REQUESTED ACTION: Council consider a resolution approving the purchase of a
security camera system from Micro Integration of Beaumont
for use in the Water Utilities Department.
BACKGROUND
The administration building, due to the information available in it and the warehouse due to the
materials stored in it,are assets that must be protected. The existing security camera system is
inefficient, outdated, and unserviceable. The proposed system would provide the necessary
measures to ensure that these valuable assets are monitored on a 24 hour basis.
Water Utilities staff investigated several security systems and concluded that the proposed
purchase from Micro Integration in the amount of$57,036.36 will furnish all necessary labor,
materials, and equipment to replace the existing security system with a reliable system(See
attached). Additionally, the City of Beaumont Technical Services Division will be installing a
new server, switches, and licenses in the amount of$19,849.38. The total project cost is
$76,885.74. This new system will include cameras, wiring, and computer software. The
existing entry door cameras will also be integrated into this system.
FUNDING SOURCE
Water Utilities Fund.

RESOLUTION NO.
WHEREAS, proposals were solicited for the purchase of a security camera system
for use by the Water Utilities Department; and,
WHEREAS, Micro Integration, Inc., of Beaumont, Texas, submitted a proposal in
the amount of$57,036.36; and,
WHEREAS, City Council is of the opinion that the proposal submitted by Micro
Integration, Inc., of Beaumont, Texas, should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby, in
all things, approved and adopted; and,
THAT the proposal submitted by Micro Integration, Inc. for the purchase of a
security camera system in the amount of $57,036.36 for use by the Water Utilities
Department be accepted by the City of Beaumont; and,
BE IT FURTHER RESOLVED THAT the City Manager be and he is hereby
authorized to execute a contract with Micro Integration, Inc., of Beaumont, Texas, for the
purposes described herein.

BACKGROUND
Nancy Nguyen and Vinh Van Le have applied for a zone change.
Ms.Nguyen and Mr. Le are converting an existing building at the northwest corner of Magnolia and
Leight into a convenience store. The property is triangular in shape. The majority of the property is
zoned GC-MD. However,the west thirty feet of the lot is zoned RM-H. Parking for the convenience
store is proposed to be located partially in that part of the property that is zoned RM-H. To use that
property for commercial purposes,the property must be zoned commercially.
At a Joint Public Hearing held November 19, 2012, the Planning Commission recommended
approval 6:0 of the zone change.

COUNTY, TEXAS; PROVIDING FOR SEVERABILITY;

BE IT ORDAINED BY THE CITY OF BEAUMONT:
Section 1.
That Chapter 28 of the Code of Ordinances of Beaumont, Texas, and in particular
the boundaries of the zoning districts, as indicated upon the Zoning Map of the City of
Beaumont, referred to in Section 28.01.005(b)thereof, is hereby amended by changing the
zoning of property presently zoned RM-H (Residential Multiple Family Dwelling-Highest
Density) District to GC-MD (General Commercial-Multiple Family Dwelling) District for
property located at 3501 Magnolia Avenue, being the West 30' of the South part of Lot 1,
Block 1, Swonger Addition, City of Beaumont, Jefferson County, Texas, containing 0.016
acres, more or less, as shown in Exhibit "A" attached hereto, and the official zoning map
of the City of Beaumont is hereby amended to reflect such changes.
Section 2.
That, in all other respects, the use of the property herein above described shall be
subject to all of the applicable regulations of the underlying zoning district as well as those
regulations contained in Chapter 28 of the Code of Ordinances of Beaumont, Texas, as
amended.
Section 3.
That if any section, subsection, sentence, clause of phrase of this ordinance, or the
application of same to a particular set of persons or circumstances, should for any reason
be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end, the various portions and provisions of this ordinance are
declared to be severable.
Section 4.
That all ordinances or parts of ordinances in conflict herewith are repealed to the
extent of the conflict only.
Section 5.
That any person who violates any provision of this ordinance shall, upon conviction,
be punished, as provided in Section 1.01.009 of the Code of Ordinances of Beaumont,
Texas.

