Mayor Ames led the Pledge of Allegiance. Roll call was made by Tina Broussard, City Clerk. Present at the meeting were Mayor Ames, Mayor Pro Tern Coleman, Councilmembers Getz, Wright, Pate, Samuel and Smith. Consider an ordinance amending the boundaries of the wards of the City of Beaumont for election purposes. As a result of the 2010 decennial census, it has been determined that an increase in population in the City of Beaumont has caused the existing ward boundaries of the City of Beaumont to be substantially unequal in population. Article I, Section 6 of the Charter of the City of Beaumont gives to the City Council responsibility of changing the ward boundaries from time-to time as the Council may deem expedient so that each ward shall contain, as nearly as possible, the same number of electors. The proposed ordinance adjusts the ward boundaries so as to comply with the Charter of the City of Beaumont.The next City election is May 11, 2013. Consider an ordinance amending Chapter 6, Section 6.09.144 of the Code of Ordinances regulating seismic testing within the city. Recently, Cimarex Energy Company and OGM Land Company applied to the City of Beaumont for a Seismic Testing Permit. However, due to the restrictions of the current ordinances, their ability to obtain a broad, detailed survey of Beaumont's North End was limited. In response, they approached staff and then City Council, requesting to amend current ordinances to allow more detailed testing. Following a demonstration of vibratory truck operation, a City Council Work Session was held on August 29, 2012 to discuss a variety of changes to the ordinance. Specifically, amendments discussed would allow for vibratory trucks to impulse within a minimum of thirty-five (35)feet of a structure instead of a minimum of two hundred and fifty (250) feet. In addition, vibratory trucks would be allowed to operate on non-concrete city streets, with the approval of the City Engineer. Also, the allowed Peak Particle Velocity (PPV) or amount of ground movement would be changed from 0.5 inches per second to a more restrictive 0.25 inches per second. Finally, amendments were discussed to allow testing and drilling only between 8:00 a.m. and 5:00 p.m., Monday through Friday, but allow drilling and testing in non-urbanized areas from 8:00 a.m. to 5:00 p.m. on weekends. One exception to this would be the allowance of emergency line maintenance, anywhere within the city on any day, but only between the operating hours of 8:00 a.m. and 5:00 p.m. Councilmember Pate made a motion to ADOPT AN ORDINANCE ENTITLED AN ORDINANCE AMENDING CHAPTER 6, SECTION 6.09.144, SUBSECTIONS (3), (4), (7)AND (8) OF THE CODE OF ORDINANCES OF BEAUMONT, TEXAS, EXCLUDING HOLIDAYS TO MAKE CHANGES AND ADDITIONS; PROVIDING FOR SEVERABILITY; PROVIDING FOR REPEAL; AND PROVIDING A PENALTY. Consider a resolution approving Change Order No. 1 to the contract with Bruce's General Construction related to the construction of the new Restroom and Police Substation at the Amtrak Station. A contract in the amount of $289,000 was awarded to Bruce's General Construction on January 24, 2012. Minutes—September 4,2012 Change Order No. 1 includes variances in the construction project due to the need for additional CMU blocks and fill dirt, relocating outside lighting, extending a sidewalk, installation of sod, and building and street signage. Contingency allowances in the original bid of$26,000 have been applied to the total cost of the additional work. The net change to the contract amount is an increase of 1.3% or $3,753.92 resulting in a total construction cost of$292,753.92. Capital Program. Approval of resolution. Councilmember Samuel made a motion to APPROVE A RESOLUTION THAT THE CITY MANAGER BE AND HE IS HEREBY AUTHORIZED TO EXECUTE CHANGE ORDER NO. 1 IN THE AMOUNT OF $29,264.28 FOR ADDITIONAL WORK,THEREBY INCREASING THE CONTRACT IN THE NET AMOUNT OF $3,753.92 FOR A TOTAL CONTRACT AMOUNT OF $292,753.92 FOR THE CONSTRUCTION OF A POLICE SUBSTATION AND PUBLIC RESTROOM ADJACENT TO THE NEWLY CONSTRUCTED AMTRAK STATION. Consider a resolution approving a bid for Masonry Restoration of the Julie Rogers Theatre. Six(6) bids were received on Thursday,August 23, 2012 for furnishing all labor, materials, equipment and supplies to restore the exterior masonry walls and paint the windows of the historical Julie Rogers Theatre. The base bid includes painting the windows, tuck-pointing mortar joints in brick and cast stone components, and replacing damaged masonry components. In addition to the base bid, two additional prices were requested; a price per square foot for additional tuck pointing in the face brick and a price per lineal foot to replace damaged horizontal steel shelf angles in the masonry wall. These prices were requested to cover the cost of unforseen damage that cannot be determined until the work commences. The age of the Julie Rogers Theatre has necessitated the labor intensive repair of the mortar