Riley,City Manager Patrice Fogarty,City Clerk The City Council of the City of Beaumont, Texas, met in a regular session on December 23, 1997, at the City Hall Council Chambers, 801 Main Street, Beaumont, Texas, at 1:30 p.m. to consider the following: OPENING *Invocation Pledge of Allegiance Roll Call *Presentations and Recognition *Public Comment: Persons may speak on scheduled agenda items *Consent Agenda Mayor Moore called the meeting to order at 1:36 p.m. The Reverend Dr. Jim Killen, Trinity United Methodist Church, gave the invocation. Four members of Boys Scout Troop 601, led the pledge of allegiance. (Troop Leader Bob Harris was present with the four scouts who are attending Council as part of the requirements for earning the Citizenship in the Community Merit Badge for Eagle Scouts.) Present at the meeting were: Mayor Moore, Mayor Pro Tem Ames, Councilmembers Smith, Cokinos, and Davis . Councilmembers Goodson and Patterson were absent. Also present were Ray A. Riley, City Manager; Tyrone Cooper, Assistant City Attorney; Patrice Fogarty, City Clerk; and Barbara Liming, Deputy City Clerk. *Presentations and Recognition City Manager Ray Riley presented the Finance Department with the Certificate of Achievement for Excellence in Financial Reporting for the fiscal year ending 1996 and the Distinguished Budget Presentation Award from the Government Finance Officers Association. The City of Beaumont has received the Certificate of Achievement of Excellence in Financial Reporting for eleven successive years. This is the first year to enter the program for the Distinguished Budget Presentation Award. Finance Officer Beverly Hodges accepted the awards and introduced Controller Paula Labrie, Budget Officer Andrea Deaton, Staff Accountants Ed Scott, Peggy Rhame, and Janice Ridley. *Public Comment: Citizens were invited to comment on the Consent Agenda and Main Agenda Items 4 through 6. No one wished to address these subjects. CONSENT AGENDA The following consent agenda items were considered: Approval of the minutes of the regular meeting held December 16, 1997; Confirmation of committee appointments - Resolution No. 97-332 A) Approve the purchase of a centrifugal trash pump for use in the Landfill Division/Solid Waste Department (Service Pump & Compressor, Inc., $17,572) - Resolution No. 97-333 B) Accept a Street Easement located at the northeast corner of the intersection of State Highway 105 and R.F.D. Road (from Madison West Properties, Inc.) - Resolution No. 97- 334 C) Approve participation in the funding of an analytical study related to efforts to secure jet service to the Jefferson County Airport (Barry Clark & Associates conduct study for Jefferson County, City of Beaumont, City of Port Arthur, and Southeast Texas Aviation Committee for $16,918 or $4,229.50 each entity) - Resolution No. 97-335 Councilmember Cokinos moved to approve the Consent Agenda. Mayor Pro Tem Ames seconded the motion. MOTION PASSED. Ayes: Mayor Moore, Mayor Pro Tem Ames, Councilmembers Smith, Cokinos, and Davis Noes: None GENERAL BUSINESS 1. Consider a request for a zone change from RS (Residential Single Family Dwelling) to GC- MD (General Commercial-Multiple Family Dwelling) for property located at 3990 Baldwin at Concord Road (The Planning Commission recommended denial of this zone change.) Mayor Pro Tem Ames moved to deny an Ordinance ENTITLED AN ORDINANCE AMENDING CHAPTER 30 OF THE CODE OF ORDINANCES OF BEAUMONT,AND IN PARTICULAR THE BOUNDARIES OF THE ZONING DISTRICTS, AS INDICATED UPON THE ZONING MAP OF BEAUMONT, TEXAS, BY CHANGING THE ZONING OF PROPERTY PRESENTLY ZONED RS (RESIDENTIAL SINGLE FAMILY DWELLING) DISTRICT TO GC-MD (GENERAL COMMERCIAL- MULTIPLE FAMILY DWELLING) DISTRICT FOR PROPERTY LOCATED AT 3990 BALDWIN AT CONCORD ROAD IN BEAUMONT, JEFFERSON COUNTY, TEXAS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL AND PROVIDING A PENALTY. Consider a request for a specific use permit to allow the construction and operation of a carwash in an NC (Neighborhood Commercial) District Councilmember Cokinos moved to adopt Ordinance No. 97-68 ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW THE CONSTRUCTION AND OPERATION OF AN AUTOMATED THREE BAY CARWASH IN AN NC (NEIGHBORHOOD COMMERCIAL)DISTRICT LOCATED ON THE NORTH SIDE OF PHELAN BLVD.,400 EAST OF MATTHEWS ROAD, IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. Mayor Pro Tem Ames seconded the motion. MOTION PASSED. Ayes: Mayor