WHEREAS, the lawsuit styled Eric Kvarme, et al vs. The City of Beauont, et al was
discussed in Executive Session properly called and held Tuesday, December 7,2010;and,
WHEREAS, the Council desires to authorize the settlement and payment of the
claims of Douglas Kibodeaux and Rebecca Chism in the lawsuit styled Eric Kvarme, et al
vs. The City of Beaumont, et al in the amount of One Hundred Five Thousand Dollars
($105,000) and authorize the bringing of a lawsuit against the Beaumont Police Officer's
Association to seek enforcement of an agreement for reimbursement of indemnity and
contribution in the amount of Fifty-Two Thousand Five Hundred Dollars ($52,500);
NOW, THEREFORE, BE IT RESOLVED BY THE
CITY COUNCIL OF THE CITY OF BEAUMONT:
THAT the statements and findings set out in the preamble to this resolution are hereby, in
all things, approved and adopted; and
THAT the City Attorney be, and he is hereby, authorized to settle the claims of
Douglas Kibodeaux and Rebecca Chism in the lawsuit styled Eric Kvarme, et al vs. The
City of Beaumont, et al for the sum of One Hundred Five Thousand Dollars ($105,000).
BE IT FURTHER RESOLVED THAT the City Attorney, or his designee, be
authorized to file a lawsuit against the Beaumont Police Officer's Association to seek
enforcement of an agreement for reimbursement of indemnity and contribution in the
amount of Fifty-Two Thousand Five Hundred Dollars ($52,000).
BE IT ALSO RESOLVED THAT the City Manager be and he is hereby authorized
to execute all documents necessary to settle the lawsuit claims of Douglas Kibodeaux and
Rebecca Chism.
