ENTITLED AN ORDINANCE PROVIDING A NINETY(90)DAY
PERIOD TO MOVE OR DEMOLISH THE SINGLE FAMILY
STRUCTURE AT 255 POLLARD IN ORDER TO CORRECT
A VIOLATION OF SPECIFIC USE PERMIT ORDINANCE NO.
94-33.
WHEREAS,on November 19, 2012, a public hearing properly noticed and held was
conducted to address the revocation of a Specific Use Permit issued June 20, 1994. The
permit was issued to Fredrick Joubert, Jr. to allow a two family dwelling (duplex) in a RS
(Residential Single Family Dwelling) District at 255 Pollard Street , being Lots 13 and 14,
Block A, Pine Hill Addition, City of Beaumont, Jefferson County, Texas, containing 0.193
acres, more or less, as shown on Exhibit 'A" attached hereto; and,
WHEREAS, demolition of the structure did not take place as stated in the June 20,
1994 Joint Public Hearing minutes; and,
WHEREAS,the City Council for the City of Beaumont finds and determines that the
Zoning Ordinance and Ordinance No. 94-33 have been violated; and
WHEREAS,the City Council finds and determines that the granting of a ninety(90)
day period of time to correct the Specific Use Permit violation will serve to protect and
preserve the health, safety, welfare, and morals of the community and is in the best
interest of the City of Beaumont; and,
WHEREAS, the City Council for the City of Beaumont desires to grant a ninety(90)
day period of time to correct the Specific Use Permit issued to Fredrick Joubert, Jr. to allow
the removal or demolition of the single family structure at 255 Pollard Street in the City of
Beaumont, Jefferson County, Texas;
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this ordinance are hereby, in
all things, approved and adopted; and,
That after having found that the Zoning Ordinance was violated,the owner is hereby
granted ninety (90) days to remove or demolish the single family structure at 255 Pollard
Street in order to correct the violation of Ordinance No. 94-33.
BE IT FURTHER ORDAINED THAT in the event the single family structure at 255
Pollard is not removed or demolished, Ordinance No. 94-33 is repealed, thereby revoking
the specific use permit.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 4th day of
December, 2012.
