HomeMy WebLinkAboutORD 79-38 ORDINANCE NO. 1022250 ENTITLED AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE 79-37 VACATING AND .?-�akrq- DONING A TWENTY (20) FOOT ALLEY RT JARRETTE ADDITION TO THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS, AS DESCRIBED HEREIN, PROVIDING THAT A 5 X 15 FOOT PORTION BE RETAINED IN THE ALLEY T EY FOR A UTILITY EASEMENT; PROVIDING FOR SEVER.- ABILITY. WFM,EAS, on D7ay 8, 1979 the City Council of the City of Beaumont passed Ordinance 79-37 abandoning a twenty (20) foot alley easement in the Jarrette Addition to the City of Beaumont; and, AREAS, the property description of said abandonment erroneously described the alley as being located between Blocks 23 and 24 of said Addition instead of correctly described the said alley as lying within Block 23 of said Addition; and, WHEREAS, the City Council of the City of Beaumont desires to correct said error; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF BEAUMONT: Section 1. That Section 1 of Ordinance 79-37 be amended to read as follows: BEING a 20 foot wide alley that lies in Block 23 of the Jarrette Addition, a subdivision recorded in Vol. 3 Page 175 of the Map Records of Jefferson County, Texas and said 20 foot wide alley being more particularly described by metes and bounds as follows: BEGINNING at an iron stake in the South line of a 12 foot wide alley locating the Northwest corner of Lot 22 of Block 23 of said Jarrette Addition and in the East line of a 20 foot wide alley locating the Northeast and the beginning corner of the tract of land herein described; 1 OF South 1° 03' East with the East line of said alley and with the Plest line of Lot 22, 21, 20, 19 and 18 of said Block 23 a distance of 125.0 feet to a point for corner in the North line of the now abandoned Missouri Pacific Railroad 100 foot wide right-of-way; said point also locates the Southwest corner of said Lot 18; THENCE South 891 04' 33" West with the North line of the now abandoned Missouri Pacific Railroad right-of-way a distance of 20.0 feet to a point locating the Southeast corner of Lot 17 Block 23 of Jarrette Addition; THENCE North 11 03' West with the East line of Lots 17, 16, 15, 14 and 13 of said Block 23 a distance of 125.0 feet to a point for corner locating the Northeast corner of Lot 13 of said Block 23 and lying in the South line of a 12 foot wide alley; THENCE North 89° 04' 33" East with the South line of said alley a distance of 20.0 feet to the place of beginning. Save and except a 5 foot wide and 15 foot long portion of said alley as described as follows: FOR Locative corner begin at an iron stake locating the Northwest corner of Lot 22 of Block 23 of said Jarrette Addition and lying in the South line of a 12 foot wide alley; THENCE South 890 04' 33" West with the South line of said alley a distance of 7.5 feet to a point locating the Northeast and beginning corner of the 5 foot wide and 15 foot long tract of land herein described.; THENCE South 10 03' East a distance of 15.0 feet to a point corner; THENCE South 89° 04' 33" West a distance of 5.0 feet to a point for corner; THENCE North 1° 03' West a distance of 15.0 feet to a point for corner; THENC P North 890 04' 33" East a distance of 5.0 feet to the place of beginning, be, and the same is hereby, vacated and abandoned, and that title to such property shall revert to and become the property of the persons entitled thereto, as provided by law, providing, however, that a 5 X 15 foot portion of the alley be retained by the City of Beaumont for utility purposes only; title to such property, other than the rights retained by the City of Beaumont herein, shall revert to and become the property of the persons entitled thereto, as provided by law. Section 2. That if any section, subsection, sentence, clause or phrase of this ordinance, or the application of same to a particular set of Persons or circumstances, should for any reason be held to be invalid, such invalidity shall not affect the remaining portions of this ordinance, and to such end the various portions and provisions of this ordinance are declared to be severable.
