CITY COUNCIL - CITY OF BEAUMONT
HELD JANUARY 2, 1990, 1:15 P.M.
BE IT REMEMBERED that the City Council of the City of Beaumont, Texas,
met in regular session this the 2nd day of January, 1990, with the
following present:

The Invocation was given by the Reverend Herbert Malvo of Greater Rising
Sun Baptist Church.
The Pledge of Allegiance was led by Councilman Smith.

Mayor Meyers said that Councilman Moore is out of the city and possibly
will be unable to attend Council.

Mayor Meyers called an Executive Session immediately following Workshop
Session of City Council, pursuant to Section II (g) of the Texas Open
Meetings Act of the State of Texas to consider appointment, employment,
evaluation, reassignment, duties, discipline, or dismissal of a public
officer or employee.
(Councilman Samuel arrived. )

Mayor Meyers read a letter from Mr. Joseph Hagen, Deputy Assistant for
the President's Appointments and Scheduling, thanking him for an

invitation for President Bush to attend the grand opening of the Texas
Energy Museum on January 10, 1990, at 10:00 a.m. , but regretfully
declined because of the events in President Bush's calendar and said that
President Bush asked that his very best wishes be conveyed with sincere
appreciation. Mayor Meyers said the primary conflict is with President
Bush's State of the Union Address to be given a few days after the
dedication of the Energy Museum. Governor Bill Clements will give the
dedicatory message at the grand opening of the museum. The public is
invited to attend the grand opening beginning at 10: 00 a.m. , with the
formal ceremony beginning about 10: 30 a.m. , a ribbon cutting about 11:45
a.m. and climaxing with a dinner for Eddie Childs.
(Councilman Moore arrived. )
Mayor Meyers also received a letter from Goodyear Corporation accepting
the invitation for the Goodyear Blimp America to participate in the
Martin Luther King, Jr. Walk-a-thon on January 15, 1990. The blimp will
follow along the route from Babe Zaharias Park to the Montagne Center
down Martin Luther King, Jr. Parkway. Details and specifics will be
announced as they become available.

Citizen comment was invited on the Consent Agenda and Main Agenda items 3
and 4 . No one wished to address these items.

The following Consent Agenda items were considered:
Approval of the Minutes of the regular City Council session held December
19, 1989;
Resolution No. 90-1 authorizing Texas Commerce Bank-Beaumont to release
$700, 000. 00 in securities held at the Federal Reserve Bank of
Dallas/Houston Branch and to pledge $720, 000. 00 in securities effective
January 2, 1990;
Resolution No. 90-3 appointing Ben Hansen and Jo Ann Polk to the Sister
City Commission with terms expiring December 31, 1991; and
Resolution No. 90-4 granting a five-foot-wide easement for a distance of
304 . 61 feet to Gulf States Utilities Company for underground electrical
service to provide power for security lighting for the Garden Center
parking lot on Tyrrell Park.
The Consent Agenda was approved on a motion made by Councilman Cokinos
and seconded by Councilman Samuel.

A public hearing was called to consider a proposed Fiscal Year 1991
Program of Projects for the Beaumont Municipal Transit System. The
program will be the basis for grant applications of $1,425, 000 in
Federal funds to help finance the system's operation ($625, 000) and pay
80% ($800, 000) of the cost of five new buses to complete the phase-out of
1975 buses.
No one wished to address the subject, and Mayor Meyers declared the
public hearing closed.
Resolution No. 90-2 authorizing filing an application with the U. S.
Department of Transportation and the Texas State Department of Highways
and Public Transportation for an operating assistance grant for the
transit system pursuant to Section 9 of the Urban Mass Transportation Act
of 1964, as amended; authorizing filing any other document required by
the U. S. Department of Transportation effectuating the purposes of Title
VI of the Civil Rights Act of 1964; and authorizing execution of
affirmative disadvantaged and women-owned business policies in connection
with the project's procurement needs was approved on a motion made by
Councilman Cokinos and seconded by Councilman Moore.