BACKGROUND
Nathaniel Tarver has applied for a specific use permit.
In January, 1997 City Council approved a specific use permit to allow a drinking, recreational
services and rental hall at this location. At the time,Mr. Tarver wished to rent the building out
for plays,wedding receptions,gospel performances, private parties, family reunions and musical
road shows. The consumption of alcoholic beverages could occur depending on the particular
function or event.
In August, 2011 City Council approved a specific use permit to Lesha Crawford to allow a
drinking place on the subject property. That business never opened.
Mr. Tarver would now like to reopen the location with a bottle club. Mr. Tarver states that he
would like to convert the space back to a rental hall for various social activities where the
participants will bring their own bottle(BYOB).
At a Joint Public Hearing held November 19, 2012, the Planning Commission recommended
approval 7:0 of the specific use permit.

An existing 5,000 sq. & metal building is located on the property. Mr. Patterson states that he will be
opening an office headquarters for his construction business in Unit One. The office will be used for
printing payroll and the creation of business documents. Additional warehouse space in Unit One will
be used for storage and occasional equipment maintenance. The actual office space for Mr.
Patterson's business will consist of 1,250 sq. ft. The rest of the building will be divided into three
storage rental units.

WHEREAS, Vanester Washington has applied for a specific use permit to allow an
accounting office in a RCR-H (Residential Conservation and Revitalization-H) District at
2580 Laurel Street, being the East 40' of Lot 15, Block 47, Averill Addition, City of
Beaumont, Jefferson County, Texas, containing 0.105 acres, more or less, as shown on
Exhibit 'A" attached hereto; and,
WHEREAS, the Planning and Zoning Commission of the City of Beaumont
considered the request and is recommending approval of a specific use permit to allow
an accounting office in a RCR-H (Residential Conservation and Revitalization-H) District
at 2580 Laurel Street, subject to the following condition:
• Remove parking space #4.
and,
WHEREAS, the City Council is of the opinion that the issuance of such specific use
permit is in the best interest of the City of Beaumont and its citizens;

THAT the statements and findings set out in the preamble to this ordinance are hereby, in
all things, approved and adopted; and,
Section 1.
That a specific use permit to allow an accounting office in a RCR-H (Residential
Conservation and Revitalization-H) District at 2580 Laurel Street, being the East 40'of Lot
15, Block 47,Averill Addition, City of Beaumont,Jefferson County,Texas, containing 0.105
acres, more or less, as shown on Exhibit 'A," attached hereto, is hereby granted to
Vanester Washington, her legal representatives, successors and assigns, as shown on
Exhibit "B," attached hereto and made a part hereof for all purposes, subject to the
following condition:
• Remove parking space #4.
Section 2.
That the specific use permit herein granted is expressly issued for and in
accordance with each particular and detail of the site plan attached hereto as Exhibit"B,"
attached hereto and made a part hereof for all purposes.
Section 3.
Notwithstanding the site plan attached hereto, the use of the property herein above
described shall be in all other respects subject to all of the applicable regulations contained
in Chapter 28 of the Code of Ordinances of Beaumont, Texas, as amended, as well as
comply with any and all federal, state and local statutes, regulations or ordinances which

BACKGROUND
Minh Tran has applied for a specific use permit.
Frontier Machine Works,LLC has the former Salvation Army Boys and Girls Club and Resale Shop
under contract for purchase. Frontier Machine Works will utilize the main building as the machine
shop and the smaller metal building will be converted to a carport. The machine shop will make
custom metal parts. Shop hours will be 8:00 am to 5:00 p.m,Monday through Saturday.
There will be one CNC machine and one milling machine with two operators. All work will be done
inside of the building. The company's air compressor will be mounted on an isolation pad for
vibration control and the mechanical room's door will be sealed for noise control.
An existing driveway on Emmett will be used as the main vehicle entrance for employees,customers
and deliveries. The pedestrian entrance will be at the front office on Pennsylvania.
At a Joint Public Hearing held November 19, 2012,the Planning Commission recommended
approval 6:0 of the specific use permit.

