ENTITLED AN ORDINANCE ISSUING AN AMENDED SPECIFIC
USE PERMIT TO ALLOW THE EXPANSION OF A CHURCH IN A
RM-H (RESIDENTIAL MULTIPLE FAMILY DWELLING-HIGHEST
DENSITY) DISTRICT AT 3175 S. MAJOR DRIVE IN THE CITY OF
BEAUMONT, JEFFERSON COUNTY, TEXAS.
WHEREAS, on January 23, 1996, City Council approved Ordinance 96-05 issuing
a specific use permit to Seventh-Day Adventist Church to allow the construction of a
church in a RM-H (Residential Multiple Family Dwelling-Highest Density) District located
at 3175 S. Major Drive, Beaumont, Jefferson County, Texas, subject to the following
conditions:
• All drainage shall be directed west to S. Major Drive.
• Phase II parking lot shall be constructed at the time of the construction of the
church (Phase 1).
• The tract is to be subdivided according to Chapter 24, City Codes; and,
WHEREAS, on December 22, 1998, City Council approved Ordinance No. 98-79
issuing an amended specific use permit to Seventh-Day Adventist Church to allow a church
school to operate out of an existing church in a RM-H (Residential Multiple Family
Dwelling) District at 3175 S. Major Drive, Beaumont, Jefferson County, Texas; and,
WHEREAS,Seventh-Day Adventist Church wishes to amend the amended specific
use permit to allow for the expansion of a church in a RM-H (Residential Multiple Family
Dwelling-Highest Density) District at 3175 S. Major Drive, being Tract 20-13, Plat SP-8,
Tract 1, Abs-231218, C. Williams Survey, City of Beaumont, Jefferson County, Texas,
containing 2,787 acres, more or less, as shown on Exhibit"A," attached hereto and made
a part hereof for all purposes; and,
WHEREAS, the Planning and Zoning Commission of the City of Beaumont
considered the request to amend the amended specific use permit to allow the expansion
of a church in a RM-H (Residential Multiple Family Dwelling-Highest Density) District at
3175 S. Major Drive as reflected in the site plan as shown on Exhibit"B," attached hereto
and made a part hereof for all purposes; and,
WHEREAS, the City Council is of the opinion that the amendment of such specific
use permit is in the best interest of the City of Beaumont and its citizens, subject to the
following conditions:
• Property shall be graded to drain towards the street and shall not drain onto
adjacent properties.
• TxDOT must approve construction plan for new driveway prior to the church
beginning construction.
NOW, THEREFORE, BE IT ORDAINED BY THE
CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby, in
all things, approved and adopted; and,
Section 1.
That Ordinance No.98-79 be amended by amending the specific use permit granted
to Seventh-Day Adventist Church, its legal representatives, successors, and assigns for
that certain tract shown on Exhibit "A," attached hereto and made a part hereof for all
purposes, to allow the expansion of a church in a RM-H (Residential Multiple Family
Dwelling-Highest Density) District at 3175 S. Major Drive as reflected in the site plan
attached hereto as Exhibit "B," subject to the following additional conditions:
• Property shall be graded to drain towards the street and shall not drain onto
adjacent properties.
• TxDOT must approve construction plan for new driveway prior to the church
beginning construction.
Section 2.
Notwithstanding the site plan attached hereto as Exhibit"B,"the use of the property
herein above described shall be in all other respects, subject to all of the applicable
regulations contained in Ordinance No. 98-79 and the regulations contained in Chapter 28
of the Code of Ordinances of the City of Beaumont,Texas, as amended, as well as comply
with any and all federal, state and local statutes, regulations or ordinances which may
apply.
PASSED BY THE CITY COUNCIL of the City of Beaumont this the 24th day of April,