Moore, Mayor Pro Tem Ames, Councilmembers Smith, Cokinos, and Davis Noes: None 3. Consider a request for a specific use permit to allow a caretaker's quarters to be located in an RS (Residential Single Family Dwelling) District at 990 Glendale Mayor Pro Tem Ames moved to adopt Ordinance No. 97$9 ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE PERMIT TO ALLOW A CARETAKER'S QUARTERS IN AN RS (RESIDENTIAL SINGLE FAMILY DWELLING) DISTRICT LOCATED AT THE REAR OF THE HOUSE AT 990 GLENDALE, IN THE CITY OF BEAUMONT, JEFFERSON COUNTY, TEXAS. Councilmember Smith seconded the motion. MOTION PASSED. Ayes: Mayor Moore, Mayor Pro Tem Ames, Councilmembers Smith, Cokinos, and Davis Noes: None 4. Consider the purchase of a fire pumper for use in the Fire Department Councilmember Cokinos moved to approve Resolution No. 97-336 authorizing purchase of a Pierce Lance 1,500 gallon per minute aluminum custom chassis fire pumper in the amount of$314,726 through the Houston-Galveston Area Council. Consider approving a fire test research project to be conducted at the Beaumont Fire Training facility Councilmember Cokinos moved to approve Resolution No. 97-337 authorizing Steel Shipping Container Institute of Washington, D.C. to conduct fire tests to develop criteria for the storage of 55 gallon drums with them providing up to $170,000 to construct a 6,400 square foot metal building for drum storage. Mayor Pro Tem Ames seconded the motion. MOTION PASSED. Ayes: Mayor Moore, Mayor Pro Tem Ames, Councilmembers Smith, Cokinos, and Davis Noes: None 6. Consider the purchase of a dump truck for use in the Sewer Maintenance Division/Water Utilities Councilmember Smith moved to approve Resolution No. 97-338 authorizing purchase of one medium duty crew cab truck chassis equipped with a 4-5 cubic yard dump body be purchased from Lawrence Marshall Chevrolet-Olds, Inc. of Hempstead in the amount of $49,973. Mayor Pro Tem Ames seconded the motion. MOTION PASSED. Ayes: Mayor Moore, Mayor Pro Tem Ames, Councilmembers Smith, Cokinos, and Davis Noes: None OTHER BUSINESS * Report from Golden Triangle Minority Business Council Mrs. Beverly Hatcher, president of the Golden Triangle Minority Business Council spoke to Council regarding a partnership with the City of Beaumont and funding of $25,000 for an economic development project and a business information center described in Exhibit "A." Mrs. Hatcher explained the group's non-profit status and stability and complimented the City's commitment to the success of minority businesses and stated that educating and training will be a future priority. Also, Mrs. Hatcher commended Purchasing Director Brenda Beadle for facilitating the Minority Business Enterprise program through the City of Beaumont's Purchasing Division. She complimented Mrs. Beadle's successful efforts in sharing and teaching use of the fax and internet programs regarding bidding procedures and information and thanked her for this new vehicle for minority businesses to receive information. Mr. Josh Allen, treasurer for the Golden Triangle Minority Business Council, and Mr. Jim Pavlovich of Mobil Oil Corporation supported the request for a partnership with the City of Beaumont and funding in the amount of $25,000. Mrs. Hatcher added Minutes; 12 123197;Page 4 information about a Business Information Center (BIC) received from Mr. Milton Wilson, District Director of the Small Business Administration, described in Exhibit "A" and said the closest Small Business Administration office is located in Houston. * Review plans for Municipal Court Building Central Services Director Kirby Richard gave a brief update of the renovation of the recently acquired White House building at 720 Orleans to be used for a new municipal court facility, as shown in Exhibit "B." He said that asbestos materials have been removed, roofing repairs are anticipated to be completed soon, drawings should be completed in January, construction begin in March and completed in approximately 200 calendar days or about October, 1998. Engineer Milton Bell reviewed the types of materials to be used for interior and exterior renovations and displayed samples of acoustical materials for the walls, the type of wood to be used on the walls and exterior tile. He explained design and layout of the court, security measures, type of work units, and an air conditioning design using a central chiller that can be enlarged at minimal expense to cool the entire