BACKGROUND
The City of Beaumont Planning Division has applied for the revocation of the specific use permit.
In June, 1994,Fredrick Joubert, Jr. received a specific use permit to allow the construction of the
duplex. At the time of the request there was a single family structure on the property. The site
plan showed that the house was to be demolished. According to the June 20, 1994 Joint Public
Hearing Minutes,Mr. Joubert was asked if he was going to demolish the structure and he stated
he was when he got the duplex finished in about a year. However, the demolition was not made a
condition of approval of the specific use permit.
Upon receiving a complaint in the summer of 2010 about having three residences on the property,
Troy Joubert, the new property owner and son of Fredrick Joubert, was given four weeks to
correct the violation. The structure was not demolished and charges were filed. When the rase
went to Municipal Court,the City's Municipal Court Attorney felt that the appropriate action was
to revoke the specific use permit.
The Zoning Ordinance states that a SUP may be revoked or modified, after notice and hearing,
for either of the following reasons:
1. The specific use permit was obtained or extended by fraud or deception; or
2. That one or more of the conditions imposed by the permit has not been met or has
been violated.
At a Joint Public Hearing held November 19, 2012, the Planning Commission recommended
approval 7:0 of revoking the specific use permit and granting a ninety(90)day extension to move
or demolish the single family structure.

Not applicable.
RECOMMENDATION
Approval of a ninety(90) day extension to move or demolish the single family structure.
If after ninety(90)days the single family structure is not removed, staff would recommend that
City Council revoke the specific use permit.

That the specific use permit herein granted is expressly issued for and in accordance

Mayor David Moore called the Joint Public Hearing of June 20, 1994 to order and
explained the purpose of the joint hearing process. The meeting was turned over to
Chairman Clark. Policies and procedures for the hearing process were discussed.
1) File 1242-P: Consider an application for a specific use permit to allow a two
family dwelling (duplex) on property zoned RS(Residential Single Family
Dwelling District).
Location: 255 Pollard Avenue
Applicant: Fredrick Joubert, Jr.
Mr.Richardson told the Commission that the applicant states that he received
a building permit for the duplex in 1983. In May, 1984, he did receive
approval on a building inspection for the plumbing and on the structure itself.
Due to a lack of time and money, the applicant did not complete the
structure. He now wishes to complete the building and use it as a duplex.
Staff recommended approval of the specific use permit subject to one
condition. The site plan shows a handicapped parking space. The required
number of parking spaces for the duplex would be four spaces, however,
Traffic Engineering stated that the width of the handicapped space as shown
on the site plan does not meet the standards. Traffic Engineering also stated
that for a duplex, a handicapped space is not required, and as the applicant
stated that he has no desire to provide a handicapped parking space, staff is
recommending that the fourth parking space not be shown as a handicapped
parking space.
There were 35 notices sent to property owners within 200' of the subject
property with none received in favor or opposition.
Mr. Richardson called for slides of the property.
Mr. Fredrick Joubert, Jr., 2635 Burgundy St., applicant, stated that the
building had been started a number of years ago. Due to the lack of time and
finances, he couldn't complete it. Now that he has time he would like to
complete it.
Commissioner Nisby asked Mr. Joubert if he was planning to demolish the
building in front of the duplex.
Mr. Joubert stated that he was, but in the future.
Commissioner Nisby asked Mr. Joubert at what point in his plans was he

Commissioner Nisby asked that if the permit is granted, what would be the
time limitation on completing this work.
Mr. Richardson answered that building permits are good for one year and
extensions can be requested.
Mr.Willie White,335 Pollard(home-3645/55 Maida),asked the Commission
why he received a letter of notification from the Planning Division and other
property owners in the area did not.
Chairman Clark asked Mr. Richardson if he could find out why the other
property owners did not receive notification.
Mr. Richardson said that he would.
Chairman Clark asked Mr.Joubert if he had any final comments. Mr.Joubert
asked when he would hear the results. Chairman Clark stated that the
Planning Commission would make a recommendation to City Council and they
would meet on June 28 for a final decision. At that time, Mr. Richardson
would let him know the outcome.
At that time, Chairman Clark closed the Public Hearing and called for a
motion.
Commissioner Bundy made a motion to approve staff's recommendation for
File #1242-P.
Commissioner Embs seconded the motion.
Motion to approve carried 7:0.

