The Pledge of Allegiance was led by Councilman .Cash. -000- The Mayor issued two proclamations: "Mental-Retardation Education Month in Beaumont" - January, 1976 ; and "Gladys City Day in Beaumont" - January 10 , 1976 . -000- Ordinance 76-1 authorizing the transfer of $.4 ,500 . from Contingency Fund Account #79-420 to General Fund Account #79-419 t0 coves the .cost of replacing a police car, and authorizing the advertisement for bids on same was considered: ORDINANCE NO. 76-1 ENTITLED AN ORDINANCE AMENDING THE BUDGET OF THE CITY OF BEAUMONT .ADAPTED__._S.EP_T_EMBER 23 , 1975, FOR THE FISCAL PERIOD BEGINNING OCTOBER 1, 1975 AND ENDING SEPTEMBEx ._30 ,, 197.6 , BY TRANSFERRING $4,500. 00 FROM CONTINGENCY FUND ACCOUNT NO. 79-420 TO GENERAL_.FUND ACCOUNT NO. 79-419 AND THENCE TRANSFERRED'. TO >FLEET MAINTE- NANCE CAPITAL ACCOUNT NO-98=50.3; AND AUTHORI- ING THE ADVERTISING OF BIDS FROM FLEET MAIN- TENANCE ACCOUNT NO. 98-503. The ordinance was approved on a motion made by Councilman Evans and seconded by Councilman Williams . Question: Ayes : All Nayes : None -000- Resolution 76-1 authorizing the award of bids -.for: furnishing twenty-five (25) fire hydrants for the Water Department to American Darling Valve, in the amount of $6 ,731. 75, this being the lowest .and. best bid received was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. Question: Ayes : All Nayes: None -000- Resolution 76-2 authorizing the award. of bids .for furnishing fifty-four (54) various sized garbage containers for the Solid Waste Department to McClain In dustries, in the amount of $16 ,223. 76 , this being the lowest and best bid re- ceived was approved on a motion made by Councilman Cash and seconded by Council- woman McGinnis. Question: Ayes : All Nayes : None -212- January 6 , 1976 Resolution 76-3 authorizing the award of bids _for_ furnishing one (1) suburban van for the Fleet Department., to GMC. Dixie, in the amount of $5 ,713 . 00 , this being the only bid received, was approved on -a motion .made by Councilwoman Mc- Ginnis and seconded by Councilman Cash. . Question: Ayes : : All Nayes : None -000- Resolution 76-4 authorizing the .award. of. b.ids_ for furnishing 1-1/2" and 2" water meters for the Water Department, to Rockwell International at a unit cost of $129 . 12 for 12 meters and $178.50 _for. 2" meters , and a trade-in allowance of $14. 00 each on 12" and $20 . 00 each on° 2" , this being .the . lowest and best bids received was approved on a. moti.on made by .Councilman Evans and seconded by Councilwoman McGinnis. Question: Ayes : All 000- Nayes : None - Resolution 76-5 authorizing the award of bids for furnishing various pieces of Fleet equipment to Kinsel Ford, in .the amount of. $3.0.,393 .41; Dixie GMC, in the amount of $6 ,633. 00; and Tideland' s_ International, in the amount of $101 ,241. 40 , these being the lowest and best bids received., was.. appr:ove.d on a motion made by Councilwoman McGinnis and seconded by Councilman Evans. (Equipment for re- placement for Solid Waste Department) Question: Ayes: All Nayes : None -000- Ordinance 76-2 amending subsections (A) III (1.) and (A) IV of Section 42-16 . 1 of Chapter 42 of the Code of Ordinances of the City of Beaumont, providing for a restriction on the sale of alcoholic beverages ; providing for indoor recreational uses ; providing for severability; and. .providing for repeal, was considered: ORDINANCE NO. 76-2 ENTITLED AN ORDINANCE AMENDING SUBSECTIONS (A) III (1) AND (A) IV OF SECTION 42-16 . 1 OF CHAPTER 4.2 OF THE CODE OF ORDINANCES OF THE CITY OF..BEAUMONT,- TEXAS, PROVIDING FOR A RESTRICTION ON THE SALE, OF ALCOHOLIC BEVERAGES; PROVIDING FOR INDOOR RECREATIONAL USES; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR REPEAL. The ordinance was approved on a._moti,on made by Councilwoman McGinnis and se- conded by Councilman Williams. Question: Ayes : All Nayes : None -000- Ordinance 76-3 amending the Fire Prevention:Code _of the City of Beaumont by ad- ding two (2) locations allowing above-ground storage of Liquified Petroleum Gas was considered: ORDINANCE. NO. 76-3 ENTITLED AN ORDINANCE AMENDING THE FIRE CODE OF THE CITY. OF BEAUMONT AS THE SAME AS FOUND IN CHAPTER 3 , SECTION 3-1. OF THE CODE OF ORDI- NANCES OF THE CITY OF BEAUMONT BY AMENDING SUBSECTION 13-1. 124 (L) BY ADDING TWO TRACTS OF LAND AND AMENDING SUBSECTION 13-1. 