REQUESTED ACTION: Council consider approving the purchase of a tractor and
slope mower for use by the Parks and Recreation
Department.
RECOMMENDATION
The administration recommends approval of the purchase of the tractor from John Deere Co., of
Cary,North Carolina, in the amount of$43,124.98 and the mower from Brookside Equipment
Sales, of Houston, in the amount of$41,350, for a total of$84,474.98
BACKGROUND
Pricing for the equipment was obtained through the BuyBoard Cooperative Purchasing Program.
Buyboard is a cooperative purchasing association which provides cities and political subdivisions
with the means to purchase specialized equipment at volume prices. BuyBoard complies with the
State of Texas procurement statutes.
The tractor-mower will be used for mowing ditches and other areas throughout the city. The new
unit will replace Unit 4232, a 1986 Ford model 4630 with 218 hours of service. The old unit will
be disposed of according to the City's surplus equipment disposal policy.
Basic warranties are two (2)years for the tractor and one(1)year for the mower. Warranty
service is available from Brookside Equipment Sales, of Houston.
Delivery is estimated at ninety(90)to one hundred twenty(120) days.
BUDGETARY IMPACT
Funds are budgeted in Capital Reserve.

BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF BEAUMONT:
THAT the City Council hereby approves the purchase of a tractor for use by the Parks and
Recreation Department, from John Deere Co., of Cary, North Carolina, in the amount of
$43,124.98 and the purchase of a mower for use by the Parks and Recreation Department,
from Brookside Equipment Sales, of Houston,Texas, in the amount of$41,350.00 through

RECOMMENDATION
The administration recommends approval of the purchase from Landmark Equipment, of Irving,
in the amount of$54,493.
BACKGROUND
Pricing for the equipment was obtained through the BuyBoard Cooperative Purchasing Program.
Buyboard is a cooperative purchasing association which provides cities and political subdivisions
with the means to purchase specialized equipment at volume prices. BuyBoard complies with the
State of Texas procurement statutes.
The excavator will be used for water construction and will replace Unit 5088, a 2001 model
tractor/loader/backhoe with 6,155 hours of service. The old unit will be disposed of according to
the City's surplus equipment disposal policy.
The basic warranty provided is twelve(12)months. Warranty service is available from CLM
Equipment, of Baytown.
Delivery is estimated at thirty(30) days.
BUDGETARY IMPACT
Funds are budgeted in the Water Fund.

CITY OF BEAUMONT:
THAT the City Council hereby approves the purchase of an excavator for use by the Water
Utilities Department, from Landmark Equipment, of Irving,Texas, in the amount of$54,493
through the BuyBoard Cooperative Purchasing Program.

REQUESTED ACTION: Council consider a resolution denying the request of Driver
Operator Grade II James Williams to approve the
accumulation of vacation leave from 2010 to 2011.
RECOMMENDATION
Administration recommends denial of the request of Driver Operator Grade II James Williams to
carry over vacation leave from 2010 to 2011.
BACKGROUND
Driver Operator Grade II James Williams has requested to be allowed to carry over vacation
leave accumulated in the year 2010 to be used in 2011 due to a line of duty injury.
The Collective Bargaining Agreement between the City and the IAFF Local 399 does not make
any exception for the carry over of accrued vacation leave. The Agreement at XIII, Section 2
states in part:
"All vacation time earned in a calendar year must be taken in the
following calendar year."
The Texas Local Government Code at Section 143.046(c), gives to the City Council the ability to
approve the accumulation of vacation leave from year to year for Firefighters and Police Officers.
In light of the fact that Driver Operator Grade II James Williams was out on a line of duty injury
in 2010 with full compensation,the Administration is of the opinion that the carry over of
accrued vacation time from 2010 to 2011 is not merited. The Administration would recommend
the denial of the request.

RESOLUTION NO.