COUNTY, TEXAS.
WHEREAS, on November 19,2012, a public hearing properly noticed and held was
conducted to address the revocation of a Specific Use Permit issued June 20, 1994. The
permit was issued to Fredrick Joubert, Jr. to allow a two family dwelling (duplex) in a RS
(Residential Single Family Dwelling) District at 255 Pollard Street , being Lots 13 and 14,
Block A, Pine Hill Addition, City of Beaumont, Jefferson County, Texas, containing 0.193
acres, more or less, as shown on Exhibit "A," attached hereto; and,
WHEREAS, demolition of the structure did not take place as stated in the June 20,
1994 Joint Public Hearing minutes; and,
WHEREAS, the City Council for the City of Beaumont finds and determines that the
Zoning Ordinance has been violated; and
WHEREAS, the City Council finds and determines that revocation of the Specific
Use Permit will serve to protect and preserve the health, safety, welfare, and morals of the
community and is in the best interest of the City of Beaumont; and,
WHEREAS, the City Council for the City of Beaumont desires to revoke the Specific

BACKGROUND
Crosstex NGL Pipeline,L.P.has applied for a specific use permit
Crosstex NGL Pipeline,L.P. is in the process of installing an interstate NGL pipeline as part of its
common carrier system. A portion of this pipeline will be installed across the City of Beaumont.
Crosstex has acquired agreements with the owners of all the properties through which the pipeline
is crossing and are zoned RS. It is those properties that require a specific use permit.
Crosstex states that the company and its subcontractors will take all necessary precautions during
construction to prevent any offensive odor,fumes,dust,noise and vibration from affecting any
properties in the immediate vicinity. Crosstex and its subcontractors do not plan to work during night
time hours. Once the pipeline is laid underground,Crosstex will return the right-of-way to the
condition prior to construction and will maintain the right-of-way after construction.
At a Joint Public Hearing held November 19,2012,the Planning Commission recommended approval
7:0 of the specific use permit subject to the following conditions:
1. Maintain and/or improve the existing natural storm water drainage in the construction
zone after construction is completed.
2. A Pipeline License Agreement and a Utility Crossing Agreement must be submitted
and approved prior to any work being performed within the City right-of-way. A map
shall be submitted to Water Utilities showing where the pipeline will be crossing any
City of Beaumont water and sanitary sewer mains,both within and outside the City.
In addition to the overall map,plan and profile drawings must be submitted for each
crossing. The pipeline must be installed a minimum of 5 feet below the bottom of the
lowest pipe crossing.
3. All traffic control shall comply with the Texas Manual on Uniform Traffic Control
Devices,Part 6(2049 edition).
4. Existing access points being utilized by Crosstex shall be shown on a map displaying
the scope of the project within the city limits.
5. Any oversized loads moving materials to the project site shall comply with the City of
Beaumont Oversized Loads regulations.
6. Clear space between the bottoms of existing ditches and storm sewer pipes to the top
of the Crosstex pipeline shall not be less than 5 feet.
7. If work is to be performed on any street or public right-of-way,submit an application
for street cuts and barricading.

BY THE CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this ordinance are hereby, in
all things, approved and adopted; and,
Section 1.
That a specific use permit to allow the construction, maintaining, operating,
repairing, replacing, altering and inspecting of a NGL Pipeline and related appurtenances
in a RS (Residential Single Family Dwelling)District extending from approximately 2,600'±
east of the southeast corner of Helbig and Gager to approximately 1,140'± west of
Lawrence Drive and from approximately 50'± east of Old Voth Road to the west side of a
LNVA Canal, as shown on Exhibit "B," attached herereto, is hereby granted to Crosstex
NGL Pipeline, L.P., its legal representatives,successors and assigns, as shown on Exhibit
"C," attached hereto and made a part hereof for all purposes, subject to the following
conditions:
• Maintain and/or improve the existing natural storm water drainage in the
construction zone after construction is completed.
• A Pipeline License Agreement and a Utility Crossing Agreement must be
submitted and approved prior to any work being performed within the City

described shall be in all other respects subject to all of the applicable regulations contained
in Chapter 28 of the Code of Ordinances of Beaumont, Texas, as amended, as well as
comply with any and all federal, state and local statutes, regulations or ordinances which
may apply.
