BE IT REMEMBERED that the City Council of the City of Beaumont, Texas,
met in regular session this the 4th day of January, 1977 , with the fol-
lowing present:

The Minutes of the regular City Council session held December 28 , 1976 ,
were approved on a motion made by Councilman Cash and seconded by Coun-
cilman Evans.

Resolution 77-1 authorizing the award of bid for furnishing five (5)
diesel cab and chassis trucks for the Solid Waste Department to Tidelands
International, Inc. for $83 ,975. 00 was approved on a motion made by Coun-
cilman Cash and seconded by Councilwoman McGinnis.

Resolution 77-2 authorizing the award of bid for furnishing one (1) full-
size sedan for the City Manager' s Office to Kinsel Ford, Inc. , for
$7 ,217. 84 was approved on a motion made by Councilman Williams and seconded
by Councilman Evans.

Resolution 77-3 authorizing the award of bid for furnishing thirteen (13)
police cars to Kinsel Ford, Inc. , for $72 ,529 .99 was approved on a motion

Ordinance No. 77-1 authorizing the abandonment of a 5-foot street light
easement located between Lots 4 and 5 , Block 3 , Washington Manor, Unit 2,
was considered:

An ordinance authorizing a zoning change from R-1 (Single Family Dwelling)
to R-2 (Two Family and Multiple Dwelling) of a 1. 28 acre tract described
as a portion of the W. B. Dyches Survey, located at 10295 Voth Road was

tract of land described as a portion of the Viola Stagg and Roy Hall
tracts, located at the southeast corner of the intersection of Gladys
Avenue and Major Drive (FM 364) - request made by Mr. Don Streety - was
considered:

Councilman Williams made a motion to deny the request; Councilwoman Mc-
Ginnis seconded the motion.
Councilman Evans made a motion to table the request; motion died for lack
of a second.

Resolution 77-4 appointing George Ingram (Chairman, 3-year term; Walter
Mayer, 3 years; Dr. James Massey, 2 years; Leo Lemell, 2 years; W. C.
Ross, Jr. , 2 years; Dan Green, 1 year; and Jack Herzik, 1 year; to serve
the Airport Advisory Committee was approved on a motion made by Council-
woman McGinnis and seconded by Councilman Cash.

Mayor Ritter read the following Charge to the Airport Advisory Committee:
"The duties of the Airport Advisory Committee shall be advisory in
nature to the City Council and the City Manager. It shall inform the
Director of Traffic and Transportation as to the needs of the Beaumont
Municipal Airport users so that a continued process of improvement can be
carried out. It shall advise the City Council, City Manager and Director
of Traffic and Transportation concerning Airport matters and policy. It
shall maintain an awareness of General Aviation "State of the Art. " It
shall meet as required by the Chairman or the Director of Traffic and

Ordinance No. 77-3 appropriating $60 ,000 from unappropriated street con-
struction funds to the Crow Road Project was considered :

Resolution 77-5 authorizing negotiations with Mr. John Reedburg, Jr. ,
et al, and Mr. Martin Kennison, et a1, for right-of-way needed for the
extension of Grant Street (C.D. Block Grant - Census Tract 17 - B-76-MC-
48-0003) was approved on a motion made by Councilwoman McGinnis and se-
conded by Councilman Cash.

Ordinance No. 77-4 amending Chapter 12 of the Code of Ordinances of the
City of Beaumont (Personnel Policy) was considered:

THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT,
TEXAS, BY AMENDING VARIOUS SECTIONS PROVIDING
FOR EMPLOYEE REGULATIONS; REPEALING SECTION
12-27; PROVIDING FOR SEVERABILITY; PROVIDING
FOR REPEAL AND PROVIDING AN EFFECTIVE DATE.
The ordinance was approved on a motion made by Councilwoman McGinnis and
seconded by Councilman Williams.

Ordinance No. 77-5 amending the budget of the City of Beaumont, transfer-
ring funds from the Police Department budget to the Traffic and Transpor-
tation Department budget for the support of school crossing guards was
considered:

Resolution 77-6 'authorizing the release of weed liens against Jimmie
Wilson ($55. 00) , Edward Sigee ($13.02) , Clarence Provost ($55. 00 & $55 . 00),
Glenn Justice Mortgage Company, Inc. ($55. 00) , and Robert R. Shane ($55 . 00)
was approved on a motion made by Councilman Williams and seconded by Coun-
cilman Evans.

The first reading of an ordinance granting the Atchison, Topeka & Santa Fe
Railway Company a renewal franchise for Track No. 90 , crossing Blanchette
and Neches Streets was held:
AN ORDINANCE
AN ORDINANCE GRANTING TO THE ATCHISON, TOPEKA AND SANTA FE
RAILWAY COMPANY, ITS SUCCESSORS, ASSIGNS AND LESSEES, THE
RIGHT AND PRIVILEGE TO N�AINTAIN AND OPERATE AN INDUSTRY SPUR
TRACK NO. 90 ACROSS BLANCHETTE STREET AND NECHES STREET IN
THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, IN ACCORD WITH
EXHIBIT ATTACHED HERETO; PROVIDING THAT SAID TRACK SHALL BE
USED ONLY FOR THE PURPOSE OF LOADING, UNLOADING AND SWITCHING
TO INDUSTRIAL TRACK SERVING COMMERCIAL ENTERPRISE; PROVIDING
REGULATIONS AND RESTRICTIONS FOR THE USE OF SAID TRACK; PRO-
VIDING THAT SUCH MAINTENANCE AND OPERATION BE IN ACCORDANCE
WITH THE CHARTER AND ORDINANCES OF THE CITY AND THAT CERTAIN
MAINTENANCE WORK SHALL BE DONE AT THE DIRECTION OF THE CITY
ENGINEER; PROVIDING FOR THE ACCEPTANCE AND FEE HEREUNDER; PRO-
VIDING THAT THIS FRANCHISE IS SUBJECT TO THE CHARTER AND OR-
DINANCES OF THE CITY OF BEAUMONT AND PROVIDING FOR TERMINATION
FOR FAILURE TO USE THE TRACK FRANCHISED HEREUNDER; PROVIDING
FOR TERMINATION OF THIS FRANCHISE ON JANUARY 1, 1978 AND THE
RESTORATION OF SAID STREETS WITHIN NINETY (90) DAYS THEREAFTER;
AND PROVIDING FOR INDEMNIFICATION OF THE CITY OF BEAUMONT.

cilman Williams and seconded by Councilwoman McGinnis.