An ordinance requesting a specific use permit for a nightclub and
drinking place featuring jazz, disco music and comedy entertainment
(between 4: 00 p.m. and 2 : 00 a.m Wednesday through Friday and 8: 00 p.m. to
2: 00 a.m. Saturday and Sunday) in the Parkdale Plaza II Shopping Center
at 4310 Dowlen Road in an area zoned GC-MD as requested by Steven Daniels
and Levi Mays of Houston was considered. Mr. Riley stated that notices
were sent to owners of property within two hundred feet of the proposed
nightclub, and that no responses, positive or negative, were received.
Subsequently, questions have been raised regarding the people within the
two-hundred-foot area receiving notice of the public hearing conducted on
December 18, 1989 . Files show six owners were notified, two of which
were sent to a trustee of the property.
Because of the questions raised by citizens regarding notification to
property owners within the two-hundred-foot area and his feelings that
even though the City has legally honored its obligations to send notices
of the public hearing, possibly the legal act did not provide the
information to the property owner, and stating "it's best not to hide or
stay behind legal action, " Mayor Meyers made a motion, seconded by
Councilman Cokinos, this item go back to the Planning and Zoning
Commission for future consideration.

Resolution No. 90-5 authorizing execution of a facilities agreement with
the Texas Department of Corrections and Jefferson County regarding

services and facilities to be provided for the new $64 million maximum
security prison to be constructed south of the City limits was approved
on a motion made by Councilman Cokinos and seconded by Councilman Lee.

Ordinance No. 90-1 considering a request by Bruce Hensel for abandonment
of the north five feet of a 15-foot-wide utility easement along the south
side of the lot at 1310 Audubon Place in Lot 13, Block 1, Audubon Place
Addition was considered:

THE NORTH FIVE FEET (51 ) OF A 15-FOOT WIDE
DEDICATED GENERAL UTILITY EASEMENT LOCATED
ALONG THE SOUTH 15 FEET OF LOT 13 , BLOCK 1,
AUDUBON PLACE ADDITION, BEAUMONT, JEFFERSON
COUNTY, TEXAS.
Ordinance No. 90-1 was approved on a motion made by Councilman Lee and
seconded by Councilman Moore.

Mayor Meyers questioned indoctrination sessions for new appointees to
Boards and Commissions and asked the City Manager to review appointments
to Boards and Commissions and evaluate success of pre-meeting
orientation.
Councilman Brumley wished citizen and Council a successful and happy new
year and said he is looking forward to the year ahead.
Councilman Lee expressed wishes for a happy new year and said he looks
forward to the opening of the Energy Museum, and it will be a special
time for citizens of Beaumont and all of Southeast Texas.
Councilman Cokinos wished everyone in Beaumont and the surrounding area a
happy new year filled with prosperity and good health.
Councilman Moore added his wishes for a happy new year, asked Mr. Riley
when the traffic light will be installed on Buford and Irving because of
serious traffic problems, and asked that the Health Department contact
Modern, Inc. on Irving regarding burning (rubbish/trash) complaints by
residents in the area creating burning eyes and coughing situations.
Councilman Samuel extended new year greetings and asked Mr. Riley for a
status report on the Helbig Street repairs and a traffic light due to be
installed at Bigner and Lucas.

Councilman Smith conveyed wishes for a happy new year and hope that our
economic progress continues upward.
Mayor Meyers added his wishes for a year of good health and prosperity to
everyone in 1990. He encouraged all citizens to attend the dedication of
the Texas Energy Museum on January 10, 1990 at 10:00 a.m. He said
Beaumont will house one of the finest energy museums in the world, and
that people will come from all over the world to see this facility. "It
is beyond all expectations" and something of which to be extremely
proud. He restated that Governor Clements will give the dedicatory
address at the dedication and at a dinner following for Eddie Childs. He
said this is going to be a very meaningful day. It is the 89th
anniversary of Spindletop Oilfield coming in. This particular date for
the dedication was chosen because of the symbolism of another beginning
of greatness for our community.

Mrs. Delia Harrington, 815 Willow Street, addressed Council to wish them
and those in the audience a happy and prosperous new year.
Mrs. Henry Dannenbaum, 1567 Wall Street, addressed Council to wish them a
happy new year in 1990 and ask if we could all stand in a moment of
silent prayer for the Reverend Charles Williams, a great humanitarian,
who died of congestive heart failure over the weekend.
Mayor Meyers invited Council and the audience to stand for a moment of
silent prayer in memory of the Reverend Charles Williams.

There being no further business, the meeting was recessed before
continuing with the Workshop Session.
