ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF
THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, AND
IN PARTICULAR THE BOUNDARIES OF THE ZONING
DISTRICTS, AS INDICATED UPON THE ZONING MAP OF
BEAUMONT, TEXAS, BY CHANGING THE ZONING OF
PROPERTY PRESENTLY ZONED RS (RESIDENTIAL
SINGLE FAMILY DWELLING) DISTRICT TO GC-MD
(GENERAL COMMERCIAL - MULTIPLE FAMILY DWELLING)
DISTRICT FOR A 1.826 ACRE TRACT OUT OF THE A.
HUSTON SURVEY, BEAUMONT, JEFFERSON COUNTY,
TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR
REPEAL AND PROVIDING A PENALTY.
BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 30 of the Code of Ordinances of Beaumont, Texas, and in particular
the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of
Beaumont, referred to in Section 30-513 thereof, is hereby amended by changing the
zoning of property presently zoned as RS (Residential Single Family Dwelling) District to
GC-MD (General Commercial - Multiple Family Dwelling) District for a 1.826 acre tract out
of the A. Huston Survey, Beaumont, Jefferson County, Texas, as described in Exhibit "A"
and shown in Exhibit"B" attached hereto and made a part hereof for all purposes, and the
official zoning map of the City of Beaumont is hereby amended to reflect such changes.
Section 2.
That, in all other respects, the use of the property hereinabove described shall be
subject to all of the applicable regulations contained in Chapter 30 of the Code of
Ordinances of Beaumont, Texas, as amended.
Section 3.
That if any section, subsection, sentence, clause of phrase of this ordinance, or the
application of same to a particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end, the various portions and provisions of this ordinance are
declared to be severable.
Section 4.
That all ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
Section 5.
That any person who violates any provision of this ordinance shall, upon conviction,
be punished, as provided in Section 1-8 of the Code of Ordinances of Beaumont, Texas.

LEGAL DESCRIPTION FOR ORDINANCE PURPOSES
FIELDNOTE DESCRIPTION of a 1.826 acre triangular shaped tract of land lying
in the A. Huston Survey, Abstract No. 33, Beaumont, Jefferson County, Texas and
being out of that certain 29.519 acre tract of land conveyed to H.G. Nichols, Sr., H.G.
Nichols, Jr., Reed E. Nichols, Kenneth B. Nichols, and R. Allan Nichols as recorded
by deed in Volume 2362, Page 461 of the Deed Records of Jefferson County, Texas,
said tract of land being more fully bounded and described as follows:
BEGINNING at the most westerly corner of the herein described tract, said corner
being located in the south line of Dishman Road and marked by an iron rod with a
DD6 (Drainage District No. 6) aluminum cap, said corner also being the northeast
corner of a 110 foot (110') wide Drainage District No. 6 right-of-way (Ditch No. 202-
E) as recorded in Film Code 103-43-0139 of the Real Property Records of Jefferson
County, Texas;
THENCE with the north line of the aforesaid 29.519 acre tract, the south line of
Dishman Road, and the north line of the herein described tract, North 89 degrees 59
minutes 50 seconds East (N 89°59'50"E) for a distance of 352.48 feet (352.48') to the
northeast corner of the herein described tract,said corner being the northwest corner
of that certain 0.2755 acre tract dedicated to the City of Beaumont by deed recorded
in Volume 1995, Page 456 of the Deed Records of Jefferson County, Texas;
THENCE with the east line of the herein described tract, South 00 degrees 00
minutes 47 seconds East (S OOo00'47E) at 30 feed (30') pass the southwest corner
of the aforementioned City of Beaumont 0.2755 acre tract and continuing along said
course for a total distance of 451.21 feet (451.21') to the southeast corner of the
herein described tract, said corner being in the northeasterly line of said DD6 right-
of-way (ditch No. 202-E);
THENCE with the northeasterly line of said DD6 right-of-way and the southwesterly
line of the herein described tract, North 38 degrees 00 minutes 22 seconds West (N
38000'22"W) for a distance of 572.61 feet (572.61') to the PLACE OF BEGINNING.
CONTAIN-ING IN AREA 1.826 acres of land, more or less.
