REQUESTED ACTION: Council consider approving a contract for furnishing and
installing a fence at the Water Utilities Complex.
RECOMMENDATION
Administration recommends the award of a contract to National Fence Company of Houston in
the amount of$49,672.59.
BACKGROUND
Four(4)bids were received on April 28, 2011 for furnishing and installing 2,976 linear feet of
chain link fencing at the Water Utilities Complex on Langham Road. For added security, the six
(6) foot chain link fence currently in place will be replaced with an eight(8) ft. chain link fence.
The fenced area will be enlarged to create additional storage for materials and equipment.
The bids received are as follow:

RESOLUTION NO.
WHEREAS, bids were received for furnishing and installing chain link fencing at the
Water Utilities Complex; and,
WHEREAS, National Fence Company, of Houston, Texas, submitted a bid in the
amount of$49,672.59; and,
WHEREAS, City Council is of the opinion that the bid submitted by National Fence
Company, of Houston, Texas, should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby, in
all things, approved and adopted; and,
THAT the bid submitted by National Fence Company, of Houston, Texas, for
furnishing and installing chain link fencing at the Water Utilities Complex, in the amount of
$49,672.59, be accepted by the City of Beaumont; and,
THAT the City Manager be and he is hereby authorized to execute a contract with
National Fence Company for the purposes described herein.

REQUESTED ACTION: Council consider approving a change order for the
Riverfront Park Bank Stabilization project.
RECOMMENDATION
Administration recommends the approval of Change Order No.I in the amount of$41,190.
BACKGROUND
A contract in the amount of$3,022,510 was awarded to Russell Marine, LLC. of Channelview
TX to stabilize the Neches River bank at Riverfront Park in December 2010.
The change order includes costs associated with unforseen work due to the failure of the concrete
bulkhead wall. The steel tie backs were splintered and much of the concrete bulkhead wall had
collapsed into the river.
This change order includes a new tie back bulkhead, additional sidewalk replacement and
bollards. The cost for this work is 1.4%of the total contract award.
BUDGETARY IMPACT
Funds for this change order are available in the Capital Program. The City is responsible for any
additional work over the contract award of$3,022,510 which was funded by the Hurricane Ike
Disaster Recovery Fund.
RESOLUTION NO.
WHEREAS, on December 14, 2010, the City Council of the City of Beaumont,
Texas, passed Resolution No. 10-322 awarding a contract in the amount of$3,022,510.00
to Russell Marine, LLC, of Channelview,Texas,for the Riverfront Park Neches River Bank
Stabilization Project; and,
WHEREAS, Change Order No. 1 in the amount of $41,190.00 is required for
unforseen work due to the failure of the concrete bulkhead wall, thereby increasing the
contract amount to $3,063,700.00.
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby, in
all things, approved and adopted; and
THAT the City Manager be and he is hereby authorized to execute Change Order
No. 1 for additional work described above, thereby increasing the contract amount by
$41,190.00 for a total contract amount of$3,063,700.00.

REQUESTED ACTION: Council consider a resolution authorizing the acquisition of
property.
RECOMMENDATION
The Administration recommends authorizing City Council approve a resolution for the
acquisition of properties for the Concord Road Pavement Widening Project.
BACKGROUND
As part of the Concord Road Pavement Widening Project, approximately sixty-two (62)parcels
of land from East Lucas to Highway 105 are being acquired. The owner of the property listed
below, has agreed to convey its property to the City:
Parcel #64 0.1170 acre out City Plat RS-1, Thomas Spear Survey
(7130 Eastex) Value: $40,000.00
Owner: Academy, Ltd.
The acquisition of the right of way is recommended for approval by the City Manager and Public
Works Director.
BUDGETARYIMPACT
Funds are available in the Capital Program.

REQUESTED ACTION: City Council consider authorizing the City Manager to
submit and accept a grant from the Texas Department of
Rural Affairs for Supplemental Disaster Recovery Non-
Housing Activities.
RECOMMENDATION
Administration recommends Council authorize the City Manager to submit and accept a grant
from the Texas Department of Rural Affairs for Supplemental Disaster Recovery Non-Housing
Activities, Phase II, Round I funding. The project identified for funding under this grant is South
Park Drainage Relief.
BACKGROUND
The Texas Department of Rural Affairs (TDRA)notified the City that $11,339,401 in
Supplemental Disaster Recovery Non-Housing Activities are available for infrastructure that was
damaged or failed to perform during Hurricane Ike. South Park Relief, a project currently
identified in the Capital Program, was recommended.
The Moore Street watershed, South Park watershed and Threadneedle watershed drain into a 60-
inch pipe that travels through Exxon-Mobil refinery property and discharges into the Neches
River. The 60-inch outfall and related conveyance systems are old and have deteriorated over
time. The proposed improvements will supplement the existing 60-inch outfall to the river with
a proposed 10 ft. x 8 ft. box culvert also discharging into the Neches River system.
BUDGETARYIMPACT
The estimated cost for the total project is $11,703,463,thus possibly requiring participation by
the City n the amount of$364 062. However,the cost of the project will not be known until the

