: Can be moved to ready status within
one hundred eighty (180) days. Has moderate credit
defects and/or needs one hundred eighty (180) days. to
gain the savings necessary to participate in the program.
d. Major Repair: Will require in excess of one hundred
eighty (180) days to move to ready status.. Has major
credit defects and/or needs more than one hundred eighty
(180) days to gain the savings necessary to participate in
the program.
e. Not Eligible: Not eligible for the program
3. Letter is generated to the applicant stating the following
a. Thanking the applicant for their participation in the
program
b. Providing the applicants a copy of their FICO score and
credit report.
C. Stating the initial actions needed by the applicant to
rectify any credit problems.
d. Confirming the follow-up interview date and time if
necessary.
III. Interim Counseling and Home Buyer Education (Average of six (6) hours per
applicant)
A. Based on the Counselor's evaluation, interim counseling of the
applicant occurs. Such counseling may include:
1. Correcting credit deficiencies
2. Assistance in obtaining third party verifications
3. Budgeting

A. The counseling entity tracks the approved applicant for a period of one
year from the date of the issuance of a Program Approval Certificate
by calling the applicant at the following intervals:
1. Thirty (30) days
2. Sixty (60) days
3. Ninety (90 days)
4. One Hundred Eighty (180) days
5. One (1) year.
6. Eighteen (18) months.
B. The following questions are asked at each contact until these questions
can be answered. The data is entered into the LoanTracker program.
1. Has the family purchased a home ?
2. What is the address of the home purchased ?
3. What is the name of the lender who financed the home ?
C. The following questions are asked at each contact. The data is entered
into the LoanTracker program.
1. Are you continuing to maintain the budget you created in the
home buyer education class ?
2. Are you current with your bills ?
3. Are you having any major problems with the house you
purchased ?
4. Have you changed employers since we last contacted you ?
5. Has there been any change in your income since the last time we
contacted you ?
6. Do you need our help ?

VII. Closing the file (Average of one (1) hour per applicant)
A. One (1) year after the issuance of the purchase of a home, or eighteen
(18) months after the applicant received a Program Approval
Certificate, the counseling entity closes the file.
B. LoanTracker is updated and the file moves from opened to closed
status.
C. The paper file is archived.
VIII. Reporting (Average of one (1) hour per applicant)
A. The counseling entity submits a report to each of the City's on a
quarterly basis. The report consists of the following information for
the period.
1. A list of persons who have obtained an application for the
program from the application log.