WHEREAS, the City of Beaumont and the International Association of Firefighters,
Local 399 (hereinafter 1AFF 399"), entered into a Collective Bargaining Agreement
effective February 13, 2008; and
WHEREAS, Article XIII, Section 2, addresses vacation leave, how it is earned and
how it is to be scheduled and taken; and
WHEREAS, the Collective Bargaining Agreement, Article XIII, Section 2, does not
allow exceptions as to the absolute no vacation carryover provision; and
WHEREAS, Local Government Code,Section 143.046(c),givestothe municipality's
governing body the ability to approve the accumulation of vacation leave from yearto year;
and
WHEREAS, neither the Beaumont City Manager nor the Beaumont Fire Chief have
been authorized to grant exceptions to Article XIII, Section 2, to allow the carryover of
vacation leave from year to year; and
WHEREAS, any past exceptions made to such provision were unauthorized in that
they were not in compliance with the Collective Bargaining Agreement or Local
Government Code, Section 143.046(c); and
WHEREAS, the City Council for the City of Beaumont does not intend to amend the
Collective Bargaining Agreement except as provided for by Article XXXIII; and
WHEREAS, the City Council has considered the request of Driver Operator Grade
II James Williams to carryover vacation leave from one year to a subsequent year and is
of the opinion that it would not be in the best interest of the citizens of Beaumont to grant
the request and, therefore, the request should be denied;
NOW, THEREFORE, BE IT RESOLVED BY
THE CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby, in
all things, approved and adopted; and,
THAT the request of Driver Operator Grade 11 James Williams to carryover vacation
leave to a subsequent year be and it is hereby denied; and,
THAT the meeting at which this resolution was approved was, in all things,
conducted in strict compliance with the Texas Open Meetings Act, Texas Government
Code, Chapter 551.

REQUESTED ACTION: Council consider a resolution seeking a determination as to
the impact of the release of certain information pertaining
to the acquisition of property.
RECOMMENDATION
The City Attorney recommends the adoption of a resolution that the release of certain
information to the public would impair the City's planning and negotiating position with regard
to the acquisition of property needed for public projects.
BACKGROUND
The City of Beaumont continually acquires property, or interest in property, for various public
projects. The Concord Road Pavement Widening Project, presently in negotiation for land
acquisition, is a prime example.
There has been a request made for certain information on the Concord Road Project which, if
released to the public, could potentially impair the City's planning and negotiating position with
respect to those specific properties and other properties yet to be acquired. This information
includes such things as offer letters and appraisal reports reflecting pertinent land values critical
to the City's negotiation efforts. The State Attorney General has indicated that his office will
accept a governmental body's good faith determination that the release of such information
would impair the entities planning and negotiating position with respect to the acquisition of
property.
Staff is seeking a determination of the City Council that the release of certain information, such
as offer letters, appraisals and correspondence sent to property owners in negotiation to acquire
property for public projects, would impair the negotiating position of the City with regard to the
acquisition efforts.
BUDGETARYIMPACT
None.
RESOLUTION NO.
WHEREAS, the City of Beaumont has authorized the reconstruction of Concord
Road from East Lucas to Highway 105; and,
WHEREAS, the Concord Road Pavement Widening Project does require the
acquisition of additional right-of-way to widen the existing roadway; and,
WHEREAS, a public information request has been made for documents that include
offer letters to property owners and appraisal reports of property to be acquired reflecting
pertinent land values; and,
WHEREAS, the release of this information would potentially compromise the efforts
of the City of Beaumont to negotiate the acquisition of property needed for the
improvement of Concord Road; and,
WHEREAS, it is in the best interest of the City of Beaumont that his information not
be release to the public,
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby, in
all things, approved and adopted; and,
THAT it is the determination of the City Council of the City of Beaumont that the
public release of information reflecting land values such as offer letters, appraisal reports
and correspondence sent to land owners in negotiation to acquire property for public
projects would be detrimental to, and would damage the negotiating position of, the City
with respect to the acquisition of essential property.
THAT the meeting at which this resolution was approved was, in all things,
conducted in strict compliance with the Texas Open Meetings Act, Texas Government
Code, Chapter 551.

RECOMMENDATION
The Administration recommends authorizing City Council approve a resolution for the
acquisition of property for the Concord Road Pavement Widening Project.
BACKGROUND
As part of the Concord Road Pavement Widening Project, approximately sixty-one(61)parcels
of land from East Lucas to Highway 105 are being acquired. The owners of the property listed
below, have agreed to convey their property to the City:
Parcel#63 0.3592 acre out of the Thomas Spear Survey,
Abstract No. 50 (5440 Concord Rd.)
Value: $80,000.00
Owners: Juanita Westmoreland
The acquisition of the right of way is recommended for approval by the City Manager and Public
Works Director.

