ENTITLED AN ORDINANCE GRANTING A SPECIFIC USE
PERMIT TO ALLOW A WASHATERIA IN A GC-MD-2
(GENERAL COMMERCIAL-MULTIPLE FAMILY DWELLING-
2) DISTRICT AT 1067 COLORADO AVENUE IN THE CITY
OF BEAUMONT, JEFFERSON COUNTY, TEXAS.
WHEREAS, on September 29, 2009, City Council approved Ordinance 09-056
issuing a specific use permit to Blupesh Patel to allow a coin operated laundry in a GC-MD-
2 (General Commercial-Multiple Family Dwelling-2) District located at 1067 Colorado
Avenue, being Lots 21 and 22, Block 1, Lamar Addition, City of Beaumont, Jefferson
County, Texas, containing 0.29 acres, more or less, subject to the following conditions:
The coin operated laundry shall be in full compliance with the landscaping
and screening requirements including a six foot wide landscape strip must
be installed along the Colorado Avenue frontage of the parking lot and
interior landscape islands in the parking lot;
• A sidewalk shall be installed along Colorado; and,
WHEREAS, the coin operated laundry was not constructed; and,
WHEREAS, Bhupesh Patel has applied for a specific use permit to allow a
washateria in a GC-MD-2(General Commercial-Multiple Family Dwelling-2)District at 1067
Colorado Avenue, being Lots 21 and 22, Block 1, Lamar Addition, City of Beaumont,
Jefferson County, Texas, containing 0.31 acres, more or less, as shown on Exhibit "A,"
attached hereto; and,
WHEREAS, the Planning and Zoning Commission of the City of Beaumont
considered the request for a specific use permit to allow a washateria in a GC-MD-2
(General Commercial-Multiple Family Dwelling-2) District at 1067 Colorado Avenue; and,
WHEREAS, the City Council is of the opinion that the issuance of such specific use
permit is in the best interest of the City of Beaumont and its citizens, subject to the
hereinafter described conditions;
NOW, THEREFORE, BE IT ORDAINED
BY THE CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this ordinance are hereby, in
all things, approved and adopted; and,
Section 1.
That a specific use permit to allow a washateria in a GC-MD-2(General Commercial-
Multiple Family Dwelling-2) District at 1067 Colorado Avenue, being Lots 21 and 22, Block
1, Lamar Addition,City of Beaumont,Jefferson County,Texas,containing 0.31 acres,more
or less, as shown on Exhibit"A,"attached hereto; and, is hereby granted to Bhupesh Patel,
his legal representatives,successors and assigns,as shown on Exhibit"B,"attached hereto
and made a part hereof for all purposes, subject to the following conditions:
• A five foot wide sidewalk will be required along Colorado Avenue;
• A six foot wide landscape strip is required along the Colorado Avenue frontage;
• Address the "outlaw" sanitary sewer service line to the satisfaction of the Water
Utilities Department.
Section 2.
That the specific use permit herein granted is expressly issued for and in accordance
with each particular and detail of the site plan attached hereto as Exhibit "B," attached
hereto and made a part hereof for all purposes.
Section 3.
Notwithstanding the site plan attached hereto, the use of the property herein above
described shall be in all other respects subject to all of the applicable regulations contained
in Chapter 28 of the Code of Ordinances of Beaumont, Texas, as amended, as well as
comply with any and all federal, state and local statutes, regulations or ordinances which
may apply.