building, if desired, at a later date. Mr. Bell said he has worked closely with Municipal Court staff, and they have contributed useful design suggestions to better serve the public efficiently. Council questions included installation of ATM's, a night depository and the enhancement the refurbished building will give to the downtown area. Mr. Bell said a night depository has been included and the suggestion of an ATM is a good idea to be considered. COMMENTS * Councilmembers comment on various matters: Councilmember Goodson wished everyone a Merry Christmas and Happy New Year. Councilmember Smith added holiday greetings to everyone, especially to City staff for being enjoyable to work with and for providing necessary information in a timely fashion this past year, and to fellow City Councilmembers. Councilmember Davis joined Council in extending holiday wishes and said he is looking forward to next year. Minutes;12123/97;Page 5 City Manager Ray Riley thanked Council for a wonderful year, probably the best ever, and on behalf of the staff and employees of the City, wished Council a Merry Christmas and Happy New Year. City Clerk Patrice Fogarty said this has been a great year for the Clerk's office, a great learning experience, that we have great bosses and added holiday greetings to everyone. Assistant City Attorney Tyrone Cooper wished everyone a happy and safe holiday season. Mayor Moore expressed delight in activities of 1997, wished everyone a great holiday season, added his encouragement to balance busy and active schedules with a time for family and to reflect on the past year. He expressed appreciation for the team with whom he has worked this past year that includes Council, staff, citizens and young people in the community who add contributions to Beaumont. He commented about the good corporate citizens in our community and reviewed some of their contributions. Mayor Moore said that giving and caring should not be seasonal and challenged everyone to make 1998 an even better year than 1997. He added hopes that citizens will share the vision of Council for Beaumont, wished everybody a happy holiday season and asked that they join him in looking forward to a fantastic year in 1998. * Public Comment (Persons are limited to 3 minutes.) Mr. Greg Shepherd, 7880 Stone Circle, extended holiday greetings and wishes for a prosperous new year to Council. Mr. Benny Mendoza, 5655 South Kenneth, announced a January 15th meeting for the Avenues Neighborhood Association and added holiday greetings to Council. Riley,City Manager From: Kirby Richard, Central Services Director Subject: New Municipal Court Building COMMENTS In February,City Council was presented with a proposal to renovate the first floor of the newly acquired White House building located at 720 Orleans for use as a new municipal court facility. The purpose of this memorandum is to provide an update on the renovation project. - 1,;A Since the presentation,all asbestos containing material . (ACM)has been removed from the building. The total cost of the ACM abatement, including specification preparation and project management is $128.507. t r Unfortunately,this phase of the renovation project was not completed until the latter part of June. This has _ prevented the architects and engineers from accessing the structure to gather vital measurements and construction information. Because of this, design of the renovations has been delayed. Final construction _ — documents, which must be available to commence the project's bidding phase, are not expected to be completed until the end of January. Also, the Building Services Division will complete the roof system replacement by the end of this month. Materials were purchased for a total cost of$27, 087 with labor being provided by in-house staff. Also not included are contingencies and the architect's fee. Attached are revised drawings depicting the proposed renovations to the 17,369 square foot first floor. Colors used to prepare these drawings represent the material colors proposed for the project. The drawings include a first floor plan, a cross section of the main court room and an exterior view of the building. Final construction documents are not expected to be completed until the end of January. If the documents are received by this time, construction could begin by the end of March. Completion of the project is anticipated within 200 calendar days from construction commencement.
