The City Council of the City of Beaumont, Texas, met in a regular session on January 6, 2004,
at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider
the following:

Consent Agenda
Mayor Evelyn Lord called the meeting to order at 1:30 p.m. Lane Nichols, City Attorney gave the
invocation. Councilmember Nancy Beaulieu led the Pledge of Allegiance. Roll call was made by
Tina Broussard, City Clerk's Office.
Present at the meeting were Mayor Lord, Mayor Pro Tern Ames, Councilmembers Smith,
Beaulieu, Cokinos, Samuel and Patterson. Also present were Kyle Hayes, City Manager; Lane
Nichols City Attorney; and Tina Broussard, City Clerk's Office.

Public Comment: Persons may speak on scheduled General Business Agenda Items 2-3 or on
the Consent Agenda.
Bea Klages 110 Woodmanor Sour Lake, TX
Ms. Klages addressed council regarding Item No. 2 on the agenda. She thanked Council for their
commitment to the Garden Council in the past and asked Council to consider passing Item No.
2 on the agenda.

A) Approve signatories of the new Workers Compensation Account - Resolution 04-
001
B) Approve the acceptance of a fifteen foot (15') wide drainage easement out of the
Washington West Addition - Resolution 04-002
Councilmember Cokinos moved to approve the Consent Agenda. Mayor Pro Tern Ames
seconded the motion.

GENERAL BUSINESS
1. Consider approving a request for a zone change from RM-H (Residential Multiple Family
Dwelling-Highest Density)to GC-MD-2 (General Commercial-Multiple Family Dwelling-2)
District for the property extending from the south side of Phelan to south of Calder and
from west of Mathews and Pinchback to the east side of the DD#6 Amelia Cutoff Ditch.
Councilmember Cokinos asked that Council defer Item No.1 for one week.
Mayor and Council agreed to defer Item No. 1.
2. Consider authorizing the City Manager to execute the renewal of a Management
Agreement with Beaumont Council of Garden Clubs (BCGC)-Resolution 04-003
Administration recommends the renewal of a five (5) year Management Agreement with
BCGC, for maintaining and managing the botanical garden, garden council building, and
Warren Loose Conservatory at the Tyrrell Park Garden Center.
The BCGC has occupied the Garden Center at Tyrrell Park since 1971. For management
services provided,the City will pay the BCGC the sum of$2,000 per month, during the five
year agreement.
The City is responsible for maintenance of the grounds and buildings during the term of the
Agreement. BCGC provides the general liability insurance forthe operations at the Center.
Other terms of the agreement are substantially the same as in prior years.

Councilmember Patterson moved to approve RESOLUTION 04-003 TO CONSIDER AUTHORIZING
THE CITY MANAGER TO EXECUTE THE RENEWAL OF A MANAGEMENT AGREEMENT WITH BEAUMONT
COUNCIL OF GARDEN CLUBS (BCGC). Mayor Pro Tern Ames seconded the motion.

3. Consider award of a grounds maintenance contract - Resolution 04-004
Administration recommends the award of a three (3) year contract, with an effective date
of February 1, 2004, to Perfect Cut Lawn Care of Beaumont to provide grounds
maintenance services at Tyrrell Park.
Grounds maintenance atthe 125 acre park includes weekly mowing,sweeping,edging and
daily litter removal from the park during the growing season (March 1 through November
30). The non-growing season ( December 1 through February 28) requires bi-weekly
mowing, edging and sweeping of the grounds. Daily litter removal is required throughout
the year.
Perfect Lawn Care maintains the grounds at the Fair Park, the Elmo Willard Library and
the Theodore Johns Library, the current contract price is $65,685.00 annually.
The estimated annual cost is $52,234.72. Funds are available in the Parks and Property
Services Division's budget.
Councilmember Smith moved to approve RESOLUTION 04-004 TO CONSIDER THE AWARD OF
A GROUNDS MAINTENANCE CONTRACT. Councilmember Patterson seconded the motion.

COUNCILMEMBER COMMENTS
COUNCILMEMBER BEAULIEU- WISHED EVERYONE A HAPPY NEW YEAR. SHE ENCOURAGE
EVERYONE THAT HAS NOT HAD AN OPPORTUNITY TO SEE THE CONSERVATORY, TO GO OUT TO
TYRRELL PARK AND SEE THE WORK THAT THE COUNCIL OF GARDENS HAS DONE.
COUNCILMEMBER COKINOS -WISHED EVERYONE A HAPPY NEW YEAR.
COUNCILMEMBER SAMUEL-WISHED EVERYONE A HAPPY NEW YEAR. COUNCILMEMBER SAMUEL
ALSO WANTED TO LET THE RESIDENTS ALONG BENNET ROAD KNOW THAT THE CONCERNS
REGARDING THE WHOLES IN THE STREET HAVE BEEN ADDRESSED. HE ALSO THANKED STAFF FOR
TALKING TO THE CONTRACTORS ALONG HELBIG ROAD.
COUNCILMEMBER PATTERSON -WISHED EVERYONE A HAPPY NEW YEAR. SHE ALSO ASKED THE
CITY MANAGER WHAT DATE THE VIRGINIA STREET PROJECT WOULD START.
COUNCILMEMBER SMITH -WISHED EVERYONE A HAPPY NEW YEAR.THANKED THE GARDEN CLUB
FOR THE WORK THEY HAVE DONE OVER THE YEARS. IT HAS BEEN A WONDERFUL PARTNERSHIP
AND THAT SHE LOOKED FORWARD TO SEVERAL MORE YEARS OF WORKING TOGETHER.
MAYOR PRO TEM AMES-WISHED EVERYONE A HAPPY NEW YEAR. SHE THANKED THE BEAUMONT
COUNCIL OF GARDEN CLUB FOR A BEAUTIFUL JOB THEY ARE DOING OUT AT TYRRELL PARK.
MAYOR LORD -STATED THAT SHE HAD THE PRIVILEGE OF GOING OUT TO SAY GOOD BYE TO ONE
OF THE UNITS THAT'S BEING DEPLOYED AND THAT SHE LOOKS FORWARD TO WELCOMING THEM
HOME IN THE NEAR FUTURE.

Thanked Council for replacing the light at Dowling and Gladys and discussed various other issues
regarding the City