between the bricks in its exterior wall. After the interior restoration in 2006, there has been notable damage to 2nd floor interior walls on the building's north side due to water intrusion. Sealing the bricks and replacing broken masonry and deteriorated window frames should prevent any further damage to its interior walls. Work is expected to be completed in approximately 120 days. Minutes—September 4,2012 Due to the specialized nature of the work to be accomplished, only direct employees rather than sub-contractors will work on this project. Scaffolding rental and supplies such as masonry grout are supplied by large corporations. Moore's Waterproofing is not certified as an MBE or HUB vendor. Capital Reserve Fund. Approval of resolution. Mayor Pro Tern Coleman made a motion to APPROVE A RESOLUTION THAT THE BID SUBMITTED BY MOORE'S WATERPROOFING, OF VIDOR, TEXAS, FOR MASONRY RESTORATION OF THE JULIE ROGERS THEATRE FOR AN ESTIMATED AMOUNT OF $268,550 BE ACCEPTED BY THE CITY OF BEAUMONT. Councilmember Samuel seconded the motion. AYES: MAYOR AMES, MAYOR PRO TEM COLEMAN, COUNCILMEMBERS GETZ, WRIGHT, PATE, SAMUEL AND SMITH NAYS: NONE MOTION PASSED Resolution 12 - 196 5. Consider a resolution approving a bid for the renovation of the Municipal Airport terminal building. Ten (10) bids were received on Thursday, August 23, 2012 for furnishing all labor, materials, equipment and supplies to renovate the terminal building at the Beaumont Municipal Airport. The renovation includes the replacement of the current glass and metal panel window system, constructing a business transaction counter, a pilot's flight plan station, painting interior trim and walls, and replacing the vinyl floor tile with a no wax floor covering. The current window system was originally installed in 1980. The window system is not energy efficient and the metal panels are deteriorating causing water leaks in the building. The building's west, east and north sides include floor to ceiling window and metal panel systems that will be replaced with a Low E glass system without metal panels. The floor plan of the building will be modified to include a pilot's flight planning room, and a new transaction counter to replace two large glass display cabinets, thus providing more space for pilots and patrons of the airport. Work is expected to be completed in approximately 85 days. Bruce's General Construction, Inc. is a certified Minority Business Enterprise company. Approval of resolution. Minutes—September 4,2012 Councilmember Smith made a motion to APPROVE A RESOLUTION THAT THE BID SUBMITTED BY BRUCE'S GENERAL CONSTRUCTION, INC., OF BEAUMONT, TEXAS, FOR RENOVATION OF THE MUNICIPAL AIRPORT TERMINAL BUILDING FOR AN ESTIMATED TOTAL OF$84,500 BE ACCEPTED BY THE CITY OF BEAUMONT. Councilmember Pate seconded the motion. CITY ATTORNEY COOPER- NONE CITY MANAGER HAYES- NONE MAYOR AMES - ANNOUNCED A 911 MEMORIAL CELEBRATION AT THE COWBOY HONDA DEALERSHIP, HOPE THAT MANY OF OUR CITIZENS WILL SHOW THEIR SUPPORT FOR OUR MILITARY AND ALL OF OUR FALLEN HEROES Public Comments (Persons are limited to three minutes) Sean Westbrooks 2570 Sweetgum Apt. 213 Beaumont TX Spoke in regards to the incident that occurred at Dr. Carrol Thomas's retirement party, asked that Council excuse him for being oppressed, stated he cannot and will not be ashamed of being black, also will not forgive his oppressor, wanted to discuss hoodies or hoods, to his knowledge the white man gave the true meaning to hood, Trayvon Martin paid with his life, stated that Councilmember Getz told the press that they were hoodlums, stated they came in peace but as usual they were racially profiled, asked that Councilmember Getz step down today as the Councilmember of Ward 11 Ricky Jason P.O. Box 61 Beaumont TX Stated that he was from Beaumont, Texas, and when he was 8 he was legally blind and had several surgeries to regain his sight, stated that he used to ride his bicycle to W.L. Pate's house so that he and his brother could book shows for him, so there's nothing racial about him, there were racial slurs made by Councilmember Getz towards Dr. Thomas and his family and them, stated that Councilmember Getz is very racist, God knows where his heart is and prays to God that he will change, asked that Councilmember Getz resign Donald Bailey 2310 S. St. Beaumont TX Stated that he lives in Old Town, very disappointed about the redistricting, he is disappointed that the Council doesn't recognize Mr. Jimmie P. Cokinos, stated to Councilmember Getz that his speech was too long and that the Councilmembers have issues and they are passing this issue on to the citizens, asked that Council invite him back so that he could show them a presentation regarding Beaumont Minutes—September 4,2012 Lastly, I feel compelled to address some comments that were made toward the end of the council meeting last week. Those comments were made by Councilmembers Smith and Samuel, and to a lesser extent, by Councilmember Wright. First, as