113 (F) TO PROVIDE A TEMPORARY PERMIT FOR RESIDENTIAL ABOVE-GROUND STORAGE OF- LP GAS, AND PROVIDE INSTALLATION REQUIREMENTS..:FOR ABOVE-GROUND LP GAS STORAGE FOR-.RETAIL PURPOSES; PROVIDING FOR REPEAL;. PROVIDING FOR SEVERABILITY; AND PROVID- ING A PENALTY. The ordinance (concerning Bill ' s Golden.: Txi_angle- Recreation Center, Eastex Free- way, and Ayres Mobile Homes, Cardinal Drive) was approved on a motion made by Councilman Cash and seconded by Councilman. Evans . Question: Ayes : All Nayes : None -213 January 6 , 1976 Ordinance 76-4 amending Section 34-4 . 1 of Chapter 34 of the Code of Ordinances of the City of Beaumont pertaining to the filing by the elderly for the Home- stead Exemption was considered: ORDINANCE NO. 76-4 ENTITLED AN ORDINANCE AMENDING SECTION 34-4 . 1 OF CHAPTER 34 OF THE CODE OF ORDINANCES OF THE CITY OF BEAUMONT PROVIDING. T.HAT PROOF OF AGE UNDER OATH MUST BE -MADE ONLY ONCE IN ORDER TO CLAIM THE FIVE_THOUSAND .AND N01100 ($5 ,000 . 00) DOLLAR EXEMPTION; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR REPEAL. The ordinance was approved on a motion made by Councilman Cash and seconded by Councilwoman McGinnis . Question: Ayes : All Nayes : None -000- Resolution 76-6 authorizing theCity Manager to execute an Assignment of Judgment of Lien to Texas Bank of Beaumont (non-payment of- taxes on property located on College Street) was approved on a motion made by Councilman Evans and seconded by Councilman Cash. Question: Ayes : Councilman: Cash Abstained: Mayor Ritter Councilwoman McGinnis Councilman Williams Councilman Evans -000- Resolution 76-7 authorizing commencement of negotiations with the owner, Alvin Randolph, of the East one-half of Lot 11, Block 2 , Flowers Addition of the City of Beaumont, for acquisition for expansion of the Sabine Pass Fire Station and authorization to offer to the owner the sum of $1,400 . , this being the appraised value of said property, was approved on a motion made by Councilman Cash and seconded by Councilman Evans . Question: Ayes : All Nayes : None -000- Resolution 76-8 authorizing payment to., Orgain, Bel.l _& Tucker for attorney' s fees and reimbursable expenses incurred in the defense of the lawsuit Vincent William Brown vs. Willie Bauer, et al, in the total amount of $12 ,173 .14 , was approved on a motion made by Councilman Cash and seconded by Councilwoman McGinnis. Question: Ayes : All Nayes : None -000- Resolution 76-9 authorizing the City to have a police car reparied by Kinsel Ford Motor Company at a cost of $1,502 . 24., was approved on a motion made by Coun- cilman Evans and seconded by Councilman Cash. Question: Ayes : All Nayes : None -000- Ordinance 76-5 transferring $14 ,008. from unappropriated Sewer Funds to Pro Rata Construction Account to provide the City ' s share of cost for sewer extensions in Gulf Terrace and along U. S. Highway 69 was considered: ORDINANCE NO. 76-5 ENTITLED AN ORDINANCE AMENDING THE BUDGET OF THE CITY OF BEAUMONT ADOPTED_ SEPTEMBER 23 , 1975 , FOR THE FISCAL PERIOD BEGINNING OCTOBER 1 , 1975 AND ENDING SEPTEMBER 30 , 1976 , BY TRANSFERRING $14 ,008 .00 FROM RETAINED EARNINGS ACCOUNT NO. 3000 TO PRO RATA CONSTRUCTION AC- COUNT NO. 2302 . -214- January 6 , 1976 The ordinance was approved on a motion made by Councilman Cash and seconded by Councilman Evans . Question: Ayes : All Nayes : None -000- Ordinance 76-6 authorizing the transfer of $7,500 . 00 from unappropriated funds in the Sewer Fund to Sewer Maintenance - Special Services Account, and also authorizing payment of the $7 ,500 . 00 to_ Tuiner, Collie & Braden, Inc. and Schaum- burg & Polk, Inc. for services rendered in preparation of the infiltration/inflow grant application was considered: ORDINANCE NO. 76-6 ENTITLED AN ORDINANCE. AMENDING THE BUDGET OF THE CITY OF BEAUMONT :ADOPTED SEPTEMBER 23 , 1975 , FOR THE FISCAL.PERIOD :.BEGIN:N.ING OCTOBER 1, 1975, AND ENDING .SEPTEMBER 30 , 1976, BY TRANSFERRING $7 ,500 . 00 FROM RETAINED EARNINGS ACCOUNT NO. 300.0. IN THE .SEWER FUND TO SEWER MAINTENANCE, SPECIAL.;:SERVICES.'ACCOUNT NO. 92 415 ; AND AUTHORIZING PAYMENT OF THIS $7 ,500 . 00 TO TURNER, COLLIE & B.RADEN,- INC. AND SCHAUMBURG & POLK, INC. FOR SERVICES RENDERED IN PREPARA- TION OF INFILTRATION/INFLOW GRANT APPLICATION. The ordinance was approved on a motion made by Councilwoman McGinnis and'lsecanded by Councilman Evans. Question: Ayes: All Nayes: None -000- Resolution 76-10 approving the budget ($193,535 .87) for the Beaumont Convention and Visitors Bureau, and authorizing the disbursement of funds, was approved on a motion made by Councilwoman McGinnis and seconded by Councilman Cash. Question: Ayes : All Nayes : None -000- Mr. Victor Russell, 2294 Broadway, addressed Council to complain about the conditions of railroad crossings.