This agreement between Juanita Westmoreland of the County of Jefferson, State of Texas,
hereinafter called GRANTOR, and the City of Beaumont, Texas, acting by and through its duly authorized
Agent,hereinafter called GRANTEE, witnesseth:
GRANTEE and the GRANTOR above recited have reached an agreement wherein the
GRANTORS are to convey to the GRANTEE the property described fully in a Special Warranty Deed to be
executed by GRANTORS,to which reference is hereby made for complete description, said property being

RECOMMENDATION
The Administration recommends authorizing City Council approve a resolution for the
acquisition of properties for the Concord Road Pavement Widening Project.
BACKGROUND
As part of the Concord Road Pavement Widening Project, approximately sixty-one (61)parcels
of land from East Lucas to Highway 105 are being acquired. The owner of the property listed
below, has agreed to convey his property to the City:
Parcel#61 0.0746 acre out of Thomas Spear Survey, Abstract No. 50
(6705 & 6715 Concord Road) Value: $16,500.00
Owner: Ina Harris
The acquisition of the right of way is recommended for approval by the City Manager and Public
Works Director.

Funds are available in the Capital Program.

RECOMMENDATION
The Administration recommends authorizing City Council approve a resolution for the
acquisition of properties for the Concord Road Pavement Widening Project.
BACKGROUND
As part of the Concord Road Pavement Widening Project, approximately sixty-one (61)parcels
of land from East Lucas to Highway 105 are being acquired. The owner of the property listed
below, has agreed to convey his property to the City:

REQUESTED ACTION: Council consider a resolution authorizing the acquisition of
property.
RECOMMENDATION
The Administration recommends authorizing City Council approve a resolution for the
acquisition of properties for the Concord Road Pavement Widening Project.
BACKGROUND
As part of the Concord Road Pavement Widening Project, approximately sixty-one (61)parcels
of land from East Lucas to Highway 105 are being acquired. The owner of the property listed
below, has agreed to convey his property to the City:
Parcel#13 0.0259 acre out of Lot 27, Block 3, French Heights Addition
(5170 Concord Road) Value: $4,995.00
Owner: Paula K. Doyle
The acquisition of the right of way is recommended for approval by the City Manager and Public
Works Director.
BUDGETARYIMPACT
Funds are available in the Capital Program.

WHEREAS, an agreement has been negotiated for the acquisition of property
described below and in Exhibit"A"and shown on Exhibits"B" and "C,"attached hereto, for

The Administration recommends acceptance of a Water Line Easement to provide water and fire
protection services for French Elementary School located at 3525 Cleveland Street.
BACKGROUND
Beaumont Independent School District has agreed to convey a ten(10) foot wide exclusive
Waterline Easement to the City of Beaumont. The Water Line Easement will provide mandatory
access to the water lines and fire hydrants for the school property and would also allow for the
construction, alteration, operation and maintenance of the said water lines and appurtenances.
This Water Line Easement is recommended for approval by the City Manager, Public Works
Director and Water Utilities Director.
BUDGETARY IMPACT
None.

THAT, BEAUMONT INDEPENDENT SCHOOL DISTRICT, of the County of
Jefferson, State of Texas, hereinafter called "GRANTOR", whether one or more, for and in
consideration of the sum of ONE AND NO/100 DOLLAR($1.00), and other good and valuable
consideration to it in hand paid by the CITY OF BEAUMONT, a municipal corporation
domiciled in Jefferson County, Texas, hereinafter called "GRANTEE", the receipt and
sufficiency of which consideration is hereby acknowledged, has GRANTED, SOLD and
CONVEYED, and by these presents does GRANT, SELL and CONVEY unto the CITY OF
BEAUMONT, P. O. Box 3827, Beaumont, Texas 77704, Jefferson County, Texas, its
successors and assigns, an easement to use, repair, alter, and maintain a single underground
water line and appurtenances on the hereinafter described lands which said easement is under,
over, in and across that certain tract or parcel of land owned by GRANTOR situated in the
County of Jefferson, State of Texas, and being more particularly described in Exhibit "A",
attached hereto and made a part hereof for all purposes. Grantor will have the right to relocate
the water line as needed for Grantor's use of the property provided the relocation is at Grantor's
expense and approved by the City of Beaumont's Water Utilities Director or similarly-titled
representative.
The easement herein granted shall be used for the purpose of operating, repairing,
rebuilding, replacing, relocating, and removing a water line as needed for operation of Grantor's
facilities on the property. The easement shall be exclusive insofar as use of the easement land for
underground utilities is concerned, but Grantor reserves the right to use the surface of the
easement land for vehicular parking, driveways, landscaping, fencing, and other surface uses that