to Councilmember Smith, whose comments last week were an attempt to censure me for being at Dr. Thomas' farewell extravaganza, where I was participating as an American citizen in the exercise of my First Amendment rights at a demonstration on public property - you indicated that you did not understand, and I quote, "Why someone would show up to protest someone's retirement". I assure you I was not protesting Dr. Thomas's retirement. I am ecstatic that the man is leaving, I just wish it had been 10 years sooner. But you also said that my presence was quote,"uncalled for and disrespectful" that I was quote, "causing problems",that I was quote, "someplace I did not need to be" and that my actions were quote, "very devisive". Sir, it was your presence at the extravaganza,along with the presence of your fellow councilmembers, Samuel and Wright,that were devisive. You were acting as ambassadors of Beaumont when you decided to give a kev to the_citylto a man who,with the help of the president of the school board, has done more to damage racial harmony in this city since the days of the abomination of the Ku Klux Klan. As platitudes were being bestowed upon the object of your admiration, did you bother to look around the room?Did you notice the demographics of those in attendance? Was it a true reflection of the racial diversity of this city or was it mostly a room filled with people that looked a lot like you? I could give you a long list of reasons why a very significant part of this community lost faith in the leadership of the Beaumont Independent School District during the past five years, however,they say a picture is worth a thousand words so let me show you this one,which really says it all - Dr. Thomas, embracing Calvin Walker, a confessed criminal,who in turn is being embraced by the school district's attorney, Melody Chappell. Dr. Thomas stated at a school board meeting that there was no proof that Calvin Walker ever did anything wrong while he had in his possession-an actual copy of the statement that Calvin Walker signed under oath in which he acknowledged that he had photo-shopped a document and turned it in to BISD as a false invoice for which he was wrongfully paid 1.5 million dollars. Dr. Thomas then led the charge to have Calvin Walker's electrical repair services contract to be re-newed by the school district, which the school board agreed to do in a 4-3 vote that was split along racial lines. Was Calvin Walker's contract renewed because of his honesty,his integrity?. Was it renewed because he was an outstanding electrician?You may recall that in performing electrical work for the school district during the BISD school construction program, agents of this city that you represent,told Mr. Walker and his employer, BISD, that the electrical work that he had performed was so substandard that it had to be done over or the buildings would not be able to be occupied. So what exactly did Dr. Thomas and his supporters on the school board see as Calvin Walker's primary qualification that would justify him having his contract extended for three more years, while still awaiting sentencing for his admitted criminal conduct? Any guesses? To most objective people in Beaumont,the answer simply comes down to the belief that Calvin Walker happens to have the skin pigmentation that Dr. Thomas and his supporters prefer to the exclusion of others. You see, Dr. Thomas does not embrace the doctrine of the Rev. Martin Luther King, whose message was that we should be color blind and who yearned for the day that his children would not be judged by the color of their skin, but by the content of their character. No. Dr. Thomas, subscribes more to the message put forth by another famous southerner,those hateful words uttered by George C. Wallace in his 1963 inauguration speech, "segregation now, segregation tomorrow and segregation forever". As you stood and gave Dr. Thomas a standing ovation,did it not even occur to you that you were essentially in the midst of a segregated audience? And given my explanation to you as to how this individual has divided this City, do you still fail to understand that by paying homage, as official representatives of the City of Beaumont,how your actions would be perceived by many in our community? The problem we have here,is you underestimate the attitude that the majority of this community has toward Dr. Thomas,his supporters and the school district. Because while it is true that the majority of Dr. Thomas's supporters happen to be black,the vast majority of black Americans in this city are not supporters of Dr. Carol Thomas or what he stands for. So I was at Ozen High School, not to protest the retirement of Dr. Carroll A. Butch Thomas. I was there to protest the hypocrisy of singing praises to a man that never embraced this community, a man that refused in 16 years to join the social fabric of this City and was conspicuous by his absence at charitable and philanthropic