REQUESTED ACTION: Council consider approving a contract for renovations to
the former Goodwill Industries building located at 790
Orleans that is utilized by the Police Department.
RECOMMENDATION
Administration recommends the award of a contract to Centerline Construction Services, Inc. of
Beaumont in the amount of$355,000.
BACKGROUND
The City purchased the former Goodwill Industries building at 790 Orleans in 2006. The
building referred to as the Police Annex, was to be renovated for confiscated property and Family
Violence Offices. Building Services staff made repairs to the HVAC, plumbing and electrical
systems in the building. The roof was replaced in 2010. The building currently houses
confiscated and surplus property and emergency supplies.
Plans were developed for the renovation of a 40 ft. x 80 ft. section of the 1St floor for Family
Violence offices. Currently, the Family Violence office is located on Gulf Street in the former
YMBL office at the Fair Grounds. The local Housing Authority plans to purchase this property
for housing development.
Exterior renovations to the building include new windows and entrance, a new awning and
stucco finish on the building's east side. Interior renovations include five offices, a waiting
room, restrooms, and a conference room. The renovated area will not reduce or interfere with
space needed for police and surplus property storage.

REQUESTED ACTION: Council consider approving a contract for the construction
of a platform to support an emergency power generator at
the Police Department.
RECOMMENDATION
Administration recommends the award of a contract to Bruce's General Construction in the
amount of$135,000.
BACKGROUND
In October 2010, Council approved the purchase of a new generator set to be installed at the
Police Department to provide emergency power for the entire three (3) story 56,250 sq. ft.
facility. The diesel powered emergency power system includes a Mustang 1500 kilowatt, 480
volt, generator powered by a Caterpillar 3512C diesel engine. Delivery date of the generator is
contingent upon completion of a support platform.
Bids were solicited for the installation of the 26'x 36' structural concrete elevated platform that
will provide a foundation to support the new generator set. The platform will be elevated in
accordance with height requirements determined by the Federal Emergency Management Agency
(FEMA). The following bids were received:

The Texas Department of Housing and Community Affairs (TDHCA)has approved the use of
Community Development Block Grant Disaster Recovery funding for the demolition and
clearance of residential properties that were damaged as a result of Hurricane Ike and are now
uninhabitable.
These structures have been inspected and have been determined to be unsafe and substandard
and contributing to slum and blight.
BUDGETARYIMPACT
Funding will be available through a grant with TDHCA, with no local match.

Ordinances of the City of Beaumont and are for want of repairs, or by reason of age or
dilapidated, decayed, unsafe or unsanitary condition, or otherwise unfit for human
habitation, or otherwise likely to endanger the health, safety or general welfare of the
citizens of the City.
Section 2.
In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont,
Section 24.04.006 of the Code of Ordinances of Beaumont, Texas, it is hereby ordered
that the owner or owners of the following described buildings demolish and remove said
structures within ten (10) days of the effective date of this ordinance.
If the property owner(s) fail(s) to comply within ten (10) days, Council orders that
the property be demolished without further notification to the property owners or City
Council action.
Section 3.
In accordance with Article XVII, Section 2, of the Charter of the City of Beaumont,
Section 24.04.003 of the Code of Ordinances of Beaumont, Texas, it is hereby ordered
that the property owner(s) of the following described buildings execute a work program
with the City within ten (10) days of the effective date of this ordinance and either
demolish or complete all repairs and receive a Certificate of Occupancy within one-
hundred fifty (150) days. Should the owner(s) fail to obtain substantial completion as
defined in the work program, within ninety (90) days from the initiating date of the work
program, Council hereby orders that the property be demolished without further
notification to the property owner(s) or City Council action.
Section 4.
If a property owner requests and is authorized by City Council to enroll in a work
program, all properties are to be secured from unauthorized entry, and all delinquent
taxes shall be paid in full or a payment plan executed prior to the enrollment of the
property in the work program.
Section 5.
That if any section, subsection, sentence, clause or phrase of this ordinance, or
the application of same to a particular set of persons or circumstances should for any
reason be held to be invalid, such invalidity shall not affect the remaining portions of this
ordinance, and to such end the various portions and provisions of this ordinance are
declared to be severable.
Section 6.
That any person who violates any provision of this ordinance shall, upon
conviction, be punished as provided in Section 1.01.009 of the Code of Ordinances of
Beaumont, Texas.

A RESOLUTION APPROVING THE DEMOLITION AND
CLEARANCE OF EIGHTY-ONE (81) RESIDENTIAL
PROPERTIES THAT WERE DAMAGED AS A RESULT OF
HURRICANE IKE. THE TEXAS DEPARTMENT OF
HOUSING AND COMMUNITY AFFAIRS WILL ALLOCATE
FUNDING FOR THE ACTIVITIES.
WHEREAS,the Texas Department of Housing and Community Affairs has approved

activities as Slum and Blight for Spot Basis; and
WHEREAS, the elimination of specific conditions of blight or deterioration on a spot
basis is designed to comply with the statutory objective for CDBG funds to be used for the
prevention of blight, on the premise that such action(s) serve to prevent the spread to
adjacent properties or areas; and
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are
hereby, in all things, approved and adopted; and
THAT the City Council of the City of Beaumont hereby finds and declares the
buildings listed on Exhibit"A,"attached hereto,to be public nuisances in that said buildings
violate Title 11, Chapter 24, Article 24.04, Division 1, et seq., of the Code of Ordinances of
the City of Beaumont and are for want of repairs or, by reason of age, are dilapidated,
decayed, unsafe or unsanitary, or otherwise unfit for human habitation, or otherwise likely
to endanger the health, safety or general welfare of the citizens of the City.