will not interfere with or damage the water line. Grantor shall have the right to pave all or any
portion of the surface of the easement land, but no permanent structures or buildings will be
constructed on the easement land. Grantor will install the water line at a depth that will not be
damaged by the contemplated use of the surface by Grantor.
It is expressly understood and agreed that the City of Beaumont shall have the right of
access to the water line and appurtenances at all reasonable times to improve, maintain and
operate the same as permitted by law, and will attempt to use existing driveways and that portion
of Grantor's property that is immediately adjacent to the water line. Non-emergency
maintenance and repairs will be with 48 hours prior notice to Grantor.
Grantor will be responsible for the initial installation or construction of the water line on
Grantor's property in accordance with the plans and specifications included in the utility plan at
Grantor's expense. After initial construction of the water line and acceptance by Grantee,
Grantee will be responsible for maintenance and repair of the water line and appurtenances at
Grantee's expense. Grantor agrees not to place any structures or appurtenances on or over the
water line that will interfere with the use of the Easement for water line purposes.
Grantee shall not be responsible for the repair and replacement of any paving or other
structures that may be damaged by Grantee's non-negligent maintenance or repair of the water
line and appurtenances.
TO HAVE AND TO HOLD the above described easement and right-of-way unto the said
CITY OF BEAUMONT, its successors and assigns forever.

RECOMMENDATION
The Administration recommends acceptance of a Water Line Easement to provide water and fire
protection services for Fehl Elementary School located at 3350 Blanchette Street.
BACKGROUND
Beaumont Independent School District has agreed to convey a ten(10) foot wide exclusive
Waterline Easement to the City of Beaumont. The Water Line Easement will provide mandatory
access to the water lines and fire hydrants for the school property and would also allow for the
construction, alteration, operation and maintenance of the said water lines and appurtenances.
This Water Line Easement is recommended for approval by the City Manager, Public Works
Director and Water Utilities Director.

RESOLUTION NO.
WHEREAS, the Beaumont Independent School District has agreed to convey a ten
(10)foot wide exclusive water line easement, said easement being out of the David Brown
League, Abstract No. 5, as described in Exhibit "A" and shown on Exhibit "B," attached
hereto, to the City of Beaumont for the purpose of providing water and fire protection
services for Fehl Elementary School located at 3350 Blanchette Street; and,
WHEREAS, the City Council has considered the purpose of said conveyance and
is of the opinion that the acceptance of said conveyance is necessary and desirable and
that same should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby, in
all things, approved and adopted; and
THAT the easement conveyed by the Beaumont Independent School District, as
described in Exhibit"A" and shown on Exhibit"B,"be and the same is hereby, in all things,
accepted.

THAT, BEAUMONT INDEPENDENT SCHOOL DISTRICT, of the County of
Jefferson, State of Texas, hereinafter called "GRANTOR", whether one or more, for and in
consideration of the sum of ONE AND NO/100 DOLLAR ($1.00), and other good and valuable
consideration to it in hand paid by the CITY OF BEAUMONT, a municipal corporation
domiciled in Jefferson County, Texas, hereinafter called "GRANTEE", the receipt and
sufficiency of which consideration is hereby acknowledged, has GRANTED, SOLD and
CONVEYED, and by these presents does GRANT, SELL and CONVEY unto the CITY OF
BEAUMONT, P. O. Box 3827, Beaumont, Texas 77704, Jefferson County, Texas, its
successors and assigns, an easement to use, repair, alter, and maintain a single underground
water line and appurtenances on the hereinafter described lands which said easement is under,
over, in and across that certain tract or parcel of land owned by GRANTOR situated in the
County of Jefferson, State of Texas, and being more particularly described in Exhibit "A",
attached hereto and made a part hereof for all purposes. Grantor will have the right to relocate
the water line as needed for Grantor's use of the property provided the relocation is at Grantor's
expense and approved by the City of Beaumont's Water Utilities Director or similarly-titled
representative.
The easement herein granted shall be used for the purpose of operating, repairing,
rebuilding, replacing, relocating, and removing a water line as needed for operation of Grantor's
facilities on the property. The easement shall be exclusive insofar as use of the easement land for
underground utilities is concerned, but Grantor reserves the right to use the surface of the
easement land for vehicular parking, driveways, landscaping, fencing, and other surface uses that