events, a man who raped the taxpayer and will leave with town with shiny new schools but more segregated than it has been in the last 25 years. In the past week, dozens of MY constituents,the people that put me in office, have called me, e-mailed me or spoken to me in person,thanking me for the actions that I took and telling me of their support. And maybe you have had some of your constituents applaud you for the comments that you directed toward me at the council meeting last week. And that's fine,because we are not going to agree on everything. But calling me down because of your belief that I should not have been able to express MY opinions about the man you seem to think so highly of is what was uncalled for and disrespectful. And finally,as to those other comments that were made last week by Councilmember Samuel, in which you made the claim that I wanted to challenge people from coming up to the podium because they did not live in the City of Beaumont and that I was trying to deny their First Amendment rights to address this council,the wonderful thing about these meetings being recorded is that you can go back and check the record to see what was actually said. I denied your allegations last week that I ever tried to prevent anyone from addressing this assembly. I invited you to check the minutes of the meeting or the video of the meeting so that you and Councilmember Wright could see for yourselves that my only suggestion was that people that are addressing the city council identify themselves by which Ward they live in. I still think that is a good suggestion and for you to take that suggestion and then make it into an accusation that I am trying to deny people the right to address this assembly shows that you either have a bad memory or that you are deliberately trying to distort the facts. I believe in open and honest government and I am in favor of anyone addressing this council to discuss legitimate city business or any concerns that they have. That is what makes America great. In fact, it is my understanding that in a few minutes we are going to be treated to some commentary by Ricky Jason, a self-proclaimed member of the New Black Panther party. Mr. Jason will come before this council making some outrageous allegations, but will be completely oblivious to the fact that his gang of thugs were all videoed, shouting racial epiteths,like"cracker, go home", "you left your sheets in the car", "go back to Jasper". The group of people that I was standing with, those that were there to protest the hypocrisy of bestowing praises on the former superintendent,refused to respond to the verbal onslaught,which infuriated Mr. Jason and his group. They then moved even closer to our group, shouting in our faces with clinched fists,trying to incite us to respond, but we would not provide them with the satisfaction. The BISD police officers assigned to the event failed to intervene as Mr. Jason and his group continued their verbal abuse and attempted intimidation. I support Mr. Jason's right to come before this council and address it, even if he is not a resident of Beaumont. As for the validity of his claims, I simply request that you look at the news coverage of the event and judge for.yourself. It is regrettable that the devisiveness that has plagued our local school district for years is now starting to appear at city council. I took an oath to uphold and defend the Constitution and laws of our state when I was sworn into office and I have a duty to do that to the best of my ability. We have a new superintendent that is taking the helm of the school district and we can only hope and pray that he is less devisive then his predecessor. I read today that even though the population of Beaumont has grown, enrollment is down in the school district. I am hoping that Dr. Chargois and his supporters see what their prior actions are doing to this city and act to restore the faith and trust that has been missing for the last several years. I, for one, am prepared to work with them and give them the opportunity to help make Beaumont a place that we are proud to live in and raise our families. i Pam Shelander 5555 Clinton Beaumont TX Commented on the garbage that was just spewed out against her Councilmember, this made her angry, stated that all of this got started evidentially because someone said something at the last meeting that should not have been dealt with at a City Council meeting, stated to Councilmember Getz that she is glad he is her Councilmember because he does listen to the people, the fact those people could come up here and spew all that racial stuff towards Councilmember Getz and no one said a word was wrong Mayor Ames reminded Council that she was given the guidelines for speakers and others in meetings in Beaumont City Council, thought everything that was said today was in line except we are not to use any specific names, all Council should be addressed with their titles in front of their names.
