ENTITLED AN ORDINANCE ISSUING AN AMENDED SPECIFIC
USE PERMIT TO ODYSSEY CARWASH TO ALLOW THE
DEMOLITION OF A 10'TALL WOOD SCREENING FENCE ALONG
THE EAST AND SOUTH SIDES OF PROPERTY LOCATED IN A
GC-MD-2 (GENERAL COMMERCIAL-MULTIPLE FAMILY
DWELLING-2) DISTRICT AT 6365 CALDER AVENUE.
WHEREAS, on April 26, 2005, City Council approved Ordinance 05-041 issuing a
specific use permit to Gulf Coast Car Wash Equipment, Inc. to allow a car wash on
property located on the south side of Calder, 197' east of the intersection of Calder and
Junker Road in a GC-MD-2 (General Commercial-Multiple Family Dwelling-2) District,
being the north 180' of Tract 1-13, Block 1, Langham Place Addition, City of Beaumont,
Jefferson County, Texas, containing 0.62 acres, more or less, based on five conditions.
One of those conditions required that a ten foot tall wood screening fence was to be
constructed along the east and south sides of the property; and,
WHEREAS, the applicant, Odyssey Carwash, wishes to amend the specific use
permit to allow the demolition of the ten foot tall wood screening fence along the east and
south sides of property in a GC-MD -2 (General Commercial-Multiple Family Dwelling-2)
District for property located at 6365 Calder Avenue being Tract 1-B, Block 1, Langham
Place Addition, City of Beaumont, Jefferson County, Texas, containing 0.62 acres, more
or less, as shown on Exhibit'A," attached hereto and made a part hereof for all purposes;
and,
WHEREAS, the Planning and Zoning Commission of the City of Beaumont
considered the request to amend the specific use permit to allow the demolition of a ten foot
tall wood screening fence along the east and south sides of property in a GC-MD-2
(General Commercial-Multiple Family Dwelling-2) District for property located at 6365
Calder Avenue; and,
WHEREAS, the City Council is of the opinion that the amendment of such specific
use permit is in the best interest of the City of Beaumont and its citizens;
NOW, THEREFORE, BE IT ORDAINED
BY THE CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby, in
all things, approved and adopted; and,
Section 1.
That Ordinance 05-041 be amended by amending the specific use permit granted
to Gulf Coast Car Wash Equipment, Inc., its legal representatives, successors, and assigns
for that certain tract shown on Exhibit 'A" attached hereto and made a part hereof for all
purposes,to allow the demolition of a ten foot tall wood screening fence along the east and
south sides of property located at 6365 Calder Avenue subject to the following conditions:
• An eight foot tall wood screening fence shall be installed along the east and south
property lines of the subject property.
• The car wash must comply with the City storm requirements and Watershed
Protection Ordinance.
• Hours of operation shall be from 7:00 a.m. - 10:00 p.m.
Section 2.
That notwithstanding the site plan attached hereto as Exhibit "B," the use of the
property herein above described shall be in all other respects, subject to all of the applicable
regulations contained in Ordinance 05-041 and the regulations contained in Chapter 28 of
the Code of Ordinances of the City of Beaumont, Texas, as amended, as well as comply
with any and all federal, state and local statutes,regulations or ordinances which may apply.