will not interfere with or damage the water line. Grantor shall have the right to pave all or any
portion of the surface of the easement land, but no permanent structures or buildings will be
constructed on the easement land. Grantor will install the water line at a depth that will not be
damaged by the contemplated use of the surface by Grantor.
It is expressly understood and agreed that the City of Beaumont shall have the right of
access to the water line and appurtenances at all reasonable times to improve, maintain and
operate the same as permitted by law, and will attempt to use existing driveways and that portion
of Grantor's property that is immediately adjacent to the water line. Non-emergency
maintenance and repairs will be with 48 hours prior notice to Grantor.
Grantor will be responsible for the initial installation or construction of the water line on
Grantor's property in accordance with the plans and specifications included in the utility plan at
Grantor's expense. After initial construction of the water line and acceptance by Grantee,
Grantee will be responsible for maintenance and repair of the water line and appurtenances at
Grantee's expense. Grantor agrees not to place any structures or appurtenances on or over the
water line that will interfere with the use of the Easement for water line purposes.
Grantee shall not be responsible for the repair and replacement of any paving or other
structures that may be damaged by Grantee's non-negligent maintenance or repair of the water
line and appurtenances.
TO HAVE AND TO HOLD the above described easement and right-of-way unto the said
CITY OF BEAUMONT, its successors and assigns forever.

RECOMMENDATION
The Administration recommends the correction of Resolution 11-046, awarding a contract for
water treatment chemicals to Ashland, Inc., of Wilmington, Delaware.
BACKGROUND
The agenda information presented to Council on February 1, 2011, incorrectly represented the
contract as a six(6)month contract for purchase of wastewater treatment polymer. The bid
specifications stated that the bid was to be awarded for a one(1)year contract. All pricing and
quantities provided on Resolution 11-046 reflected the estimated usage for a yearly contract.
It is requested that Council amend Resolution 11-046 to correct the term of the contract to reflect
one(1)year. All other provisions of the bid and contract remain unchanged. Total estimated
annual cost remains $61,500.

REQUESTED ACTION: Council consider the award of a bid for Reconstruction of
Babe Zaharias Park Walking Trail.
RECOMMENDATION
Administration recommends the award of a bid to Racehorse Foundation, Inc. of Lumberton,
Texas in the amount of$157,692.50.
BACKGROUND
Bids were received on Thursday, January 27, 2011 for furnishing all labor, materials, equipment
and supplies to reconstruct the walking trails at Babe Zaharias Park located at IH-10 and Gulf
Street. The current asphalt walking path is approximately 6,030 linear feet, or approximately
1.14 miles. The asphalt has deteriorated beyond repair and will be removed and replaced with a
five (5) ft. wide concrete walking path.

Work is expected to commence in February and be completed in approximately forty-five (45)
days. There is no MBE participation on this project.
BUDGETARY IMPACT
Funds for this project are budgeted in the Capital Program.
RESOLUTION NO.
WHEREAS, bids were solicited for all labor, materials, equipment and supplies
necessary to reconstruct the walking trails at Babe Zaharias Park located at IH-10 and Gulf
Street; and,
WHEREAS, Racehorse Foundation, Inc., of Lumberton, Texas, submitted a bid in
the amount of$157,692.50; and,
WHEREAS, City Council is of the opinion that the bid submitted by Racehorse
Foundation, Inc. should be accepted;
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the bid submitted by Racehorse Foundation, Inc., of Lumberton, Texas, in the
amount of $157,692.50 for all labor, materials, equipment and supplies necessary to
reconstruct the walking trails at Babe Zaharias Park located at IH-10 and Gulf Street, be
accepted by the City of Beaumont.
